While a fixed-term inmate can count down the days to release, a death-row prisoner lives with the knowledge that their punishment culminates in the termination of their life. The resulting uncertainty and isolation create severe psychological friction, demanding heightened vigilance and specialized care from prison authorities.<\/p>\n\n\n\n<h2 id=\"h-legal-framework-amp-custodial-duty\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Legal_Framework_Custodial_Duty\"><\/span>Legal Framework &amp; Custodial Duty<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Indian legal and constitutional framework imposes a clear duty on state and prison authorities to safeguard the mental health and physical integrity of inmates, particularly those on death row. A central pillar of this jurisprudence is Article 21 of the Constitution of India, which guarantees the right to life and personal liberty. The Supreme Court has repeatedly affirmed that this constitutional right does not vanish upon conviction or incarceration; it extends to living with basic human dignity and remaining free from cruel or degrading treatment throughout custody.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Key statutory and judicial precedents governing mental healthcare and death-row management include:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Legal Framework \/ Precedent<\/th><th>Key Principle<\/th><\/tr><\/thead><tbody><tr><td><strong>Mental Healthcare Act, 2017 (MHCA)<\/strong><\/td><td>Under Section 103, the state is explicitly mandated to provide adequate mental healthcare services within correctional facilities. The Act recognizes the right of every individual\u2014including prisoners\u2014to access mental health care, receive regular assessments, and be protected from inhuman or degrading treatment. It places a statutory duty on prison authorities to ensure early identification and professional treatment of emotional or psychiatric distress.<\/td><\/tr><tr><td><strong>Shatrughan Chauhan v. Union of India (2014)<\/strong><\/td><td>In this landmark ruling, a Constitution Bench of the Supreme Court held that prolonged delay in executing a death sentence, coupled with the agonizing mental trauma experienced by a death-row inmate, can cause severe psychiatric deterioration. The Court emphasized that mental illness developing during death-row incarceration warrants human care and can serve as a ground for commuting a death sentence to life imprisonment.<\/td><\/tr><tr><td><strong>Accused &#8216;X&#8217; v. State of Maharashtra (2019)<\/strong><\/td><td>The Supreme Court further clarified that severe mental illness developed post-conviction is a significant mitigating factor. The Court ruled that executing a person suffering from severe mental illness violates Article 21, establishing that regular psychiatric evaluations must be integrated into prison administration for death-row inmates.<\/td><\/tr><tr><td><strong>Model Prison Manual (2016)<\/strong><\/td><td>Guidelines issued by the Ministry of Home Affairs outline detailed protocols for custodial security and inmate well-being. Chapter X and Chapter XIV mandate regular medical and psychological screenings, continuous observation of death-row prisoners without subjecting them to solitary confinement unnecessarily, and immediate psychiatric intervention upon detection of self-harm tendencies or severe anxiety.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 id=\"h-the-last-hope\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Last_Hope\"><\/span>The Last Hope<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">After the Supreme Court upheld his sentence, the prisoner later claimed that he was mentally unsound and sought relief from the death sentence on that ground. His claim required medical examination. He was therefore sent to Bengaluru for medical assessment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The examination, however, did not provide the relief he had hoped for. He was declared medically fit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For the prisoner, this may have been another painful setback. His conviction and sentence had already been upheld by the highest court of the country. The medical examination had also failed to provide him with a way out of the death sentence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is important to understand that being declared medically fit does not necessarily mean that a prisoner is free from fear, anxiety or emotional suffering. A person may be medically fit and yet feel completely helpless about his future.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mental suffering is often difficult to see. A prisoner may appear calm, speak normally and follow prison rules while experiencing deep distress inside. This makes the work of prison officers especially difficult. They have to observe not only what a prisoner says but also changes in his behaviour.<\/p>\n\n\n\n<h2 id=\"h-the-return-to-prison\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Return_to_Prison\"><\/span>The Return to Prison<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">After the medical examination, the prisoner returned to the correctional home.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What happened after his return was tragic.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While in custody, he somehow managed to obtain a blade and seriously injured himself in an apparent attempt to end his life. The incident required immediate action. He was shifted to a government hospital for treatment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For prison staff, such situations are extremely serious. At that moment, the first responsibility is to save the prisoner&#8217;s life. Officers have to arrange emergency medical care, shift the injured prisoner to hospital and ensure that treatment is provided without delay.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The prisoner received medical treatment and was later brought back. Despite the efforts made to save him, however, he eventually died from the injuries he had inflicted upon himself.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He died before the State could carry out the death sentence imposed by the court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The incident was therefore not only a tragic death but also a painful reminder of the enormous psychological pressure that can be faced by a person awaiting execution.<\/p>\n\n\n\n<h2 id=\"h-more-than-a-prison-record\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"More_Than_a_Prison_Record\"><\/span>More Than a Prison Record<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Every prison has records. There are case files, court orders, medical reports, security reports and records of incidents. These documents are necessary for proper administration and accountability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But a prison record can describe what happened without describing what the prisoner may have been feeling.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A file can state that a prisoner was convicted, sentenced to death, medically examined, injured himself, taken to hospital and later died. But it cannot fully describe his fear of execution, his thoughts about his family or the hopelessness that may have developed inside him.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is one of the greatest challenges in prison administration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prison officers can see a prisoner&#8217;s physical condition and observe his behaviour, but they cannot always see what is happening inside his mind. A prisoner may sit quietly in his cell while experiencing severe emotional distress.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sometimes, a prisoner who has suddenly become very quiet may need more attention than one who is openly angry or aggressive.<\/p>\n\n\n\n<h2 id=\"h-recognising-the-warning-signs\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Recognising_the_Warning_Signs\"><\/span>Recognising the Warning Signs<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Self-harm and suicide in prisons can have many causes. Loneliness, fear, family problems, legal setbacks, mental-health difficulties and the pressures of imprisonment can all contribute to emotional distress.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Death-row prisoners may be particularly vulnerable because they live under the constant shadow of execution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prison staff should therefore be alert to changes in behaviour. A prisoner may suddenly:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Stop communicating with others.<\/li>\n\n\n\n<li>Refuse food.<\/li>\n\n\n\n<li>Lose interest in daily activities.<\/li>\n\n\n\n<li>Become unusually withdrawn.<\/li>\n\n\n\n<li>Repeatedly speak about death and hopelessness.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Such signs should not be ignored.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A prison officer or warder is often the person who spends the most time with prisoners. He may notice a change before anyone else does. A simple conversation or timely reporting of unusual behaviour may sometimes prevent a tragedy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prison staff do not need to be mental-health specialists, but they should receive basic training to recognise warning signs and know when to seek professional help.<\/p>\n\n\n\n<h2 id=\"h-security-and-compassion\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Security_and_Compassion\"><\/span>Security and Compassion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The incident inevitably raises a critical operational question: how did an inmate under high security manage to obtain a lethal object?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Whenever self-harm occurs, prison authorities must scrutinize systemic security\u2014evaluating search protocols, cell supervision, movement tracking, and the audit of everyday items. In correctional facilities, hazards often originate from routine sources, such as disposable hygiene razors, maintenance debris, or work-shed tools. Addressing these gaps requires strict physical protocols, including mandatory blade-tallying during daily sanitation routines.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Yet, physical security alone cannot prevent every act of despair. A facility may boast impenetrable walls, iron gates, and thorough searches, yet still fail to recognize when an inmate has lost the will to live. True institutional control requires two complementary forms of vigilance:<\/p>\n\n\n\n<h3 id=\"h-physical-vigilance\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Physical_Vigilance\"><\/span>Physical Vigilance<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Rigorous contraband searches.<\/li>\n\n\n\n<li>Structural checks.<\/li>\n\n\n\n<li>Controlled movement protocols.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-human-vigilance\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Human_Vigilance\"><\/span>Human Vigilance<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Active communication.<\/li>\n\n\n\n<li>Behavioural observation.<\/li>\n\n\n\n<li>Continuous mental health assessments.<\/li>\n\n\n\n<li>Prompt responses to signs of psychological distress.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-continuous-mental-health-care\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Continuous_Mental-Health_Care\"><\/span>Continuous Mental-Health Care<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Another important lesson from this case is that the mental condition of a death-row prisoner should not be assessed only once.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A prisoner may appear stable during one medical examination and become deeply distressed later. His mental condition can change because of a court decision, family problem or other personal crisis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For this reason, prisoners facing execution require regular observation and appropriate mental-health support. Special attention may be necessary after important developments in their legal cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The purpose is not to declare every distressed prisoner mentally ill. The purpose is to identify serious emotional distress early and provide appropriate help.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Doctors, psychiatrists, psychologists, counsellors and prison officers should work together. Information about a prisoner&#8217;s changing behaviour should reach the people who can take appropriate action.<\/p>\n\n\n\n<h2 id=\"h-the-importance-of-family\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Importance_of_Family\"><\/span>The Importance of Family<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">For many prisoners, family is their strongest connection with the outside world.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A visit from a parent, spouse, child, brother or sister can provide emotional strength. A telephone conversation can remind a prisoner that he has not been forgotten.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For prisoners facing the death penalty, family contact can be even more important. It cannot change a court&#8217;s decision, but it can reduce loneliness and give emotional support.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Within the limits of prison rules and security, meaningful contact with family should therefore be encouraged, particularly when a prisoner is under serious emotional stress.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Compassion does not weaken prison administration. Properly understood, compassion is part of responsible prison administration.<\/p>\n\n\n\n<h2 id=\"h-the-role-of-prison-officers\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Role_of_Prison_Officers\"><\/span>The Role of Prison Officers<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The work of a prison officer is much more than guarding gates or counting prisoners.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prison officers maintain discipline, prevent escapes, control violence and ensure security. But they also have a responsibility to protect prisoners from serious and foreseeable harm.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This responsibility becomes especially important when a prisoner is known to be vulnerable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A warder may notice that a prisoner has stopped talking. Another officer may notice that he is refusing food. A medical officer may observe signs of depression. A counsellor may discover that the prisoner has lost hope.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Each sign may seem small by itself. A court may have imposed the death penalty. He has attended Indian government sponsored specialized training in police and management matters in SVPNPA, Hyderabad, IIM, Ahmedabad and Singapore. He is the author of the books 'Police Investigation &amp; Allied Matters' and 'Alternative Dispute Resolution: Evolving Trends and Innovations' demonstrating his commitment to knowledge sharing within the law enforcement field.
