Senior doctors threatening escalation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At first glance, this looks like another confrontation between doctors and the government over remuneration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I believe that description is incomplete.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Bhopal dispute is actually a much more interesting legal problem. It sits at the intersection of medical education, administrative law, constitutional rights, police powers, public health, and government accountability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The interns are reportedly demanding that their monthly stipend be increased from approximately \u20b914,337 to \u20b930,000. But the most important question is not simply whether \u20b930,000 sounds reasonable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The more important question is<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">How did the state arrive at the present stipend, when was it last reviewed, what mechanism governs revision, and has the government properly considered the demand for a higher amount?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That question has a much better chance of surviving judicial scrutiny.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After examining the available government material, NMC regulations, Supreme Court orders, and current reporting, I would advise the interns to change the nature of their campaign.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Do not abandon the demand for \u20b930,000. Change the way you fight for it.<\/strong><\/p>\n\n\n\n<h2 id=\"h-the-first-thing-i-would-tell-the-interns\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_First_Thing_I_Would_Tell_the_Interns\"><\/span>The First Thing I Would Tell the Interns<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If I were advising the protesting interns today, my first advice would be:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Do not make \u20b930,000 an ultimatum backed by an indefinite strike. Make \u20b930,000 the result you are asking the government to justify, calculate, and decide through a transparent process.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That may sound like a subtle difference.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Legally, it is a very significant one.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A court is understandably reluctant to tell a state government exactly how much it must spend on a particular category of persons.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But a court is on much firmer ground when it asks:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What is the applicable government order?<\/li>\n\n\n\n<li>What is the governing policy?<\/li>\n\n\n\n<li>What criteria are being used?<\/li>\n\n\n\n<li>Has the government considered the representation?<\/li>\n\n\n\n<li>Why has the decision been delayed?<\/li>\n\n\n\n<li>What does the applicable NMC framework require?<\/li>\n\n\n\n<li>How do comparable institutions and states treat their interns?<\/li>\n\n\n\n<li>Is the existing mechanism still rational?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">That is where I would build the case.<\/p>\n\n\n\n<h2 id=\"h-14-337-is-not-an-arbitrary-number-pulled-from-thin-air\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"%E2%82%B914337_Is_Not_an_Arbitrary_Number_Pulled_From_Thin_Air\"><\/span>\u20b914,337 Is Not an Arbitrary Number Pulled From Thin Air<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is an important correction that must be made before anyone writes a serious legal article about this controversy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The present stipend figure cannot simply be described as an unexplained government number.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I have examined the Madhya Pradesh Department of Public Health &amp; Medical Education order dated 13 March 2026.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That order revised the MBBS intern stipend from \u20b913,928 to \u20b914,337, with effect from 1 April 2025.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The order records a Consumer Price Index figure of 2.94 as the basis for the revision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In other words, Madhya Pradesh already has a mechanism for revising stipends by reference to inflation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It means that a lawyer cannot responsibly walk into court and simply argue:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe government has arbitrarily fixed \u20b914,337 without any methodology.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The government has a document to answer that allegation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The better argument is more sophisticated:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Does an inflation-linked revision adequately determine the appropriate base stipend for a medical intern performing a compulsory clinical internship in a government hospital?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is a much more interesting question.<\/p>\n\n\n\n<h2 id=\"h-the-hidden-weakness-of-an-inflation-only-formula\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Hidden_Weakness_of_an_Inflation-Only_Formula\"><\/span>The Hidden Weakness of an Inflation-Only Formula<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Consumer Price Index measures changes in prices.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It tells us something about the purchasing power of money.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But it does not necessarily answer another question:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">What is the appropriate value of a compulsory clinical medical internship?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">A medical intern is not merely sitting in a classroom.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The internship involves clinical exposure and responsibilities within the healthcare system. Depending upon the posting, interns can be deployed in wards, outpatient departments, emergency services, labor rooms, operation theaters, and other clinical settings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, an adequate stipend methodology could reasonably consider more than inflation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It could consider:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Clinical responsibility;<\/li>\n\n\n\n<li>Workload;<\/li>\n\n\n\n<li>Duty requirements;<\/li>\n\n\n\n<li>Cost of living;<\/li>\n\n\n\n<li>Historical stipend levels;<\/li>\n\n\n\n<li>Comparable States;<\/li>\n\n\n\n<li>Institutional facilities;<\/li>\n\n\n\n<li>Accommodation;<\/li>\n\n\n\n<li>Food;<\/li>\n\n\n\n<li>Transport;<\/li>\n\n\n\n<li>State fiscal capacity.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">I am not suggesting that any one of these automatically creates a legal right to \u20b930,000.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I am saying that they provide a rational basis for asking the government to reconsider the base stipend itself.<\/p>\n\n\n\n<h2 id=\"h-the-supreme-court-has-already-entered-this-territory\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Supreme_Court_Has_Already_Entered_This_Territory\"><\/span>The Supreme Court Has Already Entered This Territory<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is where the Bhopal interns have an important legal advantage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has already considered the question of medical internship stipend in <em>Abhishek Yadav v. Army College of Medical Sciences &amp; Ors.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In that case, the Court considered the NMC&#8217;s Compulsory Rotating Medical Internship Regulations, 2021.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The regulations provide for payment of stipend to interns at the rate fixed by the appropriate authority applicable to the institution, university, or state.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court made an important observation:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe mandate of the regulations adopted by the National Medical Commission cannot be breached.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The Court then directed payment of \u20b925,000 per month as an interim stipend after considering comparative rates at other medical institutions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This precedent must, however, be used honestly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court did not declare that \u20b925,000 is a universal constitutional minimum for every MBBS intern in India.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nor did it declare \u20b930,000 to be an automatic entitlement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the order demonstrates two extremely useful propositions:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>First, the NMC&#8217;s stipend requirement has real regulatory force.<\/li>\n\n\n\n<li>Second, comparative stipend rates can be relevant when considering an appropriate interim stipend.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">That gives the Bhopal interns something far stronger than a newspaper argument.<\/p>\n\n\n\n<h2 id=\"h-the-supreme-court-is-still-dealing-with-stipend-compliance\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Supreme_Court_Is_Still_Dealing_With_Stipend_Compliance\"><\/span>The Supreme Court Is Still Dealing With Stipend Compliance<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is another development that should not be overlooked.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The stipend issue has continued before the Supreme Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In proceedings connected with the <em>Abhishek Yadav<\/em> litigation, the NMC has been required to provide information concerning stipend compliance across medical colleges. The Court&#8217;s continuing involvement demonstrates that internship stipend compliance remains a live national regulatory issue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The NMC has also issued material concerning mandatory disclosure of fee structures and stipend information.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This means that the Bhopal dispute should not be treated as though the medical interns are asking the state to invent a completely new obligation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is already a regulatory framework.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The real dispute is over the adequacy and determination of the amount.<\/p>\n\n\n\n<h2 id=\"h-the-question-i-would-put-to-the-madhya-pradesh-government\" original \u20b913,928 stipend?<\/li>\n\n\n\n<li>Under which government order?<\/li>\n\n\n\n<li>Why was the amount increased to \u20b914,337?<\/li>\n\n\n\n<li>What exactly does the CPI-linked formula require?<\/li>\n\n\n\n<li>When is the next revision due?<\/li>\n\n\n\n<li>What is the government&#8217;s response to the \u20b930,000 proposal?<\/li>\n\n\n\n<li>Was a formal proposal prepared?<\/li>\n\n\n\n<li>Was it sent to the Finance Department?<\/li>\n\n\n\n<li>Was it placed before the Cabinet?<\/li>\n\n\n\n<li>If not, why not?<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">These questions are more important than slogans.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They create a documentary trail.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And documentary trails win public-law cases.<\/p>\n\n\n\n<h2 id=\"h-the-30-000-cabinet-question-must-be-handled-carefully\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_%E2%82%B930000_Cabinet_Question_Must_Be_Handled_Carefully\"><\/span>The \u20b930,000 Cabinet Question Must Be Handled Carefully<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The interns have reportedly said that the government had indicated that a proposal for \u20b930,000 would be placed before the Cabinet.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I have found reporting supporting that allegation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But I have not located an authoritative copy of the actual Cabinet memorandum or Cabinet decision approving \u20b930,000.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, I would not write:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe Madhya Pradesh Cabinet approved \u20b930,000.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That would be irresponsible unless the actual record establishes it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The legally safer formulation is<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe interns allege that the government had assured them that a proposal for \u20b930,000 would be placed before the Cabinet.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">There is a very good reason for being precise.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the actual file exists, the government should be able to produce it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If it does not exist, that too becomes relevant.<\/p>\n\n\n\n<h2 id=\"h-the-rti-question-that-could-change-the-entire-case\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_RTI_Question_That_Could_Change_the_Entire_Case\"><\/span>The RTI Question That Could Change the Entire Case<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I would immediately seek the following documents:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Certified copy of the current government order fixing the MBBS internship stipend.<\/li>\n\n\n\n<li>Certified copy of the original order establishing the CPI-linked revision mechanism.<\/li>\n\n\n\n<li>All subsequent revision orders.<\/li>\n\n\n\n<li>The proposal for increasing the stipend to \u20b930,000, if any.<\/li>\n\n\n\n<li>Finance Department litigation.<\/p>\n\n\n\n<h2 id=\"h-why-the-march-2026-government-order-is-so-important\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" class=\"wp-block-paragraph\">The March 2026 order creates an interesting legal situation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The State has demonstrated that it recognizes a stipend-revision Keep the protest.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A designated peaceful protest site is far easier to defend constitutionally than a blockade.<\/p>\n\n\n\n<h2 id=\"h-protecting-patients-is-not-a-weakness\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Protecting_Patients_Is_Not_a_Weakness\"><\/span>Protecting Patients Is Not a Weakness<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is a temptation during a protest to say:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cWe will stop work until the government listens.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">I understand the frustration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But medical professionals occupy a special position because their dispute directly intersects with another person&#8217;s life and health.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has repeatedly recognized the importance of proper medical care and the public interest in regulating medical professionals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, I would ask the interns to give a written undertaking:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Emergency and life-saving medical services will not be compromised.<\/strong><\/p>\n\n\n\n<h3 id=\"h-that-should-include\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"That_Should_Include\"><\/span>That Should Include:<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Emergency department;<\/li>\n\n\n\n<li>ICU;<\/li>\n\n\n\n<li>Trauma;<\/li>\n\n\n\n<li>Labor-room emergencies;<\/li>\n\n\n\n<li>Life-saving surgery;<\/li>\n\n\n\n<li>Ambulance access.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This is not surrender.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is strategy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When you voluntarily protect patients, it becomes harder for the government to portray the entire movement as irresponsible.<\/p>\n\n\n\n<h2 id=\"h-the-doctors-should-not-make-a-constitutional-claim-they-cannot-sustain\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Doctors_Should_Not_Make_a_Constitutional_Claim_They_Cannot_Sustain\"><\/span>The Doctors Should Not Make a Constitutional Claim They Cannot Sustain<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I would particularly warn against saying:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cDoctors have a fundamental right to strike.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That proposition is too broad.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The stronger constitutional claim is<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Doctors have constitutional rights to expression and peaceful assembly, subject to lawful and reasonable restrictions.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The question of withdrawal of essential medical services is different.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A disciplined legal team must recognize that distinction.<\/p>\n\n\n\n<h2 id=\"h-the-government-s-strongest-defense\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Governments_Strongest_Defense\"><\/span>The Government&#8217;s Strongest Defense<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The State is likely to say:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cStipend fixation is a policy and financial matter.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is a serious argument.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The answer should not be<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe Court must fix \u20b930,000.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Instead:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cWe are not asking the Court to become the Finance Department. We are asking the Court to require the competent authority to make a rational, transparent, and time-bound decision.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is the heart of the proposed litigation.<\/p>\n\n\n\n<h2 id=\"h-the-article-226-strategy\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Article_226_Strategy\"><\/span>The Article 226 documented injury caused by unlawful or disproportionate state action, the question of compensation can legitimately arise.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But I would not make a fixed compensation amount the centrepiece before medical evidence and the circumstances of the incident are established.<\/p>\n\n\n\n<h3 id=\"h-the-first-demand-should-be\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_First_Demand_Should_Be\"><\/span>The First Demand Should Be:<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ol harder to attack.<\/p>\n\n\n\n<h2 id=\"h-the-financial-argument-needs-one-more-step\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Financial_Argument_Needs_One_More_Step\"><\/span>The Financial Argument Needs One More Step<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Based on reported figures, there are approximately 2,055 government MBBS interns in Madhya Pradesh.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Moving 2,055 interns from \u20b914,337 to \u20b930,000 would require an additional approximately \u20b938.62 crore per year.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is an arithmetic calculation based on reported numbers, not an official government expenditure figure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before presenting it in court, the number of government-funded interns must be verified.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But
