It does not, however, create an absolute or non-negotiable bar. The provision remains subject to the fundamental guarantees under Article 21 of the Constitution\u2014personal liberty and the right to a speedy trial. Where opposed, the Court must record satisfaction on two mandatory counts:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>There are reasonable grounds for believing that the accused is not guilty of the offense of money laundering.<\/li>\n\n\n\n<li>The accused is not likely to commit any offense while on bail.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These conditions apply to regular bail, anticipatory bail, and post-cognizance bail applications under the Bharatiya Nagarik Suraksha Sanhita. The inquiry is limited to a prima facie assessment of the available material; courts are not required to conduct a mini-trial or demand proof beyond reasonable doubt.<\/p>\n\n\n\n<h2 id=\"h-important-clarification-tarsem-lal-2024-insc-434\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Important_Clarification_Tarsem_Lal_2024_INSC_434\"><\/span>Important Clarification: Tarsem Lal, 2024 INSC 434<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Under the Tarsem Lal (2024) ruling, an accused who was not arrested during the investigation and appears before the Special Court solely in response to a summons is not considered to be in custody. Consequently, such an individual is not required to apply for bail, exempting them from the stringent &#8220;twin conditions&#8221; prescribed under Section 45 of the Prevention of Money Laundering Act (PMLA). Simply showing up to court in obedience to a judicial summons does not equate to being detained or surrendering into custody.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Simultaneously, once the Special Court takes cognizance of the complaint under Section 44(1)(b), the Enforcement Directorate (ED) forfeits its statutory authority under Section 19 to make an arrest. The power to arrest exists only during the investigation phase; after cognizance, the matter enters the judicial stage, transferring all authority over the accused\u2019s custody and liberty exclusively to the court. The Supreme Court has expressly held that the stringent twin conditions do not apply to women applicants.<\/p>\n\n\n\n<h3 id=\"h-prolonged-incarceration-and-trial-delay\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Prolonged_Incarceration_and_Trial_Delay\"><\/span>Prolonged Incarceration and Trial Delay<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Indefinite detention, where the trial is unlikely to conclude within a reasonable time (due to voluminous documents, a large number of witnesses, or delays attributable to the prosecution), violates Article 21. Section 436A CrPC \/ corresponding BNSS provisions and the principle that bail is the rule remain relevant.<\/p>\n\n\n\n<h3 id=\"h-no-mini-trial\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"No_Mini-Trial\"><\/span>No Mini-Trial<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Scrutiny at the bail stage is confined to a prima facie evaluation of the material on record.<\/p>\n\n\n\n<h3 id=\"h-parity\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Parity\"><\/span>Parity<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Bail on the ground of parity is not automatic. The applicant must demonstrate substantially identical roles, evidence, and circumstances relative to the co-accused already enlarged on bail.<\/p>\n\n\n\n<h3 id=\"h-foundational-facts-and-presumption-under-section-24\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Foundational_Facts_and_Presumption_Under_Section_24\"><\/span>Foundational Facts and Presumption Under Section 24<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">When the prosecution opposes bail, it must prima facie establish the foundational facts of money laundering. Time Already Spent in Jail<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Highlight how many days the accused has been locked up compared to the maximum sentence, and show that the trial will take a very long time to finish.<\/p>\n\n\n\n<h3 id=\"h-4-pass-the-3-basic-bail-conditions\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"4_Pass_the_3_Basic_Bail_Conditions\"><\/span>4. Pass the 3 Basic Bail Conditions<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Not a flight risk:<\/strong> Show local roots, family ties, and a willingness to surrender their passport.<\/li>\n\n\n\n<li><strong>Cannot destroy evidence:<\/strong> Point out that all key documents are already collected and safe with the Enforcement Directorate.<\/li>\n\n\n\n<li><strong>Cannot threaten witnesses:<\/strong> Show that the accused holds no official power or influence over any witnesses.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-5-special-grounds-for-easy-bail\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"5_Special_Grounds_for_Easy_Bail\"><\/span>5. Special Grounds for Easy Bail<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Mention if the applicant qualifies for special exceptions, such as being a woman, a minor, or sick\/elderly, or if the money involved is under the legal limit (\u20b91 crore).<\/p>\n\n\n\n<h3 id=\"h-6-right-to-a-speedy-trial-under-article-21\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"6_Right_to_a_Speedy_Trial_Under_Article_21\"><\/span>6. Imran Wahab possesses a strong academic background, holding B.Sc., M.A., L.L.B., and M.B.A. degrees. He has also completed Post Graduate Diplomas in Human Rights, Project Management, Corporate Management, Computer Application, Public Administration, Medical Law, Disaster Management, Fire Safety &amp; Hazards Management and Psychology. He has attended Indian government sponsored specialized training in police and management matters in SVPNPA, Hyderabad, IIM, Ahmedabad and Singapore. He is the author of the books 'Police Investigation &amp; Allied Matters' and 'Alternative Dispute Resolution: Evolving Trends and Innovations' demonstrating his commitment to knowledge sharing within the law enforcement field. As an observer for the Election Commission of India, he has gained firsthand experience in conducting assembly elections and bye-elections in Uttar Pradesh, Rajasthan, Assam, Bihar, and Tripura (twice). This exposure has given him a deep understanding of election management and the Election Commission's operations. He has also served as Chairman and as a member of various recruitment boards for the selection of police personnel in Kolkata Police and West Bengal Police. Md.
