Kailash Kushanrao Gorantyal<\/em>, (2020) 7 SCC 1.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Constitution Bench reaffirmed the central importance of the statutory certificate and rejected the proposition that the certificate could simply be dispensed with as a matter of convenience.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s judgement in <em>Arjun Panditrao<\/em> is an important primary authority for the proposition that the statutory requirements concerning electronic evidence cannot casually be bypassed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The significance of this history is obvious.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Indian law did not treat electronic evidence as ordinary paper evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It recognised that digital material can be copied, transferred, altered and reproduced without leaving the sort of physical trace that traditional documentary evidence often leaves.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The BSA has carried that concern into the new statutory regime.<\/p>\n\n\n\n<h2 id=\"h-4-the-2026-supreme-court-decision-pune-bar-association-v-union-of-india\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"4_The_2026_Supreme_Court_Decision_Pune_Bar_Association_v_Union_of_India\"><\/span>4. The 2026 Supreme Court Decision: Pune Bar Association v. Union of India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The most significant recent development is the Supreme Court&#8217;s decision in:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Pune Bar Association v. Union of India<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">W.P. (C) No. 599 of 2026, order dated 22 May 2026<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case directly concerned Section 63(4) of the BSA and the Schedule prescribing the certificate for electronic records.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The challenge questioned, among other things, the requirement concerning:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>disclosure of the hash value; and<\/li>\n\n\n\n<li>certification by an expert.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court rejected the constitutional challenge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court explained that the hash value operates as an electronic fingerprint and serves the objective of verifying the authenticity and integrity of the electronic data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court also considered the question of who may qualify as an expert for Part B of the certificate. Importantly, the Court did not hold that only persons notified under Section 79A of the Information Technology Act can necessarily provide the relevant expertise. It referred to the broader language of Section 39(1) of the BSA concerning persons possessing special skill.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s official cause-list material confirms that the matter was before a bench comprising the Chief Justice of India and Justices Joymalya Bagchi and Vipul M. Pancholi on 22 May 2026.<\/p>\n\n\n\n<h3 id=\"h-a-necessary-legal-caution\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_Necessary_Legal_Caution\"><\/span>A Necessary Legal Caution<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The supplied material describes the decision as though the Court definitively established a broad new evidentiary doctrine for AI and deepfakes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is too wide.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The decision principally concerned the constitutional challenge to Section 63(4) and the certification architecture.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It should not be read as a Supreme Court declaration that a Section 63 certificate itself establishes the truthfulness of everything depicted in an electronic recording.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction is fundamental.<\/p>\n\n\n\n<h2 id=\"h-5-the-hash-proves-integrity-not-necessarily-truth\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"5_The_Hash_Proves_Integrity_%E2%80%94_Not_Necessarily_Truth\"><\/span>5. The Hash Proves Integrity \u2014 Not Necessarily Truth<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is perhaps the most important proposition for lawyers and judges dealing with AI-generated evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose the prosecution produces a video file.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The file has a valid hash.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The hash matches the value recorded when the evidence was acquired.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What does that establish?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It may establish that the file has not changed since the relevant hash was calculated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is extremely important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But it does not necessarily establish:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>who created the original video;<\/li>\n\n\n\n<li>whether the original video recorded a genuine event;<\/li>\n\n\n\n<li>whether the scene was staged;<\/li>\n\n\n\n<li>whether the video was AI-generated;<\/li>\n\n\n\n<li>whether persons or objects were digitally inserted;<\/li>\n\n\n\n<li>whether the recording was manipulated before it came into the possession of the investigating agency.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In simple terms:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Integrity of the copy is not the same thing as authenticity of the event.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Imagine a perfectly preserved photograph of a nonexistent event.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The photograph may be forensically intact.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Its hash may be impeccable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Its chain of custody may be perfect.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the event depicted may still be fictional.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is the central evidentiary challenge created by generative AI.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Also Read: <a href=\"https:\/\/www.legalservicesindia.com\/can-america-reform-the-supreme-court\/\" target=\"_blank\" rel=\"noopener\">Can America Reform the Supreme Court? Admissibility Is Not Conviction<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction must be kept alive throughout every criminal trial involving AI-generated evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are at least three separate questions.<\/p>\n\n\n\n<h3 id=\"h-question-one-can-the-court-receive-the-electronic-record\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Question_One_Can_the_Court_Receive_the_Electronic_Record\"><\/span>Question One: Can the Court Receive the Electronic Record?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This is an admissibility question.<\/p>\n\n\n\n<h3 id=\"h-question-two-is-the-electronic-record-authentic\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Question_Two_Is_the_Electronic_Record_Authentic\"><\/span>Question Two: Is the Electronic Record Authentic?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This is an authentication question.<\/p>\n\n\n\n<h3 id=\"h-question-three-does-the-evidence-prove-the-prosecution-s-case-beyond-reasonable-doubt\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Question_Three_Does_the_Evidence_Prove_the_Prosecutions_Case_Beyond_Reasonable_Doubt\"><\/span>Question Three: Does the Evidence Prove the Prosecution&#8217;s Case Beyond Reasonable Doubt?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This is a weight and proof question.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They are not interchangeable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A certificate may assist with the first question.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It may provide important evidence relevant to the second.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But it does not automatically answer the third.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A criminal court must ultimately determine whether the prosecution has proved the ingredients of the offence against the particular accused beyond reasonable doubt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That constitutional and evidentiary burden cannot be outsourced to a certificate.<\/p>\n\n\n\n<h2 id=\"h-7-a-deepfake-should-not-become-admissible-merely-because-it-is-a-perfect-deepfake\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"7_A_Deepfake_Should_Not_Become_Admissible_Merely_Because_It_Is_a_Perfect_Deepfake\"><\/span>7. A Deepfake Should Not Become Admissible Merely Because It Is a Perfect Deepfake<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This proposition deserves emphasis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A sophisticated deepfake may satisfy the technical requirements applicable to an electronic record.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That does not make the underlying representation true.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court must distinguish between:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis is an authentic copy of the file that was seized.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">and<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis file is an authentic representation of what actually happened.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The two statements are entirely different.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The first is principally a question of digital integrity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The second is a question of historical truth.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That difference may become decisive in criminal trials.<\/p>\n\n\n\n<h2 id=\"h-8-section-39-bsa-and-the-role-of-experts\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"8_Section_39_BSA_and_the_Role_of_Experts\"><\/span>8. Section 39 BSA and the Role of Experts<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The BSA separately recognises expert opinion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The India Code identifies Section 39 as the provision concerning opinions of experts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That provision creates an important avenue for dealing with AI.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose the prosecution says:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cOur facial-recognition system has identified the accused.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court should not automatically treat that sentence as equivalent to:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAn eyewitness has identified the accused.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They are fundamentally different propositions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court may need to ask:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What algorithm was used?<\/li>\n\n\n\n<li>What version of the system was deployed?<\/li>\n\n\n\n<li>What input image was provided?<\/li>\n\n\n\n<li>Was the image of sufficient quality?<\/li>\n\n\n\n<li>What database was searched?<\/li>\n\n\n\n<li>What error rates exist?<\/li>\n\n\n\n<li>Was the system independently validated?<\/li>\n\n\n\n<li>How does it perform with Indian faces and comparable conditions?<\/li>\n\n\n\n<li>What false-positive rate exists?<\/li>\n\n\n\n<li>Was there human verification?<\/li>\n\n\n\n<li>Was the operator permitted to override the result?<\/li>\n\n\n\n<li>Were alternative candidates generated?<\/li>\n\n\n\n<li>Were investigators told the identity before examining the result?<\/li>\n\n\n\n<li>Could confirmation bias have affected the interpretation?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These questions are not technological decoration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They go directly to reliability.<\/p>\n\n\n\n<h2 id=\"h-9-facial-recognition-is-not-an-eyewitness\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"9_Facial_Recognition_Is_Not_an_Eyewitness\"><\/span>9. Facial Recognition Is Not an Eyewitness<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A facial-recognition score should not be described casually as an \u201cidentification\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A better legal description may be:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe system generated a similarity or identification result under specified conditions.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The difference matters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The machine did not necessarily \u201csee\u201d the accused in the legal sense.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It processed data according to an algorithm.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court must decide what evidentiary significance that output deserves.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The greater the prosecution&#8217;s dependence on the algorithm, the greater the justification for disclosure sufficient to permit meaningful adversarial testing.<\/p>\n\n\n\n<h2 id=\"h-10-article-21-adds-a-constitutional-dimension\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"10_Article_21_Adds_a_Constitutional_Dimension\"><\/span>10. Article 21 Adds a Constitutional Dimension<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is not merely a debate about computer science.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A criminal prosecution ultimately concerns liberty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article 21 protects life and personal liberty except according to procedure established by law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If an AI system materially contributes to the deprivation of liberty, the accused must have a meaningful opportunity to challenge the evidentiary basis of that system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That does not necessarily mean that every proprietary algorithm must automatically be placed completely in the public domain.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But it does mean that \u201cthe computer says so\u201d cannot become the legal equivalent of cross-examination.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court must remain the decision-maker.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The expert may assist the court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The algorithm may assist the expert.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But neither should replace the judicial function.<\/p>\n\n\n\n<h2 id=\"h-11-the-delhi-high-court-and-the-deepfake-problem\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"11_The_Delhi_High_Court_and_the_Deepfake_Problem\"><\/span>11. The Delhi High Court and the Deepfake Problem<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Delhi High Court has already confronted the practical problem of deepfakes in <em>Nirmaan Malhotra v. Tushita Kaul<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case concerned photographs relied upon in matrimonial litigation. The Court took note of the increasing prevalence of deepfake technology and declined to treat the photographs as conclusively establishing the fact asserted through them without proper proof.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The significance of the decision is larger than the matrimonial dispute in which it arose.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A photograph is no longer necessarily a passive record.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It can be a manufactured representation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That should change the courtroom instinct from:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI can see it; therefore, it happened.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">to:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI can see it; now prove to me that what I see corresponds to reality.\u201d<\/p>\n\n\n\n<h2 id=\"h-12-india-s-2026-it-rules-important-but-different\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"12_Indias_2026_IT_Rules_Important_But_Different\"><\/span>12. India&#8217;s 2026 IT Rules: Important, But Different<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">India has also moved against synthetic media through the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Amendment Rules, 2026.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">MeitY&#8217;s official materials confirm that the amendments were notified on 10 February 2026 and came into force on 20 February 2026. They introduce the concept of synthetically generated information (SGI) and impose additional obligations concerning unlawful synthetic content, labelling and provenance-related mechanisms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Government&#8217;s explanatory material expressly describes the new SGI framework and its obligations for intermediaries.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But it must not be confused with the BSA.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The IT Rules primarily regulate the creation, dissemination and handling of synthetic content in the digital ecosystem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The BSA governs the evidentiary treatment of electronic records in legal proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They address different stages of the problem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One operates largely upstream.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The other operates at the courtroom door.<\/p>\n\n\n\n<h2 id=\"h-13-a-watermark-is-not-a-certificate-of-truth\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"13_A_Watermark_Is_Not_a_Certificate_of_Truth\"><\/span>13. A Watermark Is Not a Certificate of Truth<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose an AI platform attaches an \u201cAI-generated\u201d label.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is useful.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It provides provenance information.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It may alert the viewer that the material is synthetic.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the label does not tell the Court whether the underlying proposition is true or false.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Similarly, the absence of a label does not automatically prove authenticity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Technology can tell us something about the origin or processing history of a file.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It cannot, without more, answer every historical question contained within that file.<\/p>\n\n\n\n<h2 id=\"h-14-what-the-united-states-is-considering\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"14_What_the_United_States_Is_Considering\"><\/span>14. What the United States Is Considering<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The United States provides an interesting comparison.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Federal Rules of Evidence already contain general authentication and expert-evidence principles.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The U.S. Federal Advisory Committee on Evidence Rules has considered amendments specifically addressing deepfakes and machine-generated evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Committee&#8217;s May 2026 materials discuss a possible Rule 901(c) for potentially fabricated evidence created through generative AI.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The proposed approach would require the party challenging an item as a deepfake first to present sufficient evidence to warrant an inquiry; if that threshold is met, the proponent would then have to establish authenticity by a preponderance of the evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is important precisely because it is not yet settled federal law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is a proposal under consideration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction matters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The American experience nevertheless illustrates an important procedural idea:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court should neither accept every deepfake allegation nor dismiss a credible deepfake challenge merely because the exhibit is accompanied by technical certification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There must be a disciplined procedure.<\/p>\n\n\n\n<h2 id=\"h-15-singapore-has-taken-a-different-route\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"15_Singapore_Has_Taken_a_Different_Route\"><\/span>15. Singapore Has Taken a Different Route<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Singapore&#8217;s courts have issued a formal guide on the use of generative artificial intelligence tools by court users.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Guide applies across the Supreme Court, state courts and family justice courts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It permits appropriate use of generative AI but emphasises that court users remain responsible for ensuring that material placed before the Court is independently verified, accurate and appropriate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The broader lesson is significant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The solution is not necessarily to prohibit AI.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The solution is to preserve human responsibility for what is placed before a court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That principle deserves serious consideration in India.<\/p>\n\n\n\n<h2 id=\"h-16-new-south-wales-shows-how-strict-courts-can-become\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"16_New_South_Wales_Shows_How_Strict_Courts_Can_Become\"><\/span>16. New South Wales Shows How Strict Courts Can Become<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court of New South Wales has issued Practice Note SC Gen 23 dealing with generative AI.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judicial guidance is particularly concerned with confidentiality, suppression orders, information produced under compulsion and the risks associated with feeding sensitive litigation material into AI systems.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The NSW experience demonstrates something important for Indian courts:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">AI regulation inside the justice system does not have to be limited to evidence admissibility.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Courts can regulate:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>how AI is used in affidavits;<\/li>\n\n\n\n<li>how AI is used in submissions;<\/li>\n\n\n\n<li>how confidential information is handled;<\/li>\n\n\n\n<li>what lawyers must disclose;<\/li>\n\n\n\n<li>how experts use AI;<\/li>\n\n\n\n<li>how parties verify AI-generated material.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">That is a procedural governance question, not merely an evidentiary one.<\/p>\n\n\n\n<h2 id=\"h-17-the-european-union-transparency-before-litigation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"17_The_European_Union_Transparency_Before_Litigation\"><\/span>17. The European Union: Transparency Before Litigation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The EU AI Act adopts another approach.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article 50 contains transparency obligations concerning AI-generated and manipulated content, including deepfakes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The European framework requires certain AI-generated or manipulated content to be identifiable as artificially generated or manipulated, subject to the statutory qualifications and exceptions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The European approach therefore seeks to create information about provenance before the material becomes courtroom evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is a valuable policy idea for India.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The strongest evidence system may ultimately be one in which provenance begins at creation rather than being reconstructed after a criminal investigation.<\/p>\n\n\n\n<h2 id=\"h-18-the-four-layer-test-india-should-consider\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"18_The_Four-Layer_Test_India_Should_Consider\"><\/span>18.
