The Act was enacted to deal firmly with drug trafficking and other offenses involving narcotic drugs and psychotropic substances. Section 37 places special conditions on the grant of bail and makes it more difficult to secure release before trial than under ordinary criminal law. It begins with a non-obstante clause, which means that its provisions operate notwithstanding the general bail provisions under the ordinary criminal procedure law, now contained in the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These stricter conditions apply to cases involving:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Section 19 \u2013 embezzlement of opium by a cultivator;<\/li>\n\n\n\n<li>Section 24 \u2013 external dealings in narcotic drugs and psychotropic substances;<\/li>\n\n\n\n<li>Section 27A \u2013 financing illicit traffic and harboring offenders; and<\/li>\n\n\n\n<li>Offences involving commercial quantities of narcotic drugs or psychotropic substances.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In such cases, the court cannot grant bail merely by applying the ordinary principles of bail. The special conditions laid down in Section 37 must first be satisfied.<\/p>\n\n\n\n<h2 id=\"h-the-twin-conditions-for-bail\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_%E2%80%9CTwin_Conditions%E2%80%9D_for_Bail\"><\/span>The \u201cTwin Conditions\u201d for Bail<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">When the public prosecutor opposes the bail application, the court can grant bail only when it is satisfied about both of the following conditions:<\/p>\n\n\n\n<h3 id=\"h-1-reasonable-grounds-to-believe-that-the-accused-is-not-guilty\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"1_Reasonable_Grounds_to_Believe_That_the_Accused_Is_Not_Guilty\"><\/span>1. Reasonable Grounds to Believe That the Accused Is Not Guilty<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The court must find reasonable grounds to believe that the accused is not guilty of the offense alleged. This does not mean that the court has to conduct a full trial or finally decide the guilt of the accused. At the bail stage, the court makes a limited assessment of the material available on record.<\/p>\n\n\n\n<h3 id=\"h-2-no-likelihood-of-committing-an-offence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2_No_Likelihood_of_Committing_an_Offence\"><\/span>2. No Likelihood of Committing an Offence<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The court must also be satisfied that the accused is not likely to commit any offense while on bail. The accused must satisfy both conditions, not merely one. This is why obtaining bail in a case covered by Section 37 is more difficult than in an ordinary criminal case.<\/p>\n\n\n\n<h2 id=\"h-decoding-reasonable-grounds\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Decoding_%E2%80%9CReasonable_Grounds%E2%80%9D\"><\/span>Decoding \u201cReasonable Grounds\u201d<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The term &#8220;reasonable grounds&#8221; requires a standard higher than a basic prima facie assessment, yet lower than a definitive finding of innocence.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Beyond Mere Doubts:<\/strong> In State of Kerala v. Rajesh (2020), the Supreme Court clarified that reasonable grounds demand credible and substantial material pointing away from guilt\u2014not just minor inconsistencies in the prosecution&#8217;s initial narrative.<\/li>\n\n\n\n<li><strong>Avoiding the &#8220;Mini-Trial&#8221;:<\/strong> As reiterated in NCB v. Mohit Aggarwal (2022), courts must evaluate the material on record to form a tentative belief without conducting a premature mini-trial or writing a final judgment on guilt.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-key-judicial-precedents-amp-principles\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Key_Judicial_Precedents_Principles\"><\/span>Key Judicial Precedents &amp; Principles<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 id=\"h-parity-cannot-override-section-37\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Parity_Cannot_Override_Section_37\"><\/span>Parity Cannot Override Section 37<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In State of Kerala v. Rajesh, the Supreme Court ruled that an accused cannot claim bail solely because a co-accused was granted relief. Parity does not replace or bypass the mandatory evaluation under Section 37.<\/p>\n\n\n\n<h3 id=\"h-incarceration-duration-vs-statutory-mandate\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Incarceration_Duration_vs_Statutory_Mandate\"><\/span>Incarceration Duration vs. Statutory Mandate<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In NCB v. Mohit Aggarwal, the Apex Court emphasized that factors like prolonged custody, filing of the charge sheet, or commencement of trial do not automatically entitle an accused to bail if the twin conditions remain unfulfilled.<\/p>\n\n\n\n<h3 id=\"h-physical-recovery-is-not-decisive\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Physical_Recovery_Is_Not_Decisive\"><\/span>Physical Recovery Is Not Decisive<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Absence of direct physical possession of contraband does not guarantee bail. Under Section 29 (Abetment and Conspiracy), an accused can remain liable based on financial transactions, call details, or operational linkages.<\/p>\n\n\n\n<h3 id=\"h-inadmissibility-of-section-67-statements\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Inadmissibility_of_Section_67_Statements\"><\/span>Inadmissibility of Section 67 Statements<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Following Tofan Singh v. State of Tamil Nadu (2021), confessional statements recorded by officers under Section 67 of the NDPS Act are inadmissible as confessions under Section 25 of the Evidence Act, now Section 23 (1) of the Bharatiya Sakshya Adhiniyam, 2023.
