The issue must be established through legally admissible evidence; ordinary marital incompatibility or lack of affection is not automatically equivalent to the statutory ground.<\/p>\n\n\n\n<h3 id=\"h-2-contravention-of-section-5-ii\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2_Contravention_of_Section_5ii\"><\/span>2. Contravention of Section 5(ii)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Section 12(1)(b) concerns contravention of the mental-capacity condition in Section 5(ii). This is a technical statutory ground and should be pleaded with precision rather than through general allegations about a spouse&#8217;s behaviour.<\/p>\n\n\n\n<h3 id=\"h-3-consent-obtained-by-force-or-fraud\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3_Consent_Obtained_by_Force_or_Fraud\"><\/span>3. Consent Obtained by Force or Fraud<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Section 12(1)(c) is particularly important in modern matrimonial litigation. It applies where the consent of the petitioner to the marriage was obtained by force or fraud of the nature recognised by the statutory provision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A serious mistake is to assume that every lie told before marriage automatically constitutes statutory fraud.
