The legislation provides mechanisms through which parties can seek temporary judicial protection before the underlying commercial dispute has been finally determined.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The framework is separate from the procedural systems of the Dubai International Financial Centre (DIFC) and the Abu Dhabi Global Market (ADGM), whose courts operate under their own legal frameworks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction matters. A party cannot simply assume that a procedure available in a UAE onshore court will operate in exactly the same way in a DIFC or ADGM dispute.<\/p>\n\n\n\n<h2 id=\"h-why-interim-relief-matters-in-commercial-litigation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_interim_relief_matters_in_commercial_litigation\"><\/span>Why interim relief matters in commercial litigation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The purpose of interim relief is not to decide the ultimate dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, it is designed to preserve the position of the parties until the substantive dispute can be determined.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The underlying principle is straightforward: a final judgment is meaningful only if there is something left to enforce and the evidence necessary to determine the dispute has been preserved.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The UAE Civil Procedure Code therefore gives the courts powers to deal with urgent situations where waiting for ordinary litigation could cause serious prejudice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The law recognizes situations in which an applicant may have a legitimate interest in obtaining precautionary protection even before the final merits of the dispute are decided. The urgency jurisdiction is directed toward circumstances where delay could result in damage, loss of evidence, or frustration of a future judgment.<\/p>\n\n\n\n<h2 id=\"h-1-the-urgent-matters-judge-and-summary-proceedings\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"1_The_urgent_matters_judge_and_summary_proceedings\"><\/span>1. The urgent matters judge and summary proceedings<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Civil Procedure Code provides for a judge at the Court of First Instance to deal with urgent applications.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judge&#8217;s role in such proceedings is fundamentally different from that of the court deciding the merits of the main dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An urgent order is ordinarily concerned with temporary protection. It should not finally determine the parties&#8217; underlying substantive rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is particularly important in commercial litigation because circumstances can change rapidly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A company may be preparing to dispose of valuable assets;<\/li>\n\n\n\n<li>A debtor may be considering leaving the UAE<\/li>\n\n\n\n<li>Important commercial records may be at risk;<\/li>\n\n\n\n<li>allegedly infringing goods may be entering the market;<\/li>\n\n\n\n<li>or a creditor may reasonably fear that enforcement of a future judgment will become ineffective.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The legislation also allows particularly rapid procedural treatment where circumstances justify it. The ordinary appearance period in summary proceedings is 24 hours, and, in appropriate circumstances and subject to judicial permission and personal service requirements, it can be reduced to as little as one hour.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is a striking illustration of the philosophy behind urgent proceedings: where delay itself can cause the harm, ordinary litigation timelines may not provide adequate protection.<\/p>\n\n\n\n<h2 id=\"h-2-provisional-attachment-protecting-the-assets-behind-the-claim\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2_Provisional_attachment_protecting_the_assets_behind_the_claim\"><\/span>2. Provisional attachment: protecting the assets behind the claim<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the most significant remedies available to a commercial creditor is provisional or precautionary attachment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The basic purpose is preservation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A creditor does not obtain a provisional attachment merely because it has filed a claim. The applicant must satisfy the statutory requirements and demonstrate circumstances justifying the protective measure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article 247 allows a creditor to seek provisional attachment where there is a fear that the security for its right may otherwise be lost. The circumstances identified in the legislation include situations involving an unstable residence, a serious risk of absconding, transferring or concealing assets, or concerns regarding the evidence supporting the debt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This makes the remedy particularly relevant in cross-border commercial disputes.<\/p>\n\n\n\n<h3 id=\"h-consider-a-simple-example\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Consider_a_simple_example\"><\/span>Consider a simple example.<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A UAE-based company owes a substantial amount to a foreign supplier. The supplier discovers that the debtor is rapidly transferring valuable assets to related entities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Waiting several months for a final judgment may create a serious enforcement problem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A properly supported application for provisional attachment may therefore become strategically important.<\/p>\n\n\n\n<h3 id=\"h-what-evidence-matters\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_evidence_matters\"><\/span>What evidence matters?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The court may consider documentary evidence establishing the debt and the circumstances creating the risk.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The law also recognizes situations where the creditor possesses an official or ordinary document establishing a due, unconditional, and specified debt, as well as certain judgments that have not yet become enforceable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The important practical point is that the existence of a debt and the existence of a risk are not necessarily the same thing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A creditor should therefore build the application around evidence showing why immediate protection is necessary.<\/p>\n\n\n\n<h2 id=\"h-3-proportionality-remains-important\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3_Proportionality_remains_important\"><\/span>3. Proportionality remains important.<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Interim protection is powerful, but it is not intended to become a weapon for obtaining excessive control over a debtor&#8217;s property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The attachment should generally correspond to the value of the claim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Civil Procedure Code also provides protection for certain categories of property and places limitations on the attachment of wages and fixed salary.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This reflects an important legal principle:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Interim relief should preserve legitimate rights without unnecessarily causing disproportionate harm to the opposing party.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">A creditor seeking an attachment should therefore carefully identify the amount claimed, the assets targeted, and the factual basis for the requested protection.<\/p>\n\n\n\n<h2 id=\"h-4-the-eight-day-deadline-after-a-provisional-attachment\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"4_The_eight-day_deadline_after_a_provisional_attachment\"><\/span>4. The eight-day deadline after a provisional attachment<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the most important practical issues is what happens after the attachment is granted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A provisional attachment is not a substitute for the substantive lawsuit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where the attachment has been ordered by the magistrate of summary justice, the creditor may be required to commence the action establishing the right within the statutory period.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The source material identifies an eight-day period in the relevant circumstances. Failure to commence the required substantive proceedings can result in the attachment being treated as invalid from the outset. Similar consequences can arise if the creditor fails to commence enforcement of a final judgment within the applicable statutory period.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is an important lesson for commercial litigants:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Obtaining interim relief is only the beginning of the process. Civil travel bans: preventing flight from frustrating enforcement<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Another powerful mechanism is the civil travel ban.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under Article 324 of the Civil Procedure Code, a creditor may, in qualifying circumstances, seek an order preventing a debtor from travelling outside the UAE\u2014even before the substantive civil claim has been filed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The legislation requires serious grounds for fearing that the debtor may leave the UAE and thereby jeopardize the creditor&#8217;s rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The general monetary threshold is AED 10,000, subject to statutory exceptions. The debt must generally be known, due, and unconditional.
