Two strict conditions must be met:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>The public prosecutor must be heard.<\/li>\n\n\n\n<li>If the prosecutor objects, bail can only be granted if the court believes:\n<ol style=\"list-style-type:lower-alpha\" class=\"wp-block-list\">\n<li>the accused is not guilty, and<\/li>\n\n\n\n<li>The accused will not commit another offense while on bail.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Courts have stressed that success at the bail stage often depends on showing clear breaches in procedure\u2014such as improper searches under Section 50, faulty sampling under Section 52A, delays in reporting seizures, or breaks in the chain of custody.
