Once registered, it operates from the date it would have operated had registration never been required \u2014 ordinarily, the date of execution. The Statutory Rule<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Section 47 of the Registration Act, 1908 provides:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201c47. Time from which registered document operates.\u2014A registered document shall operate from the time from which it would have commenced to operate if no registration thereof had been required or made, and not from the time of its registration.\u201d<\/p>\n<\/blockquote>\n\n\n\n<h3 id=\"h-key-implications\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Key_Implications\"><\/span>Key Implications<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The section applies only after the document is actually registered \u2014 it has nothing to say about unregistered instruments.<\/li>\n\n\n\n<li>It fixes the operative date of the document; it does not determine the moment a sale is \u201ccomplete\u201d for all purposes.<\/li>\n\n\n\n<li>Where registration is compulsory, the transfer is not complete until registration \u2014 but once registered, the deed&#8217;s operation is backdated to the intended date, usually execution.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-ii-the-foundational-authority\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"II_The_Foundational_Authority\"><\/span>II. The Foundational Authority<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 id=\"h-ram-saran-lall-v-domini-kuer\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Ram_Saran_Lall_v_Domini_Kuer\"><\/span>Ram Saran Lall v. Domini Kuer<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>AIR 1961 SC 1747; [1962] 2 SCR 474 \u2014 Constitution Bench<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Constitution Bench clarified the true scope of Section 47 in terms that remain the bedrock proposition on the subject. Section 47 does not say when a sale is complete; it only allows a registered document to operate from an earlier date than registration. The section applies to a document only after registration and has nothing to do with the completion of registration itself. A sale that is admittedly not completed until registration cannot, therefore, be said to have been completed earlier merely because Section 47 makes the registered instrument operate from an earlier date.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction \u2014 operative date of the instrument versus completion date of the transaction \u2014 is the organising principle for every subsequent authority discussed below.<\/p>\n\n\n\n<h3 id=\"h-k-j-nathan-v-s-v-maruthi-rao\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"KJ_Nathan_v_SV_Maruthi_Rao\"><\/span>K.J. Nathan v. S.V. Maruthi Rao<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>AIR 1965 SC 430 \u2014 decided 11 February 1964<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A registered memorandum of agreement dated 5 July 1947 was presented for registration only on 31 October 1947, and was actually registered nearly a year later, on 22 June 1948. The Supreme Court held that under Section 47 the document nonetheless took effect from 5 July 1947 \u2014 the date of execution \u2014 giving the mortgagee priority over a mortgage executed later in time but registered sooner. This is the clearest authority for the proposition that Section 47 tolerates a substantial gap between execution and registration without disturbing the operative date, and it strengthens the doctrine against any suggestion that relation-back applies only to prompt registrations.<\/p>\n\n\n\n<h2 id=\"h-iii-priority-between-competing-instruments\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"III_Priority_Between_Competing_Instruments\"><\/span>III. Priority Between Competing Instruments<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 id=\"h-gurbax-singh-v-kartar-singh\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Gurbax_Singh_v_Kartar_Singh\"><\/span>Gurbax Singh v. Kartar Singh<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>(2002) 2 SCC 611 : AIR 2002 SC 959<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where two documents of sale were executed on the same day, the Supreme Court held that the time of execution \u2014 not merely the date \u2014 determines priority, irrespective of the order of registration. The instrument executed earlier in time prevails. A later Bench, in Mangulal Vankunavath v. Bharath Petroleum Corporation Ltd. (2024), expressly recorded that Gurbax Singh reiterated the view earlier taken in Hamda Ammal, confirming the doctrinal lineage traced in this article: Hamda Ammal \u2192 Gurbax Singh \u2192 Kanwar Raj Singh.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Practically, this closes a gap left open by Kanwar Raj Singh alone: where competing purchasers each hold a registered deed, Gurbax Singh is the squarely-on-point authority for resolving priority by reference to the moment of execution.<\/p>\n\n\n\n<h3 id=\"h-k-r-varadaraja-iyengar-v-t-lakshminarayana-setty\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"KR_Varadaraja_Iyengar_v_T_Lakshminarayana_Setty\"><\/span>K.R. Varadaraja Iyengar v. T. Lakshminarayana Setty<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>AIR 1985 Karnataka 245 \u2014 High Court<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Karnataka High Court, relying directly on K.J. Nathan, applied Section 47 to a priority contest on materially similar facts \u2014 a useful second voice at High Court level alongside Vasudha Gupta, discussed below.<\/p>\n\n\n\n<h2 id=\"h-iv-section-47-against-intervening-attachments\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"IV_Section_47_Against_Intervening_Attachments\"><\/span>IV. Section 47 Against Intervening Attachments<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 id=\"h-hamda-ammal-v-avadiappa-pathar\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Hamda_Ammal_v_Avadiappa_Pathar\"><\/span>Hamda Ammal v. Avadiappa Pathar<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>(1991) 1 SCC 715; 1990 Supp (2) SCR 594 \u2014 decided 7 November 1990<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The appellant executed a sale deed on 9 September 1970 but registered it only on 26 October 1970. In the interim, on 17 September 1970, a money-decree creditor of the vendor obtained an attachment before judgment over the very same property. The Supreme Court held that the purchaser&#8217;s title related back to the date of execution under Section 47 and prevailed over the intervening attachment, expressly distinguishing Radhakishan Toshniwal v. Shridhar and Bishan Singh v. Khazan Singh.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is the authority to cite wherever Section 47 is invoked defensively \u2014 against a creditor&#8217;s attachment, an injunction, or a third party&#8217;s claim asserted between execution and registration \u2014 rather than merely to resolve priority between two willing transferees.<\/p>\n\n\n\n<h2 id=\"h-v-recent-affirmation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"V_Recent_Affirmation\"><\/span>V. Recent Affirmation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 id=\"h-kanwar-raj-singh-v-gejo\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Kanwar_Raj_Singh_v_Gejo\"><\/span>Kanwar Raj Singh v. Gejo<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>AIR 2024 SC 238; (2024) 2 SCC 416<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court restated and applied Section 47 in a sale-deed context, holding that on a plain reading the section permits a compulsorily registrable document, once registered, to operate from a date before registration. Where a sale deed is executed and the entire agreed consideration is paid on or before execution, the deed \u2014 once registered \u2014 operates from the date of execution, because that is when it would have operated had registration not been required. Unauthorised alterations made to the deed after execution but before registration, without the other party&#8217;s knowledge or consent, do not alter the terms as they stood on the date of execution; they are simply ignored. The Court relied squarely on Ram Saran Lall to reaffirm that Section 47 governs the operative date of the instrument, not the completion of the sale.<\/p>\n\n\n\n<h2 id=\"h-vi-high-court-application\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"VI_High_Court_Application\"><\/span>VI. High Court Application<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 id=\"h-vasudha-gupta-v-delhi-development-authority\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Vasudha_Gupta_v_Delhi_Development_Authority\"><\/span>Vasudha Gupta v. Delhi Development Authority<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>215 (2014) DLT 711<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Delhi High Court read Sections 23 and 47 together: Section 23 requires presentation for registration within four months of execution; Section 47 ensures that once registration occurs, the document relates back to the date of execution regardless. Even where registration happens later \u2014 within the statutory window, or with condonation of delay \u2014 the operative date remains the execution date, not the registration date. This reading is frequently invoked to defend transactions where registration is slightly delayed but ultimately effected within, or with condonation beyond, the statutory period.<\/p>\n\n\n\n<h2 id=\"h-vii-the-statutory-scheme-read-together\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"VII_The_Statutory_Scheme_Read_Together\"><\/span>VII. The Statutory Scheme Read Together<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Section 23 prescribes a four-month window for presentation for registration.<\/li>\n\n\n\n<li>Section 47 ensures that compliance with (or condonation of delay within) that timeline does not prejudice the intended operative date \u2014 registration relates back to execution.<\/li>\n\n\n\n<li>Section 50, addressed in several of the priority authorities above, governs the effect of registration as against unregistered instruments and interacts closely with Section 47 in title-priority litigation.<\/li>\n\n\n\n<li>Standard commentaries on the Registration Act summarise the black-letter rule identically: a registered document operates from the date of its execution, not the date of its registration \u2014 citable as secondary authority in support of the line of cases above.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-viii-citations\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"VIII_Citations\"><\/span>VIII.
