Their detention persists primarily because they cannot afford the cost of release. Felony bail is commonly set at $10,000 or more, yet millions of people lack even a few hundred dollars in emergency savings. Those who resort to commercial bail bondsmen must pay a non-refundable fee\u2014typically ten per cent of the bail amount\u2014which is forfeited regardless of acquittal or dismissal of charges. The outcome is a stark two-tiered system: affluent defendants can secure immediate freedom, while poorer defendants facing identical charges remain incarcerated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In some jurisdictions, bail for minor offences is set at levels exceeding the median monthly income, effectively criminalising poverty.<\/p>\n\n\n\n<h2 id=\"h-a-system-stacked-against-the-poor\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_System_Stacked_Against_the_Poor\"><\/span>A System Stacked Against the Poor<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Courts often set bail using fixed price lists based on the charge. They rarely check what the person can actually afford. This creates serious problems.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Being locked up quickly leads to lost jobs, lost housing, and sometimes lost custody of children.<\/li>\n\n\n\n<li>Facing these pressures, many defendants accept guilty plea deals simply to get out of jail and go home\u2014whether they are guilty or not.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The harm is not shared equally. Black and Latino defendants are regularly assigned higher bail amounts than white defendants facing similar charges. Because of existing gaps in wealth, these higher amounts are even harder for them to pay. Text reminders, phone calls, or light supervision often do just as well at making sure people appear in court. With undertrials comprising over 70% of India\u2019s prison population, monetary bail sustains systemic congestion and undermines constitutional liberty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India\u2019s Supreme Court has clearly said that \u201cbail, not jail\u201d should be the normal rule. Yet lower courts often still demand high cash bonds and financial guarantors. For daily-wage workers and people from marginalised communities who have few formal assets, these demands turn the constitutional right to liberty into something they cannot afford. The bondsman pays the court and charges the defendant a non-refundable fee (typically around 10% of the bail amount), plus possible collateral.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In essence, cash bail binds a person\u2019s pre-trial liberty to their financial means. It punishes people before they have their day in court and forces many to choose between staying free and pleading guilty. True justice should judge a person\u2019s risk to others, not the size of their bank account. Until courts stop linking liberty to cash, the promise of equal treatment under the law will remain empty for the poor.
