It will help you in the maintenance case, show the court that you wanted your wife back, and make divorce easier later.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">It sounds like a neat legal strategy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But matrimonial law is rarely that simple.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Restitution of Conjugal Rights (RCR) and divorce are not compulsory steps in a single legal process. They are separate remedies based on fundamentally different objectives.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An RCR petition tells the court, &#8220;I want my marriage to continue, and I want matrimonial cohabitation restored.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A divorce petition says something very different: \u201cThe marriage has reached a legally recognized stage at which it should be dissolved.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction is not merely semantic. It can affect pleadings, evidence, maintenance proceedings, subsequent divorce litigation, and even how a husband&#8217;s conduct is examined by the court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The real question, therefore, is not simply<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cShould a husband file RCR or divorce?\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The better question is<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cWhat does the husband genuinely want, and what can he actually prove?\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is where sound matrimonial strategy begins.<\/p>\n\n\n\n<h2 id=\"h-rcr-and-divorce-are-not-two-mandatory-stages-of-the-same-case\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" class=\"wp-block-paragraph\">Section 9 of the Hindu Marriage Act, 1955, provides for the restitution of conjugal rights where either spouse has withdrawn from the society of the other without reasonable excuse.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The remedy is essentially aimed at restoring matrimonial cohabitation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Divorce under Section 13, on the other hand, seeks dissolution of the marriage on one or more statutory grounds, such as cruelty, adultery, or desertion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, desertion under Section 13(1)(ib) requires the statutory period of at least two continuous years immediately preceding the presentation of the divorce petition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is also an important timing restriction under Section 14: ordinarily, a divorce petition cannot be presented within one year of the marriage, subject to the statutory exception concerning exceptional hardship or exceptional depravity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So the basic distinction is straightforward:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>RCR:<\/strong> \u201cI want the marriage restored.\u201d<\/li>\n\n\n\n<li><strong>Divorce:<\/strong> \u201cI want the marriage dissolved.\u201d<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A husband should therefore think carefully before filing one merely because somebody describes it as the \u201cfirst step\u201d toward the other.<\/p>\n\n\n\n<h2 id=\"h-what-exactly-does-an-rcr-petition-mean\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Exactly_Does_an_RCR_Petition_Mean\"><\/span>What Exactly Does an RCR Petition Mean?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Under Section 9 HMA, the court is concerned with whether one spouse has withdrawn from the society of the other without reasonable excuse and whether the statutory conditions for granting restitution are satisfied.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose a wife leaves the matrimonial home.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The husband genuinely wants her to return.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He approaches her, attempts reconciliation, participates in counselling or mediation, and is prepared to resume matrimonial life.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the wife nevertheless withdraws without a legally sustainable reason, an RCR petition may have a legitimate purpose.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But there is an important practical question every husband should ask himself before filing:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">If my wife walks into court tomorrow and says, \u201cI am ready to return,\u201d am I actually prepared to resume the marriage?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">If the honest answer is yes, RCR may fit the situation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the answer is no because the husband has already decided that the marriage is over, an RCR petition filed merely to obtain a tactical advantage can create complications later.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Why?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Because pleadings do not simply disappear.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Statements made in one matrimonial proceeding may subsequently become relevant in divorce proceedings, maintenance litigation, domestic violence proceedings, custody disputes, or other connected litigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consistency matters.<\/p>\n\n\n\n<h2 id=\"h-an-rcr-decree-does-not-mean-the-wife-can-be-physically-forced-to-return\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"An_RCR_Decree_Does_Not_Mean_the_Wife_Can_Be_Physically_Forced_to_Return\"><\/span>An RCR Decree Does Not Mean the Wife Can Be Physically Forced to Return<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is another misconception that needs to be removed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An RCR decree does not give a husband a license to physically bring his wife back to the matrimonial home.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nor does it authorize the police to compel a woman to live with her husband.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court considered the nature and constitutional validity of Section 9 in <em>Saroj Rani v. Sudarshan Kumar <\/em>Chadha (1984) 4 SCC 90.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court upheld the provision but made clear that the legal process does not amount to judicial enforcement of sexual relations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The enforcement mechanism associated with an RCR decree is a civil process; it is not an order authorizing physical compulsion to resume married life.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction remains fundamental.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An RCR decree may have legal consequences in subsequent proceedings, but it is not a warrant compelling cohabitation.<\/p>\n\n\n\n<h2 id=\"h-the-biggest-myth-rcr-will-stop-maintenance\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Biggest_Myth_%E2%80%9CRCR_Will_Stop_Maintenance%E2%80%9D\"><\/span>The Biggest Myth: \u201cRCR Will Stop Maintenance\u201d<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is probably the most important point for husbands to understand.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A husband may be told:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cGet an RCR decree. If your wife still refuses to come back, her maintenance claim will automatically fail.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That proposition is legally unsafe.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s decision in <em>Rina Kumari @ Rina Devi @ Reena v. Dinesh Kumar Mahto @ Dinesh Kumar Mahato<\/em>, 2025 INSC 55, is particularly important here.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court considered whether a husband who had obtained an RCR decree could automatically avoid maintenance because his wife had not returned to the matrimonial home.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The answer was no.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court restored the maintenance order in favor of the wife and held that the maintenance court must independently examine whether the wife had sufficient reason for living separately. The existence of an RCR decree, and non-compliance with it, cannot by themselves conclusively determine the maintenance question.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The decision is especially relevant today because the maintenance framework under the BNSS has replaced the corresponding CrPC provision.<\/p>\n\n\n\n<h2 id=\"h-what-does-section-144-bnss-say-about-maintenance\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Does_Section_144_BNSS_Say_About_Maintenance\"><\/span>What Does Section 144 BNSS Say About Maintenance?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Since 1 July 2024, Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), contains the statutory maintenance remedy corresponding broadly to the former Section 125 CrPC.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 144(4) provides that a wife is not entitled to maintenance under that provision where, among other circumstances, she refuses to live with her husband without sufficient reason, or the parties are living separately by mutual consent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the crucial words are<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cwithout sufficient reason.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That requires an examination of facts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The existence of an RCR decree does not eliminate that inquiry.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court may have to consider why the wife is living separately, what happened during the marriage, the conduct of both parties, allegations of cruelty or harassment, financial circumstances, and the evidence placed before the court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Rina Kumari<\/em>, the Supreme Court made precisely this distinction: an RCR decree cannot be converted into an automatic maintenance-cancellation mechanism.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The practical lesson for husbands is therefore simple:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If maintenance is the real dispute, defend the maintenance case on its own evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Do not assume that an RCR proceeding will do the work for you.<\/p>\n\n\n\n<h2 id=\"h-the-bnss-has-changed-the-provision-not-the-basic-legal-question\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_BNSS_Has_Changed_the_Provision_Not_the_Basic_Legal_Question\"><\/span>The BNSS Has Changed the Provision, Not the Basic Legal Question<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The transition from Section 125 CrPC to Section 144 BNSS is important for anyone litigating matrimonial disputes today.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 144 expressly deals with maintenance of wives, children, and parents and contains provisions dealing with circumstances in which maintenance may be refused or an existing order cancelled.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the fundamental question remains factual:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Why is the wife living separately?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">An RCR decree may be relevant evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is not a magic document.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction should be kept firmly in mind when advising a husband about litigation strategy.<\/p>\n\n\n\n<h2 id=\"h-the-rcr-to-divorce-route-what-section-13-1a-ii-actually-provides\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_RCR-to-Divorce_Route_What_Section_131Aii_Actually_Provides\"><\/span>The RCR-to-Divorce Route: What Section 13(1A)(ii) Actually Provides<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is, however, an important connection between RCR and divorce.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 13(1A)(ii) of the Hindu Marriage Act permits either party to seek divorce where there has been no restitution of conjugal rights for one year or more after an RCR decree.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The words \u201ceither party\u201d are important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A husband who obtains an RCR decree does not acquire an exclusive right to use the subsequent statutory consequence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If matrimonial cohabitation is not restored for the prescribed period, the wife can also invoke the provision, subject to the statutory requirements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And the marriage does not dissolve automatically merely because one year has passed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A fresh divorce proceeding is required.<\/p>\n\n\n\n<h3 id=\"h-the-one-year-clock-matters\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_One-Year_Clock_Matters\"><\/span>The One-Year Clock Matters<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A husband should not assume that an RCR decree immediately creates a divorce right.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The statutory period has to run.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This becomes particularly important when lawyers or parties attempt to construct a chronology around an RCR decree.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s 2024 decision in <em>X v. Y<\/em>, 2024 INSC 476, illustrates the importance of chronology. The Court examined a case where an RCR decree had been obtained, but the divorce petition based on non-restitution was filed before completion of the statutory one-year period. The divorce ultimately survived because an independent statutory ground\u2014desertion\u2014had been established.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lesson is straightforward:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An RCR decree does not allow a party to ignore the statutory clock.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where divorce is being sought on another independent ground, that ground must itself satisfy the requirements of the Hindu Marriage Act.<\/p>\n\n\n\n<h2 id=\"h-rcr-can-be-appropriate-when-reconciliation-is-genuine\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"RCR_Can_Be_Appropriate_When_Reconciliation_Is_Genuine\"><\/span>RCR Can Be Appropriate When Reconciliation Is Genuine<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There are circumstances where an RCR petition makes complete legal sense.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The wife has actually withdrawn from matrimonial society<\/li>\n\n\n\n<li>The husband genuinely wants the marriage restored;<\/li>\n\n\n\n<li>there is no reasonable excuse for the withdrawal<\/li>\n\n\n\n<li>The husband&#8217;s own conduct supports his claim of reconciliation<\/li>\n\n\n\n<li>genuine attempts at mediation or counselling have been made; and<\/li>\n\n\n\n<li>The husband is prepared to resume matrimonial life if the wife returns.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Evidence generated before litigation can become important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Messages requesting reconciliation, counselling records, mediation attempts, correspondence between families, arrangements made for the wife&#8217;s return, and other contemporaneous material may help establish whether the husband&#8217;s stated intention was genuine.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The important point is not to manufacture such evidence after litigation begins.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court is ultimately concerned with the factual history of the marriage.<\/p>\n\n\n\n<h2 id=\"h-a-2026-allahabad-high-court-decision-shows-the-proper-role-of-section-9\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_2026_Allahabad_High_Court_Decision_Shows_the_Proper_Role_of_Section_9\"><\/span>A 2026 Allahabad High Court Decision Shows the Proper Role of Section 9<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A recent decision illustrates another important aspect of RCR.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Anupam Yadav v. State of U.P.<\/em>, Habeas Corpus Writ Petition No. 235 of 2026, the Allahabad High Court&#8217;s Lucknow Bench dealt with a husband who approached the court alleging that his wife had been illegally detained by her father.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court did not treat the matrimonial disagreement as a habeas corpus matter. On the material before it, the wife appeared to have left the matrimonial home voluntarily.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court indicated that where the husband&#8217;s grievance is essentially that his wife has withdrawn from matrimonial life, the appropriate matrimonial remedy is a proceeding under Section 9 HMA, rather than attempting to convert the dispute into habeas corpus litigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case reinforces a basic principle:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">RCR is a matrimonial remedy. It is not a substitute for every other legal proceeding.<\/p>\n\n\n\n<h2 id=\"h-when-divorce-may-be-the-more-consistent-remedy\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"When_Divorce_May_Be_the_More_Consistent_Remedy\"><\/span>When Divorce May Be the More Consistent Remedy<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Now consider the opposite situation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A husband has already concluded that the marriage cannot continue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There has been prolonged litigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The parties have attempted mediation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The relationship has broken down.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And the husband has evidence capable of establishing a statutory ground for divorce\u2014for example, cruelty under Section 13(1)(ia).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In such circumstances, filing RCR merely to create a paper trail saying \u201cI wanted my wife back\u201d may be inconsistent with the actual case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court does not decide matrimonial disputes by looking at the label attached to a petition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It examines the pleadings, evidence, and conduct of the parties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the real case is cruelty, the husband must establish cruelty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the case is desertion, he must establish the legal ingredients of desertion and the statutory period.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the marriage has not completed the period required for filing a divorce petition, Section 14 must also be considered.<\/p>\n\n\n\n<h2 id=\"h-mere-separation-does-not-automatically-prove-desertion\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Mere_Separation_Does_Not_Automatically_Prove_Desertion\"><\/span>Mere Separation Does Not Automatically Prove Desertion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is another area where matrimonial litigation frequently goes wrong.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A husband and wife living separately does not automatically mean that the wife has legally deserted the husband.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Desertion involves more than physical separation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The statutory requirements\u2014including the required period\u2014must be established.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under Section 13(1)(ib), the relevant period is two continuous years immediately preceding the presentation of the divorce petition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The chronology should therefore be prepared carefully before filing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dates of separation, attempts at reconciliation, communications between the spouses, mediation proceedings, previous litigation, and the date on which the statutory period was completed can all matter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A matrimonial case can turn on chronology.<\/p>\n\n\n\n<h2 id=\"h-a-significant-2026-kerala-high-court-decision\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_Significant_2026_Kerala_High_Court_Decision\"><\/span>A Significant 2026 Kerala High Court Decision<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A recent Kerala High Court judgment provides another useful illustration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Moli Thomas v. Keshab Chand<\/em>, 2026:KER:54076, the dispute arose from a long-running matrimonial relationship. The Family Court had granted divorce to the husband and rejected the wife&#8217;s counterclaim for restitution of conjugal rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The parties had also undergone mediation and counselling efforts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The wife maintained that she was willing to resume matrimonial life. of that remedy can depend upon whether his pleadings, documents, communications, and conduct tell a coherent story.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">RCR should therefore not be treated as a
