In parts of Michigan, USA, drinking water has been contaminated by PFAS, including chemicals associated with firefighting foams. Lawsuits have been brought against manufacturers seeking compensation, medical monitoring, and environmental clean-up.<\/p>\n\n\n\n<h3 id=\"h-2-2-climate-litigation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"22_Climate_Litigation\"><\/span>2.2. Climate Litigation<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Citizens and environmental groups are increasingly approaching courts to compel the executive and corporations to take stronger action against climate change.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Urgenda Foundation v. State of the Netherlands<\/em>, the Dutch courts required the government to take stronger measures to reduce greenhouse-gas emissions. Core Challenges<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In India, Public Interest Litigations (PILs) have played an important role in addressing environmental harm, including the Bhopal Gas Disaster, industrial pollution, and air pollution in Delhi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Victims often face difficulties in:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>proving that a particular activity caused the harm;<\/li>\n\n\n\n<li>obtaining scientific evidence;<\/li>\n\n\n\n<li>bearing the cost of litigation;<\/li>\n\n\n\n<li>dealing with powerful corporate defendants; and<\/li>\n\n\n\n<li>obtaining timely relief.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-3-2-important-legal-doctrines\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"32_Important_Legal_Doctrines\"><\/span>3.2. Union of India<\/em> (Oleum Gas Leak case), the Supreme Court established the principle of absolute liability for enterprises engaged in hazardous or inherently dangerous activities. Union of India<\/em>, the Supreme Court recognized the Precautionary Principle and the Polluter Pays Principle as important parts of Indian environmental law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The precautionary principle requires preventive action where there is a risk of serious environmental harm, even where scientific certainty is incomplete. It now focuses on:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Systemic accountability of corporations and administrative authorities;<\/li>\n\n\n\n<li>Climate governance through judicial intervention;<\/li>\n\n\n\n<li>Prevention of environmental harm through precautionary measures; and<\/li>\n\n\n\n<li>Protection of human rights, including the right to a clean, healthy, and sustainable environment.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Thus, modern environmental tort law is gradually developing from a system focused mainly on compensation for past harm into a broader framework aimed at preventing environmental damage, holding powerful actors accountable, and protecting present and future generations.<\/p>\n\n\n\n<h2 id=\"h-conclusion\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Environmental tort law is undergoing a significant transformation. It is no longer concerned only with compensating victims after environmental damage has occurred; it increasingly seeks to prevent harm, hold corporations and administrative authorities accountable, and protect public health and environmental rights. The development of principles such as absolute liability, the precautionary principle, and the polluter pays principle has strengthened this approach in India.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, emerging issues such as PFAS contamination, climate change, corporate responsibility, and regulatory immunity present new legal and scientific challenges.
