An accused person is presumed innocent until proven guilty, and pre-trial detention should not become a form of punishment. At the same time, the criminal justice system has a corresponding responsibility to protect victims\u2014particularly women, children, elderly persons and persons with disabilities\u2014from intimidation, further harm, coercion and secondary victimisation.<\/p><div id=\"ez-toc-container\" class=\"ez-toc-v2_0_87_1 counter-hierarchy ez-toc-counter ez-toc-grey class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Bail involves the release of an accused person from custody, subject to conditions prescribed by the competent court. Grant of bail does not amount to acquittal; the criminal proceedings continue in accordance with law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The principal purposes of bail are to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>secure the accused\u2019s presence during investigation and trial;<\/li>\n\n\n\n<li>prevent the accused from absconding;<\/li>\n\n\n\n<li>prevent tampering with evidence;<\/li>\n\n\n\n<li>prevent intimidation or influence of witnesses;<\/li>\n\n\n\n<li>protect the victim where a genuine risk exists; and<\/li>\n\n\n\n<li>preserve the integrity of the investigation and trial.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The decision to grant or refuse bail must therefore be based on the circumstances of the individual case rather than on a mechanical or one-dimensional approach.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Core Bail Consideration<\/th><th>Purpose<\/th><\/tr><\/thead><tbody><tr><td>Accused\u2019s presence<\/td><td>Secure the accused\u2019s presence during investigation and trial.<\/td><\/tr><tr><td>Absconding<\/td><td>Prevent the accused from absconding.<\/td><\/tr><tr><td>Evidence<\/td><td>Prevent tampering with evidence.<\/td><\/tr><tr><td>Witnesses<\/td><td>Prevent intimidation or influence of witnesses.<\/td><\/tr><tr><td>Victim protection<\/td><td>Protect the victim where a genuine risk exists.<\/td><\/tr><tr><td>Administration of justice<\/td><td>Preserve the integrity of the investigation and trial.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 id=\"h-special-considerations-where-the-victim-is-vulnerable-women\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Special_Considerations_Where_the_Victim_Is_Vulnerable_Women\"><\/span>Special Considerations Where the Victim Is Vulnerable: Women<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Women may face heightened vulnerability where the accused is a spouse, former spouse, relative, employer, neighbour or another person exercising social, economic or personal influence over them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In such circumstances, the court may consider the nature of the relationship, any history of threats or harassment, the stage of investigation, the possibility of contact or influence, and the likelihood of interference with witnesses or evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the mere fact that the victim is a woman cannot, by itself, be treated as a ground for automatic refusal of bail. The assessment must remain fact-specific and legally sustainable.<\/p>\n\n\n\n<h2 id=\"h-domestic-violence-and-matrimonial-cases\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Domestic_Violence_and_Matrimonial_Cases\"><\/span>Domestic Violence and Matrimonial Cases<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Cases arising out of matrimonial relationships or domestic settings require particular sensitivity because the accused and victim may continue to share family connections, social networks or geographical proximity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court may take into account:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the nature and seriousness of the allegations;<\/li>\n\n\n\n<li>the relationship between the accused and the victim;<\/li>\n\n\n\n<li>any previous threats, harassment or violence;<\/li>\n\n\n\n<li>the stage and progress of investigation;<\/li>\n\n\n\n<li>the possibility of influencing witnesses;<\/li>\n\n\n\n<li>the possibility of tampering with evidence; and<\/li>\n\n\n\n<li>the likelihood of further harassment or repetition of the alleged conduct.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, bail proceedings should not become a substitute for the trial itself. The court must avoid determining disputed questions of guilt or innocence at the interim stage.<\/p>\n\n\n\n<h2 id=\"h-sexual-offence-cases\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Sexual_Offence_Cases\"><\/span>Sexual Offence Cases<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Bail applications in cases involving sexual offences require particularly careful judicial scrutiny. The court may consider the nature of the allegations, the material collected during investigation, the relationship between the accused and the victim, the stage of investigation, the possibility of influencing witnesses and the risk of further contact or intimidation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where appropriate, protective conditions may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>prohibiting direct or indirect contact with the victim;<\/li>\n\n\n\n<li>restricting the accused from visiting specified places associated with the victim;<\/li>\n\n\n\n<li>prohibiting contact with particular witnesses;<\/li>\n\n\n\n<li>requiring cooperation with the investigation; and<\/li>\n\n\n\n<li>imposing other lawful and proportionate conditions necessary to protect the interests of justice.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Such conditions should be specific, reasonable, enforceable and proportionate to the risks identified in the case. They should protect the victim without becoming punitive restrictions imposed before conviction.<\/p>\n\n\n\n<h2 id=\"h-children\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Children\"><\/span>Children<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Children require special protection because of their age and vulnerability. This is particularly significant in cases governed by the Protection of Children from Sexual Offences Act, 2012 (POCSO Act).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While considering bail in such cases, the court must remain conscious of the possibility of psychological pressure, intimidation, influence and secondary victimisation. The privacy, dignity and emotional well-being of the child must be protected throughout the criminal process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The special vulnerability of a child, however, does not eliminate the requirement for a fair and lawful determination of the accused\u2019s bail application.<\/p>\n\n\n\n<h2 id=\"h-elderly-persons-and-persons-with-disabilities\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Elderly_Persons_and_Persons_with_Disabilities\"><\/span>Elderly Persons and Persons with Disabilities<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Elderly persons and persons with disabilities may face particular difficulties in criminal proceedings and may be more susceptible to intimidation, dependency or exploitation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where the accused has access to or influence over such a vulnerable person, the court may consider whether release could create a genuine risk of interference or further harm.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Conversely, vulnerability may also arise on the side of the accused. Advanced age, serious disability or other exceptional circumstances may be relevant considerations in a bail application, subject to the facts of the case and applicable law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Thus, vulnerability must be assessed objectively and cannot automatically operate either in favour of or against a particular party.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Vulnerable Person<\/th><th>Relevant Bail Consideration<\/th><\/tr><\/thead><tbody><tr><td>Women<\/td><td>Relationship with the accused, threats, harassment, contact or influence, and interference with witnesses or evidence.<\/td><\/tr><tr><td>Children<\/td><td>Psychological pressure, intimidation, influence, secondary victimisation, privacy, dignity and emotional well-being.<\/td><\/tr><tr><td>Elderly Persons<\/td><td>Intimidation, dependency, exploitation and risk of further harm.<\/td><\/tr><tr><td>Persons with Disabilities<\/td><td>Intimidation, dependency, exploitation and risk of interference or further harm.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 id=\"h-victim-safety-and-bail-conditions\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Victim_Safety_and_Bail_Conditions\"><\/span>Victim Safety and Bail Conditions<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Victim safety is a legitimate consideration in bail proceedings where there is a credible and identifiable risk.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Courts may consider factors such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>previous threats or acts of intimidation;<\/li>\n\n\n\n<li>criminal antecedents;<\/li>\n\n\n\n<li>the relationship between the accused and the victim;<\/li>\n\n\n\n<li>geographical proximity;<\/li>\n\n\n\n<li>the accused\u2019s influence over the victim or witnesses;<\/li>\n\n\n\n<li>previous violations of court orders or bail conditions; and<\/li>\n\n\n\n<li>the possibility of repetition of the alleged offence.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Bail conditions provide an important mechanism for reconciling personal liberty with legitimate concerns regarding victim and witness protection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, conditions should be tailored to the circumstances of the case. They should not be excessive, vague or impossible to comply with. Their purpose should be to secure the administration of justice, not to punish the accused before conviction.<\/p>\n\n\n\n<h2 id=\"h-cancellation-of-bail\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Cancellation_of_Bail\"><\/span>Cancellation of Bail<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The grant of bail carries with it an obligation to comply with the conditions imposed by the court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where an accused misuses the liberty granted, cancellation of bail may be sought in accordance with law.
