A wife may discover intimate WhatsApp conversations. There may be photographs, hotel bookings, unexplained payments, frequent travel, or a series of late-night calls. To the spouse involved, these circumstances may appear conclusive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But a courtroom operates differently.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Suspicion may trigger a matrimonial dispute; evidence is what allows a court to decide it.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction has become particularly important as matrimonial litigation increasingly involves smartphones, WhatsApp conversations, electronic records, hotel databases, call-detail records, location information, photographs, recordings, and material collected by private investigators.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Indian courts have repeatedly recognized that adultery generally takes place behind closed doors. Direct evidence of the sexual relationship is therefore uncommon. The real legal question is whether the surrounding circumstances, taken together, establish the allegation on the applicable civil standard of proof.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That makes one principle particularly important:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>A large collection of suspicious material is not necessarily the same thing as a legally convincing case.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<h2 id=\"h-what-does-adultery-mean-under-indian-matrimonial-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Does_Adultery_Mean_Under_Indian_Matrimonial_Law\"><\/span>What Does Adultery Mean Under Indian Matrimonial Law?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The everyday meaning of \u201cinfidelity\u201d is broader than the legal concept of adultery.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under Section 13(1)(i) of the Hindu Marriage Act, 1955, voluntary sexual intercourse with a person other than the spouse after marriage constitutes a ground for divorce.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Special Marriage Act, 1954, also contains a substantially similar matrimonial ground under Section 27(1)(a).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction matters because conduct that may appear improper or emotionally damaging does not automatically satisfy the legal test of adultery.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>romantic or flirtatious messages;<\/li>\n\n\n\n<li>frequent telephone calls;<\/li>\n\n\n\n<li>an emotional attachment;<\/li>\n\n\n\n<li>meeting another person socially;<\/li>\n\n\n\n<li>photographs taken together; or<\/li>\n\n\n\n<li>an unusually close friendship<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">may raise questions, but none of these facts, standing alone, necessarily establishes statutory adultery.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending upon the circumstances, such conduct may nevertheless become relevant to another matrimonial ground, including cruelty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court ultimately examines what the evidence proves\u2014not merely what the conduct appears to suggest.<\/p>\n\n\n\n<h2 id=\"h-is-adultery-still-a-crime-in-india\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Is_Adultery_Still_a_Crime_in_India\"><\/span>Is Adultery Still a Crime in India?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>No.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s decision in Joseph Shine v. Union of India removed adultery from the category of criminal offenses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That does not mean adultery became legally irrelevant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It can continue to operate as a ground for dissolution of marriage under applicable matrimonial law and may have civil or matrimonial consequences. Decriminalization and legal approval are therefore two entirely different concepts.<\/p>\n\n\n\n<h2 id=\"h-what-standard-of-proof-applies-to-adultery\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Standard_of_Proof_Applies_to_Adultery\"><\/span>What Standard of Proof Applies to Adultery?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the most important misconceptions in matrimonial litigation is that adultery must be proved beyond reasonable doubt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is the criminal-law standard.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A divorce proceeding is a civil matrimonial proceeding. The Supreme Court in Dr. N.G. Dastane v. Mrs. S. Dastane (1975) 2 SCC 326 explained that matrimonial allegations are assessed on the basis of preponderance of probabilities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In simple terms, the Family Court considers the evidence as a whole and asks whether the alleged fact is sufficiently probable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This does not mean that allegations of adultery can be made casually.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Because an alleged affair normally takes place privately, the court may have to reconstruct events from surrounding circumstances. The circumstances must, however, form a credible and persuasive chain.<\/p>\n\n\n\n<h2 id=\"h-can-adultery-be-proved-without-direct-evidence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_Adultery_Be_Proved_Without_Direct_Evidence\"><\/span>Can Adultery Be Proved Without Direct Evidence?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Yes.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In fact, direct evidence is often difficult to obtain.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Sachin Arora v. Manju Arora, the Delhi High Court recognized that direct evidence of adultery can rarely be available. The case illustrates why courts may examine surrounding evidence such as hotel records and call records when they are connected with specific allegations. The Supreme Court upheld the relevant judgment in July 2026.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The practical approach is therefore not<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cShow the court the affair.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">It is:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cShow the court the connected circumstances from which the matrimonial allegation can reasonably be established.\u201d<\/p>\n<\/blockquote>\n\n\n\n<h2 id=\"h-what-evidence-can-be-used-to-prove-adultery\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Evidence_Can_Be_Used_to_Prove_Adultery\"><\/span>What Evidence Can Be Used to Prove Adultery?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is no single document that automatically becomes \u201cproof of adultery.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The evidentiary value of material depends upon its relevance, authenticity, context, source, and connection with other evidence.<\/p>\n\n\n\n<h3 id=\"h-1-whatsapp-chats-and-other-messages\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"1_WhatsApp_Chats_and_Other_Messages\"><\/span>1. WhatsApp Chats and Other Messages<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">WhatsApp conversations, emails, and social media messages can become significant evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They may contain:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>admissions;<\/li>\n\n\n\n<li>intimate conversations;<\/li>\n\n\n\n<li>arrangements to meet;<\/li>\n\n\n\n<li>travel plans;<\/li>\n\n\n\n<li>hotel discussions;<\/li>\n\n\n\n<li>expressions indicating a continuing relationship; or<\/li>\n\n\n\n<li>other facts connecting the parties.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">But a screenshot is not automatically conclusive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A cropped screenshot can leave unanswered questions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Who sent it?<\/li>\n\n\n\n<li>Was the conversation complete?<\/li>\n\n\n\n<li>Has anything been deleted?<\/li>\n\n\n\n<li>Is the account genuine?<\/li>\n\n\n\n<li>Has the material been altered?<\/li>\n\n\n\n<li>Where is the original device?<\/li>\n\n\n\n<li>Can the electronic record be properly proved?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A complete, properly preserved conversation is generally more useful than a collection of isolated screenshots.<\/p>\n\n\n\n<h3 id=\"h-2-hotel-booking-and-check-in-records\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2_Hotel_Booking_and_Check-In_Records\"><\/span>2. Hotel Booking and Check-In Records<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Hotel records can become important where they correspond with a specific allegation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, evidence concerning:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the hotel;<\/li>\n\n\n\n<li>date of stay;<\/li>\n\n\n\n<li>booking details;<\/li>\n\n\n\n<li>identification documents;<\/li>\n\n\n\n<li>payment records;<\/li>\n\n\n\n<li>check-in information; and<\/li>\n\n\n\n<li>related travel evidence<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">may collectively help establish a chain of circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But a hotel record alone does not necessarily establish sexual intercourse.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Its significance depends upon the surrounding evidence.<\/p>\n\n\n\n<h3 id=\"h-3-call-detail-records\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3_Call_Detail_Records\"><\/span>3. Call Detail Records<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Call Detail Records (CDRs) can demonstrate patterns of communication.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They may help establish:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>frequency of calls;<\/li>\n\n\n\n<li>timing;<\/li>\n\n\n\n<li>duration;<\/li>\n\n\n\n<li>repeated communication; and<\/li>\n\n\n\n<li>connections between particular numbers.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Tower-location information may sometimes provide additional corroboration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But a CDR has limitations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It ordinarily does not tell the court what was discussed. Similarly, two phones registering on the same mobile tower does not, by itself, prove that the persons were engaged in an adulterous relationship.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The value of CDR evidence therefore increases when it corroborates other circumstances.<\/p>\n\n\n\n<h3 id=\"h-4-bank-upi-and-credit-card-records\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"4_Bank_UPI_and_Credit-Card_Records\"><\/span>4. Bank, UPI, and Credit-Card Records<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Financial records can sometimes reveal patterns that are difficult to explain through isolated evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Relevant material may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>bank statements;<\/li>\n\n\n\n<li>credit card transactions;<\/li>\n\n\n\n<li>UPI payments;<\/li>\n\n\n\n<li>hotel payments;<\/li>\n\n\n\n<li>travel bookings;<\/li>\n\n\n\n<li>toll records;<\/li>\n\n\n\n<li>invoices; and<\/li>\n\n\n\n<li>other expenditure records.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Again, the objective is not to create suspicion through individual transactions but to determine whether several pieces of evidence form a coherent factual pattern.<\/p>\n\n\n\n<h3 id=\"h-5-photographs-cctv-and-videos\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"5_Photographs_CCTV_and_Videos\"><\/span>5. Photographs, CCTV, and Videos<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Photographs and videos can certainly become part of an evidentiary chain.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But a photograph of two people together does not automatically establish adultery.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court may need to consider:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>when it was taken;<\/li>\n\n\n\n<li>where it was taken;<\/li>\n\n\n\n<li>who took it;<\/li>\n\n\n\n<li>whether the original exists;<\/li>\n\n\n\n<li>whether it has been edited;<\/li>\n\n\n\n<li>whether the context is known; and<\/li>\n\n\n\n<li>whether other evidence supports the inference sought to be drawn.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-6-admissions-and-witness-evidence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"6_Admissions_and_Witness_Evidence\"><\/span>6. Admissions and Witness Evidence<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">An admission contained in a message, pleading, or testimony can sometimes carry considerable evidentiary importance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Similarly, a witness who personally observed relevant circumstances may assist the court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But there is an important distinction between personal knowledge and hearsay.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Statements such as \u201ceverybody in the neighborhood knows about the affair\u201d are not substitutes for evidence of facts personally observed by a witness.<\/p>\n\n\n\n<h2 id=\"h-can-a-court-order-the-production-of-hotel-records-or-cdrs\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_a_court_order_the_production_of_hotel_records_or_CDRs\"><\/span>Can a court order the production of hotel records or CDRs?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Yes, where the request is properly connected with the pleaded case.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The decision in Sachin Arora v. Manju Arora is particularly relevant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The wife had alleged a particular hotel stay involving her husband and another woman. The Family Court directed preservation and production of specified hotel records and CDRs in a sealed cover. The Delhi High Court upheld the order, and the Supreme Court upheld the judgment on 2 July 2026.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But there is an important limitation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is a major difference between asking for:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe hotel records relating to this specific stay on this particular date.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">and asking for:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cGive me every hotel record, phone record, and digital activity of my spouse for the last several years.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The first may be a focused evidentiary request.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The second may amount to a fishing expedition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Delhi High Court&#8217;s decision in Ms. Tanvi Chaturvedi v. Ms. Smita Shrivastava &amp; Anr. (2025) also illustrates the importance of relevance and proportionality, including safeguards such as supervised inspection or sealed-cover production where appropriate.<\/p>\n\n\n\n<h2 id=\"h-how-should-whatsapp-and-electronic-evidence-be-preserved\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_Should_WhatsApp_and_Electronic_Evidence_Be_Preserved\"><\/span>How Should WhatsApp and Electronic Evidence Be Preserved?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is an area where otherwise substantial matrimonial cases can become unnecessarily vulnerable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Bharatiya Sakshya Adhiniyam, 2023 (BSA), applies to proceedings commenced after its enforcement on 1 July 2024, subject to its savings provisions for earlier proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sections 61 to 63 deal with electronic and digital records.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A litigant relying upon digital evidence should therefore think beyond screenshots.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where possible:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Preserve the original device.<\/li>\n\n\n\n<li>Retain the complete conversation.<\/li>\n\n\n\n<li>Preserve timestamps and dates.<\/li>\n\n\n\n<li>Keep attachments and media files.<\/li>\n\n\n\n<li>Preserve relevant backups.<\/li>\n\n\n\n<li>Avoid editing or recreating material.<\/li>\n\n\n\n<li>Maintain information about the source of the electronic record.<\/li>\n\n\n\n<li>Comply with the applicable statutory certification requirements.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">For electronic records requiring proof under Section 63 BSA, appropriate certification and device particulars should be prepared.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Family courts have considerable flexibility in receiving material under Section 14 of the Family Courts Act, but that flexibility should not be confused with a license to rely upon manipulated or unexplained electronic material.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Receiving evidence and proving its reliability are two different questions.<\/strong><\/p>\n\n\n\n<h2 id=\"h-can-a-secret-recording-of-a-spouse-be-used-in-court\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_a_Secret_Recording_of_a_Spouse_Be_Used_in_Court\"><\/span>Can a Secret Recording of a Spouse Be Used in Court?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court addressed this issue in Vibhor Garg v. Neha, 2025 INSC 829.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court held that a recorded conversation between spouses could be admitted in matrimonial proceedings, applying considerations including relevance, identification, and accuracy. The fact that the other spouse was unaware of the recording or had not consented to it did not, by itself, prevent its admission.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But this judgment should not be misunderstood.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It does not mean that a spouse has unlimited freedom to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>hack an email account;<\/li>\n\n\n\n<li>install spyware;<\/li>\n\n\n\n<li>break into another person&#8217;s device;<\/li>\n\n\n\n<li>impersonate someone;<\/li>\n\n\n\n<li>obtain passwords unlawfully; or<\/li>\n\n\n\n<li>commit an independent unlawful act to collect evidence.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">There is an important legal distinction between preserving a conversation in which you participated and illegally accessing another person&#8217;s private digital account or device.<\/p>\n\n\n\n<h2 id=\"h-what-has-the-supreme-court-said-about-private-investigators\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Has_the_Supreme_Court_Said_About_Private_Investigators\"><\/span>What Has the Supreme Court Said About Private Investigators?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A significant warning came from the Supreme Court in Himanshu Chordia v. State of Rajasthan, 2026 INSC 778, decided on 31 July 2026.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case involved maintenance proceedings and an allegation that the wife was living in adultery.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The record reportedly contained approximately 92 videos and 237 photographs, apparently collected through a third party or private investigation. The Supreme Court did not treat the sheer quantity of material as proof.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, the Court raised fundamental questions concerning the source and collection of the material, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Who took the photographs, and whether they had authorization to do so?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Court also raised concerns relating to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>authenticity;<\/li>\n\n\n\n<li>storage;<\/li>\n\n\n\n<li>possible doctoring;<\/li>\n\n\n\n<li>morphing;<\/li>\n\n\n\n<li>privacy; and<\/li>\n\n\n\n<li>the regulation of private investigators.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The practical lesson is straightforward:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>A private investigator&#8217;s file is not automatically a court-proof evidence file.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The court may still examine who collected the material, how it was obtained, whether the original files exist, whether the material is authentic, and whether the applicable evidentiary requirements have been satisfied.<\/p>\n\n\n\n<h2 id=\"h-can-dna-testing-be-used-to-prove-an-affair\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_DNA_Testing_Be_Used_to_Prove_an_Affair\"><\/span>Can DNA Testing Be Used to Prove an Affair?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">DNA testing should not be treated as a shortcut for proving adultery.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This issue becomes particularly sensitive where allegations concern the paternity of a child.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Aparna Ajinkya Firodia v. Ajinkya Arun Firodia, the Supreme Court emphasized the legal protection surrounding the legitimacy of a child and held that DNA testing should not ordinarily be ordered merely to facilitate an allegation of adultery.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The applicable legal requirements concerning paternity and non-access remain important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A matrimonial dispute between adults should not casually turn a child into an instrument of evidence.<\/p>\n\n\n\n<h2 id=\"h-does-the-alleged-paramour-have-to-be-made-a-party\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Does_the_Alleged_Paramour_Have_to_Be_Made_a_Party\"><\/span>Does the Alleged Paramour Have to Be Made a Party?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This question requires particular caution because the supplied authorities indicate a divergence at the High Court level.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Delhi High Court in Shivi Bansal v.
