State of Maharashtra<\/em>, arising from Crime No. 573 of 2023 registered at Wanwadi Police Station, Pune.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The accused had been arrested on November 24, 2023, and had remained in custody for more than two years and nine months.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Bombay High Court, while considering the bail application, examined both the medical circumstances placed before it and the fact that the trial had not yet concluded.<\/p>\n\n\n\n<h2 id=\"h-matrimonial-dispute-preceded-husband-s-death\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Matrimonial_Dispute_Preceded_Husbands_Death\"><\/span>Matrimonial Dispute Preceded Husband\u2019s Death<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">According to the prosecution case, the couple had an altercation at their Pune residence following a matrimonial dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The prosecution referred to disagreements between the husband and wife, including an allegation that the husband had not taken his wife to Dubai for her birthday and had not given her the marriage anniversary gift that she expected.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The dispute allegedly escalated into a physical confrontation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During the altercation, the accused woman is also stated to have suffered injuries. The prosecution alleges that the husband was pushed during the incident and subsequently fell on a heavy and sharp object, resulting in his death.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These allegations remain matters for determination at trial. The Bombay High Court&#8217;s grant of bail does not constitute a finding that the prosecution&#8217;s allegations are false or that the accused is innocent.<\/p>\n\n\n\n<h2 id=\"h-serious-spinal-condition-was-a-significant-consideration\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Serious_Spinal_Condition_Was_a_Significant_Consideration\"><\/span>Serious Spinal Condition Was a Significant Consideration<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The woman&#8217;s medical condition had previously been brought before the High Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In April 2026, another Bench had granted her temporary bail for three months after considering a medical report from the Chief Medical Officer of Yerwada Central Prison.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The report indicated that she required spinal surgery followed by post-operative treatment. The Court consequently permitted her to undergo treatment at a private hospital.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Her temporary bail was subsequently extended.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the proposed surgery was later deferred after doctors found that she was responding satisfactorily to physiotherapy. She ultimately surrendered before the authorities on August 4, 2026.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The medical material subsequently placed before the Court showed that her treatment requirements continued.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She was advised to undertake spinal exercises twice a day and undergo supervised physiotherapy. She was also required to attend hospital follow-ups approximately every four weeks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The medical advice further restricted her from bending forward and from lifting weights exceeding 5 kilograms.<\/p>\n\n\n\n<h2 id=\"h-prosecution-opposed-regular-bail\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Prosecution_Opposed_Regular_Bail\"><\/span>Prosecution Opposed Regular Bail<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The prosecution opposed the application for regular bail.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It submitted that the trial was expected to commence shortly and could be completed within a relatively short period.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The prosecution pointed out that there were 16 witnesses and that approximately 10 of them were likely to be examined.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The State therefore argued that the continued custody of the accused could be justified because the trial was approaching.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court, however, considered the overall circumstances, including the length of custody already undergone and the accused&#8217;s continuing medical difficulties.<\/p>\n\n\n\n<h2 id=\"h-bombay-high-court-takes-note-of-prolonged-custody\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Bombay_High_Court_Takes_Note_of_Prolonged_Custody\"><\/span>Bombay High Court Takes Note of Prolonged Custody<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the important factors considered by the Bombay High Court was the period for which the accused had remained in custody.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She had spent more than two years and nine months behind bars, while the trial had still not been completed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court also took note of her medical condition and described her as an \u201cinfirm woman.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The combination of her physical condition and the substantial period already spent in custody weighed in favour of granting regular bail.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court accordingly directed her release subject to the prescribed conditions.<\/p>\n\n\n\n<h2 id=\"h-bail-granted-with-conditions\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Bail_Granted_With_Conditions\"><\/span>Bail Granted With Conditions<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Bombay High Court directed that the accused be released on a personal recognisance bond of Rs. 25,000, together with one or two sureties for the same amount.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The bail order does not bring the criminal proceedings to an end.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The prosecution remains entitled to present its evidence concerning the circumstances surrounding the husband&#8217;s death, while the accused will have the opportunity to challenge that evidence and establish her defence before the trial court.<\/p>\n\n\n\n<h2 id=\"h-bail-is-not-acquittal\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Bail_Is_Not_Acquittal\"><\/span>Bail Is Not Acquittal<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">An important legal point arising from the order is the distinction between grant of bail and acquittal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A bail order does not determine the guilt or innocence of an accused person.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The allegations against the wife remain to be proved through evidence in the criminal trial.
