A financial security, known as <em>cautionnement<\/em>, may form part of judicial supervision. These measures are mainly governed by Articles 137 to 150 of the Code de proc\u00e9dure p\u00e9nale (CPP), together with decisions of the Cour de cassation and European human rights standards.<\/p>\n\n\n\n<h2 id=\"h-liberty-as-the-basic-rule\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Liberty_as_the_Basic_Rule\"><\/span>Liberty as the Basic Rule<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Article 137 of the CPP provides that a person under judicial investigation remains free. Pre-trial detention (<em>d\u00e9tention provisoire<\/em>) may be ordered only when less restrictive measures are not sufficient.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The law therefore creates a clear order of preference:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Liberty<\/li>\n\n\n\n<li>Judicial Supervision<\/li>\n\n\n\n<li>Electronic Monitoring<\/li>\n\n\n\n<li>Pre-Trial Detention<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This approach reflects the presumption of innocence under Article 9 of the 1789 Declaration of the Rights of Man and of the Citizen and the protection of liberty under Article 5 of the European Convention on Human Rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under Article 143-1 CPP, pre-trial detention is subject to specified statutory conditions, including the seriousness of the offense. Article 144 further requires detention to be necessary for one or more specific purposes, such as<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Preserving evidence;<\/li>\n\n\n\n<li>Preventing pressure on witnesses or victims;<\/li>\n\n\n\n<li>Preventing collusion;<\/li>\n\n\n\n<li>Ensuring the accused&#8217;s availability to the justice system;<\/li>\n\n\n\n<li>Preventing continuation or repetition of the offense; or<\/li>\n\n\n\n<li>Addressing an exceptional and continuing disturbance of public order.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The <em>juge des libert\u00e9s et de la d\u00e9tention<\/em> (JLD), or Judge of Liberties and Detention, must also consider whether judicial supervision or electronic monitoring would be sufficient.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Also Read: <a href=\"https:\/\/www.legalservicesindia.com\/manipur-relief-camps-supreme-court-25-unnatural-deaths\/\" target=\"_blank\" rel=\"noopener\">Manipur Relief Camps: Supreme Court Seeks Probe Into 25 Unnatural Deaths<\/a><\/p>\n\n\n\n<h2 id=\"h-controle-judiciaire-the-main-alternative-to-detention\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Controle_Judiciaire_The_Main_Alternative_to_Detention\"><\/span>Contr\u00f4le Judiciaire: The Main Alternative to Detention<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Contr\u00f4le judiciaire<\/em> allows a person to remain at liberty while being subject to conditions imposed by the court. Introduced by the Law of 17 July 1970, it is an important alternative to pre-trial detention.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article 138 of the CPP provides a range of possible conditions. These may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Restrictions on movement;<\/li>\n\n\n\n<li>Reporting regularly to the authorities;<\/li>\n\n\n\n<li>Prohibition on contacting particular persons;<\/li>\n\n\n\n<li>Prohibition on entering certain places;<\/li>\n\n\n\n<li>Surrender of identity or travel documents;<\/li>\n\n\n\n<li>Medical, social, or psychological treatment; and<\/li>\n\n\n\n<li>Payment of a <em>cautionnement<\/em>.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The conditions should be connected with the needs of the investigation or public safety and should be appropriate to the circumstances of the individual case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Failure to comply with the conditions may result in their modification or, in appropriate cases, revocation of judicial supervision and placement in pre-trial detention under Article 141-2 CPP.<\/p>\n\n\n\n<h2 id=\"h-cautionnement-the-financial-element-of-french-bail\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Cautionnement_The_Financial_Element_of_French_Bail\"><\/span>Cautionnement: The Financial Element of French Bail<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The closest French equivalent to financial bail is the <em>cautionnement<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article 138, 11\u00b0 CPP permits the court to require a person under judicial supervision to provide financial security. The amount and method of payment are determined by the court, taking into account the person&#8217;s financial resources and financial obligations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unlike systems based on fixed bail schedules, French law does not establish a standard amount for every offense. The amount must therefore be determined according to the circumstances of the individual case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">French jurisprudence has emphasized that the amount of the <em>cautionnement<\/em> must take account of the person&#8217;s financial means. The Cour de cassation, including in its decision of 5 September 1981 and subsequent cases, has recognized the importance of this requirement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A financial condition that is beyond the person&#8217;s realistic means may effectively prevent release. This is why the financial capacity of the accused is an important consideration.<\/p>\n\n\n\n<h2 id=\"h-two-purposes-of-cautionnement\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Two_Purposes_of_Cautionnement\"><\/span>Two Purposes of Cautionnement<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Article 142 of the CPP divides the <em>cautionnement<\/em> into two parts.<\/p>\n\n\n\n<h3 id=\"h-first-purpose-securing-compliance-and-appearance\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"First_Purpose_Securing_Compliance_and_Appearance\"><\/span>First Purpose: Securing Compliance and Appearance<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">First, one part is intended to ensure:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The person&#8217;s appearance before the judicial authorities;<\/li>\n\n\n\n<li>Compliance with the obligations of judicial supervision; and<\/li>\n\n\n\n<li>Execution of the eventual judgment.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-second-purpose-financial-consequences-of-the-proceedings\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Second_Purpose_Financial_Consequences_of_the_Proceedings\"><\/span>Second Purpose: Financial Consequences of the Proceedings<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Second, another part may be used for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Compensation for damage caused by the offense;<\/li>\n\n\n\n<li>Restitution; and<\/li>\n\n\n\n<li>Payment of fines, where applicable.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The rules governing the return or application of the security depend on the outcome of the proceedings and the person&#8217;s compliance with the conditions imposed by the court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The law also permits payment according to an authorized schedule, and a third person may, in appropriate circumstances, provide the security.<\/p>\n\n\n\n<h2 id=\"h-important-principles-in-french-jurisprudence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Important_Principles_in_French_Jurisprudence\"><\/span>Important Principles in French Jurisprudence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">French courts, particularly the Cour de cassation, have developed several important principles concerning pre-trial liberty and judicial supervision.<\/p>\n\n\n\n<h3 id=\"h-a-proportionality-and-reasons\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_Proportionality_and_Reasons\"><\/span>A. Proportionality and Reasons<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A decision imposing judicial supervision or a <em>cautionnement<\/em> should be properly reasoned. The amount of financial security should take account of the person&#8217;s financial resources and obligations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A disproportionately high amount may raise serious concerns because a financial condition should not become an indirect means of denying liberty to a person who cannot afford it.<\/p>\n\n\n\n<h3 id=\"h-b-preference-for-less-restrictive-measures\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"B_Preference_for_Less_Restrictive_Measures\"><\/span>B. Preference for Less Restrictive Measures<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Before ordering pre-trial detention, the court must consider whether judicial supervision or electronic monitoring would be sufficient.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Detention is therefore not simply another available option. It is intended to be used only where the less restrictive measures cannot adequately achieve the purposes recognized by law.<\/p>\n\n\n\n<h3 id=\"h-c-continuing-review-of-detention\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"C_Continuing_Review_of_Detention\"><\/span>C. Continuing Review of Detention<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Pre-trial detention is subject to statutory time limits and judicial review. Its justification must continue throughout the proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The fact that detention was justified at the beginning of an investigation does not automatically mean that it remains justified indefinitely. As the investigation progresses, the circumstances may change, and the need for detention must continue to be examined.<\/p>\n\n\n\n<h3 id=\"h-d-breach-of-judicial-supervision\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"D_Breach_of_Judicial_Supervision\"><\/span>D. Breach of Judicial Supervision<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A deliberate breach of the conditions of <em>contr\u00f4le judiciaire<\/em> can have serious consequences. Under Article 141-2 CPP, the judicial supervision may be revoked and detention may be ordered in accordance with the applicable legal requirements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The courts nevertheless remain required to apply the statutory safeguards governing deprivation of liberty.<\/p>\n\n\n\n<h3 id=\"h-e-procedural-safeguards\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"E_Procedural_Safeguards\"><\/span>E. Procedural Safeguards<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">French law also attaches importance to procedural regularity. Orders concerning pre-trial detention must comply with the statutory requirements, including the requirement that the decision be properly reasoned.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Defects affecting the validity of a detention order may provide grounds for challenging the detention.<\/p>\n\n\n\n<h3 id=\"h-f-role-of-the-judge-of-liberties-and-detention\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"F_Role_of_the_Judge_of_Liberties_and_Detention\"><\/span>F. Role of the Judge of Liberties and Detention<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The <em>juge des libert\u00e9s et de la d\u00e9tention<\/em> plays a central role in protecting pre-trial liberty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The JLD is responsible for deciding important questions concerning pre-trial detention and its continuation.
