The other says the child was taken because of illness or an urgent situation. One parent alleges that visitation was deliberately prevented. The other says the child was distressed, unwilling or uncomfortable. Allegations of threats, intimidation, interference by relatives and confrontations during handovers are also common.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In such cases, <strong>CCTV evidence in child custody cases<\/strong> can become extremely important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A CCTV camera at the entrance of a house, a society security camera, a doorbell camera, a mobile-phone recording, an audio conversation, an access-control record or even a properly preserved digital message may help the Family Court determine what actually happened.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But there is an important qualification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Having a recording is not the same thing as proving a case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court must be satisfied about the relevance, authenticity and evidentiary foundation of electronic material. And even where the recording is genuine and clearly establishes an incident, it does not automatically decide custody.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ultimate question in every custody dispute remains the welfare and best interests of the child.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction is particularly important in 2026, when electronic evidence has become increasingly common in family litigation and the Bharatiya Sakshya Adhiniyam, 2023 (BSA) has replaced the Indian Evidence Act for proceedings to which the new law applies.<\/p>\n\n\n\n<h2 id=\"h-what-is-the-law-governing-cctv-and-audio-recordings-in-family-court\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Is_the_Law_Governing_CCTV_and_Audio_Recordings_in_Family_Court\"><\/span>What Is the Law Governing CCTV and Audio Recordings in Family Court?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There are three important parts of the legal framework.<\/p>\n\n\n\n<h3 id=\"h-1-section-14-of-the-family-courts-act-1984\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"1_Section_14_of_the_Family_Courts_Act_1984\"><\/span>1. Section 14 of the Family Courts Act, 1984<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Family Courts are not confined by the same rigid approach to evidence that may apply in ordinary civil litigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 14 of the Family Courts Act gives the Family Court considerable latitude to receive a report, statement, document, information or other material which, in its opinion, may assist it in effectively dealing with the dispute, even if the material might otherwise face an objection under the traditional rules of relevance or admissibility.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This provision is particularly significant in matrimonial and custody litigation, where the Court is frequently required to understand the realities of a family relationship rather than decide a dispute solely through formal documents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That does not mean that every recording handed to the Court must be accepted at face value.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court can still examine whether the material is reliable, relevant and capable of assisting it in reaching a just conclusion.<\/p>\n\n\n\n<h3 id=\"h-2-the-bharatiya-sakshya-adhiniyam-2023\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2_The_Bharatiya_Sakshya_Adhiniyam_2023\"><\/span>2. The Bharatiya Sakshya Adhiniyam, 2023<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The evidentiary framework changed substantially from 1 July 2024, when the Bharatiya Sakshya Adhiniyam came into force.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For proceedings governed by the BSA:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Section 61 recognises electronic or digital records and gives them legal effect subject to the statutory requirements.<\/li>\n\n\n\n<li>Section 62 deals with proof of the contents of electronic records.<\/li>\n\n\n\n<li>Section 63 provides the specific framework for proving electronic records in the circumstances covered by that provision.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This is an important practical point for lawyers and litigants.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is no longer sufficient to mechanically write \u201cSection 65B certificate\u201d whenever a digital recording is produced. The applicable provision must be identified according to the law governing the proceeding.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The BSA also contains a specific transitional provision. Section 170 preserves the application of the repealed Indian Evidence Act to proceedings that were already pending immediately before the BSA came into force.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, in a 2026 custody case, the first question should be:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Which evidentiary regime governs this particular proceeding?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That question should be answered before deciding how an electronic record should be proved.<\/p>\n\n\n\n<h2 id=\"h-does-cctv-evidence-automatically-decide-a-child-custody-case\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Does_CCTV_Evidence_Automatically_Decide_a_Child_Custody_Case\"><\/span>Does CCTV Evidence Automatically Decide a Child Custody Case?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">No.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is probably the most important point for parents who are collecting recordings for litigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A CCTV camera may establish that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the father arrived at the residence at a particular time;<\/li>\n\n\n\n<li>the child was or was not handed over;<\/li>\n\n\n\n<li>a parent left the premises with the child;<\/li>\n\n\n\n<li>a confrontation took place;<\/li>\n\n\n\n<li>a relative intervened during a custody exchange;<\/li>\n\n\n\n<li>a parent attempted to exercise court-ordered visitation;<\/li>\n\n\n\n<li>a particular person entered or left a property.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">But none of those facts, by themselves, answers the ultimate custody question.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Family Court still has to ask:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What arrangement is in the best interests of this particular child?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For Hindu minors, Section 13 of the Hindu Minority and Guardianship Act, 1956 expressly makes the welfare of the minor the paramount consideration. The same child-centred principle is deeply embedded in custody jurisprudence under the Guardians and Wards Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, CCTV can establish an event.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court must decide what that event means for the welfare of the child.<\/p>\n\n\n\n<h2 id=\"h-when-can-cctv-evidence-be-important-in-a-child-custody-case\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"When_Can_CCTV_Evidence_Be_Important_in_a_Child_Custody_Case\"><\/span>When Can CCTV Evidence Be Important in a Child Custody Case?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The strongest use of CCTV is generally where there is a specific factual dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, suppose a father has been given visitation from 10 a.m. to 6 p.m. He arrives at the mother&#8217;s residence at 10 a.m. The mother later tells the Court that he never came.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A society CCTV recording showing his arrival may be highly relevant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Similarly, if one parent alleges that the other forcibly removed the child, footage from a building entrance or security camera may help the Court reconstruct the incident.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">CCTV may also become relevant where there are allegations concerning:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>obstruction of court-ordered visitation;<\/li>\n\n\n\n<li>refusal to hand over the child;<\/li>\n\n\n\n<li>confrontation during custody exchanges;<\/li>\n\n\n\n<li>threats or aggressive behaviour in the child&#8217;s presence;<\/li>\n\n\n\n<li>interference by grandparents or other relatives;<\/li>\n\n\n\n<li>unauthorised removal of the child;<\/li>\n\n\n\n<li>compliance or non-compliance with an interim custody order;<\/li>\n\n\n\n<li>the circumstances surrounding a particular handover.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The important principle is specificity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A 40-second recording may conclusively answer one disputed question.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It does not necessarily tell the Court who is the better parent.<\/p>\n\n\n\n<h2 id=\"h-a-2026-bombay-high-court-example-shamik-haresh-hirani\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_2026_Bombay_High_Court_Example_Shamik_Haresh_Hirani\"><\/span>A 2026 Bombay High Court Example: Shamik Haresh Hirani<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A recent Bombay High Court matter illustrates why courts must be careful when dealing with CCTV allegations in custody disputes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Shamik Haresh Hirani v. State of Maharashtra &amp; Ors.<\/em>, 2026:BHC-AS:19566-DB, the father approached the High Court in a habeas corpus proceeding concerning his minor child.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The father alleged that the child had been forcibly removed from his custody and relied upon CCTV footage in support of his version.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The mother disputed that account. She maintained that the child was unwell and that she had taken the child in those circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The High Court did not treat the existence of CCTV footage as automatically resolving the custody dispute. Given the disputed factual issues and the pending custody proceedings before the Family Court, the High Court left the relevant custody and access questions to be considered in the appropriate proceedings, while keeping the parties&#8217; contentions open.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lesson is important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">CCTV can establish what happened at a particular moment. It does not eliminate the Family Court&#8217;s responsibility to examine the child&#8217;s overall welfare.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is precisely why a parent should avoid presenting one piece of footage as though it were the entire custody case.<\/p>\n\n\n\n<h2 id=\"h-can-a-secretly-recorded-conversation-be-used-in-family-court\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_a_Secretly_Recorded_Conversation_Be_Used_in_Family_Court\"><\/span>Can a Secretly Recorded Conversation Be Used in Family Court?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This question has become especially important after the Supreme Court&#8217;s judgment in <em>Vibhor Garg v. Neha<\/em>, 2025 INSC 829.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In that case, the husband sought to rely upon telephone conversations with his wife which he had recorded without her knowledge. The recordings, memory cards, CDs and transcripts were produced before the Family Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Family Court permitted the recordings to be proved, subject to the necessary examination of their correctness and authenticity. The Punjab and Haryana High Court subsequently interfered, including on privacy-related considerations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court reversed that approach and restored the Family Court&#8217;s order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court reiterated the established requirements concerning:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>relevance;<\/li>\n\n\n\n<li>identification; and<\/li>\n\n\n\n<li>accuracy.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The important point is that the absence of the other person&#8217;s knowledge or consent does not, by itself, make the recording inadmissible.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But this should not be misunderstood.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Vibhor Garg<\/em> does not mean that every secret recording will succeed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A recording can still be challenged on several grounds, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>whether it is relevant to the dispute;<\/li>\n\n\n\n<li>whether the voices can be identified;<\/li>\n\n\n\n<li>whether the recording is complete;<\/li>\n\n\n\n<li>whether it has been edited;<\/li>\n\n\n\n<li>whether portions have been deleted;<\/li>\n\n\n\n<li>whether the recording has been taken out of context;<\/li>\n\n\n\n<li>whether the original source is available;<\/li>\n\n\n\n<li>whether the digital record has been properly proved;<\/li>\n\n\n\n<li>whether the recording actually establishes anything relevant to the child&#8217;s welfare.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Thus, the correct approach is not:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI secretly recorded my spouse, therefore I have won the case.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The correct approach is:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhat does this recording reliably establish, and how does that fact relate to the child&#8217;s welfare?\u201d<\/p>\n\n\n\n<h2 id=\"h-secret-recording-is-different-from-hacking-a-spouse-s-device\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Secret_Recording_Is_Different_from_Hacking_a_Spouses_Device\"><\/span>Secret Recording Is Different from Hacking a Spouse&#8217;s Device<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is an important distinction which litigants should not ignore.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Recording a conversation in which you are participating is one issue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Breaking into another person&#8217;s email account, stealing passwords, accessing a private cloud account, installing spyware or obtaining information through unauthorised access is an entirely different matter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The desire to collect evidence does not give a litigant a licence to commit a separate legal wrong.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Information Technology Act, 2000, contains provisions dealing with unauthorised access and related conduct. Evidence should therefore be collected lawfully and with considerable caution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A badly obtained \u201cpiece of evidence\u201d can create a second legal problem without necessarily solving the first.<\/p>\n\n\n\n<h2 id=\"h-how-should-cctv-evidence-be-preserved-for-a-child-custody-case\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_Should_CCTV_Evidence_Be_Preserved_for_a_Child_Custody_Case\"><\/span>How Should CCTV Evidence Be Preserved for a Child Custody Case?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is where many cases go wrong.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A parent may have genuinely useful footage but lose much of its evidentiary value because the original material was not properly preserved.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you believe CCTV evidence will become relevant to a custody dispute, consider preserving the following.<\/p>\n\n\n\n<h3 id=\"h-1-preserve-the-original-source\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"1_Preserve_the_Original_Source\"><\/span>1. Preserve the Original Source<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Keep the original DVR, NVR, mobile phone, memory card or other source wherever possible.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Do not rely solely upon a WhatsApp-forwarded copy.<\/p>\n\n\n\n<h3 id=\"h-2-preserve-the-complete-relevant-footage\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2_Preserve_the_Complete_Relevant_Footage\"><\/span>2. Preserve the Complete Relevant Footage<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Do not save only the ten seconds that support your case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the relevant event begins five minutes earlier and continues for another five minutes, preserve the surrounding material.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Context can sometimes change the meaning of a clip completely.<\/p>\n\n\n\n<h3 id=\"h-3-preserve-the-original-file-and-available-metadata\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3_Preserve_the_Original_File_and_Available_Metadata\"><\/span>3. Preserve the Original File and Available Metadata<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Maintain information concerning:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>date and time;<\/li>\n\n\n\n<li>device;<\/li>\n\n\n\n<li>camera number;<\/li>\n\n\n\n<li>file format;<\/li>\n\n\n\n<li>extraction method;<\/li>\n\n\n\n<li>available metadata.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-4-consider-hash-values-and-certification-requirements\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"4_Consider_Hash_Values_and_Certification_Requirements\"><\/span>4. Consider Hash Values and Certification Requirements<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The statutory framework governing electronic evidence under the BSA specifically addresses certification and electronic records, including prescribed requirements relating to the integrity of the electronic material.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The precise evidentiary route should be considered according to the manner in which the electronic record is produced before the Court.<\/p>\n\n\n\n<h3 id=\"h-5-maintain-a-chain-of-custody\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"5_Maintain_a_Chain_of_Custody\"><\/span>5. Maintain a Chain of Custody<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A litigation file should ideally record:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>who extracted the footage;<\/li>\n\n\n\n<li>from which device;<\/li>\n\n\n\n<li>when it was extracted;<\/li>\n\n\n\n<li>how it was copied;<\/li>\n\n\n\n<li>where it was stored;<\/li>\n\n\n\n<li>who subsequently handled it.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This becomes particularly important where authenticity is disputed.<\/p>\n\n\n\n<h3 id=\"h-6-preserve-the-original-audio\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"6_Preserve_the_Original_Audio\"><\/span>6. Preserve the Original Audio<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A transcript can help the Judge understand a long conversation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the transcript should not be treated as a substitute for the underlying recording.<\/p>\n\n\n\n<h3 id=\"h-7-be-prepared-for-forensic-examination\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"7_Be_Prepared_for_Forensic_Examination\"><\/span>7. Be Prepared for Forensic Examination<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If the opposing party alleges editing, manipulation, deleted frames, AI-generated alteration or voice manipulation, forensic examination may become relevant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The basic principle is simple:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Preserve first. Authenticate properly. Produce strategically.<\/strong><\/p>\n\n\n\n<h2 id=\"h-what-kind-of-cctv-or-electronic-evidence-is-weak\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Kind_of_CCTV_or_Electronic_Evidence_Is_Weak\"><\/span>What Kind of CCTV or Electronic Evidence Is Weak?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">More evidence does not necessarily mean a stronger case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Courts may closely scrutinise:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>edited video clips;<\/li>\n\n\n\n<li>recordings with unexplained gaps;<\/li>\n\n\n\n<li>screen recordings without the original source;<\/li>\n\n\n\n<li>CCTV files with no reliable information concerning their origin;<\/li>\n\n\n\n<li>unidentified voices;<\/li>\n\n\n\n<li>transcripts unsupported by the underlying audio;<\/li>\n\n\n\n<li>heavily compressed WhatsApp copies;<\/li>\n\n\n\n<li>recordings produced after unexplained delay;<\/li>\n\n\n\n<li>selective extracts where a longer recording exists;<\/li>\n\n\n\n<li>material whose authenticity is disputed.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A parent may have 500 recordings of arguments between husband and wife.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That does not necessarily make the custody case stronger.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A single complete recording showing that court-ordered visitation was deliberately obstructed may be far more relevant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court is deciding a child custody dispute, not conducting a referendum on the entire history of a failed marriage.<\/p>\n\n\n\n<h2 id=\"h-the-supreme-court-s-approach-the-child-remains-at-the-centre\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Supreme_Courts_Approach_The_Child_Remains_at_the_Centre\"><\/span>The Supreme Court&#8217;s Approach: The Child Remains at the Centre<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The importance of electronic evidence must always be understood against the larger principle of custody law: the welfare of the child is paramount.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s decision in <em>Arathy Ramachandran v. Bijay Raj Menon<\/em>, 2025 INSC 587 is instructive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case concerned an interim custody arrangement under which the children were to spend alternating periods with their parents. The Supreme Court interacted with the elder daughter in camera and considered her views and the circumstances surrounding the proposed arrangement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court ultimately modified the arrangement, preserving meaningful paternal access while rejecting the particular alternating arrangement that it found unsuitable in the circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The significance of the decision goes beyond the particular schedule.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It demonstrates that custody is not a contest in which the parent producing the most damaging evidence against the other automatically receives custody.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court has to consider the child&#8217;s emotional security, stability, relationships, circumstances and overall welfare.<\/p>\n\n\n\n<h2 id=\"h-2026-supreme-court-update-do-not-turn-the-child-into-evidence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2026_Supreme_Court_Update_Do_Not_Turn_the_Child_into_Evidence\"><\/span>2026 Supreme Court Update: Do Not Turn the Child into Evidence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s judgment in <em>Sheetal Vasant Thakur v. Chirag Arora<\/em>, 2026 INSC 638 provides another important development.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case involved a deeply contested custody and access dispute and issues concerning psychological assessment of the child. The Supreme Court&#8217;s judgment emphasises the need to keep custody proceedings centred on the child&#8217;s welfare and psychological well-being.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This has a direct practical implication for parents using mobile phones and cameras to collect evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A child should not be repeatedly questioned on camera simply because litigation is pending.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A parent should not coach a child into making a particular statement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nor should private recordings of a child be casually circulated through WhatsApp groups, relatives or social media.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is a very real danger that an attempt to \u201ccreate evidence\u201d may itself become harmful to the child.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The child is not a litigation instrument.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The purpose of evidence is to help the Court understand the child&#8217;s circumstances\u2014not to manufacture a witness.<\/p>\n\n\n\n<h2 id=\"h-can-cctv-evidence-help-a-father-obtain-custody\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_CCTV_Evidence_Help_a_Father_Obtain_Custody\"><\/span>Can CCTV Evidence Help a Father Obtain Custody?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Yes\u2014but not simply because the CCTV footage is damaging to the mother.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For a father seeking custody or meaningful visitation, CCTV becomes valuable when it objectively establishes conduct that is genuinely relevant to the child&#8217;s welfare or to compliance with an existing custody arrangement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, footage may be useful if it establishes repeated obstruction of court-ordered access.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It may also be relevant where the father is accused of conduct that did not occur and complete CCTV footage objectively contradicts the allegation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the Family Court will ordinarily look at the larger picture, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the child&#8217;s safety;<\/li>\n\n\n\n<li>emotional stability;<\/li>\n\n\n\n<li>continuity of care;<\/li>\n\n\n\n<li>education;<\/li>\n\n\n\n<li>health;<\/li>\n\n\n\n<li>daily routine;<\/li>\n\n\n\n<li>developmental needs;<\/li>\n\n\n\n<li>relationship with both parents;<\/li>\n\n\n\n<li>each parent&#8217;s ability to care for the child;<\/li>\n\n\n\n<li>each parent&#8217;s willingness to facilitate the child&#8217;s relationship with the other parent;<\/li>\n\n\n\n<li>the child&#8217;s own views where appropriate and depending upon maturity and circumstances.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>CCTV evidence in child custody cases is strongest when it proves a fact that matters to the child&#8217;s welfare.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is much weaker when it merely demonstrates that the marriage was unhappy.<\/p>\n\n\n\n<h2 id=\"h-for-fathers-build-a-custody-evidence-file-not-a-matrimonial-revenge-file\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" class=\"wp-block-paragraph\">A parent can spend months collecting evidence showing that the other spouse was a difficult husband or wife.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That may have significance in other matrimonial proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But custody litigation asks a different question:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What arrangement is best for the child?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If visitation is being obstructed, preserve:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the relevant court order;<\/li>\n\n\n\n<li>messages requesting compliance;<\/li>\n\n\n\n<li>the date and time of the proposed handover;<\/li>\n\n\n\n<li>travel records;<\/li>\n\n\n\n<li>complete CCTV footage;<\/li>\n\n\n\n<li>the other parent&#8217;s response;<\/li>\n\n\n\n<li>any relevant communication with the school or other institution.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If you are accused of aggressive behaviour during a visitation exchange, preserve the complete recording, rather than producing a carefully selected 15-second clip.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the child was not returned after an agreed handover, maintain a chronology supported by objective records.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And if an allegation against you is false, answer it with evidence rather than responding with another series of allegations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A good custody case is not necessarily the case with the largest volume of material.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is the case in which the evidence is credible, relevant, properly preserved and capable of surviving custody.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Family Court must make an independent assessment of the child&#8217;s welfare.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A recording may become highly persuasive where it proves serious conduct directly affecting the child.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But even then, the Court must consider the circumstances as a whole.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, a recording showing an argument between parents does not necessarily establish that either parent is unfit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Likewise, a recording showing one parent behaving badly on one occasion does not automatically establish that permanent custody should be transferred.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court has to consider the nature of the conduct, its effect on the child, whether it was isolated or repeated, the surrounding circumstances and the broader welfare class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">How does this evidence actually relate to the child&#8217;s safety, welfare, stability or best interests?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>That last question is often the most important.<\/strong><\/p>\n\n\n\n<h2 id=\"h-the-real-value-of-cctv-evidence-in-child-custody-cases\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Real_Value_of_CCTV_Evidence_in_Child_Custody_Cases\"><\/span>The Real Value of CCTV Evidence in Child Custody Cases<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The growing use of CCTV cameras, smartphones, doorbell cameras and digital communication has changed the nature of family litigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Previously, a custody dispute might depend heavily upon conflicting oral versions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Today, there may be a digital record of what happened.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That can be extremely useful.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But technology has not changed the basic philosophy of custody law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A camera can tell the Court what happened at a particular time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An audio recording may establish what was said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A message may establish what was communicated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A digital access record may establish who entered or left a particular place.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But none of these automatically answers the most important question:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What is best for the child?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That remains a judicial determination.<\/p>\n\n\n\n<h2 id=\"h-conclusion\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">CCTV evidence in child custody cases can be powerful, but it is not self-proving and it is certainly not self-executing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Family Courts have considerable flexibility under Section 14 of the Family Courts Act, 1984, while electronic records in proceedings governed by the current evidentiary regime are dealt with under Sections 61 to 63 of the Bharatiya Sakshya Adhiniyam, 2023. The BSA came into force on 1 July 2024 and contains a saving provision for proceedings covered by the transitional rule in Section 170.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s decision in <em>Vibhor Garg v. Neha<\/em>, 2025 INSC 829 is particularly relevant to secretly recorded conversations. It makes clear that lack of the other person&#8217;s knowledge or consent does not, by itself, make a recording inadmissible, while questions of relevance, identification, accuracy and authenticity remain important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The more recent custody decisions of the Supreme Court also reinforce the other side of the equation: the child must remain at the centre of the proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For a parent involved in a custody dispute, the sensible approach is therefore not to collect every possible recording.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is to preserve the right evidence, in its original and complete form, establish its authenticity, present it in its proper legal context and explain why it matters to the child&#8217;s welfare.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A recording may prove what happened.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Family Court must still decide what should happen next in the best interests of the child.<\/p>\n\n\n\n<h2 id=\"h-frequently-asked-questions\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Frequently_Asked_Questions\"><\/span>Frequently Asked Questions<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 id=\"h-can-cctv-footage-be-used-as-evidence-in-a-child-custody-case\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_CCTV_Footage_Be_Used_as_Evidence_in_a_Child_Custody_Case\"><\/span>Can CCTV Footage Be Used as Evidence in a Child Custody Case?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Yes. Relevant CCTV footage can be considered by a Family Court, subject to questions concerning authenticity, reliability, completeness and the applicable requirements for proving electronic evidence.<\/p>\n\n\n\n<h3 id=\"h-can-i-secretly-record-my-spouse-and-use-the-recording-in-family-court\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_I_Secretly_Record_My_Spouse_and_Use_the_Recording_in_Family_Court\"><\/span>Can I Secretly Record My Spouse and Use the Recording in Family Court?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Potentially, yes. In <em>Vibhor Garg v. Neha<\/em>, 2025 INSC 829, the Supreme Court held that the absence of the spouse&#8217;s knowledge or consent does not, by itself, make a recording inadmissible. Section 63 of the BSA provides the statutory framework for proving electronic records in the circumstances covered by it. The precise mode of proof should therefore be examined before the evidence is filed.<\/p>\n\n\n\n<h3 id=\"h-can-edited-cctv-footage-be-rejected-by-the-family-court\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_Edited_CCTV_Footage_Be_Rejected_by_the_Family_Court\"><\/span>Can Edited CCTV Footage Be Rejected by the Family Court?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Editing, missing portions, unexplained gaps or doubts regarding authenticity can seriously undermine the evidentiary value of a recording. Where manipulation is alleged, forensic examination may become relevant.<\/p>\n\n\n\n<h3 id=\"h-can-cctv-evidence-help-a-father-obtain-custody-0\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_CCTV_Evidence_Help_a_Father_Obtain_Custody-2\"><\/span>Can CCTV Evidence Help a Father Obtain Custody?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">It can help if it establishes conduct that is genuinely relevant to the child&#8217;s welfare or to compliance with custody and visitation orders. But CCTV alone does not determine custody. The child&#8217;s welfare remains the paramount consideration.<\/p>\n\n\n\n<h3 id=\"h-should-i-record-my-child-to-collect-evidence-against-my-spouse\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Should_I_Record_My_Child_to_Collect_Evidence_Against_My_Spouse\"><\/span>Should I Record My Child to Collect Evidence Against My Spouse?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Extreme caution is required. Repeatedly questioning, coaching or emotionally pressuring a child to create evidence can be harmful and may undermine the credibility of the litigation strategy.
