Tarun Choudhury<\/strong><br><strong>Supreme Court Advocate | 25+ Years of Legal Experience<\/strong><\/p>\n\n\n\n<h2 id=\"h-introduction-why-should-india-care-about-a-1958-german-judgment\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Introduction_Why_Should_India_Care_About_a_1958_German_Judgment\"><\/span>Introduction: Why Should India Care About a 1958 German Judgment?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There are judgments that solve a dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are judgments that develop a doctrine.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And then there are judgments that quietly change the way we understand the Constitution itself.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The L\u00fcth judgment of the German Federal Constitutional Court, delivered on 15 January 1958, belongs to the third category.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At first sight, it was a dispute about a boycott of a film.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But beneath that controversy lay a question of extraordinary constitutional importance:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Are fundamental rights merely shields against the state, or do they also represent constitutional values that should influence the entire legal system, including disputes between private parties?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The German Constitutional Court answered that fundamental rights were primarily defensive rights against the State but were also an objective order of constitutional values that permeated the legal system. Private-law provisions therefore had to be interpreted in light of those constitutional values.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This became one of the foundational formulations of the indirect horizontal effect of fundamental rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The proposition sounds technical.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Its modern implications are anything but technical.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Because India in 2026 is entering a world in which some of the most consequential decisions affecting individuals are increasingly made not by governments but by:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Technology companies;<\/li>\n\n\n\n<li>Social media platforms;<\/li>\n\n\n\n<li>Employers;<\/li>\n\n\n\n<li>Private universities;<\/li>\n\n\n\n<li>Private hospitals;<\/li>\n\n\n\n<li>Financial institutions;<\/li>\n\n\n\n<li>Digital marketplaces;<\/li>\n\n\n\n<li>Data-processing companies;<\/li>\n\n\n\n<li>Artificial-intelligence systems.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The constitutional question is therefore changing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The twentieth-century question was often:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What can the state do to the citizen?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The twenty-first-century question is increasingly:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What happens when a private institution acquires enough power to profoundly affect the citizen&#8217;s freedom, dignity, privacy, livelihood, or participation in society?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is where L\u00fcth becomes unexpectedly contemporary.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Also Read: <a href=\"https:\/\/www.legalservicesindia.com\/manipur-relief-camps-supreme-court-25-unnatural-deaths\/\" target=\"_blank\" rel=\"noopener\">Manipur Relief Camps: Supreme Court Seeks Probe Into 25 Unnatural Deaths<\/a><\/p>\n\n\n\n<h2 id=\"h-1-the-real-significance-of-luth\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"1_The_Real_Significance_of_Luth\"><\/span>1. The Real Significance of L\u00fcth<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The easiest way to misunderstand L\u00fcth is to describe it as saying:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u201cFundamental rights apply to private parties.\u201d<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is too broad.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The German doctrine is more subtle.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Fundamental rights remain primarily rights against the State.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the Constitution establishes values that permeate the entire legal order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, when a court applies ordinary private law, it cannot interpret that law as though the Constitution does not exist.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In L\u00fcth, the civil courts had relied upon a general clause of German private law concerning conduct contrary to good morals. The Constitutional Court held that freedom of expression had to influence the interpretation of that provision. The L\u00fcth Principle Was a Middle Path<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There are two obvious extremes.<\/p>\n\n\n\n<h3 id=\"h-extreme-one-the-constitution-stops-at-the-state\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Extreme_One_The_Constitution_Stops_at_the_State\"><\/span>Extreme One: The Constitution Stops at the State<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">On this view:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Government action is constitutional law.<\/li>\n\n\n\n<li>Private conduct is private law.<\/li>\n\n\n\n<li>A citizen facing the state can invoke fundamental rights.<\/li>\n\n\n\n<li>A citizen facing a private company must rely upon contract, tort, consumer law, employment law, or statute.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This approach protects the conceptual distinction between public and private law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But it becomes increasingly difficult when private institutions exercise enormous power.<\/p>\n\n\n\n<h3 id=\"h-extreme-two-every-private-actor-is-directly-bound-by-fundamental-rights\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Extreme_Two_Every_Private_Actor_Is_Directly_Bound_by_Fundamental_Rights\"><\/span>Extreme Two: Every Private Actor Is Directly Bound by Fundamental Rights<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This goes too far in the opposite direction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If every private company, employer, university, newspaper, association, or individual were treated exactly like the state, constitutional law could overwhelm:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Freedom of contract;<\/li>\n\n\n\n<li>Property;<\/li>\n\n\n\n<li>Association;<\/li>\n\n\n\n<li>Institutional autonomy;<\/li>\n\n\n\n<li>Editorial freedom;<\/li>\n\n\n\n<li>Commercial freedom;<\/li>\n\n\n\n<li>Private choice.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">L\u00fcth offers something between the two.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It says, in substance:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">The private sphere remains private, but private law does not operate outside the constitutional order.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That middle path is precisely what makes L\u00fcth interesting for India.<\/p>\n\n\n\n<h2 id=\"h-3-india-must-not-simply-import-german-constitutional-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3_India_Must_Not_Simply_Import_German_Constitutional_Law\"><\/span>3. India Must Not Simply Import German Constitutional Law<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This point is essential.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Germany and India do not have identical constitutional structures.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The German Basic Law, the powers of the Federal Constitutional Court, the German constitutional complaint mechanism, and the structure of German private law are different from India&#8217;s constitutional framework.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India has its own architecture:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Article 12 and the definition of &#8220;State&#8221;;<\/li>\n\n\n\n<li>Article 13;<\/li>\n\n\n\n<li>Article 14;<\/li>\n\n\n\n<li>Article 15;<\/li>\n\n\n\n<li>Article 17;<\/li>\n\n\n\n<li>Article 19;<\/li>\n\n\n\n<li>Article 21;<\/li>\n\n\n\n<li>Article 23;<\/li>\n\n\n\n<li>Article 24;<\/li>\n\n\n\n<li>Article 32;<\/li>\n\n\n\n<li>Article 226.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">India also possesses an important constitutional feature that cannot be ignored: certain fundamental protections already operate, expressly or by constitutional design, against private conduct.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article 15(2), for example, addresses certain forms of discrimination by private persons.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article 17 abolishes untouchability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article 23 prohibits trafficking and forced labor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article 24 protects children from specified forms of hazardous employment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, India has never maintained an absolutely sealed constitutional boundary between state and private conduct.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But India has also not adopted a general rule that Articles 19 and 21 automatically operate horizontally against every private actor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Indeed, in Kaushal Kishor, the Supreme Court discussed this distinction expressly, noting the difference between fundamental rights enforceable against the State and corresponding common-law rights capable of horizontal enforcement against private actors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That makes the Indian position particularly interesting.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India does not need to choose between:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>\u201cOnly the State matters.&#8221;<\/strong><\/li>\n\n\n\n<li><strong>\u201cEveryone is the State.\u201d<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">There is another possibility.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Also Read: <a href=\"https:\/\/www.legalservicesindia.com\/government-legal-risk-rule-of-law-judicial-review\/\" target=\"_blank\" rel=\"noopener\">UK Government Legal Risk, Rule of Law, and Citizens\u2019 Rights: When Does Legal Uncertainty Become Constitutional Danger<\/a>?<\/p>\n\n\n\n<h2 id=\"h-4-the-constitution-must-follow-power\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"4_The_Constitution_Must_Follow_Power\"><\/span>4. The Constitution Must Follow Power<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This may be the most important lesson India can extract from L\u00fcth.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Constitutional law has traditionally focused on state power.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That focus was entirely understandable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The State controls:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Police;<\/li>\n\n\n\n<li>Prisons;<\/li>\n\n\n\n<li>Taxation;<\/li>\n\n\n\n<li>Legislation;<\/li>\n\n\n\n<li>Public administration;<\/li>\n\n\n\n<li>Coercive machinery.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">But technological development has redistributed power.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A private company may now control something almost equally significant:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Access.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A private platform may determine whether a person:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Reaches an audience;<\/li>\n\n\n\n<li>Earns money;<\/li>\n\n\n\n<li>Advertises a business;<\/li>\n\n\n\n<li>Accesses a digital marketplace;<\/li>\n\n\n\n<li>Maintains an online identity;<\/li>\n\n\n\n<li>Communicates with customers;<\/li>\n\n\n\n<li>Receives financial services;<\/li>\n\n\n\n<li>Has data processed;<\/li>\n\n\n\n<li>Remains visible within a digital ecosystem.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The institution may be private.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The consequences may nevertheless be enormous.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This creates a new constitutional problem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Should constitutional law care only about who formally owns the institution, or should it also consider the nature and magnitude of the power being exercised?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L\u00fcth does not answer that question for India.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But it gives us a powerful way to frame it.<\/p>\n\n\n\n<h2 id=\"h-5-social-media-the-modern-luth-laboratory\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"5_Social_Media_The_Modern_Luth_Laboratory\"><\/span>5. India Already Has the Foundations of This Idea<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">India does not need to start from zero.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Indian constitutional jurisprudence has developed an extraordinary body of law around:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Dignity;<\/li>\n\n\n\n<li>Liberty;<\/li>\n\n\n\n<li>Privacy;<\/li>\n\n\n\n<li>Autonomy;<\/li>\n\n\n\n<li>Equality;<\/li>\n\n\n\n<li>Livelihood;<\/li>\n\n\n\n<li>Reputation;<\/li>\n\n\n\n<li>Personal choice.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Article 21, in particular, has moved far beyond its earliest interpretation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s privacy jurisprudence recognized privacy as a constitutionally protected interest while also recognizing that privacy is not absolute and that constitutional restrictions must satisfy legal and proportionality requirements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Why?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Because many threats to privacy today do not originate directly from the state.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They originate from:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Data companies;<\/li>\n\n\n\n<li>Platforms;<\/li>\n\n\n\n<li>Employers;<\/li>\n\n\n\n<li>Financial institutions;<\/li>\n\n\n\n<li>Apps;<\/li>\n\n\n\n<li>Online services;<\/li>\n\n\n\n<li>Private healthcare providers;<\/li>\n\n\n\n<li>Technology systems.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">India therefore faces a peculiar constitutional situation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The value may be constitutional.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The wrongdoer may be private.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The remedy may be statutory or common law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is not a contradiction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It may be the beginning of an Indian version of constitutional influence on private law.<\/p>\n\n\n\n<h2 id=\"h-8-privacy-is-perhaps-the-clearest-modern-example\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"8_Privacy_Is_Perhaps_the_Clearest_Modern_Example\"><\/span>8. Privacy Is Perhaps the Clearest Modern Example<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Imagine an ordinary Indian citizen using a smartphone.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Behind that simple activity may lie the collection and processing of information concerning:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Location;<\/li>\n\n\n\n<li>Financial transactions;<\/li>\n\n\n\n<li>Browsing behavior;<\/li>\n\n\n\n<li>Preferences;<\/li>\n\n\n\n<li>Purchasing patterns;<\/li>\n\n\n\n<li>Identity;<\/li>\n\n\n\n<li>Communications;<\/li>\n\n\n\n<li>Online activity.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The company processing the information may be private.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Yet privacy is constitutionally significant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India&#8217;s response has increasingly been legislative.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Digital Personal Data Protection Act, 2023, created a statutory framework for processing digital personal data, and the Government notified the Digital Personal Data Protection Rules, 2025, on 14 November 2025. Private Universities: Where Autonomy Meets Equality<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Education provides another difficult example.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A private university may control:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Admission;<\/li>\n\n\n\n<li>Examinations;<\/li>\n\n\n\n<li>Discipline;<\/li>\n\n\n\n<li>Expulsion;<\/li>\n\n\n\n<li>Scholarships;<\/li>\n\n\n\n<li>Academic records;<\/li>\n\n\n\n<li>Access to facilities;<\/li>\n\n\n\n<li>Online learning;<\/li>\n\n\n\n<li>Institutional expression.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, educational institutions possess legitimate autonomy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This creates a constitutional balancing problem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It would be simplistic to say:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cEducation is important; therefore, every private educational institution is state.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">But it would be equally simplistic to say:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe institution is private; therefore, constitutional values have no relevance.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The better question is<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What legal duties does the institution have, and how should those duties be interpreted in light of equality, dignity, educational rights, and institutional autonomy?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is a far more sophisticated constitutional inquiry.<\/p>\n\n\n\n<h2 id=\"h-11-employment-could-become-the-next-major-frontier\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"11_Employment_Could_Become_the_Next_Major_Frontier\"><\/span>11. Employment Could Become the Next Major Frontier<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The workplace of the future may be governed partly by algorithms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Imagine an employer using an AI system to determine:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Recruitment;<\/li>\n\n\n\n<li>Promotion;<\/li>\n\n\n\n<li>Productivity;<\/li>\n\n\n\n<li>Performance;<\/li>\n\n\n\n<li>Termination;<\/li>\n\n\n\n<li>Employee monitoring.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">An applicant receives an automated rejection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No government officer participated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Yet the consequences may affect the individual&#8217;s livelihood.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now suppose the algorithm systematically produces discriminatory results.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The traditional question\u2014<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cHas the State violated Article 14?\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">\u2014may not fit the situation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But neither should the legal system become indifferent simply because the employer is private.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The relevant question may instead be:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What do equality, dignity, privacy, and fairness require from the private-law rules governing employment?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is where L\u00fcth&#8217;s methodology could become particularly valuable.<\/p>\n\n\n\n<h2 id=\"h-12-ai-may-make-the-luth-question-unavoidable\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"12_AI_May_Make_the_Luth_Question_Unavoidable\"><\/span>12. The New Constitutional Problem: Power Without Sovereignty<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This may be the most important conceptual shift.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Traditional constitutional law deals with sovereign power.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The State has authority because the Constitution creates and limits it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But modern society also contains power without sovereignty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A technology company may not possess sovereign authority.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Yet it may control:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Information;<\/li>\n\n\n\n<li>Data;<\/li>\n\n\n\n<li>Communication;<\/li>\n\n\n\n<li>Economic access;<\/li>\n\n\n\n<li>Digital identity;<\/li>\n\n\n\n<li>Visibility;<\/li>\n\n\n\n<li>Algorithmic decision-making.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">It does not legislate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But it may establish rules for millions of users.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It does not imprison.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But it may exclude someone from an economically essential digital ecosystem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It does not conduct elections.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But it may influence the information environment in which democratic debate occurs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is why the concept of private power deserves much greater attention in Indian constitutional scholarship.<\/p>\n\n\n\n<h2 id=\"h-14-the-democratic-dimension\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"14_The_Democratic_Dimension\"><\/span>14. The Deeper Indian Constitutional Opportunity<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">India has an opportunity to develop something more sophisticated than simply copying Germany.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Indian constitutional experience is different.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India has:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>an extraordinarily expansive Article 21;<\/li>\n\n\n\n<li>a strong equality jurisprudence;<\/li>\n\n\n\n<li>express horizontal provisions;<\/li>\n\n\n\n<li>public-law review of bodies performing public functions;<\/li>\n\n\n\n<li>constitutional remedies under Articles 32 and 226;<\/li>\n\n\n\n<li>an expanding privacy jurisprudence;<\/li>\n\n\n\n<li>statutory regulation of private actors;<\/li>\n\n\n\n<li>an enormous digital population;<\/li>\n\n\n\n<li>rapidly expanding AI deployment.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">India therefore has the ingredients for a distinctly Indian doctrine.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Not:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cEverything is constitutional.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">And not:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cPrivate conduct is none of constitutional law&#8217;s business.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">But:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cPrivate law must remain conscious of constitutional values when private power substantially affects constitutional interests.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is the proposition worth debating.<\/p>\n\n\n\n<h2 id=\"h-35-the-final-lesson-from-luth\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"35_The_Final_Lesson_From_Luth\"><\/span>35. bank + platform + university + hospital + data processor + algorithm.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Some are public.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some are private.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some are hybrids.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some exercise power without possessing sovereignty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Constitution cannot treat all of them identically.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But neither can it afford to become blind to the consequences of private
