He also reportedly referred to persons from Diamond Harbour allegedly transferring money.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The political context is significant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Abhishek Banerjee is the Lok Sabha MP from Diamond Harbour, and contemporary reporting notes that \u201cBhaipo\u201d\u2014meaning nephew\u2014is commonly used in West Bengal political discourse as a reference to him. The Law Recognizes Indirect Identification<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Section 356 of the Bharatiya Nyaya Sanhita, 2023, deals with defamation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It covers an imputation concerning a person made with the requisite intention, knowledge, or reason to believe that it would harm that person&#8217;s reputation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Significantly, Explanation 4 recognizes reputational harm resulting from an imputation made directly or indirectly. The statutory illustrations themselves contemplate situations in which a person may be identified without the speaker simply naming that person.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This produces a useful legal proposition:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A lawyer should not ask only, \u201cWas my client named?\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The better question is<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cWould a reasonable person, knowing the surrounding circumstances, understand the statement as referring to my client?\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction can completely change the drafting strategy.<\/p>\n\n\n\n<h2 id=\"h-4-the-diamond-harbour-connection-makes-the-context-legally-interesting\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"4_The_Diamond_Harbour_Connection_Makes_the_Context_Legally_Interesting\"><\/span>4. The Diamond Harbour Connection Makes the Context Legally Interesting<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose a political speaker says:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cA particular gang financed a murder.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That statement by itself may leave the identity of the alleged gang uncertain.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But now suppose the same speaker adds that people from Diamond Harbour allegedly delivered the money.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And suppose the principal political figure whom the term \u201cBhaipo\u201d commonly denotes is also the sitting MP representing Diamond Harbour.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now the lawyer has something more substantial to analyze.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This does not automatically prove identification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But it provides contextual material from which identification might potentially be argued.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is precisely why the legal notice should not make an absolute statement such as<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cYou named Abhishek Banerjee.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That would be inaccurate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The more careful formulation is<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cYour statement, read in its full context, has been widely understood as referring to my client.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is a lawyer&#8217;s formulation\u2014not a political slogan.<\/p>\n\n\n\n<h2 id=\"h-5-the-second-question-what-exactly-is-the-allegation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"5_The_Second_Question_What_Exactly_Is_the_Allegation\"><\/span>5. What About Truth and Public Good?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A good lawyer must anticipate the defense before sending the notice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 356 contains statutory exceptions, including an exception concerning a true imputation where publication is for the public good. It also contains exceptions relating to good-faith opinions concerning public servants and public questions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, the notice should not pretend that every harsh political statement automatically constitutes defamation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That would weaken the lawyer&#8217;s credibility.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, I would expressly acknowledge:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cMy client does not object to good-faith political criticism or legitimate public scrutiny.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Then draw the line:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe objection concerns the attribution of specific criminal conduct.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">This is the kind of distinction that makes a legal notice look like the work of a lawyer rather than a press release.<\/p>\n\n\n\n<h2 id=\"h-12-political-speech-is-not-the-enemy\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"12_Political_Speech_Is_Not_the_Enemy\"><\/span>12.
