It is a constitutional guarantee protected principally by Articles 21 and 22 of the Constitution of India. A person may initially be arrested under lawful authority, but the detention can later become unlawful if mandatory safeguards are ignored, judicial orders are disobeyed, or custody continues without a valid legal basis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Indian law provides several remedies in such circumstances. Depending on the facts, an affected person may seek <strong>habeas corpus, release from unlawful custody, constitutional compensation, damages for false imprisonment, or appropriate criminal and departmental action.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But there is an important distinction that is sometimes missed: an acquittal, discharge or closure of a criminal case does not by itself prove that the original arrest was illegal. Siby Mathews, (2018) 10 SCC 804<\/strong>, the Supreme Court awarded \u20b950 lakh in the context of the violation suffered by the former ISRO scientist.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These decisions form part of the constitutional jurisprudence that the Supreme Court considered while dealing with the question of compensation in Daudayal.<\/p>\n\n\n\n<h2 id=\"h-compensation-and-the-correct-legal-forum-union-of-india-v-man-singh-verma\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Compensation_and_the_Correct_Legal_Forum_Union_of_India_v_Man_Singh_Verma\"><\/span>Compensation and the Correct Legal Forum: Union of India v. Man Singh Verma<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is another important lesson that should not be overlooked.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Union of India v. Man Singh Verma<\/em>, 2025 INSC 292, the Supreme Court considered a direction issued by the Allahabad High Court awarding \u20b95 lakh compensation for alleged wrongful confinement while dealing with a bail application.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court held that the High Court had exceeded the proper limits of its bail jurisdiction by granting such compensation in that proceeding.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This does not mean that compensation for unlawful detention is unavailable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rather, it demonstrates that the legal basis and forum through which compensation is claimed matter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A person may have a genuine grievance arising from unlawful detention, but the relief must be sought through a proceeding in which the court has the appropriate jurisdiction to adjudicate that claim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is an important practical lesson: a legally valid grievance can still encounter procedural difficulty if the wrong remedy or forum is chosen.<\/p>\n\n\n\n<h2 id=\"h-habeas-corpus-the-immediate-constitutional-remedy\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Habeas_Corpus_The_Immediate_Constitutional_Remedy\"><\/span>Habeas Corpus: The Immediate Constitutional Remedy<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">When a person is still unlawfully detained, the primary concern is not compensation. It is liberty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A petition for habeas corpus can therefore become the most immediate constitutional remedy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under Article 226, the High Court can examine whether the person&#8217;s detention has a lawful basis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The basic purpose of habeas corpus is straightforward:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The authority detaining the person must justify the detention.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If the detention cannot be legally justified, the court may order appropriate relief, including release.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s decision in <em>Daudayal<\/em> also reaffirmed the importance of habeas corpus as a safeguard against wrongful deprivation of personal liberty.<\/p>\n\n\n\n<h2 id=\"h-what-if-the-person-has-already-been-released\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_If_the_Person_Has_Already_Been_Released\"><\/span>What If the Person Has Already Been Released?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Once the detention has ended, habeas corpus may no longer serve the same immediate purpose because there is no longer a person physically in custody whom the court can order to be released.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But that does not necessarily end the legal consequences.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on the circumstances, an affected person may consider:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>constitutional compensation through writ jurisdiction;<\/li>\n\n\n\n<li>a civil claim for damages for false imprisonment;<\/li>\n\n\n\n<li>criminal proceedings where the statutory ingredients of an offence are established;<\/li>\n\n\n\n<li>departmental proceedings against responsible officials; or<\/li>\n\n\n\n<li>other remedies available under the applicable law.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Each remedy has different requirements.<\/p>\n\n\n\n<h2 id=\"h-false-imprisonment-a-separate-civil-remedy\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"False_Imprisonment_A_Separate_Civil_Remedy\"><\/span>False Imprisonment: A Separate Civil Remedy<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A claim for false imprisonment is conceptually different from constitutional compensation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where maintainable, a civil action may seek damages for unlawful confinement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The limitation rules are particularly important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under Article 73 of the Limitation Act, 1963, a suit for compensation for false imprisonment is generally subject to a one-year limitation period from the date the imprisonment ends.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This makes timing critical.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A person who believes that he has suffered unlawful confinement should therefore obtain legal advice promptly rather than waiting until the limitation period is about to expire.<\/p>\n\n\n\n<h2 id=\"h-what-about-a-suit-against-the-government-or-a-public-officer\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_About_a_Suit_Against_the_Government_or_a_Public_Officer\"><\/span>What About a Suit Against the Government or a Public Officer?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Where a civil suit is proposed against the government or a public officer concerning an act purportedly done in an official capacity, Section 80 of the Code of Civil Procedure, 1908, may require prior notice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 80(2), however, provides a mechanism for instituting a suit with the court&#8217;s leave in cases requiring urgent or immediate relief.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The procedural requirements should therefore be examined before filing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In liberty cases, procedure is not merely a technical afterthought.
