A complaint can run into several pages and may contain allegations covering years of a matrimonial relationship. But the real difficulty for a husband is not the length of the complaint. It is responding to it without making avoidable admissions, unnecessary allegations or sweeping denials.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A reply stating that every allegation is simply \u201cfalse and denied\u201d is rarely a satisfactory defence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, a husband&#8217;s response should not become an emotional account of everything that went wrong during the marriage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The better approach is much more disciplined:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Every material allegation should be answered with a fact, a date, a clear position and, wherever available, supporting evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is particularly important because proceedings under the Protection of Women from Domestic Violence Act, 2005, may involve protection orders, residence orders, monetary relief, custody, compensation and interim or ex parte orders. The Act gives the magistrate procedural flexibility, making the quality of the respondent&#8217;s factual record particularly important at the early stage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The question, therefore, is:<\/p>\n\n\n\n<h2 id=\"h-how-should-a-husband-draft-a-para-wise-reply-to-a-domestic-violence-complaint-0\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_Should_a_Husband_Draft_a_Para-Wise_Reply_to_a_Domestic_Violence_Complaint-2\"><\/span>How Should a Husband Draft a Para-Wise Reply to a Domestic Violence Complaint?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The answer is not found in a single prescribed format. It lies in preparing a factual, allegation-by-allegation defence that allows the Magistrate to understand exactly what is admitted, what is disputed and what documentary material supports the respondent&#8217;s case.<\/p>\n\n\n\n<h2 id=\"h-is-there-a-prescribed-format-for-a-husband-s-reply-to-a-dv-complaint\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Is_There_a_Prescribed_Format_for_a_Husbands_Reply_to_a_DV_Complaint\"><\/span>Is There a Prescribed Format for a Husband&#8217;s Reply to a DV Complaint?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is no statutory Form II prescribed specifically for the husband&#8217;s written reply to a Section 12 application.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rule 6 of the Protection of Women from Domestic Violence Rules, 2006, prescribes Form II for an application under Section 12 by the aggrieved person. The respondent does not have an equivalent mandatory statutory reply form.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 28(2) of the DV Act is also important because it permits the court to lay down its own procedure for disposal of an application under Section 12 or an application under Section 23(2).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, the absence of a prescribed reply form does not mean that the husband can file an informal or casual response.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court in Kamatchi v. Lakshmi Narayanan, Criminal Appeal No. 627 of 2022, explained the nature of notice under Section 12 and recognised that the respondent is called upon to respond to the application.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In practical terms, the reply becomes the husband&#8217;s opportunity to place his factual defence on the record.<\/p>\n\n\n\n<h2 id=\"h-1-begin-with-preliminary-submissions-but-keep-them-relevant\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"1_Begin_With_Preliminary_Submissions_%E2%80%94_But_Keep_Them_Relevant\"><\/span>1. Begin With Preliminary Submissions \u2014 But Keep Them Relevant<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The preliminary portion should not become a history of the entire marriage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Include only facts that have a legal or procedural significance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending upon the case, this may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>date of marriage;<\/li>\n\n\n\n<li>date of separation;<\/li>\n\n\n\n<li>present living arrangements;<\/li>\n\n\n\n<li>pending matrimonial or criminal proceedings;<\/li>\n\n\n\n<li>previous settlements or mediation proceedings;<\/li>\n\n\n\n<li>earlier complaints;<\/li>\n\n\n\n<li>previous maintenance orders;<\/li>\n\n\n\n<li>previous judicial findings;<\/li>\n\n\n\n<li>jurisdictional facts;<\/li>\n\n\n\n<li>material suppression of relevant proceedings or orders.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The question of territorial jurisdiction should also be approached carefully.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 27 of the DV Act provides for jurisdiction in circumstances including the place where the aggrieved person permanently or temporarily resides or carries on business or is employed, the place where the respondent resides or carries on business or is employed, or where the cause of action has arisen.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, a husband should not mechanically challenge jurisdiction merely because the wife is presently residing in another city.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A jurisdiction objection must be based on the actual statutory requirements and facts of the case.<\/p>\n\n\n\n<h2 id=\"h-2-answer-the-complaint-paragraph-by-paragraph\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2_Answer_the_Complaint_Paragraph_by_Paragraph\"><\/span>2. Answer the Complaint Paragraph by Paragraph<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is the heart of a paragraph-wise reply to a domestic violence complaint.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If paragraph 12 contains three allegations, all three should be addressed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe marriage between the parties on 15 January 2019 is admitted. However, the allegation that the respondent assaulted the applicant on 14 March 2025 is specifically denied. On that date, the respondent was travelling from Bengaluru to Hyderabad in connection with his employment. The relevant travel records are annexed as Annexure R-4.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is a meaningful defence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Compare it with:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cContents of paragraph 12 are wrong and denied.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The second response does not tell the court what is actually disputed or why.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A good reply should, wherever appropriate, distinguish between:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Position<\/th><th>Purpose in the Reply<\/th><\/tr><\/thead><tbody><tr><td>Admitted<\/td><td>Facts that are accepted.<\/td><\/tr><tr><td>Denied<\/td><td>Facts or allegations that are disputed.<\/td><\/tr><tr><td>Partly admitted<\/td><td>Facts that are accepted only to the extent stated.<\/td><\/tr><tr><td>Incorrectly stated<\/td><td>Facts that have been inaccurately presented.<\/td><\/tr><tr><td>Matter of record<\/td><td>Facts established by existing records or proceedings.<\/td><\/tr><tr><td>Not within knowledge<\/td><td>Facts that the respondent cannot properly admit or deny.<\/td><\/tr><tr><td>Explained with supporting evidence<\/td><td>Allegations requiring a factual explanation supported by documents or other evidence.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">This makes the pleadings easier for the court to understand and reduces ambiguity.<\/p>\n\n\n\n<h2 id=\"h-3-do-not-treat-the-husband-s-reply-as-a-matrimonial-autobiography\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3_Do_Not_Treat_the_Husbands_Reply_as_a_Matrimonial_Autobiography\"><\/span>3. Do Not Treat the Husband&#8217;s Reply as a Matrimonial Autobiography<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the most common mistakes is to respond to a DV complaint by narrating the entire history of the marriage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is usually counterproductive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the complaint alleges that the husband demanded money on a particular date, answer that allegation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the complaint alleges that the husband assaulted the wife at a particular place, answer that incident.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the complaint alleges that she was denied access to a particular residence, address the residential facts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Do not spend several pages describing every disagreement that occurred during ten years of marriage unless those facts have a direct bearing on the allegations or relief claimed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court needs a legal defence, not an emotional counter-narrative.<\/p>\n\n\n\n<h2 id=\"h-4-deal-separately-with-allegations-against-different-family-members\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"4_Deal_Separately_With_Allegations_Against_Different_Family_Members\"><\/span>4. Deal Separately With Allegations Against Different Family Members<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A particularly important issue arises when a complaint names the husband, parents, siblings and other relatives together.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A husband should not automatically adopt a collective defence on behalf of every respondent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Each person should be dealt with separately.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court in Shyamlal Devda v. Parimala examined proceedings under the DV Act and emphasised the significance of specific allegations concerning the individual respondents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, if the complaint merely states that:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe husband and his entire family harassed the complainant.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The reply should identify the deficiency.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What conduct is attributed to the husband&#8217;s mother?<\/li>\n\n\n\n<li>What particular incident is alleged against the father?<\/li>\n\n\n\n<li>When did the alleged incident occur?<\/li>\n\n\n\n<li>Where did it occur?<\/li>\n\n\n\n<li>What role is attributed to the sister or brother?<\/li>\n\n\n\n<li>Was that relative even residing with the parties at the relevant time?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The objective is not to attack the complainant personally.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The objective is to make the pleading respondent-specific.<\/p>\n\n\n\n<h2 id=\"h-5-answer-specific-incidents-not-merely-descriptive-words\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"5_Answer_Specific_Incidents_%E2%80%94_Not_Merely_Descriptive_Words\"><\/span>5. Answer Specific Incidents \u2014 Not Merely Descriptive Words<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Words such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u201cContinuously tortured\u201d;<\/li>\n\n\n\n<li>\u201cMentally harassed\u201d;<\/li>\n\n\n\n<li>\u201cHumiliated\u201d;<\/li>\n\n\n\n<li>\u201cThreatened\u201d;<\/li>\n\n\n\n<li>\u201cAbused\u201d;<\/li>\n\n\n\n<li>\u201cIll-treated\u201d;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">may appear serious, but the defence should examine the underlying factual allegations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Ask:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>What exactly happened?<\/strong><\/li>\n\n\n\n<li><strong>When did it happen?<\/strong><\/li>\n\n\n\n<li><strong>Where did it happen?<\/strong><\/li>\n\n\n\n<li><strong>Who was present?<\/strong><\/li>\n\n\n\n<li><strong>What was allegedly said or done?<\/strong><\/li>\n\n\n\n<li><strong>Is there a document, message, medical record, complaint or witness supporting the allegation?<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If a specific incident is pleaded, answer it specifically.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the allegation is vague, explain <strong>why it is vague<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is a major difference between saying:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe allegation is false.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">and saying:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe allegation is denied. No date, place, particular act, person present or other material particulars have been identified from which the respondent can reasonably understand the alleged incident.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The second formulation gives the court something concrete to examine.<\/p>\n\n\n\n<h2 id=\"h-6-respond-separately-to-every-relief-claimed\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"6_Respond_Separately_to_Every_Relief_Claimed\"><\/span>6. Respond Separately to Every Relief Claimed<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A DV complaint is not limited to allegations of domestic violence. The applicant may also seek several different forms of relief.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The reply should therefore address each relief independently.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Relief<\/th><th>Reply<\/th><\/tr><\/thead><tbody><tr><td><strong>Protection Order \u2014 Section 18<\/strong><\/td><td>If a protection order is sought, examine the particular conduct relied upon and explain why the statutory conditions are or are not established on the facts pleaded.<\/td><\/tr><tr><td><strong>Residence Order \u2014 Section 19<\/strong><\/td><td>The defence should address the actual residential history of the parties and the nature of the premises.<\/td><\/tr><tr><td><strong>Monetary Relief \u2014 Section 20<\/strong><\/td><td>The husband should address income, expenses, liabilities, existing orders and the factual basis of the monetary claim.<\/td><\/tr><tr><td><strong>Custody \u2014 Section 21<\/strong><\/td><td>If temporary custody is claimed, the response should focus on the welfare and circumstances of the child rather than turning the issue into another matrimonial dispute.<\/td><\/tr><tr><td><strong>Compensation \u2014 Section 22<\/strong><\/td><td>The husband should specifically answer the alleged injury, loss, mental torture or other basis on which compensation is claimed.<\/td><\/tr><tr><td><strong>Interim or Ex Parte Relief \u2014 Section 23<\/strong><\/td><td>This deserves particular attention because an interim application may be decided at an early stage.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The response should therefore identify the factual material relevant to the immediate relief sought rather than assuming that the final defence can be filed later.<\/p>\n\n\n\n<h2 id=\"h-7-maintenance-claims-require-financial-transparency\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"7_Maintenance_Claims_Require_Financial_Transparency\"><\/span>7. Maintenance Claims Require Financial Transparency<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Maintenance is often one of the most important parts of a DV proceeding.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A husband should not simply write:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cI have no income.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">or:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe wife is financially independent.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Such statements should be supported by appropriate documentary material.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s decision in <strong>Rajnesh v. Neha<\/strong> established important directions concerning disclosure of assets and liabilities in maintenance proceedings. The disclosure framework is intended to assist courts in determining maintenance claims on a more reliable factual basis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Accordingly, where applicable, the husband&#8217;s reply should be consistent with his financial disclosure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Relevant material may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Salary slips;<\/li>\n\n\n\n<li>Income-tax returns;<\/li>\n\n\n\n<li>Bank statements;<\/li>\n\n\n\n<li>Business records;<\/li>\n\n\n\n<li>Loan liabilities;<\/li>\n\n\n\n<li>Rent;<\/li>\n\n\n\n<li>Medical expenses;<\/li>\n\n\n\n<li>Dependent family members;<\/li>\n\n\n\n<li>Existing maintenance orders;<\/li>\n\n\n\n<li>Other legally relevant financial commitments.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The important principle is simple:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Do not make a financial assertion in the reply that your own documents can disprove.<\/strong><\/p>\n\n\n\n<h2 id=\"h-8-every-important-defence-should-be-linked-to-evidence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"8_Every_Important_Defence_Should_Be_Linked_to_Evidence\"><\/span>8. Every Important Defence Should Be Linked to Evidence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A common drafting mistake is attaching a large bundle of documents without explaining their relevance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">More documents do not automatically create a stronger defence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The better approach is to connect the document with the allegation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Allegation:<\/strong> Husband assaulted the wife on 14 March 2025.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Defence:<\/strong> Husband was outside Delhi on that date.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Evidence:<\/strong> Flight ticket, boarding pass, hotel record and employment attendance record.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That creates a coherent evidentiary chain.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Potentially relevant documents may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Bank records;<\/li>\n\n\n\n<li>Travel records;<\/li>\n\n\n\n<li>Employment records;<\/li>\n\n\n\n<li>Rent agreements;<\/li>\n\n\n\n<li>Medical records;<\/li>\n\n\n\n<li>Emails;<\/li>\n\n\n\n<li>WhatsApp or other electronic communications;<\/li>\n\n\n\n<li>Prior complaints;<\/li>\n\n\n\n<li>Legal notices;<\/li>\n\n\n\n<li>Mediation records;<\/li>\n\n\n\n<li>Settlement agreements;<\/li>\n\n\n\n<li>Previous court orders;<\/li>\n\n\n\n<li>Photographs;<\/li>\n\n\n\n<li>Relevant financial documents.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">But electronic evidence should be handled carefully. <strong>Do not rely on cropped screenshots where the complete conversation may tell a different story.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The defence should preserve the original material and comply with applicable evidentiary requirements.<\/p>\n\n\n\n<h2 id=\"h-9-do-not-rely-on-the-old-the-house-belongs-to-my-parents-defence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"9_Do_Not_Rely_on_the_Old_%E2%80%9CThe_House_Belongs_to_My_Parents%E2%80%9D_Defence\"><\/span>9. Do Not Rely on the Old \u201cThe House Belongs to My Parents\u201d Defence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is an area where outdated legal advice can create serious problems.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is not sufficient to say:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe house belongs to my parents, therefore it can never be a shared household.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s decision in <strong>Satish Chander Ahuja v. Sneha Ahuja<\/strong> rejected the narrow interpretation associated with the earlier approach in <em>S.R. Batra v. Taruna Batra<\/em>. The Court examined the expression \u201cshared household\u201d in the context of the statutory scheme and the actual nature of the domestic relationship and residence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, a proper reply should set out the <strong>actual residential history<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Who owned the property?<\/li>\n\n\n\n<li>Who ordinarily lived there?<\/li>\n\n\n\n<li>For how long did the parties reside there?<\/li>\n\n\n\n<li>Was the residence continuous or temporary?<\/li>\n\n\n\n<li>When did the wife move into or leave the premises?<\/li>\n\n\n\n<li>Who else was living there?<\/li>\n\n\n\n<li>What was the nature of the parties&#8217; domestic relationship at the relevant time?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The ownership document may be relevant, but ownership alone should not be treated as the complete answer.<\/p>\n\n\n\n<h2 id=\"h-10-do-not-automatically-treat-delay-as-a-one-year-limitation-defence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"10_Do_Not_Automatically_Treat_Delay_as_a_One-Year_Limitation_Defence\"><\/span>10. Do Not Automatically Treat Delay as a One-Year Limitation Defence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is another area where old drafting formulas can be dangerous.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A husband may come across allegations relating to incidents several years old and assume that the entire Section 12 proceeding is automatically barred because it was not filed within one year.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That proposition should not be mechanically pleaded.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Kamatchi v. Lakshmi Narayanan, the Supreme Court rejected the proposition that an application under Section 12 of the DV Act must necessarily be filed within one year of the alleged domestic violence. The Court distinguished the Section 12 proceeding from prosecution for an offence and considered the relevance of the factual circumstances surrounding the alleged acts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That does not mean that delay is irrelevant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It means that delay should be used factually and carefully.<\/p>\n\n\n\n<h3 id=\"h-ask\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Ask\"><\/span>Ask:<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Was the alleged incident mentioned in an earlier complaint?<\/li>\n\n\n\n<li>Was it mentioned in a divorce petition?<\/li>\n\n\n\n<li>Was it raised during mediation?<\/li>\n\n\n\n<li>Was it referred to in a legal notice?<\/li>\n\n\n\n<li>Was it included in an earlier FIR?<\/li>\n\n\n\n<li>Was there a settlement after the alleged incident?<\/li>\n\n\n\n<li>Are the present allegations materially different from earlier versions?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A long delay coupled with inconsistent versions may become relevant to credibility and the factual assessment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But delay alone should not be presented as an automatic knockout argument.<\/p>\n\n\n\n<h2 id=\"h-11-a-major-2026-development-dhananjay-rathi-v-ruchika-rathi\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"11_A_Major_2026_Development_Dhananjay_Rathi_v_Ruchika_Rathi\"><\/span>11. A Major 2026 Development: Dhananjay Rathi v. Ruchika Rathi<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s 2026 decision in Dhananjay Rathi v. Ruchika Rathi, 2026 INSC 360, is particularly relevant when considering vague allegations against a husband or his relatives.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judgment was delivered on 13 April 2026.
