prevail?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Should Parliament always prevail?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Or is there a third possibility?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I believe there is.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And surprisingly, one of the most interesting clues comes from France.<\/p>\n\n\n\n<h2 id=\"h-the-french-lesson-begins-with-a-seemingly-ordinary-freedom\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_French_Lesson_Begins_With_a_Seemingly_Ordinary_Freedom\"><\/span>The French Lesson Begins With a Seemingly Ordinary Freedom<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In 1971, the French Constitutional Council decided a case concerning freedom of association.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At first glance, it might not appear to have anything to do with artificial intelligence, climate change or international law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the decision changed French constitutional law in a profound way.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In its 16 July 1971 Freedom of Association decision, the French Constitutional Council recognised that constitutional protection could derive not merely from the operative provisions of the Constitution but also from foundational constitutional principles contained in the constitutional preamble and associated texts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The result was the development of what is known as the French <em>bloc de constitutionnalit\u00e9<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The deeper lesson was revolutionary:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">A Constitution can contain principles whose constitutional force is greater than their literal wording might initially suggest.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That idea has enormous relevance to India.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Indian constitutional law has travelled a similar path in many respects.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has interpreted Articles 14, 19 and 21 to protect values such as dignity, privacy, autonomy and substantive equality.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Constitution has therefore never been merely a collection of isolated clauses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is a living constitutional structure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And this brings us to the first part of the proposal.<\/p>\n\n\n\n<h2 id=\"h-india-needs-to-recognise-the-constitutional-core\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"India_Needs_to_Recognise_the_%E2%80%9CConstitutional_Core%E2%80%9D\"><\/span>India Needs to Recognise the \u201cConstitutional Core\u201d<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose a case concerns an artificial-intelligence system used by the Government to decide whether a citizen receives a welfare benefit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The citizen is rejected.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No human being appears to have examined the application.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No meaningful explanation is given.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The citizen approaches the court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What is the real constitutional question?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is not simply:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cDoes the AI system comply with the relevant statute?\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The deeper questions are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Is there equality?<\/li>\n\n\n\n<li>Is there procedural fairness?<\/li>\n\n\n\n<li>Is there dignity?<\/li>\n\n\n\n<li>Is there meaningful accountability?<\/li>\n\n\n\n<li>Can a person challenge an automated decision?<\/li>\n\n\n\n<li>Does Article 21 require a human explanation?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The court must first identify this constitutional core.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is the first principle I propose.<\/p>\n\n\n\n<h3 id=\"h-constitution-must-come-before-international-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Constitution_Must_Come_Before_International_Law\"><\/span>Constitution Must Come Before International Law<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">An Indian judge should first ask:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">What does the Constitution itself protect?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Only after answering that question should the court look outward.<\/p>\n\n\n\n<h2 id=\"h-then-came-france-s-nicolo-moment\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Then_Came_Frances_Nicolo_Moment\"><\/span>Then Came France&#8217;s Nicolo Moment<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Nearly two decades after the 1971 decision, France confronted another difficult question.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Nicolo<\/em>, decided on 20 October 1989, the French Conseil d&#8217;\u00c9tat accepted judicial review of the compatibility of domestic legislation with treaty obligations under Article 55 of the French Constitution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The significance of the case was enormous.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It demonstrated that a domestic court could play an active role in ensuring coherence between domestic legislation and international obligations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But here India must be careful.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">France has a constitutional provision\u2014Article 55\u2014that creates a treaty hierarchy materially different from India&#8217;s constitutional structure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, India should not copy Nicolo.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But India can learn from its underlying philosophy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">International commitments should not become legally meaningless simply because they exist outside the four corners of an Indian statute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, they cannot automatically become superior to Parliament.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India therefore needs a middle path.<\/p>\n\n\n\n<h2 id=\"h-india-already-has-the-ingredients-of-that-middle-path\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"India_Already_Has_the_Ingredients_of_That_Middle_Path\"><\/span>India Already Has the Ingredients of That Middle Path<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s jurisprudence provides an important starting point.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Jolly George Varghese v. Bank of Cochin<\/em>, the Court recognised that an international covenant does not automatically become enforceable municipal law merely because India has undertaken the international obligation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That principle protects the constitutional role of Parliament.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But then came another line of cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Vishaka<\/em>, the Supreme Court used international conventions and norms as an aid to constitutional interpretation where domestic law did not adequately address the problem and there was no inconsistency with Indian law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That principle has subsequently been reaffirmed in various contexts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So India already possesses two apparently competing ideas:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Treaties do not automatically become domestic law.<\/li>\n\n\n\n<li>International law can nevertheless help Indian courts interpret constitutional rights.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">I do not see these propositions as contradictory.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They answer two different questions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And that is precisely where the new doctrine can begin.<\/p>\n\n\n\n<h2 id=\"h-the-second-principle-international-law-can-illuminate-the-constitution\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Second_Principle_International_Law_Can_Illuminate_the_Constitution\"><\/span>The Second Principle: International Law Can Illuminate the Constitution<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Imagine that the Constitution protects dignity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An international human-rights instrument also protects dignity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court should not say:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe international treaty has automatically become Indian law.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">But neither should it say:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe treaty is irrelevant.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">There is a third approach.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court can say:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe Constitution protects dignity. International law provides persuasive material that helps us understand the contemporary content of that constitutional protection.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is a very different proposition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The source of the enforceable right remains:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The Constitution.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">International law provides:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Interpretive illumination.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction is fundamental.<\/p>\n\n\n\n<h2 id=\"h-then-france-gave-us-something-even-more-sophisticated\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Then_France_Gave_Us_Something_Even_More_Sophisticated\"><\/span>Then France Gave Us Something Even More Sophisticated<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The most interesting French decision for India, in my view, is not Nicolo.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is <em>Arcelor Atlantique et Lorraine<\/em>, decided by the French Conseil d&#8217;\u00c9tat on 8 February 2007.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case involved a difficult relationship between French constitutional requirements and European Union law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The French court did something intellectually sophisticated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead of immediately declaring:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cFrench constitutional law wins.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">or:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cEuropean law wins.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">it first asked whether the constitutional principle had an equivalent and effective protection within European law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is a remarkable judicial technique.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before declaring two legal orders to be in conflict, determine whether they are actually protecting the same value to substantially the same degree.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is the part of Arcelor that India can use.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Not the European institutional structure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Not the EU legal hierarchy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The method.<\/strong><\/p>\n\n\n\n<h2 id=\"h-from-arcelor-to-an-indian-equivalence-test\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"From_Arcelor_to_an_Indian_%E2%80%9CEquivalence_Test%E2%80%9D\"><\/span>From Arcelor to an Indian \u201cEquivalence Test\u201d<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Imagine that India is considering a privacy question.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Indian constitutional law protects privacy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An international instrument protects privacy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A foreign constitutional court has developed an elaborate privacy doctrine.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A multinational technology company has its own global privacy framework.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Do we simply pick one?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court should compare them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It should ask:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What is the scope of protection?<\/li>\n\n\n\n<li>Who is protected?<\/li>\n\n\n\n<li>What restrictions are permitted?<\/li>\n\n\n\n<li>What procedural safeguards exist?<\/li>\n\n\n\n<li>What remedies are available?<\/li>\n\n\n\n<li>And most importantly: Does the protection actually work?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This would be the Equivalence Test.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The question would not be:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cDoes another legal system use the same words?\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The question would be:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cDoes it provide substantially equivalent and effective protection?\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is a much more mature approach to comparative constitutional class=\"wp-block-paragraph\">Putting these ideas together, I propose what may be called the:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Constitutional Dialogue Doctrine<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Its central proposition is simple:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">International law may illuminate the meaning of the Indian Constitution, but it cannot displace the Constitution. Domestic legislation may remain applicable notwithstanding an untransformed international obligation, but that legislation remains subject to constitutional review.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">This gives us neither international supremacy nor international isolation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>It gives us dialogue.<\/strong><\/p>\n\n\n\n<h2 id=\"h-how-would-an-indian-court-actually-apply-it\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_Would_an_Indian_Court_Actually_Apply_It\"><\/span>How Would an Indian Court Actually Apply It?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I would propose a seven-stage test.<\/p>\n\n\n\n<h3 id=\"h-1-constitutional-core\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"1_Constitutional_Core\"><\/span>1. Constitutional Core<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">First ask:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What Indian constitutional right or structural principle is involved?<\/li>\n\n\n\n<li>Article 14?<\/li>\n\n\n\n<li>Article 19?<\/li>\n\n\n\n<li>Article 21?<\/li>\n\n\n\n<li>Privacy?<\/li>\n\n\n\n<li>Dignity?<\/li>\n\n\n\n<li>Equality?<\/li>\n\n\n\n<li>Environmental protection?<\/li>\n\n\n\n<li>Federalism?<\/li>\n\n\n\n<li>Separation of powers?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The court begins at home.<\/p>\n\n\n\n<h3 id=\"h-2-domestic-framework\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2_Domestic_Framework\"><\/span>2. Domestic Framework<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The court then examines the complete Indian legal framework:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Constitution;<\/li>\n\n\n\n<li>Parliamentary legislation;<\/li>\n\n\n\n<li>State legislation;<\/li>\n\n\n\n<li>Rules and regulations;<\/li>\n\n\n\n<li>Executive action;<\/li>\n\n\n\n<li>Binding Supreme Court precedent.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A court should not compare an international provision with one isolated sentence in a statute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The entire domestic framework must be considered.<\/p>\n\n\n\n<h3 id=\"h-3-classify-the-international-norm\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3_Classify_the_International_Norm\"><\/span>3. Classify the International Norm<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This is extremely important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Not everything called \u201cinternational law\u201d has the same legal force.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court should distinguish between:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>International Norm<\/th><th>Legal Character<\/th><\/tr><\/thead><tbody><tr><td>Binding treaties<\/td><td>International obligations undertaken by states<\/td><\/tr><tr><td>Customary international law<\/td><td>Rules recognised through international practice and legal acceptance<\/td><\/tr><tr><td>International judicial decisions<\/td><td>Decisions of international judicial bodies<\/td><\/tr><tr><td>UN declarations and soft law<\/td><td>Non-binding international standards and principles<\/td><\/tr><tr><td>Foreign judgments<\/td><td>Comparative and potentially persuasive judicial reasoning<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Their persuasive or legal significance should not be treated as identical.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A treaty obligation and a foreign court&#8217;s judgment are obviously not the same thing.<\/p>\n\n\n\n<h3 id=\"h-4-the-equivalence-inquiry\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"4_The_Equivalence_Inquiry\"><\/span>4. The Equivalence Inquiry<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The court then asks:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Does the international norm provide equivalent and effective protection of the Indian constitutional value?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The comparison should examine:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Scope;<\/li>\n\n\n\n<li>Beneficiaries;<\/li>\n\n\n\n<li>Restrictions;<\/li>\n\n\n\n<li>Safeguards;<\/li>\n\n\n\n<li>Remedies;<\/li>\n\n\n\n<li>Enforcement;<\/li>\n\n\n\n<li>Effectiveness.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This is the principal lesson India can draw from Arcelor.<\/p>\n\n\n\n<h3 id=\"h-5-harmonious-interpretation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"5_Harmonious_Interpretation\"><\/span>5. hide behind \u201cthe computer decided\u201d?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These questions will increasingly reach constitutional courts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The intellectually isolated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is the central insight.<\/p>\n\n\n\n<h2 id=\"h-the-c-dialogue-test\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" Yet an international norm cannot, without constitutional or legislative authority, displace the Constitution or automatically override domestic legislation.
