It raises a much larger question:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Can India build an economic relationship with the United States in which cooperation becomes more valuable to both countries than repeated tariff escalation?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In my view, the answer lies not in a tariff war and certainly not in making unlimited concessions for temporary relief.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India needs something more durable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It needs an <strong>India\u2013U.S. Economic Security Compact 2035<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The idea is simple but strategically important:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>India should become increasingly important to the United States without becoming strategically dependent upon the United States\u2014or any other single country.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is the doctrine I would describe as<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Strategic Interdependence Without Strategic Dependence.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<h3 id=\"h-the-question-india-should-really-be-asking\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Question_India_Should_Really_Be_Asking\"><\/span>The Question India Should Really Be Asking<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The immediate reaction to an American tariff is naturally to ask:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>How can India persuade Washington to reduce or remove the tariff?<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But that question is too narrow.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A tariff negotiated away today can potentially be replaced tomorrow by another measure imposed under a different legal authority, another investigation, another geopolitical dispute, or another political consideration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The developments of 2025\u20132026 illustrate precisely why India needs to think beyond individual tariff negotiations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The February 2026 India\u2013U.S. framework already demonstrated that bilateral economic relations can involve:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Reciprocal tariffs<\/li>\n\n\n\n<li>Market access<\/li>\n\n\n\n<li>Rules of origin<\/li>\n\n\n\n<li>Supply-chain cooperation<\/li>\n\n\n\n<li>Major purchasing commitments<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Yet subsequent developments have shown that a framework without sufficiently durable institutional protections can remain vulnerable to new measures.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India therefore needs to move from <strong>tariff-by-tariff diplomacy to an institutional economic architecture<\/strong>.<\/p>\n\n\n\n<h3 id=\"h-a-new-proposition-for-washington\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_New_Proposition_for_Washington\"><\/span>A New Proposition for Washington<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">India should not approach Washington merely by saying:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;Please reduce your tariffs.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">India should take a much larger proposition to the United States:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Let us build an economic relationship in which both countries gain more from investment, manufacturing, technology, and supply-chain integration than either country can gain from unilateral tariff escalation.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">This changes the conversation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The United States has legitimate commercial interests. It wants greater access to India&#8217;s enormous market. It wants American companies to export more. It wants resilient supply chains. It wants greater energy exports and greater participation by American businesses in India&#8217;s growth.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India can respond constructively to these interests\u2014but it should do so in a manner that creates long-term productive capacity inside India.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This leads to what I believe should become the central economic idea of the relationship:<\/p>\n\n\n\n<h2 id=\"h-move-from-buy-american-to-build-american-in-india\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Move_from_%E2%80%9CBuy_American%E2%80%9D_to_%E2%80%9CBuild_American_in_India%E2%80%9D\"><\/span>Move from &#8220;Buy American&#8221; to &#8220;Build American in India.&#8221;<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If American companies want greater access to India&#8217;s market, India should encourage them to manufacture, invest, research, and build supply chains in India.<\/p>\n\n\n\n<h3 id=\"h-the-economic-equation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Economic_Equation\"><\/span>The Economic Equation<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The economic equation then becomes remarkably different:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>American capital, American technology, Indian talent, Indian manufacturing, Indian market, and global exports.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is not merely trade.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is economic integration.<\/p>\n\n\n\n<h2 id=\"h-turning-the-trade-deficit-debate-into-an-investment-opportunity\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Turning_the_Trade-Deficit_Debate_into_an_Investment_Opportunity\"><\/span>Turning the Trade-Deficit Debate into an Investment Opportunity<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Washington&#8217;s concern about the bilateral goods trade deficit cannot simply be dismissed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But there is a fundamental difference between addressing a trade imbalance through economically inefficient purchases and addressing it through productive investment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If India simply buys more American products to improve headline trade numbers, India may spend enormous amounts without necessarily creating corresponding domestic economic value.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is another route.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Encourage American companies to invest in India.<\/li>\n\n\n\n<li>Let them manufacture in India.<\/li>\n\n\n\n<li>Let them establish research centers.<\/li>\n\n\n\n<li>Let them develop Indian supply chains.<\/li>\n\n\n\n<li>Let them use India&#8217;s engineering and technical talent.<\/li>\n\n\n\n<li>Let them export from India to third-country markets.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The relationship then changes from<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>American exports \u2192 Indian imports<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">to:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>American investment \u2192 Indian production \u2192 Indian and global sales.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is a far more sophisticated response to the trade-deficit question.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It gives American companies access to India&#8217;s growth while giving India employment, technology, manufacturing capacity, exports, and investment.<\/p>\n\n\n\n<h2 id=\"h-india-should-make-its-market-a-strategic-asset\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"India_Should_Make_Its_Market_a_Strategic_Asset\"><\/span>India Should Make Its Market a Strategic Asset<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">India&#8217;s market is not merely something to be &#8220;given&#8221; away during negotiations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Market access is one of India&#8217;s most valuable economic assets.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It should therefore become part of a reciprocal bargain.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where India provides greater technology-market access, it can seek American investment and research and development in India.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where India considers greater automobile access, it can seek manufacturing and supply-chain development.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where India expands defense procurement, it can, where appropriate and consistent with national security requirements, seek Indian production and technology cooperation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where India purchases energy, it can seek long-term commercial and infrastructure cooperation.<\/p>\n\n\n\n<h3 id=\"h-the-principle-should-be-straightforward\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Principle_Should_Be_Straightforward\"><\/span>The Principle Should Be Straightforward:<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Market access should create productive capacity in India.<\/strong><\/p>\n\n\n\n<h2 id=\"h-the-500-billion-question\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_500_Billion_Question\"><\/span>The $500 Billion Question<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The February 2026 framework contemplated substantial Indian purchases of American energy, aircraft and aircraft parts, precious metals, technology products, coking coal, and other products over a five-year period.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India should honor economically rational commitments that it has undertaken.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But implementation should be designed to create maximum developmental value.<\/p>\n\n\n\n<h3 id=\"h-the-guiding-principle-should-be\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Guiding_Principle_Should_Be\"><\/span>The Guiding Principle Should Be:<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Buy where necessary. Build where possible. Co-develop where strategic.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Aircraft purchases, for example, can potentially be connected with Indian maintenance, repair and overhaul facilities, component manufacturing, engineering, training and aerospace supply chains.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Technology purchases can be linked, wherever commercially viable, with Indian research and development, skills development, data center investment, and local manufacturing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Energy purchases can be connected with storage, infrastructure, and downstream investment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Defense procurement can, where appropriate, maximize Indian manufacturing, maintenance, component production, and co-development.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The objective is not to reject American products.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is to ensure that purchasing also strengthens India&#8217;s productive capabilities.<\/p>\n\n\n\n<h2 id=\"h-india-needs-tariff-stability-not-temporary-peace\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"India_Needs_Tariff_Stability%E2%80%94Not_Temporary_Peace\"><\/span>India Needs Tariff Stability\u2014Not Temporary Peace<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The next pillar of the Compact should be a genuine tariff-stability mechanism.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India should seek, wherever legally feasible, defined tariff ceilings for covered products, structured consultation mechanisms, and periodic review of reciprocal concessions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If one side materially withdraws an agreed benefit, the corresponding commitments should be capable of review under the agreed framework and applicable law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The objective is not to create automatic retaliation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is to create predictability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Businesses cannot make ten-year investments when the economic assumptions underlying those investments can change overnight.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Long-term investment requires long-term certainty.<\/p>\n\n\n\n<h3 id=\"h-there-should-also-be-a-basic-negotiating-rule\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"There_Should_Also_Be_a_Basic_Negotiating_Rule\"><\/span>There Should Also Be a Basic Negotiating Rule:<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Permanent concessions should obtain permanent reciprocal benefits.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If India permanently reduces a tariff, the corresponding benefit should ideally be durable\u2014whether through an American tariff reduction, improved quota access, rules-of-origin advantages, services access, investment commitments, technology cooperation, or procurement opportunities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Temporary relief should not automatically produce permanent Indian concessions.<\/p>\n\n\n\n<h2 id=\"h-agriculture-cannot-be-treated-like-every-other-sector\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Agriculture_Cannot_Be_Treated_Like_Every_Other_Sector\"><\/span>Agriculture Cannot Be Treated Like Every Other Sector<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Agriculture deserves separate treatment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India&#8217;s agricultural economy involves farmers, food security, and rural livelihoods. It therefore cannot be negotiated in exactly the same manner as industrial machinery or consumer electronics.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, India can explore carefully calibrated arrangements such as tariff-rate quotas, phased reductions, seasonal arrangements, product-specific negotiations, and sanitary and phytosanitary cooperation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The objective should be greater bilateral agricultural trade without unnecessary disruption to sensitive Indian agricultural sectors.<\/p>\n\n\n\n<h2 id=\"h-energy-security-must-remain-an-indian-interest\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Energy_Security_Must_Remain_an_Indian_Interest\"><\/span>Energy Security Must Remain an Indian Interest<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The energy question has acquired additional importance because of the September 2026 U.S. legislative development concerning countries purchasing Russian energy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Whatever the eventual legal and policy consequences of that legislation may be, the broader lesson for India is unmistakable:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Energy security cannot depend excessively upon any single country.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India should therefore pursue diversification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Its energy portfolio can involve the United States, the Middle East, Russia, Africa, Latin America, and domestic sources, alongside nuclear power and renewable energy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is not an anti-American or anti-Russian doctrine.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is an Indian doctrine of resilience.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No single country should be in a position to determine India&#8217;s energy security.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India should also consider creating an Energy Security and Transition Fund to channel favorable periods of energy economics into strategic investments in petroleum reserves, nuclear energy, renewable power, battery storage, grid modernization, energy efficiency, domestic exploration, and alternative fuels.<\/p>\n\n\n\n<h3 id=\"h-the-philosophy-should-be\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Philosophy_Should_Be\"><\/span>The Philosophy Should Be:<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Use periods of favorable energy economics to finance the long-term reduction of energy vulnerability.<\/strong><\/p>\n\n\n\n<h2 id=\"h-india-can-become-a-major-china-1-manufacturing-platform\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"India_Can_Become_a_Major_China1_Manufacturing_Platform\"><\/span>India Can Become a Major China+1 Manufacturing Platform<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The restructuring of global supply chains provides India with another opportunity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The objective should not be presented as an anti-China campaign.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It should instead be framed as global supply-chain resilience.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India can position itself as an additional manufacturing platform for pharmaceuticals, electronics, semiconductors, chemicals, machinery, aerospace, defense, batteries, critical minerals, and medical devices.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is particularly important because the United States and other advanced economies are increasingly concerned about concentration risks in strategic supply chains.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India possesses a large domestic market, engineering talent, manufacturing potential, and geographic advantages.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The challenge is to convert those advantages into globally competitive production.<\/p>\n\n\n\n<h2 id=\"h-the-american-investment-opportunity\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_American_Investment_Opportunity\"><\/span>The American Investment Opportunity<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">India should establish a dedicated investment facilitation program for substantial American production and research projects.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Priority sectors could include semiconductors, aerospace, pharmaceuticals, medical devices, defense manufacturing, artificial intelligence, data centers, energy technology, critical minerals, advanced electronics, and industrial machinery.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Government support should not become an open-ended subsidy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, meaningful support should be connected to measurable outcomes such as<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>actual capital investment;<\/li>\n\n\n\n<li>employment;<\/li>\n\n\n\n<li>domestic value addition;<\/li>\n\n\n\n<li>research and development;<\/li>\n\n\n\n<li>exports;<\/li>\n\n\n\n<li>technology development; and<\/li>\n\n\n\n<li>supply chain integration.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The underlying principle is simple:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Greater economic privilege should be accompanied by greater economic value creation in India.<\/strong><\/p>\n\n\n\n<h2 id=\"h-india-also-needs-a-legal-strategy\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"India_Also_Needs_a_Legal_Strategy\"><\/span>India Also Needs a Legal Strategy<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As a lawyer, I believe the legal dimension of the relationship deserves much greater institutional attention.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Every major American tariff measure should be examined through the precise legal authority under which it has been imposed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That means examining the relevant U.S. statute, administrative procedure, congressional authority, WTO obligations, GATT provisions, applicable exceptions, product-specific rules, and procedural safeguards.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The importance of this approach has been highlighted by the 2026 U.S. Supreme Court decision in <em>Learning Resources, Inc. v. Trump<\/em>, concerning the scope of presidential authority under IEEPA.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lesson for India is not that every future American tariff will necessarily be unlawful.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lesson is more basic:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>India should never assume that an American executive tariff proclamation is beyond legal scrutiny.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Every measure must be examined on its own statutory and legal foundation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India should therefore establish a permanent India\u2013U.S. Trade Law Cell, bringing together trade lawyers, economists, diplomats, and relevant government departments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Litigation should be used strategically.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where India&#8217;s legal position is strong, litigation may deserve serious consideration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where the legal position is mixed, litigation preparation can proceed alongside negotiation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where the measure is predominantly a foreign-policy instrument, diplomacy, exemptions, transition arrangements, and economic diversification may be more appropriate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This would make India&#8217;s response strategic rather than automatic.<\/p>\n\n\n\n<h2 id=\"h-protecting-indian-exporters\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Protecting_Indian_Exporters\"><\/span>Protecting Indian Exporters<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Tariff shocks do not affect every Indian industry equally.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some exporters may face immediate pressure because they are heavily dependent on the American market.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India should therefore consider an Export Adjustment and Diversification Fund capable of supporting viable exporters through export credit, technology upgrading, certification, logistics, market-entry assistance, and trade promotion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But such assistance should not become
