Mamata Banerjee has now approached the Supreme Court challenging the interim order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If I were appearing for Mamata Banerjee, however, I would not fight this case merely as a battle between Mamata Banerjee and a rival faction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would fight it as a case about the legal identity and continuity of a recognised political organisation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And that distinction, in my view, could be the key to the entire case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Also Read: <a href=\"https:\/\/www.legalservicesindia.com\/tmc-name-symbol-freeze-election-commission-paragraph-15\/\" target=\"_blank\" rel=\"noopener\">TMC Name-Symbol Freeze: Can the Election Commission Freeze a Political Party\u2019s Identity<\/a>?<\/p>\n\n\n\n<h2 id=\"h-the-real-question-is-not-who-owns-the-symbol\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Real_Question_Is_Not_%E2%80%9CWho_Owns_the_Symbol%E2%80%9D\"><\/span>The Real Question Is Not \u201cWho Owns the Symbol?\u201d<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The first mistake I would avoid is treating the \u201cFlowers &amp; Grass\u201d symbol as if it were personal property belonging to Mamata Banerjee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is not.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The symbol follows the legal recognition of the political party under the statutory framework.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The real sequence is:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Which organisation is the recognised political party?<\/li>\n\n\n\n<li>Which faction constitutes that organisation?<\/li>\n\n\n\n<li>Which name and reserved symbol consequently belong to that recognised organisation?<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">That is why the real battle is over party identity, not ownership of a piece of electoral imagery.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Election Commission&#8217;s own interim order recognises this distinction: it has frozen the original name and symbol only while the substantive Paragraph 15 dispute is resolved.<\/p>\n\n\n\n<h2 id=\"h-my-central-defence-organisational-continuity\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"My_Central_Defence_Organisational_Continuity\"><\/span>My Central Defence: Organisational Continuity<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If I had to reduce the entire defence to one proposition, it would be this:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Before deciding who has succeeded to the TMC identity, the Election Commission must first determine whether there was a legally valid organisational succession at all.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is the heart of my case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would not simply say:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cMamata founded TMC; therefore, TMC belongs to Mamata.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is politically understandable but legally incomplete.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, I would establish that the organisation represented by Mamata Banerjee is the continuing constitutional and organisational entity of the recognised All India Trinamool Congress, unless the rival faction can demonstrate a lawful constitutional process by which that organisation was displaced.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This takes the case away from personalities and puts it where a court is most comfortable:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>documents,<\/li>\n\n\n\n<li>constitutional provisions,<\/li>\n\n\n\n<li>organisational authority, and<\/li>\n\n\n\n<li>evidence.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-the-first-question-which-constitution-was-actually-in-force\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_First_Question_Which_Constitution_Was_Actually_in_Force\"><\/span>The First Question: Which Constitution Was Actually in Force?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This, to my mind, could become one of the most important questions in the entire litigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The present dispute reportedly includes a serious disagreement about the tenure of the National Working Committee. The rival side has reportedly argued that the earlier committee&#8217;s tenure expired in February 2025, while the Mamata faction disputes that position and maintains that the relevant constitutional arrangement continued for a longer period.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would not try to resolve that question through political statements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would ask for the documents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would place it before the Election Commission:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>every version of the TMC Constitution;<\/li>\n\n\n\n<li>every amendment;<\/li>\n\n\n\n<li>resolutions adopting those amendments;<\/li>\n\n\n\n<li>organisational election records;<\/li>\n\n\n\n<li>minutes of relevant meetings;<\/li>\n\n\n\n<li>membership records;<\/li>\n\n\n\n<li>delegate lists;<\/li>\n\n\n\n<li>notices;<\/li>\n\n\n\n<li>office-bearer records; and<\/li>\n\n\n\n<li>every relevant filing and communication with the Election Commission.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Then I would ask one deceptively simple question:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Which Constitution was legally operative on the date on which the rival faction says the existing organisational authority expired?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Only after answering that question can we determine:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Who had authority?<\/li>\n\n\n\n<li>And only after determining authority can we decide whether a subsequent organisational change was legally valid.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-the-foundation-of-the-rival-claim-must-be-examined\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Foundation_of_the_Rival_Claim_Must_Be_Examined\"><\/span>The Foundation of the Rival Claim Must Be Examined<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose the rival faction says that the existing organisational leadership had ceased to possess authority.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">My response would be straightforward:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Who declared it invalid?<\/li>\n\n\n\n<li>Under which provision of the Constitution?<\/li>\n\n\n\n<li>Who convened the subsequent meeting?<\/li>\n\n\n\n<li>Who issued the notice?<\/li>\n\n\n\n<li>Who were entitled to attend?<\/li>\n\n\n\n<li>Who were the delegates?<\/li>\n\n\n\n<li>How were those delegates selected?<\/li>\n\n\n\n<li>Was the quorum satisfied?<\/li>\n\n\n\n<li>Was the required majority obtained?<\/li>\n\n\n\n<li>Was the resolution validly recorded?<\/li>\n\n\n\n<li>Was it implemented according to the Constitution?<\/li>\n\n\n\n<li>Was it communicated to the ECI?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This is what I would call the chain of constitutional authority.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It can be expressed simply:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Constitution \u2192 competent authority \u2192 notice \u2192 eligible participants \u2192 quorum \u2192 vote \u2192 resolution \u2192 implementation \u2192 ECI record.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a fundamental link in that chain is missing, the subsequent claim of organisational succession deserves very close scrutiny.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A group cannot simply declare an existing organisation invalid, establish another organisation and then rely upon the existence of that new organisation as proof of its own authority.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The source of authority must first be established.<\/p>\n\n\n\n<h2 id=\"h-this-is-where-the-tmc-constitution-becomes-the-battlefield\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"This_Is_Where_the_TMC_Constitution_Becomes_the_Battlefield\"><\/span>This Is Where the TMC Constitution Becomes the Battlefield<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I would therefore turn the Paragraph 15 proceeding into a documentary exercise.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For every important organisational event, I would prepare a table:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Question<\/th><th>Evidence Required<\/th><\/tr><\/thead><tbody><tr><td>Which Constitution governed?<\/td><td>Certified constitutional record<\/td><\/tr><tr><td>Who had authority?<\/td><td>Relevant constitutional clause<\/td><\/tr><tr><td>When did the NWC&#8217;s term expire?<\/td><td>Constitution + amendments<\/td><\/tr><tr><td>Was the term extended?<\/td><td>Resolution\/amendment<\/td><\/tr><tr><td>Who could convene a new meeting?<\/td><td>Constitution<\/td><\/tr><tr><td>Who were eligible delegates?<\/td><td>Membership\/delegate records<\/td><\/tr><tr><td>Was the quorum satisfied?<\/td><td>Attendance records<\/td><\/tr><tr><td>Was the election valid?<\/td><td>Election documents<\/td><\/tr><tr><td>Was the change communicated to ECI?<\/td><td>ECI filings<\/td><\/tr><tr><td>What organisation continued thereafter?<\/td><td>Organisational records<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">This would transform a politically charged dispute into a forensic legal inquiry.<\/p>\n\n\n\n<h2 id=\"h-a-political-party-is-bigger-than-its-legislature\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_Political_Party_Is_Bigger_Than_Its_Legislature\"><\/span>A Political Party Is Bigger Than Its Legislature<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I expect legislative strength to be a major part of the rival faction&#8217;s case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would not make the mistake of arguing that MLAs are irrelevant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They are obviously relevant evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But relevance is not the same thing as conclusiveness.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s Constitution Bench decision in Subhash Desai v. Principal Secretary, Governor of Maharashtra is particularly important because it distinguishes the political party from the legislature party. The Court noted that the Symbols Order recognises the political party and does not simply equate it with a legislature party.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That gives us an important legal distinction:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Legislative strength may be evidence of support; it is not automatically proof of organisational succession.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A political party has a wider institutional structure:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>primary members;<\/li>\n\n\n\n<li>district organisations;<\/li>\n\n\n\n<li>block organisations;<\/li>\n\n\n\n<li>state and national committees;<\/li>\n\n\n\n<li>delegates;<\/li>\n\n\n\n<li>office-bearers;<\/li>\n\n\n\n<li>organisational elections;<\/li>\n\n\n\n<li>a Constitution; and<\/li>\n\n\n\n<li>an established institutional history.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, if the argument becomes:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cWe have more MLAs; therefore, we are TMC.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">My answer would be:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThat is an important fact. But it does not answer the anterior question of whether the political organisation itself was lawfully transferred.\u201d<\/p>\n<\/blockquote>\n\n\n\n<h2 id=\"h-the-supreme-court-s-precedents-must-be-used-carefully\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Supreme_Courts_Precedents_Must_Be_Used_Carefully\"><\/span>The Supreme Court&#8217;s Precedents Must Be Used Carefully<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The defence cannot ignore Sadiq Ali v. Election Commission of India.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That case establishes the ECI&#8217;s authority to adjudicate competing claims concerning a recognised political party and its election symbol.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nor should we misrepresent the law by saying that legislative strength is irrelevant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The jurisprudence instead requires a more nuanced approach.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Subhash Desai, the Supreme Court recorded the historical use of several tests in party-symbol disputes, including examination of the party Constitution, its aims and objects, and the relative strength of rival groups in the legislature and organisational wing. It also discussed the relevance of the \u201ctest of majority\u201d in the circumstances of a particular dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, my argument would be:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The law does not require the Commission to ignore legislative numbers. It requires the Commission to determine what those numbers mean in the particular factual and organisational context of the dispute.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is a far class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I would prepare what I would call the TMC Continuity Dossier.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It would trace:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Recognition<\/li>\n\n\n\n<li>Party Constitution<\/li>\n\n\n\n<li>Constitutional amendments<\/li>\n\n\n\n<li>Organisational elections<\/li>\n\n\n\n<li>Office-bearers<\/li>\n\n\n\n<li>Primary membership<\/li>\n\n\n\n<li>District and block organisations<\/li>\n\n\n\n<li>State and national committees<\/li>\n\n\n\n<li>Delegates<\/li>\n\n\n\n<li>ECI filings<\/li>\n\n\n\n<li>Present organisational structure<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">The purpose would be to answer:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Is the Mamata-led organisation a new claimant to the TMC identity, or is it the continuing organisation historically recognised as TMC?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction is crucial.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Election Commission itself maintains records concerning recognised political parties, their constitutions and organisational elections.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those records should therefore become part of the evidentiary foundation.<\/p>\n\n\n\n<h2 id=\"h-primary-membership-deserves-serious-attention\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Primary_Membership_Deserves_Serious_Attention\"><\/span>Primary Membership Deserves Serious Attention<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If I were arguing the case, I would devote substantial attention to primary membership.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would seek evidence concerning:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>membership registers;<\/li>\n\n\n\n<li>membership enrolment;<\/li>\n\n\n\n<li>district membership;<\/li>\n\n\n\n<li>block membership;<\/li>\n\n\n\n<li>delegates;<\/li>\n\n\n\n<li>committee composition;<\/li>\n\n\n\n<li>organisational elections; and<\/li>\n\n\n\n<li>authorised office-bearers.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The question would not be:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cWho can produce the largest political crowd?\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">It would be:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cWhich organisation possesses the continuing institutional structure of the recognised political party?\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is a much more legally meaningful question.<\/p>\n\n\n\n<h2 id=\"h-the-self-created-authority-problem\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_%E2%80%9CSelf-Created_Authority%E2%80%9D_Problem\"><\/span>The \u201cSelf-Created Authority\u201d Problem<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is another issue that I would explore carefully.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose a group says:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe existing committee no longer has authority.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That group then convenes a meeting.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That meeting elects a new leadership.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The new leadership then says:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cWe are legitimate because we were elected at that meeting.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">My response is:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Where did the authority to convene the original meeting come from?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If that authority cannot be traced back to the Constitution or a valid constitutional act, there is a foundational problem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The successor organisation cannot simply use its own creation as proof of the authority necessary to create it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is why the first organisational act in the alleged succession becomes critically important.<\/p>\n\n\n\n<h2 id=\"h-i-would-not-let-the-case-become-a-one-day-snapshot\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"I_Would_Not_Let_the_Case_Become_a_One-Day_Snapshot\"><\/span>I Would Not Let the Case Become a One-Day Snapshot<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A decades-old political organisation should not be reduced to a headcount taken on the date of an ECI hearing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Imagine that legislative allegiance changes immediately before the hearing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Should that one-day numerical position alone determine the identity of the entire political organisation?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would argue that it should not.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Paragraph 15 requires the Commission to consider the available facts and circumstances in resolving the rival claim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, the Commission should examine:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Constitutional authority<\/li>\n\n\n\n<li>Organisational continuity<\/li>\n\n\n\n<li>Membership<\/li>\n\n\n\n<li>Organisational elections<\/li>\n\n\n\n<li>Delegates<\/li>\n\n\n\n<li>Legislative support<\/li>\n\n\n\n<li>Circumstances of the dispute<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The answer should emerge from the whole record.<\/p>\n\n\n\n<h2 id=\"h-legislative-strength-important-but-not-a-substitute-for-party-identity\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Legislative_Strength_Important_But_Not_a_Substitute_for_Party_Identity\"><\/span>Legislative Strength: Important, But Not a Substitute for Party Identity<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is perhaps the most delicate part of the defence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would concede immediately:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>&#8220;Yes, legislative strength is relevant.&#8221;<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Then I would add:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow class=\"wp-block-paragraph\">This is important because the Supreme Court&#8217;s jurisprudence has recognised the usefulness of the majority test in appropriate circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, I would not ask the Court to abandon the majority test.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would ask it to ensure that the correct question is being answered.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The question is not simply:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Who has more legislators?<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">It is:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Which group, considering all relevant facts and circumstances, constitutes the recognised political party?<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is the Paragraph 15 question.<\/p>\n\n\n\n<h2 id=\"h-the-tenth-schedule-must-be-kept-in-its-proper-place\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Tenth_Schedule_Must_Be_Kept_in_Its_Proper_Place\"><\/span>The Tenth Schedule Must Be Kept in Its Proper Place<span interim arrangement because the Commission considered that the available time before the October 6 by-elections was insufficient to complete the substantive Paragraph 15 determination. It therefore temporarily barred both factions from using the original party name and symbol and created alternative identities for the by-election process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Mamata faction was subsequently allotted \u201cMamata All India Trinamool Congress\u201d with the football player symbol, while the rival faction was allotted \u201cDemocratic Trinamool Congress\u201d with an envelope symbol.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is politically significant, but legally it remains an interim arrangement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would therefore seek an express principle:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>An interim electoral arrangement must not become a presumption concerning the final identity of the recognised political party.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Temporary neutrality must remain temporary neutrality.<\/strong><\/p>\n\n\n\n<h2 id=\"h-natural-justice-could-become-an-important-judicial-safeguard\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Natural_Justice_Could_Become_an_Important_Judicial_Safeguard\"><\/span>Natural Justice Could Become an Important Judicial Safeguard<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If I were appearing for the Mamata faction, I would insist upon complete disclosure of the material relied upon by the ECI.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There should be no:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Surprise document \u2192 immediate reliance \u2192 adverse conclusion.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The proper sequence is:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Disclosure<\/strong><\/li>\n\n\n\n<li><strong>Opportunity to respond<\/strong><\/li>\n\n\n\n<li><strong>Hearing<\/strong><\/li>\n\n\n\n<li><strong>Reasoned determination<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">The final order should clearly explain:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Which constitution was treated as operative<\/li>\n\n\n\n<li>Why;<\/li>\n\n\n\n<li>Whether the rival organisational changes were valid;<\/li>\n\n\n\n<li>What organisational evidence was accepted;<\/li>\n\n\n\n<li>What evidence was rejected;<\/li>\n\n\n\n<li>What weight was given to legislative strength<\/li>\n\n\n\n<li>Why one faction was found to constitute the recognised political party.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A reasoned determination is particularly important because the result has consequences not merely for internal party administration but for electoral identity and voter recognition.<\/p>\n\n\n\n<h2 id=\"h-i-would-also-challenge-any-procedural-defect-in-the-interim-order\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"I_Would_Also_Challenge_Any_Procedural_Defect_in_the_Interim_Order\"><\/span>I Would Also Challenge Any Procedural Defect in the Interim Order<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court petition should not attempt to win the entire factual dispute at the interim stage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The more disciplined approach would be to examine whether the ECI:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Considered the relevant material;<\/li>\n\n\n\n<li>Ignored material evidence;<\/li>\n\n\n\n<li>Relied upon material not properly disclosed;<\/li>\n\n\n\n<li>Afforded adequate opportunity to respond;<\/li>\n\n\n\n<li>Gave adequate reasons for its interim conclusions; or<\/li>\n\n\n\n<li>Allowed the urgency of the by-elections to effectively prejudge the merits.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The aim should be to ensure that the interim order does not become a de facto final adjudication.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mamata Banerjee has already approached the Supreme Court challenging the ECI&#8217;s interim order, according to reports published on September 19.<\/p>\n\n\n\n<h2 id=\"h-the-most-powerful-cross-examination-question\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Most_Powerful_Cross-Examination_Question\"><\/span>The Most Powerful Cross-Examination Question<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If I were preparing the case, I would repeatedly return to one question:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>&#8220;Show us the exact constitutional provision and documentary act by which the recognised TMC organisation was lawfully replaced.&#8221;<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Not:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Who is more popular?<\/li>\n\n\n\n<li>Who has more supporters?<\/li>\n\n\n\n<li>Not even: Who has more MLAs?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Those questions may be relevant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the foundational question is:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Who had the legal authority to change the organisation\u2014and where is the evidence of that authority?<\/strong><\/p>\n<\/blockquote>\n\n\n\n<h2 id=\"h-the-defence-i-would-put-before-the-court\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Defence_I_Would_Put_Before_the_Court\"><\/span>The Defence I Would Put Before the Court<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">My submissions would ultimately follow a simple sequence.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>First:<\/strong> Identify the Constitution that governed TMC at the relevant time.<\/li>\n\n\n\n<li><strong>Second:<\/strong> Identify who possessed authority under that Constitution.<\/li>\n\n\n\n<li><strong>Third:<\/strong> Determine whether a valid constitutional act displaced or altered the existing organisation.<\/li>\n\n\n\n<li><strong>Fourth:<\/strong> Examine the membership, delegates, committees and organisational elections.<\/li>\n\n\n\n<li><strong>Fifth:<\/strong> Consider legislative strength as an important but contextual factor.<\/li>\n\n\n\n<li><strong>Sixth:<\/strong> Keep Paragraph 15 and Tenth Schedule questions legally distinct while recognising their factual interaction.<\/li>\n\n\n\n<li><strong>Seventh:<\/strong> Ensure complete procedural fairness and a reasoned ECI determination.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Finally:<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Determine which faction actually constitutes the recognised All India Trinamool Congress.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If that determination favours the continuing organisation represented by Mamata Banerjee, the restoration of the recognised party name and \u201cFlowers &amp; Grass\u201d symbol should follow under the Symbols Order.<\/p>\n\n\n\n<h2 id=\"h-if-i-were-addressing-the-supreme-court\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"If_I_Were_Addressing_the_Supreme_Court\"><\/span>If I Were Addressing the Supreme Court<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I would put the case in language that is simple but legally precise:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>&#8220;My Lords, this is not a dispute about personal ownership of an election symbol. It is a dispute concerning the legal identity of a recognised political organisation.&#8221;<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Then:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>&#8220;The question is not merely which faction presently commands a larger number of legislators. The anterior question is whether the organisation claiming to have displaced the recognised party possessed the constitutional authority to do so.&#8221;<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">And finally:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>&#8220;Legislative strength may be relevant evidence, but it cannot by itself manufacture organisational succession. The Commission must first identify the operative Constitution, the competent authority and the validity of the organisational acts upon which the rival claim rests.&#8221;<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That, in my opinion, is the cleanest legal architecture for the defence.<\/p>\n\n\n\n<h2 id=\"h-a-master-lesson-in-election-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_Master_Lesson_in_Election_Law\"><\/span>A Master Lesson in Election Law<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This dispute provides a fascinating case study in an often-misunderstood area of Indian constitutional and election law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When a recognised political party splits, the legal question is not simply:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Who is the leader?<\/li>\n\n\n\n<li>Who has more legislators?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The deeper question is:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">What is the legal identity of the political organisation, and which competing group can establish its claim to that identity under the applicable constitutional and electoral framework?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That requires lawyers to move beyond political narratives and examine:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Constitution.<\/li>\n\n\n\n<li>Authority.<\/li>\n\n\n\n<li>Membership.<\/li>\n\n\n\n<li>Organisation.<\/li>\n\n\n\n<li>Evidence.<\/li>\n\n\n\n<li>Legislative strength.<\/li>\n\n\n\n<li>Procedure.<\/li>\n\n\n\n<li>Natural justice.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The lesson for every student of constitutional law and election law is equally important:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">In a political-party dispute, numbers can tell us who has support.
