precedents and separation of powers), Chinese legal thought has always cared more about social harmony, public order, morality, duties, group interests, and using law to keep society stable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Today\u2019s Chinese legal thinking is not only about the old philosophy. Since the People\u2019s Republic of China was founded in 1949, and especially after the reform and opening-up started in the late 1970s, China\u2019s legal system has grown a lot. Modern Chinese legal ideas combine Marxist legal theory with Chinese traditions and newer ideas such as the rule of law, constitutional government, protecting rights, managing the economy, and making courts more professional.<\/p>\n\n\n\n<h2 id=\"h-historical-foundations-of-chinese-jurisprudence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Historical_Foundations_of_Chinese_Jurisprudence\"><\/span>Historical Foundations of Chinese Jurisprudence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Chinese legal ideas come from several important ancient schools of thought.<\/p>\n\n\n\n<h3 id=\"h-confucianism\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Confucianism\"><\/span>Confucianism<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Confucius taught that people should behave well, care about others, and keep good relationships. He believed society works best when people learn good morals, not just when they are punished. A person was seen as part of family and community, so duties to family, neighbours and society were very important.<\/p>\n\n\n\n<h3 id=\"h-legalism\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Legalism\"><\/span>Legalism<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Thinkers like Han Feizi had a different view. They wanted clear rules, strong government power, rewards and punishments, and good administration. Legalism helped create the idea that law is a useful tool for the government to control society.<\/p>\n\n\n\n<h3 id=\"h-how-confucianism-and-legalism-worked-together\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_Confucianism_and_Legalism_Worked_Together\"><\/span>How Confucianism and Legalism Worked Together<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Chinese history never used only one or the other. In real life, Chinese rulers mixed moral ideas with formal rules. Confucian morals guided how people should treat each other, while laws helped keep public order.<\/p>\n\n\n\n<h2 id=\"h-marxist-foundations-of-modern-chinese-jurisprudence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Marxist_Foundations_of_Modern_Chinese_Jurisprudence\"><\/span>Marxist Foundations of Modern Chinese Jurisprudence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Modern Chinese legal thinking is strongly shaped by Marxist ideas. Law is seen as connected to the economy, society and politics of the country.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Law is not just a set of abstract rules that exist on their own. It is linked to social relations, economic growth and how state power is organised.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Chinese legal theory therefore looks carefully at the links between:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>law and the state<\/li>\n\n\n\n<li>law and economic development<\/li>\n\n\n\n<li>law and social stability<\/li>\n\n\n\n<li>law and public interests<\/li>\n\n\n\n<li>law and building a socialist society<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, Chinese legal scholars now also study foreign and international legal ideas.<\/p>\n\n\n\n<h2 id=\"h-the-constitution-and-the-legal-order\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Constitution_and_the_Legal_Order\"><\/span>The Constitution and the Legal Order<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Constitution of the People\u2019s Republic of China is the basic foundation of the whole legal system. It sets out the structure of the state, the main government bodies, and the basic rights and duties of citizens.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It says China is a socialist country. All state organs, the army, political parties, social groups, companies and other organisations must follow the Constitution and the law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A big change in modern Chinese legal thinking is the stronger focus on \u201cgoverning the country according to law\u201d and building a socialist rule-of-law system.<\/p>\n\n\n\n<h2 id=\"h-rule-of-law-with-chinese-characteristics\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rule_of_Law_with_Chinese_Characteristics\"><\/span>Rule of Law with Chinese Characteristics<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One key idea in today\u2019s Chinese legal thinking is \u201crule of law with Chinese characteristics&#8221;.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">China does not simply copy the Western liberal model. Instead, it connects the rule of law to its own Constitution, political system, social goals and development needs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The rule of law means:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>governing according to law<\/li>\n\n\n\n<li>respecting legal procedures<\/li>\n\n\n\n<li>building a complete set of laws<\/li>\n\n\n\n<li>making legal institutions more professional<\/li>\n\n\n\n<li>protecting people\u2019s lawful rights<\/li>\n\n\n\n<li>stopping officials from acting arbitrarily<\/li>\n\n\n\n<li>making sure laws are properly enforced<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">So Chinese legal thinking sees law both as a way to protect rights and as a tool for good government.<\/p>\n\n\n\n<h2 id=\"h-the-role-of-the-state-in-chinese-jurisprudence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Role_of_the_State_in_Chinese_Jurisprudence\"><\/span>The Role of the State in Chinese Jurisprudence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The state plays a very important role in Chinese legal thinking.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The state:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>makes and carries out laws<\/li>\n\n\n\n<li>regulates the economy<\/li>\n\n\n\n<li>keeps public order<\/li>\n\n\n\n<li>promotes social development<\/li>\n\n\n\n<li>protects national interests<\/li>\n\n\n\n<li>carries out long-term public policies<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Because of this, Chinese legal thought pays more attention to the balance between individual rights and group or public interests than theories that put the individual first.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This does not mean individual rights are missing. Rights are simply understood inside the larger framework of the Chinese Constitution and laws.<\/p>\n\n\n\n<h2 id=\"h-individual-rights-and-social-responsibilities\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Individual_Rights_and_Social_Responsibilities\"><\/span>Individual Rights and Social Responsibilities<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Modern Chinese law recognises many civil, political, economic, social and cultural rights. The Constitution talks about equality, personal freedom, property, education, work and other lawful rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, it also stresses duties. Citizens must follow the Constitution and laws and protect national interests and social order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A special feature of Chinese legal thinking is that rights and responsibilities are seen as connected, not completely separate.<\/p>\n\n\n\n<h2 id=\"h-law-as-an-instrument-of-social-development\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Law_as_an_Instrument_of_Social_Development\"><\/span>Law as an Instrument of Social Development<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Chinese legal thinking strongly sees law as a tool for social development. Law is not only used to settle disputes after they happen. It is also used to guide the economy and society.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This can be seen clearly in areas such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>economic regulation<\/li>\n\n\n\n<li>environmental protection<\/li>\n\n\n\n<li>technology<\/li>\n\n\n\n<li>digital governance<\/li>\n\n\n\n<li>intellectual property<\/li>\n\n\n\n<li>market rules<\/li>\n\n\n\n<li>public administration<\/li>\n\n\n\n<li>social welfare<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Law is one of the main ways the state responds to changing economic and social conditions.<\/p>\n\n\n\n<h2 id=\"h-economic-reform-and-the-development-of-chinese-legal-thought\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Economic_Reform_and_the_Development_of_Chinese_Legal_Thought\"><\/span>Economic Reform and the Development of Chinese Legal Thought<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">China\u2019s economic reforms that started in the late 1970s greatly changed its legal system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Building a socialist market economy needed better rules for contracts, companies, property, investment, competition, finance and commercial disputes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This led to many new civil and commercial laws and more professional lawyers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Civil Code of the People\u2019s Republic of China (which came into force in 2021) is a major step. It brought together important areas of private law: personality rights, property, contracts, marriage and family, inheritance and tort liability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This shows that Chinese legal thinking now gives more importance to legal certainty, private rights, contracts and civil responsibility inside a socialist market economy.<\/p>\n\n\n\n<h2 id=\"h-judicial-institutions-and-chinese-jurisprudence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Judicial_Institutions_and_Chinese_Jurisprudence\"><\/span>Judicial Institutions and Chinese Jurisprudence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The People\u2019s Courts are China\u2019s judicial organs. The Supreme People\u2019s Court is the highest court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Chinese courts:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>interpret and apply the law<\/li>\n\n\n\n<li>settle civil, criminal and administrative disputes<\/li>\n\n\n\n<li>protect lawful rights<\/li>\n\n\n\n<li>keep legal order<\/li>\n\n\n\n<li>help make the application of law more uniform<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">China does not follow the common-law rule of <em>stare decisis<\/em> (binding precedents) in the same way as England, Australia or India.
