An election is not one event. It is a chain\u2014or, more accurately, a graph.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Voter eligibility connects to the electoral roll. The roll connects to the polling station. The polling station connects to the machine. The machine connects to custody. Custody connects to counting. Counting connects to the result. The result connects to the election petition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The real constitutional safeguard is therefore not merely independence at one point in the chain. It is the existence of independent breaks, records, and verification points between successive stages.<\/p>\n\n\n\n<h2 id=\"h-the-constitutional-foundation-article-324-is-powerful-but-not-unlimited\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Constitutional_Foundation_Article_324_Is_Powerful_But_Not_Unlimited\"><\/span>The Constitutional Foundation: Article 324 Is Powerful, But Not Unlimited<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Article 324 of the Constitution vests the Election Commission of India with the superintendence, direction, and control of elections to Parliament, State Legislatures, and the offices of President and Vice-President. Parliament has also enacted legislation governing elections and the institutional structure of the Commission.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The present statutory appointment framework is contained in the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service, and Term of Office) Act, 2023. The Act contains separate provisions dealing with the Search Committee, Selection Committee, appointment, tenure, removal, and service conditions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But Article 324 contains another important feature. That would turn the Constitution into an election manual.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The better question is<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Which protections are so fundamental to electoral independence that they deserve constitutional protection, and which should remain flexible statutory safeguards?<\/strong><\/p>\n\n\n\n<h2 id=\"h-stop-thinking-of-elections-as-a-chain-think-of-them-as-a-graph\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Stop_Thinking_of_Elections_as_a_Chain_Think_of_Them_as_a_Graph\"><\/span>Stop Thinking of Elections as a Chain: Think of Them as a Graph<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A conventional description of an election looks like this:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Roll \u2192 Poll \u2192 Count \u2192 Result.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is too simple.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A more realistic model is<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Stage<\/th><th>Critical two-stage randomization, first-level checking, candidate\/party participation at specified stages, strong-room procedures, and Form 17C and VVPAT verification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The point of reform is therefore not to pretend that these mechanisms do not exist.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The better question is<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Which of these controls are genuinely independent, and which merely produce several documents from the same institutional source?<\/strong><\/p>\n\n\n\n<h2 id=\"h-the-visible-break-principle\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Visible-Break_Principle\"><\/span>The Visible-Break Principle<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The proposed principle is deliberately modest:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>No critical electoral action capable of changing who may vote, how a vote is recorded, how a machine is held, how a count is made or how a result is certified should rest upon the unilateral and unrecorded discretion of one political or administrative actor.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">This principle contains four basic tests:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Separation\u2014Is the decision separated from its verification?<\/li>\n\n\n\n<li>Visibility\u2014Does the action create a contemporaneous record?<\/li>\n\n\n\n<li>Verification\u2014Can another source test that record?<\/li>\n\n\n\n<li>Challenge\u2014Is there a legally meaningful mechanism to challenge the result?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">There is, however, a fifth test that emerged from the deeper analysis:<\/p>\n\n\n\n<h3 id=\"h-the-independent-record-test\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Independent-Record_Test\"><\/span>The Independent-Record Test<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Can the same actor manufacture both the event and the evidence used to prove that the event occurred?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This question is surprisingly powerful.<\/p>\n\n\n\n<h2 id=\"h-the-single-scribe-problem-five-documents-may-still-be-one-witness\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Single-Scribe_Problem_Five_Documents_May_Still_Be_One_Witness\"><\/span>The Single-Scribe Problem: Five Documents May Still Be One Witness<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose a presiding officer and his team create:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the polling-station diary;<\/li>\n\n\n\n<li>Form 17A records;<\/li>\n\n\n\n<li>Form 17C Part I;<\/li>\n\n\n\n<li>seal and paper accounts; and<\/li>\n\n\n\n<li>other polling-station records.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Five documents may appear to be five safeguards.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But if the same operational team creates all five, they are not five independent witnesses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They may simply be five versions of the same story.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is what may be called the <strong>Single-Scribe Problem<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The problem can appear again at the counting stage. If the Returning Officer alone reads the Control Unit, records the result, and prepares the corresponding forms, several documents can again originate from one source.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This does not mean that these officers are dishonest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is precisely the point.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A good institutional design should not require the law to assume dishonesty before it creates independent evidence.<\/strong><\/p>\n\n\n\n<h2 id=\"h-form-17c-from-administrative-form-to-evidentiary-anchor\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Form_17C_From_Administrative_Form_to_Evidentiary_Anchor\"><\/span>Form 17C: From Administrative Form to Evidentiary Anchor<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Form 17C is particularly interesting because it sits between polling and counting.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Election Commission explains that Part I records the account of votes recorded and includes information concerning voters and votes recorded, while Part II relates to the result of counting. Copies of Form 17C are provided to polling agents present at the close of the poll.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That makes Form 17C more than a routine form.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It can become an audit anchor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The proposed reform would connect:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Polling station<\/li>\n\n\n\n<li>Form 17C Part I<\/li>\n\n\n\n<li>Machine identity<\/li>\n\n\n\n<li>Custody<\/li>\n\n\n\n<li>Control Unit result<\/li>\n\n\n\n<li>Form 17C Part II<\/li>\n\n\n\n<li>Form 20<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If there is an unexplained discrepancy, the discrepancy itself should become a recorded fact rather than disappearing into administrative correspondence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is a subtle but important shift in the philosophy of election reform in India:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Do not merely create another authority. Create continuity of evidence.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<h2 id=\"h-evm-and-vvpat-the-question-is-not-simply-can-a-machine-be-trusted\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"EVM_and_VVPAT_The_Question_Is_Not_Simply_%E2%80%9CCan_a_Machine_Be_Trusted%E2%80%9D\"><\/span>EVM and VVPAT: The Question Is Not Simply \u201cCan a Machine Be Trusted?\u201d<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The ECI currently describes EVM management as involving procedures such as first-level checking, randomization, commissioning, mock polls, custody safeguards, and VVPAT verification. Its current material states that mandatory VVPAT verification applies to five randomly selected polling stations per Assembly Constituency or Assembly Segment in a parliamentary constituency election, with additional mechanisms in specified circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That existing architecture should be acknowledged before proposing new safeguards.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But a sophisticated legal analysis asks a different question:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What exactly does each verification prove?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A firmware hash can prove that a particular file has a particular fingerprint.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It does not, by itself, establish every fact about what software ultimately executed on every physical unit throughout the election.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Similarly, a VVPAT sample can provide important statistical and evidentiary verification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But a sample is still a sample.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Form 17C can establish consistency between records.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But consistency does not automatically establish that the underlying software or physical process was honest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction should not be misunderstood as a claim that EVMs are compromised. It is a systems-design question.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The correct question is<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>If a sophisticated technical failure existed, what independent evidence would expose it?<\/strong><\/p>\n<\/blockquote>\n\n\n\n<h2 id=\"h-the-power-of-time-separated-evidence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Power_of_Time-Separated_Evidence\"><\/span>The Power of Time-Separated Evidence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the most interesting lessons from the stress test is that independence does not always require another institution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sometimes time itself creates evidentiary independence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consider a machine identity record created and distributed before the machine enters later custody.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Later, someone cannot simply change the machine&#8217;s identity without creating a conflict with the earlier record.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The same principle applies to physical VVPAT evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The VVPAT slip is generated at the moment of voting. It is therefore not merely another statement written later by the returning officer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This suggests a general rule:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>The actor being tested should not be the sole author of the evidence used to test that actor.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<h2 id=\"h-article-324-6-the-field-force-nobody-should-pretend-belongs-to-the-commission\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Article_3246_The_Field_Force_Nobody_Should_Pretend_Belongs_to_the_Commission\"><\/span>Article 324(6): The Field Force Nobody Should Pretend Belongs to the Commission<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the most uncomfortable institutional facts is that the Election Commission does not operate every polling station through a permanent independent election cadre.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article 324(6) provides the constitutional mechanism by which the President or Governor makes staff available to the Commission when requested.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This creates a structural distinction between:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>superintendence over an election<\/li>\n\n\n\n<li>and<\/li>\n\n\n\n<li>permanent ownership of every person implementing that election.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A realistic reform should not pretend that Article 324(6) can simply be wished away by statute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A more modest approach is visibility:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>written requests for staff;<\/li>\n\n\n\n<li>written reasons for non-supply;<\/li>\n\n\n\n<li>communication to the governor where appropriate;<\/li>\n\n\n\n<li>aggregate compliance reporting after the election; and<\/li>\n\n\n\n<li>disclosure in the Commission&#8217;s report laid before Parliament.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This does not create an independent field force.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It does something more realistic:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>It makes failure to provide the field machinery visible.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<h2 id=\"h-the-constitutional-master-key-ordinary-repeal\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Constitutional_%E2%80%9CMaster_Key%E2%80%9D_Ordinary_Repeal\"><\/span>The Constitutional \u201cMaster Key\u201d: Ordinary Repeal<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is another lesson that lawyers and law students should not overlook.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose Parliament enacts a detailed statutory architecture containing:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>appointment safeguards;<\/li>\n\n\n\n<li>roll-in inspection triggers;<\/li>\n\n\n\n<li>machine-identity requirements;<\/li>\n\n\n\n<li>VVPAT floors;<\/li>\n\n\n\n<li>Form 17C reconciliation;<\/li>\n\n\n\n<li>custody requirements; and<\/li>\n\n\n\n<li>technical audit duties.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If these protections are all ordinary statutory provisions, a later Parliament can generally amend or repeal them through the ordinary legislative process, subject of course to constitutional limitations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is not a drafting defect.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is a consequence of the constitutional allocation of legislative power.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, a serious proposal for election reform in India should resist the temptation to constitutionalize every operational safeguard.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The more disciplined approach is to constitutionalize only the institutional independence that genuinely requires constitutional protection\u2014for example, the appointment and removal architecture\u2014while leaving technical and evidentiary safeguards to ordinary legislation.<\/p>\n\n\n\n<h2 id=\"h-why-a-list-of-reserved-matters-is-not-enough\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_a_List_of_Reserved_Matters_Is_Not_Enough\"><\/span>Why a List of Reserved Matters Is Not Enough<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose legislation says that the Commission cannot reduce a particular safeguard except through a special procedure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Could the same result be achieved indirectly?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Possibly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A circular might change the technical specification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A procurement decision might narrow the available suppliers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A scheduling decision might make meaningful observation practically impossible.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A delegation might move a decision into an apparently ordinary administrative category.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A secrecy classification might prevent meaningful external verification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is why a serious statutory design needs a functional anti-circumvention rule:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>No rule, notification, circular, technical specification, administrative direction, delegation, or procurement decision should have the effect of reducing a safeguard expressly fixed by the Act.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The purpose is not to prevent the Commission from administering elections.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The purpose is to prevent an administrative instrument from doing indirectly what the statute prohibits directly.<\/p>\n\n\n\n<h2 id=\"h-article-329-the-hard-reality-of-electoral-finality\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Article_329_The_Hard_Reality_of_Electoral_Finality\"><\/span>Article 329: The Hard Reality of Electoral Finality<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is another constitutional reality that reformers sometimes overlook.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Election disputes are not ordinary administrative disputes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article 329 channels challenges to elections through the election-petition framework established by law. The Representation of the People Act, 1951, provides the statutory framework for election petitions, including the filing provision and appellate mechanism.
