Government of Karnataka, 2026 INSC 1030, is one such case.<\/p>\n\n\n\n<h2 id=\"h-supreme-court-orders-a-de-novo-investigation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Supreme_Court_Orders_a_De_Novo_Investigation\"><\/span>Supreme Court Orders a De Novo Investigation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Court has directed a de novo investigation into the 2012 rape and murder of a 17-year-old girl in Karnataka.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court directed the State to constitute a fresh Special Investigation Team comprising investigators familiar with modern investigative technology, headed by a senior police officer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Importantly, officers who were associated with the earlier investigations by the local police, CID, or CBI are not to be part of the new SIT.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court has also directed that the investigation be completed within three months.<\/p>\n\n\n\n<h2 id=\"h-protection-for-the-acquitted-accused\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Protection_For_The_Acquitted_Accused\"><\/span>Protection For The Acquitted Accused<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">But there is another equally important part of the judgment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The man who had been prosecuted for the crime, Santhosh Rao, was acquitted in 2023.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has specifically protected him from being subjected to further investigation or prosecution in relation to that offense, invoking Article 20(2) of the Constitution and Section 300 CrPC.<\/p>\n\n\n\n<h2 id=\"h-what-a-genuine-fresh-investigation-should-look-like\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_a_Genuine_Fresh_Investigation_Should_Look_Like\"><\/span>What a Genuine Fresh Investigation Should Look Like<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">That tells us something important about what a genuine fresh investigation should look like.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is not about finding somebody else to blame.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is about finding out what actually happened.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If I were advising the victim&#8217;s family, I would start with one rule.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would tell the family something that may not always be easy to hear:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Do not start by asking who should be arrested. Start by asking what the evidence actually says.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction becomes extremely important after fourteen years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The family understandably wants justice. They may have their own understanding of what happened and may have reasons to suspect particular individuals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But a lawyer handling a case of this nature has to be more disciplined than that.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The investigation cannot begin with a conclusion and then search for evidence to support it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It must begin with the evidence and follow it wherever it leads.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court itself has been careful on this point. While directing a fresh investigation, it expressly stated that nothing in its judgment should be understood as even a prima facie opinion about the role of particular individuals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is exactly how a fresh investigation should proceed.<\/p>\n\n\n\n<h2 id=\"h-the-first-battle-is-not-in-court-it-is-over-the-evidence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_First_Battle_Is_Not_in_Court_It_Is_Over_the_Evidence\"><\/span>The First Battle Is Not in Court. It Is Over the Evidence.<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If I were appearing for the victim&#8217;s family, my first instruction to the SIT would be very simple:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Secure everything that still exists.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before questioning dozens of people, before holding press conferences, before announcing theories, I would want a complete inventory of the surviving evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That means:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>every material object still in police custody;<\/li>\n\n\n\n<li>clothing and other physical exhibits;<\/li>\n\n\n\n<li>biological samples;<\/li>\n\n\n\n<li>DNA material;<\/li>\n\n\n\n<li>forensic reports;<\/li>\n\n\n\n<li>photographs;<\/li>\n\n\n\n<li>post-mortem records;<\/li>\n\n\n\n<li>inquest papers;<\/li>\n\n\n\n<li>call-detail records, if still available;<\/li>\n\n\n\n<li>electronic records;<\/li>\n\n\n\n<li>statements of witnesses;<\/li>\n\n\n\n<li>previous case diaries;<\/li>\n\n\n\n<li>mahazars and seizure records;<\/li>\n\n\n\n<li>photographs and videos;<\/li>\n\n\n\n<li>location information;<\/li>\n\n\n\n<li>earlier forensic correspondence;<\/li>\n\n\n\n<li>records relating to persons who were examined but not properly followed up.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The reason is obvious.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A fresh investigation cannot be allowed to become merely another round of interviews.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It has to be an <strong>evidence reconstruction exercise<\/strong>.<\/p>\n\n\n\n<h2 id=\"h-fourteen-years-later-forensic-evidence-becomes-extremely-important\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Fourteen_Years_Later_Forensic_Evidence_Becomes_Extremely_Important\"><\/span>Fourteen Years Later, Forensic Evidence Becomes Extremely Important<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the most interesting aspects of the Supreme Court&#8217;s judgment is its treatment of the argument that the important forensic window had already been lost.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The High Court had taken the view that evidence that was not collected during the &#8220;golden hour&#8221; might no longer be available and that a fresh investigation might therefore serve little purpose.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court disagreed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judgment records the evidence of the DNA expert, who stated that hairs found on a material object could potentially still be matched against samples obtained from persons investigated in the case. The Supreme Court consequently found the High Court&#8217;s assumption about the absence of usable evidence to be erroneous.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This does not mean that modern forensic science can magically reconstruct everything after fourteen years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It cannot.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">DNA evidence can deteriorate. Samples can become contaminated. Chain of custody can become difficult to establish. Some evidence may simply have been lost forever.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the correct legal question is not<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>&#8220;Is all the old evidence still available?&#8221;<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The correct question is<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&#8220;What evidence is still available, and what can modern science reliably tell us from it?&#8221;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is a very different approach.<\/p>\n\n\n\n<h2 id=\"h-i-would-reconstruct-the-victim-s-last-known-hours\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"I_Would_Reconstruct_the_Victims_Last_Known_Hours\"><\/span>I Would Reconstruct the Victim&#8217;s Last Known Hours<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In a case like this, the victim&#8217;s last few hours become the center of the investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would want the SIT to construct a minute-by-minute timeline as far as the evidence permits.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where was she?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Who saw her?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Who spoke to her?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What route did she take?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What vehicles were in the area?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Which phones were active?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Which persons were present?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What changed between the last confirmed sighting and the discovery of the body?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Were there witnesses whose statements were previously ignored?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Were there people who had information but were never examined properly?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Were CCTV recordings available at the relevant time?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Were mobile-phone records obtained and analyzed?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Were all possible routes to and from the scene examined?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A timeline often exposes something that a conventional charge sheet can hide.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A criminal investigation is not just a collection of statements. It is an attempt to reconstruct an event that happened in the past.<\/p>\n\n\n\n<h2 id=\"h-the-earlier-investigation-must-also-be-investigated\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Earlier_Investigation_Must_Also_Be_Investigated\"><\/span>The Earlier Investigation Must Also Be Investigated<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is where I would spend considerable time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s judgment records serious concerns regarding the earlier investigation. The case had passed through investigations by the Belthangady Police, the Karnataka CID, and the CBI, yet the prosecution ultimately failed to establish the case against Santhosh Rao, who was acquitted in 2023.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The new SIT, therefore, should not simply take the previous case file and start from page one.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It should conduct an <strong>investigative audit<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For every significant piece of evidence, the SIT should ask:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What was known?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>When was it known?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Who knew it?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What did the investigating officer do with that information?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>If nothing was done, why not?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That exercise can be uncomfortable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But if an important witness came forward and was never examined, that matters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a forensic opportunity was missed, that matters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a material object was improperly preserved, that matters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a line of investigation was abandoned without explanation, that matters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The purpose is not to punish the previous investigators.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The purpose is to understand why the earlier investigation failed and ensure that the same mistake is not repeated.<\/p>\n\n\n\n<h2 id=\"h-the-witnesses-who-were-missed-may-now-matter-more-than-ever\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Witnesses_Who_Were_Missed_May_Now_Matter_More_Than_Ever\"><\/span>The Witnesses Who Were Missed May Now Matter More Than Ever<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One particularly striking fact recorded in the Supreme Court judgment is that potential witnesses could still be located.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court had earlier directed protection for eight potential witnesses identified by the petitioner. The state was able to locate them within three weeks. The Supreme Court observed that this raised questions about why earlier investigating agencies had been unable to examine such leads when the information was timely.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is a significant investigative lesson.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A witness does not become irrelevant merely because an earlier investigating officer failed to follow up.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a person had information capable of advancing the investigation, that person should now be examined properly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But I would also be extremely careful here.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After fourteen years, witness memory is vulnerable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A witness may unconsciously incorporate information learned later.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">People may discuss the case among themselves.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Media reports may influence recollection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some witnesses may have personal interests.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, every new statement would need to be compared with:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>earlier statements;<\/li>\n\n\n\n<li>contemporaneous documents;<\/li>\n\n\n\n<li>call records;<\/li>\n\n\n\n<li>location evidence;<\/li>\n\n\n\n<li>forensic material; and<\/li>\n\n\n\n<li>other objective evidence.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The SIT should not simply ask, <em>&#8220;What does this witness say today?&#8221;<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It should ask:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&#8220;What part of this witness&#8217;s account can independently be verified?&#8221;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is the difference between investigation and storytelling.<\/p>\n\n\n\n<h2 id=\"h-the-acquitted-man-must-not-become-the-shortcut\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Acquitted_Man_Must_Not_Become_the_Shortcut\"><\/span>The Acquitted Man Must Not Become the Shortcut<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is another constitutional line that the new investigation cannot cross.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Santhosh Rao was tried and acquitted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has expressly held that he cannot be subjected to further investigation or prosecution in relation to this offense because of the protection flowing from Article 20(2) and Section 300 CrPC.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That protection must be respected completely.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is important because a fresh investigation can sometimes create an unconscious temptation:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>&#8220;If the old prosecution failed, perhaps we should simply find new evidence against the same person.&#8221;<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is not the route available here.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The new investigation has to look at the crime independently.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The fact that one person was previously prosecuted does not answer the larger question of who actually committed the offense.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But equally, the constitutional protection of an acquitted person cannot be diluted merely because the original investigation was defective.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Both propositions can exist together.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The investigation can be reopened without reopening the acquittal.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is one of the most important legal features of this judgment.<\/p>\n\n\n\n<h2 id=\"h-what-does-article-21-have-to-do-with-investigation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Does_Article_21_Have_to_Do_With_Investigation\"><\/span>What Does Article 21 Have to Do With Investigation?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A common misconception is that constitutional protection becomes relevant only after the accused enters the courtroom.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has repeatedly recognized that the fairness of criminal justice begins much earlier.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court in this case reiterated that <strong>a fair investigation is part of the constitutional guarantee under Article 21<\/strong>. It relied upon earlier authorities, including <em>Zahira Habibulla Sheikh<\/em> and <em>Neetu Kumar Nagaich<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That principle has a practical consequence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An investigation is not legally acceptable simply because a police report was eventually filed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The question is whether the investigation was fair, objective, and capable of producing a reliable prosecution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the investigative process itself is seriously compromised, the resulting prosecution may also be compromised.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is why constitutional courts retain the power, in exceptional circumstances, to intervene.<\/p>\n\n\n\n<h2 id=\"h-but-the-supreme-court-should-not-become-the-investigating-officer\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"But_the_Supreme_Court_Should_Not_Become_the_Investigating_Officer\"><\/span>But the Supreme Court Should Not Become the Investigating Officer<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is where judicial restraint becomes important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If I were arguing the case, I would not ask the Supreme Court to determine who committed the crime.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is not the court&#8217;s institutional role.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would ask the court to ensure that the investigation is:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>independent;<\/li>\n\n\n\n<li>fair;<\/li>\n\n\n\n<li>scientifically sound;<\/li>\n\n\n\n<li>free from predetermined conclusions;<\/li>\n\n\n\n<li>properly supervised where necessary; and<\/li>\n\n\n\n<li>completed within the framework of law.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The actual collection of evidence belongs to investigators.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The decision on whether the evidence is sufficient to prosecute belongs to the prosecuting machinery and ultimately the trial court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s role is to ensure that the machinery of justice has not itself become the obstacle to justice.<\/p>\n\n\n\n<h2 id=\"h-my-90-day-roadmap-would-look-something-like-this\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"My_90-Day_Roadmap_Would_Look_Something_Like_This\"><\/span>My 90-Day Roadmap Would Look Something Like This<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has given the SIT three months to complete the fresh investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If I were advising the legal team assisting the family, I would divide those ninety days into stages.<\/p>\n\n\n\n<h3 id=\"h-first-7-days-preserve-everything\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"First_7_Days_Preserve_Everything\"><\/span>First 7 Days: Preserve Everything<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The SIT should immediately secure and catalogue all surviving physical, documentary, digital, and forensic evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nothing should be discarded merely because it appears old.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Every item should have a documented chain of custody.<\/p>\n\n\n\n<h3 id=\"h-days-8-30-reconstruct-the-case\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Days_8%E2%80%9330_Reconstruct_the_Case\"><\/span>Days 8\u201330: Reconstruct the Case<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Build the complete chronology.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Read every earlier statement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Identify contradictions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Identify witnesses who were ignored.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Identify investigative steps that were never taken.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Map the victim&#8217;s movements and the relevant persons, places, and communications.<\/p>\n\n\n\n<h3 id=\"h-days-31-60-scientific-and-independent-verification\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Days_31%E2%80%9360_Scientific_and_Independent_Verification\"><\/span>Days 31\u201360: Scientific and Independent Verification<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Where surviving material permits, conduct forensic testing using contemporary scientific methods.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But every forensic result
