How can the award be enforced and the money recovered in India?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is where the law relating to the enforcement of foreign arbitral awards in India becomes commercially important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India has a statutory framework for recognizing and enforcing foreign arbitral awards under Part II, Chapter I of the Arbitration and Conciliation Act, 1996. The framework is built around the New York Convention and reflects a generally pro-enforcement approach. At the same time, enforcement is not automatic. The award must satisfy the statutory requirements, and the award debtor can resist enforcement on the limited grounds recognized by Section 48.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A recent judgment of the Delhi High Court has provided an important illustration of how these principles operate in practice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On 1 July 2026, Justice Jasmeet Singh of the Delhi High Court delivered judgment in <em>Vedanta Limited &amp; Anr. v. Government of India through Joint Secretary, Ministry of Petroleum &amp; Natural Gas<\/em>, O.M.P.(EFA)(COMM.) 5\/2017. The Court allowed enforcement of the foreign arbitral awards and rejected the objections raised by the Government under Section 48 of the Arbitration and Conciliation Act, 1996.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The decision is particularly relevant to foreign companies, multinational corporations, international investors, lenders, funds, and other award creditors seeking to recover amounts from parties whose assets or commercial interests are located in India.<\/p>\n\n\n\n<h2 id=\"h-the-commercial-reality-winning-the-award-is-only-half-the-battle\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Commercial_Reality_Winning_the_Award_Is_Only_Half_the_Battle\"><\/span>The Commercial Reality: Winning the Award Is Only Half the Battle<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A foreign company may spend years resolving an international commercial dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It may have:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>negotiated a contract with an Indian company;<\/li>\n\n\n\n<li>commenced arbitration outside India;<\/li>\n\n\n\n<li>obtained a favorable arbitral award;<\/li>\n\n\n\n<li>successfully defended the award against challenges at the seat of arbitration; and<\/li>\n\n\n\n<li>still face the practical problem that the award debtor has not paid.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The debtor may have substantial assets in India.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those assets could include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>immovable property;<\/li>\n\n\n\n<li>receivables;<\/li>\n\n\n\n<li>shares;<\/li>\n\n\n\n<li>securities;<\/li>\n\n\n\n<li>bank-related assets, where legally attachable;<\/li>\n\n\n\n<li>commercial interests;<\/li>\n\n\n\n<li>contractual receivables;<\/li>\n\n\n\n<li>business assets; or<\/li>\n\n\n\n<li>other property belonging to the judgment debtor.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The commercial objective then changes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is no longer simply<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&#8220;Have we won the arbitration?&#8221;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It becomes:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&#8220;How do we convert the foreign arbitral award into actual recovery in India?&#8221;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That requires a carefully planned Indian enforcement strategy.<\/p>\n\n\n\n<h2 id=\"h-the-2026-vedanta-judgment-why-it-matters\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_2026_Vedanta_Judgment_Why_It_Matters\"><\/span>The 2026 Vedanta Judgment: Why It Matters<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Delhi High Court&#8217;s 1 July 2026 judgment arose from a long-running dispute concerning the Ravva oil field and a Production Sharing Contract dated 28 October 1994.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The petitioners, Vedanta Limited and Ravva Oil (Singapore) Pte. Ltd., sought enforcement of a Partial Award dated 12 October 2004 and a Final Award dated 26 October 2016.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The arbitration had its venue in Kuala Lumpur, Malaysia.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The dispute concerned the interpretation and application of the Production Sharing Contract, including issues relating to the calculation of the post-tax rate of return and the treatment of amounts connected with ONGC&#8217;s &#8220;carry&#8221; obligations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Government of India opposed enforcement and raised objections under Section 48.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Among the issues raised were<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>limitation;<\/li>\n\n\n\n<li>public policy;<\/li>\n\n\n\n<li>the doctrine of public trusteeship;<\/li>\n\n\n\n<li>alleged loss to the public exchequer;<\/li>\n\n\n\n<li>the interpretation of the Production Sharing Contract;<\/li>\n\n\n\n<li>alleged excess of jurisdiction;<\/li>\n\n\n\n<li>the tribunal&#8217;s mandate;<\/li>\n\n\n\n<li>whether the tribunal had become <em>functus officio<\/em>; and<\/li>\n\n\n\n<li>whether the Final Award travelled beyond the matters submitted to arbitration.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Delhi High Court rejected those objections.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court held that the objections were without substance and allowed the enforcement petition. It also directed release of the bank guarantees furnished by the petitioners within eight weeks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The importance of the judgment, however, goes beyond the particular Ravva dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It demonstrates how an Indian court approaches a foreign award when the losing party attempts to resist enforcement by reopening matters that were already considered by the arbitral tribunal or courts at the seat.<\/p>\n\n\n\n<h2 id=\"h-what-is-a-foreign-arbitral-award-under-indian-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Is_a_Foreign_Arbitral_Award_Under_Indian_Law\"><\/span>What Is a Foreign Arbitral Award Under Indian Law?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The first question in any enforcement strategy should be<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Does the award qualify as a &#8220;foreign award&#8221; under Indian law?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The answer cannot be assumed merely because one of the parties is incorporated outside India.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 44 of the Arbitration and Conciliation Act, 1996, provides the statutory gateway for foreign awards covered by the New York Convention framework.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Broadly, the award must arise from a commercial legal relationship, be made pursuant to a written arbitration agreement to which the Convention applies, and be made in a territory recognized under the statutory framework.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The seat of arbitration is therefore critically important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nationality of the parties alone is not the determining test.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s decision in <em>PASL Wind Solutions (P) Ltd. v. GE Power Conversion India (P) Ltd.<\/em>, (2021) 7 SCC 1, is particularly important in this regard. The Supreme Court recognized that parties can choose a foreign seat and that the resulting award can qualify as a foreign award even where the parties themselves are Indian entities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The converse is equally important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A foreign company participating in an India-seated arbitration does not automatically produce a foreign award.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Getting this classification wrong at the beginning can lead to the wrong enforcement strategy.<\/p>\n\n\n\n<h2 id=\"h-the-first-legal-assessment-for-a-foreign-award-creditor\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_First_Legal_Assessment_for_a_Foreign_Award_Creditor\"><\/span>The First Legal Assessment for a Foreign Award Creditor<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Before approaching an Indian court, an award creditor should establish at least the following:<\/p>\n\n\n\n<h3 id=\"h-1-where-was-the-arbitration-seated\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"1_Where_Was_the_Arbitration_Seated\"><\/span>1. Was There a Valid Written Arbitration Agreement?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The arbitration agreement is the foundation of the award.<\/p>\n\n\n\n<h3 id=\"h-3-has-the-award-become-binding\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3_Has_the_Award_Become_Binding\"><\/span>3. Has the Award Become Binding?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The status of the award under the law governing the arbitration must be established.<\/p>\n\n\n\n<h3 id=\"h-4-has-the-award-been-challenged-at-the-seat\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"4_Has_the_Award_Been_Challenged_at_the_Seat\"><\/span>4. Has the Award Been Challenged at the Seat?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If proceedings have taken place before the courts of the seat, their outcome must be examined.<\/p>\n\n\n\n<h3 id=\"h-5-has-the-award-been-set-aside-or-suspended\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"5_Has_the_Award_Been_Set_Aside_or_Suspended\"><\/span>5.
