If the victim dies, the financial consequences can be even more devastating for the family.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is where the law relating to Motor Accident Claims Tribunals (MACT) becomes important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The object of motor accident compensation is not to put an arbitrary price on a human life or injury. Nor is it to provide a windfall. The statutory objective is to award &#8220;just compensation&#8221;\u2014compensation that is fair, evidence-based, and sufficiently comprehensive to address the losses caused by the accident.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Over the years, the Supreme Court has transformed this area of law from a largely discretionary exercise into a considerably more structured system. Sarla Verma v. Delhi Transport Corporation brought greater consistency to the multiplier and deduction methodology. Raj Kumar v. Ajay Kumar explained how permanent disability must be translated into actual loss of earning capacity. Pranay Sethi standardized future prospects and conventional heads in fatal accident claims. Magma General Insurance and later decisions developed the law of consortium.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">More recent Supreme Court decisions have continued to refine the principles, including the treatment of functional disability, future medical expenses, collateral benefits, and the prohibition against double recovery.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The result is a body of law in which the facts of the individual claimant remain crucial, but the methodology is increasingly settled.<\/p>\n\n\n\n<h2 id=\"h-what-is-a-motor-accident-claim\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Is_a_Motor_Accident_Claim\"><\/span>What Is a Motor Accident Claim?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A motor accident claim is a claim for compensation arising from death, bodily injury or, where applicable, property damage resulting from the use of a motor vehicle.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The principal statutory framework is contained in the Motor Vehicles Act, 1988.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Act provides for Claims Tribunals under Section 165 and empowers them under Section 168 to determine the amount of compensation that appears to be &#8220;just.&#8221; Careers develop. Businesses grow. and<\/li>\n\n\n\n<li>other medically necessary treatment.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">But future medical expenses require a proper evidentiary foundation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The claimant should ideally place before the Tribunal medical evidence explaining:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What further treatment is required<\/li>\n\n\n\n<li>whether another surgery is likely;<\/li>\n\n\n\n<li>whether prosthetic replacement will be required;<\/li>\n\n\n\n<li>the expected cost;<\/li>\n\n\n\n<li>the expected duration of treatment; and<\/li>\n\n\n\n<li>whether continuing medical supervision will be necessary.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-attendant-charges-can-be-substantial\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Attendant_Charges_Can_Be_Substantial\"><\/span>Attendant Charges Can Be Substantial<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A severely disabled claimant may require assistance not merely during hospitalization but for years afterwards.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In appropriate cases, compensation can therefore be awarded for attendant services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has recognized attendant charges as a legitimate component of personal-injury compensation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A 2025 Supreme Court decision, for example, included substantial attendant charges in the computation of compensation for a claimant with severe disability, alongside medical expenses, future medical expenditure, pain and suffering, and loss of income.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The practical significance is obvious: an award that pays the hospital bill but ignores the continuing cost of care may fail to address the real consequences of the injury.<\/p>\n\n\n\n<h3 id=\"h-pain-and-suffering-cannot-be-reduced-to-a-salary-calculation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Pain_and_Suffering_Cannot_Be_Reduced_to_a_Salary_Calculation\"><\/span>Pain and Suffering Cannot Be Reduced to a Salary Calculation<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Not every loss caused by an accident appears in a bank statement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A victim may suffer:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>prolonged physical pain;<\/li>\n\n\n\n<li>repeated surgeries;<\/li>\n\n\n\n<li>permanent disfigurement;<\/li>\n\n\n\n<li>loss of mobility;<\/li>\n\n\n\n<li>loss of independence;<\/li>\n\n\n\n<li>inability to participate in normal activities;<\/li>\n\n\n\n<li>psychological trauma associated with serious physical injury; and<\/li>\n\n\n\n<li>a permanent reduction in the quality of everyday life.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These consequences are considered under non-pecuniary heads such as pain and suffering and loss of amenities, depending on the facts and applicable precedent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s recent compensation calculations continue to recognize these heads separately.<\/p>\n\n\n\n<h3 id=\"h-loss-of-amenities-of-life\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Loss_of_Amenities_of_Life\"><\/span>Loss of Amenities of Life<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A person may continue earning an income and yet suffer a profound loss in the quality of life.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, a claimant may no longer be able to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>walk normally;<\/li>\n\n\n\n<li>play sports;<\/li>\n\n\n\n<li>travel independently;<\/li>\n\n\n\n<li>participate in social activities;<\/li>\n\n\n\n<li>perform household activities;<\/li>\n\n\n\n<li>pursue hobbies; or<\/li>\n\n\n\n<li>enjoy ordinary physical activities.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The law recognizes that such losses have value even though they do not come with an invoice.<\/p>\n\n\n\n<h2 id=\"h-marriage-prospects-and-other-consequences\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Marriage_Prospects_and_Other_Consequences\"><\/span>Marriage Prospects and Other Consequences<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on the age, circumstances, and evidence, courts may also consider consequences such as disfigurement or loss of marriage prospects.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The precise heads and amounts cannot be assumed in every case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The safer legal approach is to identify the actual consequence and then determine whether it falls within a recognized head of compensation supported by the evidence and precedent.<\/p>\n\n\n\n<h2 id=\"h-contributory-negligence-a-traffic-violation-is-not-the-whole-story\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Contributory_Negligence_A_Traffic_Violation_Is_Not_the_Whole_Story\"><\/span>Contributory Negligence: A Traffic Violation Is Not the Whole Story<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Insurance companies frequently raise contributory negligence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The argument is often straightforward:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;The victim violated a traffic rule; therefore, the compensation should be reduced.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The law, however, requires more careful analysis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A traffic violation and contributory negligence are not automatically synonymous.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The real question is whether the claimant&#8217;s conduct contributed to the accident or to the injury suffered.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s decision in <em>Mohammed Siddique v. National Insurance Co. <\/em>Ltd. (2020) 3 SCC 57 is important in this context.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court rejected the proposition that merely carrying an additional passenger on a motorcycle automatically established contributory negligence. There had to be a causal connection between the violation and the accident or resulting injury.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This principle is important because compensation cannot be reduced merely by identifying an unrelated regulatory breach.<\/p>\n\n\n\n<h3 id=\"h-the-difference-between-negligence-and-contributory-negligence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Difference_Between_Negligence_and_Contributory_Negligence\"><\/span>The Difference Between Negligence and Contributory Negligence<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">There are really two separate questions.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Question<\/th><th>Issue To Be Examined<\/th><\/tr><\/thead><tbody><tr><td><strong>Question 1<\/strong><\/td><td>Was the driver of the offending vehicle negligent?<\/td><\/tr><tr><td><strong>Question 2<\/strong><\/td><td>Did the claimant&#8217;s own conduct contribute to the accident or the resulting injury?<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The existence of negligence by the offending driver does not automatically answer the second question.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Similarly, the claimant&#8217;s violation of a traffic rule does not automatically establish that the claimant contributed to the accident.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Causation matters.<\/strong><\/p>\n\n\n\n<h2 id=\"h-income-often-the-most-contested-issue\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Income_Often_the_Most_Contested_Issue\"><\/span>Income: Often the Most Contested Issue<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In many MACT cases, the insurer disputes the claimant&#8217;s income.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For salaried employees, the evidence may be relatively straightforward:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>salary slips;<\/li>\n\n\n\n<li>appointment letter;<\/li>\n\n\n\n<li>bank statements;<\/li>\n\n\n\n<li>Form 16;<\/li>\n\n\n\n<li>income tax returns;<\/li>\n\n\n\n<li>employer records.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">For self-employed persons, the evidence may be more complicated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A claimant may have to rely upon:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>income tax returns;<\/li>\n\n\n\n<li>GST records;<\/li>\n\n\n\n<li>bank statements;<\/li>\n\n\n\n<li>account books;<\/li>\n\n\n\n<li>business documents;<\/li>\n\n\n\n<li>professional records;<\/li>\n\n\n\n<li>contracts;<\/li>\n\n\n\n<li>licenses;<\/li>\n\n\n\n<li>employer\/customer testimony; or<\/li>\n\n\n\n<li>other surrounding evidence.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The absence of a conventional salary slip does not mean that the claimant had no income.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Tribunal must assess the evidence realistically.<\/p>\n\n\n\n<h2 id=\"h-informal-workers-and-daily-wage-earners\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Informal_Workers_and_Daily-Wage_Earners\"><\/span>Informal Workers and Daily-Wage Earners<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">India&#8217;s workforce contains a very large informal sector.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A construction worker, driver, mechanic, street vendor, domestic worker, or small trader may not have a formal employment contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That does not make the person&#8217;s economic contribution worthless.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where documentary evidence is incomplete, the Tribunal may have to determine income using the evidence available, the nature of the occupation, and other relevant circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A proper claim should therefore collect every credible piece of income evidence, however modest it may appear.<\/p>\n\n\n\n<h2 id=\"h-the-problem-of-notional-income\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Problem_of_Notional_Income\"><\/span>The Problem of Notional Income<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Where income cannot be proved satisfactorily, tribunals sometimes resort to notional income.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But notional income should not become an automatic substitute for evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the claimant can produce:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>bank credits;<\/li>\n\n\n\n<li>tax filings;<\/li>\n\n\n\n<li>employer evidence;<\/li>\n\n\n\n<li>business records;<\/li>\n\n\n\n<li>professional receipts; or<\/li>\n\n\n\n<li>other reliable evidence,<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Those materials should be placed before the Tribunal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The difference between proved income and an artificially low notional figure can become substantial once future prospects and the multiplier are applied.<\/p>\n\n\n\n<h2 id=\"h-collateral-benefits-and-the-2026-dolly-satish-gandhi-judgment\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Collateral_Benefits_and_the_2026_Dolly_Satish_Gandhi_Judgment\"><\/span>Collateral Benefits and the 2026 Dolly Satish Gandhi Judgment<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the most significant recent Supreme Court developments concerns a question that arises increasingly in modern accident litigation:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What happens when the claimant has already received money from another insurance policy or source?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose a victim has a Mediclaim policy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The health insurer pays the hospital bill.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Can the motor accident insurer then argue that the same medical expenses should be deducted from the MACT award?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This issue came before the Supreme Court in <em>New India Assurance Co. Dolly Satish Gandhi<\/em>, 2026 INSC 498.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court examined the competing approaches and the principle against double recovery.<\/p>\n\n\n\n<h3 id=\"h-the-central-principle-in-dolly-satish-gandhi\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Central_Principle_in_Dolly_Satish_Gandhi\"><\/span>The Central Principle in Dolly Satish Gandhi<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The important question is not simply:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;Did the claimant receive money from another source?&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The more meaningful question is<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;What was that money intended to compensate?&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">If two payments compensate exactly the same loss, allowing complete recovery under both heads may result in duplication.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But if a payment arises from an independent contractual or statutory entitlement, it does not automatically follow that it must be deducted from the motor accident compensation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The distinction between an independent benefit and compensation for the same loss is therefore crucial.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The 2026 judgment revisited earlier collateral-benefit jurisprudence and examined authorities, including <em>Helen C. and<\/li>\n\n\n\n<li>Motor accident compensation.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The question is whether each payment arises from an <strong>independent legal entitlement<\/strong> or represents compensation for the <strong>same loss<\/strong>.<\/p>\n\n\n\n<h2 id=\"h-insurance-company-liability-pay-first-recover-later\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Insurance_Company_Liability_Pay_First_Recover_Later\"><\/span>Insurance Company Liability: Pay First, Recover Later<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Motor accident litigation often involves disputes over the insurance policy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Common issues include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Invalid or ineffective driving license;<\/li>\n\n\n\n<li>Breach of policy conditions;<\/li>\n\n\n\n<li>Unauthorized use of the vehicle;<\/li>\n\n\n\n<li>Permit violations;<\/li>\n\n\n\n<li>Use of a private vehicle for commercial purposes;<\/li>\n\n\n\n<li>Overloading;<\/li>\n\n\n\n<li>Other statutory or contractual breaches.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">An important distinction must be maintained between:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>The victim&#8217;s right to recover the award<\/strong>;
