PF and ESPP: Harpreet Sawhney<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A significant 2026 development is Harpreet Sawhney v. The Court specifically stated that the obligation to support a former wife does not end merely because she is educated or has parental support.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That was a decision on the facts of that case, not a fixed alimony formula.<\/p>\n\n\n\n<h2 id=\"h-22-when-the-mother-earns-can-children-still-receive-maintenance\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"22_When_the_Mother_Earns_Can_Children_Still_Receive_Maintenance\"><\/span>22. Can a Child Claim Maintenance If the Mother Is Earning?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Yes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The child&#8217;s entitlement is not simply determined by asking which parent earns more.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court examines the overall financial responsibility of both parents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Education, healthcare, accommodation, transportation, and other reasonable expenses may be relevant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s 2026 decision in Harpreet Sawhney is particularly relevant to the assessment of actual financial capacity, although its maintenance amount should not be treated as a tariff for other families.<\/p>\n\n\n\n<h2 id=\"h-27-child-custody-welfare-comes-first\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"27_Child_Custody_Welfare_Comes_First\"><\/span>27. Physical Custody, Legal Custody, and Visitation Are Different<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A parent may not have primary physical custody but may still have meaningful rights of access.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Orders can address:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>weekend visitation;<\/li>\n\n\n\n<li>holiday access;<\/li>\n\n\n\n<li>video calls;<\/li>\n\n\n\n<li>school holidays;<\/li>\n\n\n\n<li>birthdays;<\/li>\n\n\n\n<li>special occasions;<\/li>\n\n\n\n<li>travel;<\/li>\n\n\n\n<li>communication.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A carefully drafted parenting arrangement can sometimes prevent repeated litigation.<\/p>\n\n\n\n<h2 id=\"h-29-the-child-s-preference\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"29_The_Childs_Preference\"><\/span>29. The Child&#8217;s Preference<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A mature child&#8217;s preference can be relevant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the child&#8217;s preference is not necessarily decisive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court considers whether the preference appears informed, voluntary, and consistent with the child&#8217;s welfare.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A child should not be placed in the position of being forced to \u201cchoose\u201d between parents.<\/p>\n\n\n\n<h2 id=\"h-30-parental-alienation-and-psychological-assessment\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"30_Parental_Alienation_and_Psychological_Assessment\"><\/span>30. Parental Alienation and Psychological Assessment<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Allegations of parental alienation require careful factual examination.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They should not simply become labels attached to one parent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Similarly, psychological evaluation is not automatically prohibited and is not automatically justified.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Sheetal Vasant Thakur v. Chirag Arora<\/em>, 2026 INSC 638, decided 11 June 2026, the Supreme Court dealt with psychological evaluation in a sensitive custody\/child-protection context.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court emphasized child welfare, minimum intrusion, institutional neutrality, and the risk of repeated evaluation and retraumatization. The judgment did not establish a blanket prohibition on psychological assessment.<\/p>\n\n\n\n<h3 id=\"h-the-practical-principle\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Practical_Principle\"><\/span>The Practical Principle<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If psychological assessment is ordered, it should have a legitimate purpose and remain child-centric, welfare-oriented, and proportionate to the circumstances.<\/p>\n\n\n\n<h2 id=\"h-31-relocation-passport-and-international-travel\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"31_Relocation_Passport_and_International_Travel\"><\/span>31. Relocation, Passport, and International Travel<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Custody litigation can become substantially more complicated where one parent wants to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>move to another city;<\/li>\n\n\n\n<li>move abroad;<\/li>\n\n\n\n<li>obtain a passport for a child;<\/li>\n\n\n\n<li>travel internationally;<\/li>\n\n\n\n<li>relocate permanently.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The court may consider:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>child&#8217;s education;<\/li>\n\n\n\n<li>existing access arrangements;<\/li>\n\n\n\n<li>purpose of relocation;<\/li>\n\n\n\n<li>proposed safeguards for the other parent;<\/li>\n\n\n\n<li>child&#8217;s relationship with both parents;<\/li>\n\n\n\n<li>international enforcement concerns.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These matters should be raised early rather than after travel arrangements have already been made.<\/p>\n\n\n\n<h2 id=\"h-32-international-child-custody\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"32_International_Child_Custody\"><\/span>32. International Child Custody<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">India&#8217;s position in international custody disputes requires careful attention to Indian law, comity, and the child&#8217;s welfare.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India is not a contracting state to the Hague Convention on the Civil Aspects of International Child Abduction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That does not mean that an international custody dispute is without legal remedies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It means the legal strategy has to be built around the actual facts, the orders already passed, the child&#8217;s habitual circumstances, and the jurisdictions involved.<\/p>\n\n\n\n<h2 id=\"h-33-stridhan-is-not-the-same-as-matrimonial-property\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"33_Stridhan_Is_Not_the_Same_as_Matrimonial_Property\"><\/span>33. Stridhan Is Not the Same as Matrimonial Property<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Stridhan should be separately identified.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has repeatedly recognized a woman&#8217;s proprietary rights over her stridhan.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Authorities including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em>Pratibha Rani v. Suraj Kumar<\/em><\/li>\n\n\n\n<li><em>Krishna Bhattacharjee v. Sarathi Choudhury<\/em><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">are important in this area.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A woman should not assume that she has lost ownership of her stridhan merely because the property was kept in the matrimonial home.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Conversely, not every asset acquired during a marriage automatically becomes jointly owned property.<\/p>\n\n\n\n<h2 id=\"h-34-is-there-an-automatic-50-50-division-of-matrimonial-property\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"34_Is_There_an_Automatic_50_50_Division_of_Matrimonial_Property\"><\/span>34. Is There an Automatic 50:50 Division of Matrimonial Property?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">No general statutory rule provides that every matrimonial asset in India is automatically divided 50:50 on divorce.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ownership depends on:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>title;<\/li>\n\n\n\n<li>source of funds;<\/li>\n\n\n\n<li>applicable law;<\/li>\n\n\n\n<li>nature of the property;<\/li>\n\n\n\n<li>contractual arrangements;<\/li>\n\n\n\n<li>statutory remedies;<\/li>\n\n\n\n<li>court orders;<\/li>\n\n\n\n<li>facts surrounding acquisition.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Domestic Violence Act may provide monetary or residence-related relief, but a right of residence should not automatically be confused with ownership.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s decision in <em>Satish Chander Ahuja v. Sneha Ahuja<\/em> is particularly important concerning the concept of shared household.<\/p>\n\n\n\n<h2 id=\"h-35-domestic-violence-proceedings-and-divorce\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"35_Domestic_Violence_Proceedings_and_Divorce\"><\/span>35. Domestic Violence Proceedings and Divorce<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Divorce and domestic-violence proceedings are separate legal proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A matrimonial dispute may involve:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>protection orders;<\/li>\n\n\n\n<li>residence orders;<\/li>\n\n\n\n<li>monetary relief;<\/li>\n\n\n\n<li>compensation;<\/li>\n\n\n\n<li>custody-related relief;<\/li>\n\n\n\n<li>Stridhan claims.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A divorce petition does not automatically extinguish those remedies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Similarly, a domestic-violence complaint does not automatically establish every allegation merely because it has been filed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Each proceeding must be examined according to its governing statute and evidence.<\/p>\n\n\n\n<h2 id=\"h-36-multiple-maintenance-proceedings\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"36_Multiple_Maintenance_Proceedings\"><\/span>36. Multiple Maintenance Proceedings<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A spouse may have maintenance claims under more than one statutory framework.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That does not necessarily mean the claimant receives completely separate, duplicative amounts without adjustment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s <em>Rajnesh v.
