Union of India<\/em> in 2023.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court was concerned not merely with who formally appoints Election Commissioners, but with the institutional independence of the Election Commission itself.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The underlying constitutional concern was straightforward: an institution responsible for administering elections must be sufficiently independent from the executive whose political fortunes may be affected by its decisions.<\/p>\n\n\n\n<h2 id=\"h-what-the-supreme-court-held-in-anoop-baranwal\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_the_Supreme_Court_Held_in_Anoop_Baranwal\"><\/span>What the Supreme Court Held in Anoop Baranwal<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Anoop Baranwal<\/em>, a five-judge Constitution Bench dealt with the absence of parliamentary legislation governing appointments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court recognised free and fair elections as a constitutional requirement connected with the basic structure of the Constitution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Until Parliament enacted a law, the Court directed that appointments should be made on the recommendation of a committee comprising:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the Prime Minister;<\/li>\n\n\n\n<li>the Leader of the Opposition in the Lok Sabha; and<\/li>\n\n\n\n<li>the Chief Justice of India.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>But there is an important qualification.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court&#8217;s arrangement was expressly intended to operate until Parliament made a law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That qualification has become central to the present dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Datta&#8217;s reasoning in the 2026 case rests substantially on this distinction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to that view, the judicially prescribed committee in <em>Anoop Baranwal<\/em> was an interim arrangement fashioned to fill a legislative vacuum. Once Parliament enacted the 2023 legislation, that interim arrangement ceased to operate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The question then becomes different:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Did Parliament merely replace a temporary judicial arrangement, or did it enact a framework that fails the constitutional requirement of an independent Election Commission?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is the real constitutional controversy now awaiting determination.<\/p>\n\n\n\n<h2 id=\"h-parliament-s-2023-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Parliaments_2023_Law\"><\/span>Parliament&#8217;s 2023 Law<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Parliament enacted the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The legislation came into force in February 2024.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Act created a statutory mechanism involving both a Search Committee and a Selection Committee.<\/p>\n\n\n\n<h3 id=\"h-the-search-committee\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Search_Committee\"><\/span>The Search Committee<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Section 6 establishes a Search Committee headed by the Union Minister of Law and Justice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Search Committee prepares a panel of five persons.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Also Read: <a by the Prime Minister.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Whether that change is constitutionally permissible is the question now pending.<\/p>\n\n\n\n<h2 id=\"h-the-challenge-before-the-supreme-court\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Challenge_Before_the_Supreme_Court\"><\/span>The Challenge Before the Supreme Court<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Several petitions challenged provisions of the 2023 Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The principal challenge concerns the composition of the Selection Committee, particularly Section 7.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The petitioners&#8217; argument is that the new arrangement places the appointment process under effective executive dominance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Their concern is not simply numerical.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They argue that the Prime Minister and the Cabinet Minister nominated by the Prime Minister constitute two members of a three-member committee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Leader of Opposition can therefore be outvoted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The petitioners contend that such a structure undermines both the actual independence of the Election Commission and public confidence in that independence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The challenge also extends to the Search Committee mechanism and Section 8, which permits the Selection Committee to consider persons outside the Search Committee&#8217;s panel.<\/p>\n\n\n\n<h2 id=\"h-what-the-supreme-court-decided-on-23-september-2026\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_the_Supreme_Court_Decided_on_23_September_2026\"><\/span>What the Supreme Court Decided on 23 September 2026<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>This is where precision is essential.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The two-judge bench did not decide the constitutional validity of the 2023 Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The immediate issue before the Court was whether the challenge raised a substantial question of law as to the interpretation of the Constitution requiring a Constitution Bench under Article 145(3).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Dipankar Datta and Justice Satish Chandra Sharma disagreed.<\/p>\n\n\n\n<h3 id=\"h-justice-dipankar-datta-no-constitution-bench-reference-necessary\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Justice_Dipankar_Datta_No_Constitution_Bench_Reference_Necessary\"><\/span>Justice Dipankar Datta: No Constitution Bench Reference Necessary<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Datta&#8217;s approach was that <em>Anoop Baranwal<\/em> had already established the relevant constitutional principles.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those principles include the importance of free and fair elections and the need to protect the Election Commission from exclusive executive control.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In his view, the three-member committee prescribed in <em>Anoop Baranwal<\/em> was an interim arrangement under Article 142.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It was not a permanent constitutional command under Article 141 requiring Parliament to retain the Chief Justice of India on every future selection committee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Once Parliament enacted legislation under Article 324(2), the interim judicial arrangement ceased to operate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The remaining question, therefore, was whether the statutory arrangement complied with the constitutional principles already established.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On that reasoning, Justice Datta did not consider a Constitution Bench reference necessary.<\/p>\n\n\n\n<h3 id=\"h-but-justice-datta-also-raised-serious-prima-facie-concerns\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" class=\"wp-block-paragraph\">This part of the judgement deserves careful treatment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Although Justice Datta did not consider a reference necessary, his opinion contained significant observations about the structure created by the 2023 Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He questioned whether a Cabinet Minister nominated by the Prime Minister could provide a genuinely independent counterweight within a three-member committee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The concern was connected with the constitutional principle that institutional independence must not merely exist in theory but must also be capable of being perceived by the public.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In other words, the issue is not simply:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Is the Election Commission legally independent?<\/li>\n\n\n\n<li>It can also be: Does the method by which its members are selected inspire reasonable confidence in that independence?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Those observations are important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But they must not be misunderstood.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They are not a declaration that the 2023 Act is unconstitutional.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The constitutional validity of the Act remains undecided.<\/p>\n\n\n\n<h3 id=\"h-justice-satish-chandra-sharma-constitution-bench-reference-required\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Justice_Satish_Chandra_Sharma_Constitution_Bench_Reference_Required\"><\/span>Justice Satish Chandra Sharma: Constitution Bench Reference Required<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Sharma took a different approach.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For him, the central question was not simply whether the principles in <em>Anoop Baranwal<\/em> were settled.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The 2023 Act itself had never been tested by the Supreme Court for constitutional validity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The question of whether Parliament could replace the Chief Justice of India with a Union Cabinet Minister nominated by the Prime Minister raised a fresh constitutional issue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That, according to Justice Sharma, was precisely the kind of question contemplated by Article 145(3).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article 145(3) requires that a case involving a substantial question of law as to the interpretation of the Constitution be heard by a Bench of at least five judges.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">His reasoning therefore focused on the distinction between:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>applying an existing constitutional rule<\/li>\n\n\n\n<li>and determining whether new legislation complies with the Constitution.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">For Justice Sharma, the latter question remained unresolved.<\/p>\n\n\n\n<h2 id=\"h-the-article-145-3-question\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Article_1453_Question\"><\/span>The Article 145(3) Question<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The significance of the judgement extends beyond the Election Commission.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It also concerns the circumstances in which the Supreme Court should constitute a Constitution Bench.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article 145(3) establishes a minimum five-judge bench where a substantial question of law concerning constitutional interpretation arises.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The disagreement between the judges therefore raises an institutional question:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>When Parliament legislates after a Supreme Court judgement, is a subsequent constitutional challenge merely an application of the earlier judgement, or can the new legislation itself create a fresh constitutional question requiring a larger bench?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That issue could have implications well beyond election law.<\/p>\n\n\n\n<h2 id=\"h-article-141-and-article-142-the-hidden-constitutional-issue\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Article_141_and_Article_142_The_Hidden_Constitutional_Issue\"><\/span>Article 141 and Article 142: The Hidden Constitutional Issue<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the most important legal distinctions in the case concerns Articles 141 and 142.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article 141 provides that the law declared by the Supreme Court is binding on all courts in India.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article 142 empowers the Supreme Court to make orders necessary to do complete justice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Datta&#8217;s approach places particular emphasis on the character of the directions issued in <em>Anoop Baranwal<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the committee prescribed there was an Article 142 arrangement designed to operate only until Parliament legislated, then Parliament was constitutionally entitled to create a different statutory mechanism\u2014subject, of course, to the Constitution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That does not mean Parliament can legislate anything it wishes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It means that the question shifts from:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Must Parliament retain the <em>Anoop Baranwal<\/em> committee?<\/li>\n\n\n\n<li>to:<\/li>\n\n\n\n<li>Does Parliament&#8217;s replacement mechanism satisfy the Constitution?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction may ultimately be central to the Constitution Bench&#8217;s analysis.<\/p>\n\n\n\n<h2 id=\"h-the-njac-analogy\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_NJAC_Analogy\"><\/span>The NJAC Analogy<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Sharma also drew attention to the Supreme Court&#8217;s decision concerning the National Judicial Appointments Commission.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The NJAC judgement dealt with judicial independence and the participation of the executive in judicial appointments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The present case concerns appointments to the Election Commission, not appointments to the judiciary.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, the analogy cannot simply be transplanted without further constitutional analysis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The larger question is whether principles developed to protect judicial independence necessarily operate in precisely the same way when the institution concerned is the Election Commission.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is one of the issues a Constitution Bench may eventually have to examine.<\/p>\n\n\n\n<h2 id=\"h-why-the-search-committee-and-section-8-matter\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_the_Search_Committee_and_Section_8_Matter\"><\/span>Why the Search Committee and Section 8 Matter<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The debate is not confined to Section 7.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 6 creates the Search Committee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But Section 8 allows the Selection Committee to consider persons who were not included in the Search Committee&#8217;s panel.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This raises an important institutional question.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the Search Committee is intended to function as an initial filter, how much constitutional significance does that filter have if the final Selection Committee is free to look beyond it?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The answer is not self-evident.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Union can argue that the provision gives the Selection Committee flexibility and prevents a preliminary administrative panel from unnecessarily restricting the final choice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The petitioners can argue that it weakens the independent screening mechanism.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The constitutional question is ultimately whether the overall structure sufficiently protects the independence and credibility of the Election Commission.<\/p>\n\n\n\n<h2 id=\"h-the-removal-question\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Removal_Question\"><\/span>The Removal Question<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is another issue that deserves greater attention in discussions about institutional independence: removal protection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Chief Election Commissioner enjoys protection broadly comparable to that of a Supreme Court judge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The other Election Commissioners do not enjoy identical removal protection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That difference matters because institutional independence does not end on the day an appointment is made.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are two distinct questions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Who selects an election commissioner?<\/li>\n\n\n\n<li>How secure is that commissioner after appointment?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A constitutional analysis of institutional independence may therefore have to consider both.<\/p>\n\n\n\n<h2 id=\"h-the-sir-judgement-is-related-but-legally-different\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_SIR_Judgement_Is_Related%E2%80%94but_Legally_Different\"><\/span>The SIR Judgement Is Related\u2014but Legally Different<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The appointment case is also being discussed alongside the Supreme Court&#8217;s May 2026 judgement concerning the Special Intensive Revision of electoral rolls.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That connection needs to be handled carefully.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Association for Democratic Reforms v. Election Commission of India<\/em>, the Supreme Court examined the ECI&#8217;s authority to conduct the Special Intensive Revision of electoral rolls in Bihar.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court upheld the exercise while addressing questions concerning Article 324, Section 21 of the Representation of the People Act, 1950, proportionality and the Commission&#8217;s role in relation to citizenship-related electoral-roll enquiries.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But that case concerned the powers exercised by the Election Commission.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Jaya Thakur litigation concerns the constitutional validity of the mechanism used to appoint the Election Commissioners.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These are different legal questions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The distinction is important because one can accept that the Election Commission possesses statutory and constitutional authority to conduct a particular electoral exercise while separately questioning whether the institutional appointment mechanism adequately protects its independence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The two questions should therefore not be collapsed into one.<\/p>\n\n\n\n<h2 id=\"h-the-arguments-on-both-sides\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Arguments_on_Both_Sides\"><\/span>The Arguments on Both Sides<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 id=\"h-the-case-in-defence-of-the-2023-act\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Case_in_Defence_of_the_2023_Act\"><\/span>The Case in Defence of the 2023 Act<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Union&#8217;s position can be understood through Article 324(2).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Constitution expressly contemplates parliamentary legislation governing appointments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <em>Anoop Baranwal<\/em> committee was expressly designed to operate only until Parliament made a law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parliament subsequently enacted the 2023 Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Government can therefore argue that the constitutional scheme does not require the Chief Justice of India to remain part of the Selection Committee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It can also point to the presence of the Leader of Opposition as an institutional check.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Search Committee provides another layer of scrutiny.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From this perspective, the Constitution requires an adequate and lawful appointment mechanism but does not necessarily prescribe one particular composition.<\/p>\n\n\n\n<h3 id=\"h-the-petitioners-constitutional-objection\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Petitioners_Constitutional_Objection\"><\/span>The Petitioners&#8217; Constitutional Objection<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The petitioners approach the issue differently.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Their argument is that Parliament&#8217;s power under Article 324(2) is not unlimited.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Legislation governing appointments to a constitutional body must remain consistent with constitutional requirements, including the basic-structure principle of free and fair elections.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Their central concern is structural.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If two out of three members of the Selection Committee are aligned with the Union executive, the opposition member can be outvoted on every appointment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The question is therefore whether the presence of one opposition member is sufficient to provide meaningful institutional balance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The petitioners also challenge the effectiveness of the Search Committee because the final Selection Committee is not confined to its panel.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These arguments will now have to be examined at the appropriate judicial level.<\/p>\n\n\n\n<h2 id=\"h-what-is-settled-and-what-is-still-open\" two judges differed on the reference question, the papers have been placed before the Chief Justice for consideration of an appropriate Constitution Bench.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court has also drawn attention to the problem of delays in Constitution Bench matters and considered whether a more permanent mechanism for deciding pure constitutional questions would be desirable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That observation may have significance beyond this particular litigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Constitutional questions involving major institutions cannot remain unresolved indefinitely while the statutory framework continues to operate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, the existence of a constitutional challenge does not itself suspend a parliamentary enactment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is the position here.<\/p>\n\n\n\n<h2 id=\"h-the-real-constitutional-question\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Real_Constitutional_Question\"><\/span>The Real Constitutional Question<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The most important question arising from this litigation is not simply whether the Chief Justice of India should sit on the Selection Committee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The deeper question is this:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>How should the Constitution protect the independence of an institution that administers elections while leaving Parliament sufficient democratic authority to design its appointment mechanism?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are competing constitutional principles at work.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Article 324(2) gives Parliament legislative space.<\/li>\n\n\n\n<li>The basic structure doctrine places constitutional limits on legislative power.<\/li>\n\n\n\n<li>The independence of the Election Commission is connected with the constitutional requirement of free and fair elections.<\/li>\n\n\n\n<li>And the judiciary must decide how these principles fit together without converting an interim judicial arrangement into a permanent constitutional formula\u2014or, conversely, allowing legislation to dilute a constitutional safeguard merely because Parliament has acted.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">That is the question that ultimately matters.<\/p>\n\n\n\n<h2 id=\"h-current-legal-position-as-of-24-september-2026\" class=\"wp-block-heading\"><span Election Commission, while the specific committee prescribed in that judgment cannot simply be treated as the permanent statutory appointment mechanism after Parliament enacted the 2023 law.<\/p>\n\n\n\n<h2 id=\"h-conclusion\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The 23 September 2026 judgement is important precisely because it did not settle the ultimate question.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It has moved the dispute to the next constitutional stage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court must eventually confront a difficult balance: Parliament has the constitutional authority to legislate on the appointment of Election Commissioners, but that legislative power exists within a constitutional structure that treats free and fair elections as fundamental.<\/p>\n\n\n\n<h3 id=\"h-the-institutional-design-questions\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Institutional_Design_Questions\"><\/span>The Institutional Design Questions<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The controversy is therefore not merely about three names on a Selection Committee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is about institutional design.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Who should have the power to select the people who administer elections?<\/li>\n\n\n\n<li>How much executive influence is constitutionally permissible?<\/li>\n\n\n\n<li>Does the presence of the Leader of Opposition provide sufficient institutional balance?<\/li>\n\n\n\n<li>Does the Search Committee provide a meaningful independent filter?<\/li>\n\n\n\n<li>Can a selection process be legally valid while still failing the constitutional requirement that the Election Commission must be\u2014and appear to be\u2014independent?<\/li>\n\n\n\n<li>And, perhaps most importantly, where should the line be drawn between Parliament&#8217;s power to legislate and the Constitution&#8217;s demand for institutional independence?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has not answered those questions yet.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What it has decided is that the dispute has reached a point where the constitutional architecture of India&#8217;s Election Commission itself is under examination.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The next authoritative answer will come from the Bench constituted to decide it.<\/p>\n\n\n\n<h2 id=\"h-frequently-asked-questions\"
