>Conclusion<\/a><\/li><\/ul><\/li><\/ul><\/nav><\/div>\n\n\n\n\n<p class=\"wp-block-paragraph\">The petition has been filed by advocate Ashwini Kumar Upadhyay and seeks, among other measures, greater public awareness about the legal consequences of filing false complaints and fabricated evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court had issued notice on the petition in February 2026. The matter has subsequently remained under consideration, and the latest available order records that it was listed on 25 September 2026, with the Court directing that the matter be listed on 30 November 2026 and that pleadings be completed in the meantime.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Importantly, the Supreme Court has not held that false FIRs are widespread as a matter of established fact, nor has it granted the substantive safeguards sought by the petitioner.<\/strong> The allegations and proposed reforms remain matters for judicial consideration.<\/p>\n\n\n\n<h2 id=\"h-why-the-pil-on-false-firs-matters\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_the_PIL_on_False_FIRs_Matters\"><\/span>Why the PIL on False FIRs Matters<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A criminal case is not an ordinary dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Once an FIR is registered, an accused person may have to face investigation, interrogation, arrest-related consequences, court proceedings, legal expenses and restrictions on personal and professional life. Even when the accused is ultimately acquitted, the intervening period may carry serious consequences for reputation, employment, business relationships and family life.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The petitioner&#8217;s central concern is that, in some situations, the criminal process itself can become a source of punishment, irrespective of the final outcome.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The plea refers to allegations that criminal provisions may sometimes be invoked in disputes involving property, matrimonial relationships, personal rivalry or other private conflicts. It particularly raises concerns regarding alleged misuse of serious criminal provisions, including allegations involving rape and offences under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These are serious allegations, and they require an important qualification: a high acquittal rate or an allegation of misuse in an individual case does not, by itself, establish that the original complaint was false. Whether an accusation is genuine, mistaken, exaggerated or deliberately fabricated has to be determined on the facts and according to law.<\/p>\n\n\n\n<h2 id=\"h-a-civil-dispute-becomes-a-criminal-case\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"%E2%80%9CA_Civil_Dispute_Becomes_a_Criminal_Case%E2%80%9D\"><\/span>\u201cA Civil Dispute Becomes a Criminal Case\u201d<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the broader concerns raised during the proceedings was the alleged conversion of private or civil disputes into criminal proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The petitioner has described the problem in simple terms: <strong>\u201cA civil dispute becomes a criminal case.\u201d<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That concern is significant because Indian law does recognise situations where the same factual background may give rise to both civil and criminal consequences. A property dispute, contractual disagreement or matrimonial conflict cannot automatically be labelled \u201ccivil\u201d merely because a civil remedy exists. At the same time, criminal law cannot legitimately be used simply as a pressure tactic where the essential ingredients of a criminal offence are absent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The real legal question is therefore not whether civil and criminal proceedings can coexist. They can. The question is whether criminal machinery is being invoked without a genuine criminal foundation and with an intention to cause injury or exert unlawful pressure.<\/p>\n\n\n\n<h2 id=\"h-supreme-court-s-concern-over-the-criminal-process\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Supreme_Courts_Concern_Over_the_Criminal_Process\"><\/span>Supreme Court&#8217;s Concern Over the Criminal Process<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">During the earlier proceedings, concerns were also raised about complaints allegedly being filed without the actual complainant&#8217;s knowledge, including instances involving alleged forged signatures.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court also considered the possibility of vulnerable persons being used by others to initiate criminal proceedings in their names. Such situations, if established, raise concerns extending beyond an individual dispute because they potentially affect the integrity of the criminal justice system itself.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The proceedings have therefore brought into focus a difficult balance.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>On one side is the need to ensure that genuine complainants are able to approach the police and courts without fear.<\/li>\n\n\n\n<li>On the other is the need to prevent false FIRs and fabricated complaints from becoming instruments of harassment.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Any future safeguards will necessarily have to preserve both objectives.<\/p>\n\n\n\n<h2 id=\"h-what-does-the-pil-seek\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Does_the_PIL_Seek\"><\/span>What Does the PIL Seek?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The petition proposes several preventive and awareness-based measures.<\/p>\n\n\n\n<h3 id=\"h-1-display-boards-warning-against-false-complaints\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"1_Display_Boards_Warning_Against_False_Complaints\"><\/span>1. Display Boards Warning Against False Complaints<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">One of the principal prayers is for prominent display boards at places such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Police stations<\/li>\n\n\n\n<li>Tehsil and district court premises<\/li>\n\n\n\n<li>Panchayat bhawans<\/li>\n\n\n\n<li>Municipal offices<\/li>\n\n\n\n<li>Educational institutions<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The proposed boards would inform citizens about the legal consequences of making false complaints, false statements, false claims, false information and false evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The idea is straightforward: a person approaching a public authority should know that deliberately providing false information or instituting a knowingly baseless criminal proceeding can have legal consequences.<\/p>\n\n\n\n<h3 id=\"h-2-informing-complainants-about-legal-consequences\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2_Informing_Complainants_About_Legal_Consequences\"><\/span>2. Informing Complainants About Legal Consequences<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The petitioner has also sought directions requiring authorities to inform complainants about the penal consequences of knowingly filing false complaints or providing fabricated information.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The petition argues that such information could operate as a preventive safeguard against deliberately false proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, such a mechanism would have to be carefully designed so that it does not discourage genuine victims from reporting offences.<\/p>\n\n\n\n<h3 id=\"h-3-undertaking-or-affidavit-from-complainants\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3_Undertaking_or_Affidavit_From_Complainants\"><\/span>3. It is also about designing a criminal justice system that protects genuine victims while preventing deliberate abuse of legal machinery.<\/p>\n\n\n\n<h2 id=\"h-article-14-and-article-21-the-constitutional-dimension\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Article_14_and_Article_21_The_Constitutional_Dimension\"><\/span>Article 14 and Article 21: The Constitutional Dimension<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The petition invokes Articles 14 and 21 of the Constitution of India.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article 14 guarantees equality before the law and equal protection of the laws.
