Therefore, the keeper or owner of such an animal may be held liable for damage caused by it, even where there is no intention to cause harm. This area of law is an important part of the law of torts and is designed to protect the public from foreseeable risks arising from dangerous animals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The principle of strict liability for harm caused by dangerous animals was firmly established in the landmark case of <em>May v. Burdett (1846)<\/em>, where the court held that a person who keeps a wild animal is liable for injuries caused by it, regardless of proof of negligence.<\/p>\n\n\n\n<h2 id=\"h-classification-of-animals\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Classification_of_Animals\"><\/span>Classification of Animals<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Under tort law, animals are divided into two main legal categories to determine owner liability:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Animals ferae naturae:<\/strong> wild or inherently dangerous species, such as lions, tigers, bears, monkeys, and elephants, for which keepers are held strictly liable regardless of prior good behavior or lack of negligence.<\/li>\n\n\n\n<li><strong>Animals mansuetae naturae:<\/strong> domesticated or naturally harmless species, such as dogs, cats, horses, and cattle, where liability depends on the scienter rule, requiring proof that the owner knew or ought to have known of that specific animal&#8217;s vicious propensity.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-scientific-rule\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Scientific_Rule\"><\/span>Scientific Rule<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Scienter Rule is a principle of tort law that imposes liability on the keeper of an animal when the keeper knows, or ought to know, of the animal&#8217;s dangerous or vicious propensity. The term <em>&#8220;scienter&#8221;<\/em> is derived from the Latin word meaning \u201cknowledge.\u201d Under this rule, if an owner is aware that an animal has previously displayed aggressive or dangerous behavior, such as biting, attacking, or charging at people, the owner will be liable for any subsequent injury caused by that animal, even without proof of specific negligence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The rule is often expressed through the maxim \u201cevery dog is entitled to one bite,\u201d meaning that once the owner becomes aware of the animal&#8217;s dangerous tendency, legal responsibility arises for future harm. Thus, liability is based not merely on ownership but on the owner&#8217;s knowledge of the animal&#8217;s abnormal and dangerous characteristics.<\/p>\n\n\n\n<h2 id=\"h-who-is-a-keeper-of-a-dangerous-animal\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_Is_a_Keeper_of_a_Dangerous_Animal\"><\/span>Who Is a Keeper of a Dangerous Animal?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A keeper is any person who owns, possesses, controls, harbours, or has custody of an animal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The term includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Owners of wild animals kept in zoos or private collections.<\/li>\n\n\n\n<li>Circuses and animal exhibitions.<\/li>\n\n\n\n<li>Farms keeping dangerous livestock.<\/li>\n\n\n\n<li>Persons who keep aggressive dogs or other animals known to cause harm.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The law focuses on control and responsibility rather than mere ownership.<\/p>\n\n\n\n<h2 id=\"h-what-is-a-dangerous-animal\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Is_a_Dangerous_Animal\"><\/span>What Is a Dangerous Animal?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A dangerous animal is one that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Belongs to a species naturally likely to cause serious injury; or<\/li>\n\n\n\n<li>Possesses dangerous characteristics known to its keeper.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Examples include<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Lions<\/li>\n\n\n\n<li>Tigers<\/li>\n\n\n\n<li>Leopards<\/li>\n\n\n\n<li>Bears<\/li>\n\n\n\n<li>Wolves<\/li>\n\n\n\n<li>Venomous snakes<\/li>\n\n\n\n<li>Aggressive dogs with known violent tendencies<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Even ordinarily harmless animals may become legally dangerous if they exhibit abnormal aggressive behavior known to the owner.<\/p>\n\n\n\n<h2 id=\"h-rule-of-strict-liability\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rule_of_Strict_Liability\"><\/span>Rule of Strict Liability<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The general legal principle is that a person who keeps a dangerous animal does so at their own risk.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the animal causes injury, the keeper may be liable even without proof of negligence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The reasoning is simple:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A person who introduces a dangerous risk into society must bear the consequences when that risk causes harm.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The victim need not prove intentional wrongdoing.
