Remedies are the legal mechanisms through which wrongs are redressed, losses are compensated, and future harm is prevented. They fall into two broad categories:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Judicial <\/strong>remedies\u2014those granted by courts<\/li>\n\n\n\n<li><strong>Extra-judicial <\/strong>remedies\u2014self-help measures that a person may lawfully take without approaching a court<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Closely connected to remedies is the concept of damages\u2014monetary compensation awarded for loss or injury caused by another\u2019s wrongful act. Together, remedies and damages form the backbone of civil justice and the law of torts.<\/p>\n\n\n\n<h2 id=\"h-what-is-a-remedy\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Is_a_Remedy\"><\/span>What Is a Remedy?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A remedy is a legal means of enforcing a right or correcting a wrong. Its principal objects are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>To compensate the injured party<\/li>\n\n\n\n<li>To prevent or stop continuing harm<\/li>\n\n\n\n<li>To restore the violated right<\/li>\n\n\n\n<li>To do justice between the parties<\/li>\n\n\n\n<li>To deter future wrongdoing<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-judicial-remedies\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Judicial_Remedies\"><\/span>Judicial Remedies<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Judicial remedies are those ordered by a court after hearing both sides.<\/p>\n\n\n\n<h3 id=\"h-3-1-damages\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"31_Damages\"><\/span>3.1 Damages<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Damages are monetary compensation awarded by a court for loss or injury caused by a wrongful act. This is the most common remedy in tort law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Example:<\/strong> A negligent driver causes an accident. The injured person may claim compensation for medical expenses, loss of earnings, and pain and suffering.<\/p>\n\n\n\n<h3 id=\"h-3-2-injunction\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"32_Injunction\"><\/span>3.2 Injunction<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">An injunction is a court order requiring a person to do, or to refrain from doing, a particular act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Types:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Temporary (interlocutory) <\/strong>injunction\u2014remains in force only until the final disposal of the suit<\/li>\n\n\n\n<li><strong>Permanent (perpetual) <\/strong>injunction\u2014continues indefinitely after the final judgment<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Injunctions are also classified as<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Mandatory (positive) <\/strong>injunction\u2014directs a person to perform a specific act (e.g., to demolish an illegally constructed wall)<\/li>\n\n\n\n<li><strong>Prohibitory (negative) <\/strong>injunction\u2014restrains a person from doing an act (e.g., from continuing construction on disputed land)<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Example:<\/strong> A court orders a factory to stop discharging toxic waste into a river.<\/p>\n\n\n\n<h3 id=\"h-3-3-specific-restitution-of-property\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"33_Specific_Restitution_of_Property\"><\/span>3.3 Specific Restitution of Property<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Where a person has been wrongfully deprived of property (movable or immovable), the court may order its return to the rightful owner.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Example:<\/strong> If a person unlawfully occupies another\u2019s land, the court may order restoration of possession.<\/p>\n\n\n\n<h2 id=\"h-extra-judicial-remedies\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Extra-Judicial_Remedies\"><\/span>Extra-Judicial Remedies<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Extra-judicial remedies are lawful self-help measures that a person may take without approaching a court. They exist to enable immediate protection of rights where delay would cause irreparable harm, provided the action remains within legal limits\u2014particularly the requirement of reasonable and proportionate force.<\/p>\n\n\n\n<h3 id=\"h-4-1-right-of-self-defence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"41_Right_of_Self-Defence\"><\/span>4.1 Right of Self-Defence<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A person may use reasonable force to protect their person or property against an unlawful attack. The force employed must be proportionate to the threat.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Example:<\/strong> Using proportionate force to resist an armed robbery.<\/p>\n\n\n\n<h3 id=\"h-4-2-right-of-expulsion-and-re-entry\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"42_Right_of_Expulsion_and_Re-entry\"><\/span>4.2 Right of Expulsion and Re-entry<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The lawful owner or occupier of immovable property may use reasonable force to expel a trespasser and to re-enter the property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Example:<\/strong> Using reasonable force to remove a trespasser from private land.<\/p>\n\n\n\n<h3 id=\"h-4-3-recaption\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"43_Recaption\"><\/span>4.3 Recaption<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A person who has been wrongfully dispossessed of movable goods may retake immediate possession by using reasonable force. This is known as the right of recaption (or recapture).<\/p>\n\n\n\n<h3 id=\"h-4-4-abatement-of-nuisance\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"44_Abatement_of_Nuisance\"><\/span>4.4 Abatement of Nuisance<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In cases of private nuisance (and, in limited circumstances, public nuisance), the injured party may take reasonable steps to remove or abate the nuisance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Example:<\/strong> Cutting overhanging branches of a neighbor&#8217;s tree that extend onto one\u2019s own land.<\/p>\n\n\n\n<h3 id=\"h-4-5-distress-damage-feature\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"45_Distress_Damage_Feature\"><\/span>4.5 Distress Damage Feature<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Where animals belonging to another enter land without permission and cause damage (to land, crops, grass, etc.), the landowner may detain the animals until adequate compensation is paid. He has also completed Post Graduate Diplomas in Human Rights, Project Management, Corporate Management, Computer Application, Public Administration, Medical Law, Disaster Management, Fire Safety &amp; Hazards Management and Psychology. He has attended Indian government sponsored specialized training in police and management matters in SVPNPA, Hyderabad, IIM, Ahmedabad and Singapore. He is the author of the books 'Police Investigation &amp; Allied Matters' and 'Alternative Dispute Resolution: Evolving Trends and Innovations' demonstrating his commitment to knowledge sharing within the law enforcement field. As an observer for the Election Commission of India, he has gained firsthand experience in conducting assembly elections and bye-elections in Uttar Pradesh, Rajasthan, Assam, Bihar, and Tripura (twice).
