After several years, one spouse moves to another country. The marriage breaks down. Proceedings concerning divorce, maintenance, custody or property are initiated in India. At the same time, proceedings may also be initiated abroad.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Family Court decides the matter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An appeal may then lie to the Calcutta High Court under the applicable law. It is not simply another routine appeal after the High Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is why the question in an SLP is not merely:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>\u201cWhy do I disagree with the High Court?\u201d<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The more important question is:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u201cWhat legal, jurisdictional, procedural or constitutional error justifies the Supreme Court&#8217;s intervention?\u201d<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending upon the facts, a case may warrant consideration where there is:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a serious jurisdictional error;<\/li>\n\n\n\n<li>an incorrect interpretation or application of the governing statute;<\/li>\n\n\n\n<li>a substantial legal error;<\/li>\n\n\n\n<li>a violation of natural justice;<\/li>\n\n\n\n<li>material evidence being ignored or misunderstood;<\/li>\n\n\n\n<li>an incorrect approach to a foreign judgment;<\/li>\n\n\n\n<li>a serious error concerning child custody or welfare;<\/li>\n\n\n\n<li>an important procedural irregularity causing prejudice; or<\/li>\n\n\n\n<li>circumstances resulting in a grave miscarriage of justice.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, the Supreme Court does not ordinarily function as a routine third court of facts merely because a litigant is dissatisfied with concurrent findings of the courts below.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is why an SLP has to be carefully structured around the legal significance of the error rather than simply repeating every grievance raised in the earlier litigation.<\/p>\n\n\n\n<h2 id=\"h-family-court-appeal-under-section-19-of-the-family-courts-act\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Family_Court_Appeal_Under_Section_19_of_the_Family_Courts_Act\"><\/span>Family Court Appeal Under Section 19 of the Family Courts Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">For a person beginning with a Family Court in Kolkata or elsewhere in West Bengal, <strong>Section 19 of the Family Courts Act, 1984<\/strong> is particularly important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 19 provides for an appeal to the High Court from a Family Court judgment or order, other than an interlocutory order, subject to the statutory exceptions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The provision states that the appeal lies on both facts and law. It also contains provisions dealing with consent orders, certain criminal proceedings, revision and the exclusion of other appellate or revisional remedies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">West Bengal is within the operation of the Family Courts Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, where a Family Court in Kolkata has passed a judgment or order from which an appeal lies, the appropriate High Court appellate remedy generally has to be considered before approaching the Supreme Court.<\/p>\n\n\n\n<h2 id=\"h-family-court-appeal-limitation-30-days-or-90-days\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Family_Court_Appeal_Limitation_30_Days_or_90_Days\"><\/span>Family Court Appeal Limitation: 30 Days or 90 Days?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is one of the most important practical issues in the entire subject.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 19(3) of the Family Courts Act states that an appeal under Section 19 is to be preferred within <strong>30 days<\/strong> from the date of the Family Court judgment or order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Family Courts Act also contains an overriding provision in Section 20.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court considered the interaction between the Family Courts Act and matrimonial appellate limitation in <strong>Arunoday Singh v. Lee Anne Elton, SLP (C) No. 10751\/2021, decided on 23 July 2021<\/strong>. In the statutory context before it, the Supreme Court gave effect to the 30-day period under Section 19 of the Family Courts Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, limitation should <strong>not<\/strong> be calculated mechanically from a generic article on the internet.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The applicable limitation can depend upon:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the matrimonial statute involved;<\/li>\n\n\n\n<li>whether the proceeding is governed by the Family Courts Act;<\/li>\n\n\n\n<li>the nature of the decree or order;<\/li>\n\n\n\n<li>whether the order is interlocutory;<\/li>\n\n\n\n<li>the particular statutory appellate provision;<\/li>\n\n\n\n<li>the effect of the Family Courts Act&#8217;s overriding clause; and<\/li>\n\n\n\n<li>the binding judicial authorities applicable in the relevant High Court.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">There has been judicial disagreement in different High Courts concerning the interaction between the Family Courts Act&#8217;s 30-day provision and longer matrimonial appellate limitation periods under particular statutes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>For a litigant in West Bengal, the safe course is therefore to have limitation calculated specifically from the actual Family Court judgment, the statute involved and the applicable Calcutta High Court and Supreme Court authorities.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Do not assume that you automatically have either 30 days or 90 days without a case-specific limitation calculation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A missed limitation period can create an entirely avoidable procedural problem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Also Read: <a href=\"https:\/\/www.legalserviceindia.com\/\/Legal-Articles\/wills-succession-inheritance-probate-india-2026\/\">Wills, Succession, Inheritance &amp; Probate in India: Complete 2026 Guide.<\/a><\/p>\n\n\n\n<h2 id=\"h-how-much-time-do-you-have-to-file-an-slp\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_Much_Time_Do_You_Have_to_File_an_SLP\"><\/span>How Much Time Do You Have to File an SLP?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The limitation applicable to an SLP is governed by the Supreme Court Rules and depends upon the nature and procedural circumstances of the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In civil matters, the commonly encountered limitation periods include 90 days in the ordinary situation and 60 days in specified circumstances involving refusal of a certificate, subject to the applicable Rules and the facts of the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The calculation should be made from the relevant judgment or order after taking into account the applicable procedural rules, exclusion of legally excludable time and any question of condonation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the petition is filed beyond the applicable period, an appropriate application for condonation of delay may be required.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For this reason, the safest practical advice is simple:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Do not wait until the last few days to decide whether to challenge a Calcutta High Court judgment in the Supreme Court.<\/strong><\/p>\n\n\n\n<h2 id=\"h-foreign-divorce-decree-can-a-foreign-court-s-divorce-be-recognised-in-india\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Foreign_Divorce_Decree_Can_a_Foreign_Courts_Divorce_Be_Recognised_in_India\"><\/span>Foreign Divorce Decree: Can a Foreign Court&#8217;s Divorce Be Recognised in India?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Cross-border matrimonial disputes require a different level of legal analysis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Imagine that a Hindu couple married in Kolkata. One spouse subsequently moved to the United States or United Kingdom. After the marriage broke down, the spouse living abroad obtained a divorce decree from a foreign court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The foreign decree is then produced before an Indian court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The foreign spouse says:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>\u201cThe marriage has already ended.\u201d<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Indian spouse says:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>\u201cThat foreign divorce is not legally effective in India.\u201d<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At that point, the existence of the foreign decree is only the beginning of the legal analysis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The important question becomes whether the foreign judgment is entitled to recognition or conclusiveness in India under Indian law.<\/p>\n\n\n\n<h2 id=\"h-section-13-cpc-and-foreign-judgments\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Section_13_CPC_and_Foreign_Judgments\"><\/span>Section 13 CPC and Foreign Judgments<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Section 13 of the Code of Civil Procedure, 1908<\/strong> provides the principal statutory framework for considering when a foreign judgment is or is not conclusive in India.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A foreign judgment may not be conclusive where, among other circumstances, it:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>has not been pronounced by a court of competent jurisdiction;<\/li>\n\n\n\n<li>has not been given on the merits of the case;<\/li>\n\n\n\n<li>appears to be founded on an incorrect view of international law or a refusal to recognise Indian law where such law is applicable;<\/li>\n\n\n\n<li>proceeds from proceedings opposed to natural justice;<\/li>\n\n\n\n<li>has been obtained by fraud; or<\/li>\n\n\n\n<li>sustains a claim founded on a breach of Indian law.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Consequently, neither of the following propositions is safe:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u201cEvery foreign divorce is automatically valid in India.\u201d<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">or<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u201cNo foreign divorce can ever be recognised in India.\u201d<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The answer depends upon the particular foreign court, its jurisdiction, the law governing the marriage, the ground on which the decree was granted, participation by the parties, service, natural justice, fraud and the other requirements of Section 13 CPC.<\/p>\n\n\n\n<h2 id=\"h-satya-v-teja-singh-foreign-divorce-and-jurisdiction\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Satya_v_Teja_Singh_Foreign_Divorce_and_Jurisdiction\"><\/span>Satya v. Teja Singh: Foreign Divorce and Jurisdiction<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the foundational Supreme Court authorities is <strong>Satya v. Vidushi Jain Bajoria, 2026 INSC 1034<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case has a direct Kolkata connection. The underlying proceedings included litigation before the Civil Judge at <strong>Alipore, South 24 Parganas<\/strong>, followed by proceedings before the Calcutta High Court and ultimately the Supreme Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The dispute involved parallel matrimonial proceedings in India and the United Kingdom and an attempt to restrain the foreign proceedings through an <strong>anti-suit injunction<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Indian court had granted an injunction affecting the foreign proceedings. The Indian court may then be asked to return the child or to recognise the foreign order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Indian law does not reduce this question to a mechanical rule that a foreign custody order must always be followed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <strong>welfare and best interests of the child<\/strong> remain central.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has considered international custody questions in authorities including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Dhanwanti Joshi v. and<\/li>\n\n\n\n<li>other applications required by the facts of the matter.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The objective should not be to make the petition unnecessarily long.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The objective is to make the legal error understandable to the Court quickly and accurately.<\/p>\n\n\n\n<h2 id=\"h-can-new-evidence-be-produced-for-the-first-time-in-the-supreme-court\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_New_Evidence_Be_Produced_for_the_First_Time_in_the_Supreme_Court\"><\/span>Can New Evidence Be Produced for the First Time in the Supreme Court?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">An SLP is not ordinarily an opportunity to start the entire trial again with a new collection of documents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court Rules contain procedural requirements concerning the material that can be relied upon in an SLP.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If genuinely new evidence becomes important, the appropriate application and legal basis for bringing that material on record should be considered.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Simply attaching documents to an SLP does not automatically make them part of the evidentiary record.<\/p>\n\n\n\n<h2 id=\"h-can-the-supreme-court-grant-interim-relief\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_the_Supreme_Court_Grant_Interim_Relief\"><\/span>Can the Supreme Court Grant Interim Relief?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Yes, depending upon the facts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But filing an SLP does <strong>not automatically stay<\/strong> the operation of the High Court judgment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where immediate protection is necessary, an appropriate interim-relief application should be considered.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending upon the case, the requested relief may concern:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>implementation of the impugned judgment;<\/li>\n\n\n\n<li>custody of a child;<\/li>\n\n\n\n<li>travel of a child;<\/li>\n\n\n\n<li>maintenance;<\/li>\n\n\n\n<li>execution of monetary directions;<\/li>\n\n\n\n<li>property-related consequences;<\/li>\n\n\n\n<li>continuation of proceedings; or<\/li>\n\n\n\n<li>other consequences that may become difficult to reverse.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In cross-border matrimonial cases, a party may also seek an anti-suit injunction against foreign proceedings. However, such relief is not automatic merely because parallel proceedings exist in India and another country.
