In law, nuisance is treated as a civil wrong (tort) and sometimes as a crime. It is not about minor daily annoyances. The interference must be substantial and go beyond what a reasonable person is expected to tolerate.<\/p>\n<p>Famous definitions include:<\/p>\n<ul>\n<li><strong>Winfield:<\/strong> Unlawful interference with a person\u2019s use or enjoyment of land, or of some right over or in connection with it.<\/li>\n<li><strong>Salmond:<\/strong> The wrong of unlawfully allowing the escape of harmful things (like smoke, noise, gas, or water) from one person\u2019s land to another\u2019s.<\/li>\n<\/ul>\n<p>Nuisance can arise from noise, smoke, smells, vibrations, dust, pollution, overhanging trees, blocking of light or air, or obstruction of public paths.<\/p>\n<h2 id=\"types-of-nuisance\"><span class=\"ez-toc-section\" id=\"Types_of_Nuisance\"><\/span>Types of Nuisance<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Nuisance is mainly divided into two kinds:<\/p>\n<h3 id=\"public-nuisance\"><span class=\"ez-toc-section\" id=\"Public_Nuisance\"><\/span>Public Nuisance<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>This affects the public at large or a large section of the community. It interferes with rights that everyone shares, such as the use of public roads, clean air, or public health and safety.<\/p>\n<p>Examples:<\/p>\n<ul>\n<li>Blocking a public road<\/li>\n<li>Polluting a river used by many people<\/li>\n<li>Creating excessive noise or foul smells that disturb an entire neighbourhood<\/li>\n<li>Dumping garbage that breeds mosquitoes and affects public health<\/li>\n<\/ul>\n<p>In India, public nuisance is defined under Section 270 of the Bharatiya Nyaya Sanhita. It is both a crime and a civil wrong. An ordinary person can usually sue only if they suffer special damage (harm greater than what the public suffers).<\/p>\n<h3 id=\"right-of-private-individual-to-sue-for-public-nuisance\"><span class=\"ez-toc-section\" id=\"Right_of_a_Private_Individual_to_Sue_for_Public_Nuisance\"><\/span>Right of a Private Individual to Sue for Public Nuisance<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>A private individual generally has no right to sue for public nuisance as it is primarily a crime actionable by the State, but an exception exists where the individual can file a civil suit if he proves special or particular damage\u2014harm that is greater in degree or different in kind from that suffered by the general public, such as extra expense from a blocked road, specific damage to his business or clinic, or unique physical or financial loss. This principle is well-established in Indian law, as seen in <em>Ram Raj Singh v. Babulal<\/em>, where a doctor was allowed to sue due to special interference with his clinic, and it follows the common law rule requiring particular damage beyond common public injury; without such special damage, only the State or public authorities can take action against public nuisance.<\/p>\n<h3 id=\"private-nuisance\"><span class=\"ez-toc-section\" id=\"Private_Nuisance\"><\/span>Private Nuisance<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>This affects a specific individual or a small number of people in the use or enjoyment of their private land.<\/p>\n<p>Examples:<\/p>\n<ul>\n<li>A neighbour\u2019s factory producing constant loud noise and dust that enters your house<\/li>\n<li>Smoke or foul smells from a nearby business<\/li>\n<li>Roots of a neighbour\u2019s tree damaging your wall<\/li>\n<li>Continuous vibrations from heavy machinery<\/li>\n<\/ul>\n<p>Private nuisance is a pure civil wrong. The affected person can file a lawsuit for compensation or to stop the activity.<\/p>\n<h2 id=\"essential-elements-of-nuisance\"><span class=\"ez-toc-section\" id=\"Essential_Elements_of_Nuisance_Especially_Private_Nuisance\"><\/span>Essential Elements of Nuisance (Especially Private Nuisance)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>To succeed in a claim for private nuisance, the following must usually be proved:<\/p>\n<ul>\n<li><strong>Wrongful or Unreasonable Interference<\/strong> \u2013 The act must be more than a minor inconvenience. Courts look at the locality (what is normal in an industrial area may not be acceptable in a quiet residential colony), duration, intensity, and time of day.<\/li>\n<li><strong>Interference with Use or Enjoyment of Land<\/strong> \u2013 This can be physical damage to property or interference with comfort and convenience (noise, smell, etc.).<\/li>\n<li><strong>Damage<\/strong> \u2013 There must be actual or substantial harm. Minor or temporary annoyance is usually not enough.<\/li>\n<li><strong>Plaintiff\u2019s Interest in Land<\/strong> \u2013 The person suing must have a legal interest in the affected property (owner, tenant, etc.).<\/li>\n<\/ul>\n<p>Public nuisance requires proof that the act affects the public or a class of people and, for private civil action, special damage.<\/p>\n<h2 id=\"remedies-for-public-and-private-nuisance\"><span class=\"ez-toc-section\" id=\"Remedies_for_Public_Nuisance_and_Private_Nuisance\"><\/span>Remedies for Public Nuisance and Private Nuisance<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<h3 id=\"remedies-for-public-nuisance\"><span class=\"ez-toc-section\" id=\"Remedies_for_Public_Nuisance\"><\/span>Remedies for Public Nuisance<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li><strong>Criminal Prosecution<\/strong> \u2013 Action under criminal law (e.g., Section 270 BNS) leading to fine or other penalties.<\/li>\n<li><strong>Injunction<\/strong> \u2013 Court order obtained by the State, public authority, or an individual (who has suffered special damage) to stop the nuisance.<\/li>\n<li><strong>Abatement by Public Authorities<\/strong> \u2013 Removal or stopping of the nuisance by government or local authorities (e.g., under Section 152 BNSS).<\/li>\n<li><strong>Damages<\/strong> \u2013 Available to a private individual only if he proves special damage (harm greater than that suffered by the general public).<\/li>\n<li><strong>Declaration or Other Civil Remedies<\/strong> \u2013 In suitable cases, courts may grant declaratory relief or direct authorities to take action.<\/li>\n<\/ul>\n<h3 id=\"remedies-for-private-nuisance\"><span class=\"ez-toc-section\" id=\"Remedies_for_Private_Nuisance\"><\/span>Remedies for Private Nuisance<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li><strong>Damages<\/strong> \u2013 Monetary compensation for the loss, discomfort, or injury suffered.<\/li>\n<li><strong>Injunction<\/strong> \u2013 Court order to stop or restrain the continuation of the nuisance (temporary or permanent).<\/li>\n<li><strong>Abatement<\/strong> \u2013 Self-help remedy where the affected person can reasonably remove or stop the nuisance (e.g., cutting overhanging branches) after giving notice, if required.<\/li>\n<\/ul>\n<h2 id=\"defences-available-in-nuisance\"><span class=\"ez-toc-section\" id=\"Defences_Available\"><\/span>Defences Available<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Common defences against a nuisance claim include:<\/p>\n<ul>\n<li><strong>Statutory Authority<\/strong> \u2013 The activity is specifically allowed by law (for example, certain public works).<\/li>\n<li><strong>Prescription<\/strong> \u2013 The activity has continued openly for a long period (usually 20 years) and the right has been acquired.<\/li>\n<li><strong>Consent of the Plaintiff<\/strong> \u2013 The affected person agreed to the activity.<\/li>\n<li><strong>Act of God or Inevitable Accident<\/strong> \u2013 The harm was caused by natural forces beyond control and without negligence.<\/li>\n<li><strong>Coming to the Nuisance<\/strong> \u2013 It is generally <strong>not<\/strong> a strong defence. Moving next to an existing activity does not automatically prevent a claim if the interference is unreasonable.<\/li>\n<\/ul>\n<h2 id=\"invalid-defences-in-nuisance\"><span class=\"ez-toc-section\" id=\"Invalid_Defences_in_Nuisance_Brief\"><\/span>Invalid Defences in Nuisance (Brief)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>These arguments are <strong>not accepted<\/strong> as complete defences in nuisance cases:<\/p>\n<h3 id=\"coming-to-the-nuisance\"><span class=\"ez-toc-section\" id=\"Coming_to_the_Nuisance\"><\/span>Coming to the Nuisance<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>It is no defence that the plaintiff moved next to an already existing activity.<\/p>\n<p>(<em>Sturges v. Bridgman<\/em>, <em>Bliss v.
