for example, careless driving that injures someone amounts to the tort of negligence, while deliberately hitting someone constitutes the tort of battery.<\/p>\n\n\n\n<h2 id=\"h-essential-requirements-of-tortious-liability\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Essential_Requirements_of_Tortious_Liability\"><\/span>Essential Requirements of Tortious Liability<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Wrongful act or omission:<\/strong> Doing something wrong or failing to do something the law requires.<\/li>\n\n\n\n<li><strong>Legal damage (injuria sine damno):<\/strong> Violation of a legal right (even without money loss).<\/li>\n\n\n\n<li><strong>Legal remedy available:<\/strong> Where there is a right, there is a remedy.<\/li>\n\n\n\n<li><strong>Causation:<\/strong> The defendant\u2019s act or omission must be the real cause of the harm. This involves two steps: (i) (i) the harm would not have occurred but for the defendant\u2019s conduct (the \u2018but-for\u2019 test), and (ii) the connection must not be too remote.<\/li>\n\n\n\n<li><strong>No valid defence:<\/strong> Liability will not arise if the defendant successfully raises a recognised defence, such as consent (volenti non fit injuria), self-defence, necessity, Act of God (vis major), inevitable accident, or statutory authority.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-physical-element-what-happened-outside\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Physical_Element_What_Happened_Outside\"><\/span>Physical Element (What Happened Outside)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Positive act:<\/strong> (e.g., hitting, entering land without permission).<\/li>\n\n\n\n<li><strong>Actionable omission:<\/strong> Failure to act when there is a duty.<\/li>\n\n\n\n<li><strong>Resulting injury or damage:<\/strong> (to body, property, reputation, etc.).<\/li>\n\n\n\n<li><strong>Clear link between the act\/omission and the harm.<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Common law does not force people to help others, unless a legal duty exists.<\/p>\n\n\n\n<h2 id=\"h-mental-element-state-of-mind\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Mental_Element_State_of_Mind\"><\/span>Mental Element (State of Mind)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Spectrum of fault:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Intention:<\/strong> Deliberately causing harm (needed in battery, assault, false imprisonment, and trespass).<\/li>\n\n\n\n<li><strong>Recklessness:<\/strong> Knowing a big risk and ignoring it.<\/li>\n\n\n\n<li><strong>Negligence:<\/strong> Failing to take reasonable care (most common).<\/li>\n\n\n\n<li><strong>Strict liability:<\/strong> Liable even without fault.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-key-points-on-the-mental-element\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Key_Points_on_the_Mental_Element\"><\/span>Key Points on the Mental Element<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Intention<\/strong> means the defendant either deliberately aims to produce a particular result or knows with substantial certainty that the result will follow from their act.<\/li>\n\n\n\n<li><strong>Knowledge of a danger or risk<\/strong> raises the standard of care expected; ignoring a known hazard can amount to fault.<\/li>\n\n\n\n<li><strong>Malice<\/strong> (ill-will or improper motive) is generally not required for liability, except in a few specific torts such as malicious prosecution.<\/li>\n\n\n\n<li><strong>Negligence<\/strong> is established by proving four elements: a legal duty of care, breach of that duty, causation, and legally recognised damage.<\/li>\n\n\n\n<li><strong>Motive<\/strong> (the underlying reason for the act) is usually irrelevant; what matters is intention (the immediate purpose or knowledge of the consequences).<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-summary-comparison\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Summary_Comparison\"><\/span>Summary Comparison<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Aspect<\/th><th>Physical Element<\/th><th>Mental Element<\/th><\/tr><\/thead><tbody><tr><td><strong>Focus<\/strong><\/td><td>The external act or omission and the harm that results from it<\/td><td>The defendant\u2019s state of mind or degree of carelessness<\/td><\/tr><tr><td><strong>Required in<\/strong><\/td><td>Present in almost every tort<\/td><td>Required only in some torts; not needed under strict liability<\/td><\/tr><tr><td><strong>Standard<\/strong><\/td><td>Purely objective \u2013 based on what actually happened<\/td><td>Either subjective (actual intention\/knowledge) or objective (\u201creasonable person\u201d test in negligence)<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">In short, the physical element looks at what was done and the harm caused, while the mental element examines how blameworthy the defendant\u2019s mind was.<\/p>\n\n\n\n<h2 id=\"h-bottom-line\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Bottom_Line\"><\/span>Bottom Line<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Tort liability rests on a combination of the physical element (what the defendant actually did or failed to do and the harm that resulted) and the mental element (the degree of blameworthiness in the defendant\u2019s state of mind).
