Gill case illustrates that physical contact need not necessarily result in bodily injury to make the conduct legally actionable; the nature, intention and circumstances of the contact are important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In civil cases, Indian courts have generally applied common-law principles concerning assault, battery, intention, apprehension of immediate force, unlawful physical contact and lawful justification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cases such as Stephens v. Myers and Collins v. Wilcock remain useful common-law authorities for understanding the basic distinction between assault and battery, though their application must be considered in the context of Indian law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under the Bharatiya Nyaya Sanhita, 2023 (BNS), certain forms of assault, criminal force, hurt and grievous hurt are dealt with as criminal offences.
