An insurance company can be legally challenged in India for wrongful claim rejection, unreasonable delay, underpayment, unfair exclusions or deficiency in service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But filing a case is not the first question.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The real question is: where should you file it?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Choose the wrong forum, ignore limitation or file without the right documents, and even a genuine insurance claim can become a procedural mess.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Updated:<\/strong> October 2026<\/p>\n\n\n\n<h2 id=\"h-can-you-actually-sue-an-insurance-company-in-india\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_You_Actually_Sue_an_Insurance_Company_in_India\"><\/span>Can You Actually Sue an Insurance Company in India?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Yes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on the policy, claimant and nature of dispute, remedies may be available through the Insurance Ombudsman, Consumer Commission, Civil Court or Commercial Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Insurance companies are governed not merely by the wording of their policies but also by the Insurance Act, 1938, Consumer Protection Act, 2019, applicable IRDAI regulations and binding judicial precedent. The current IRDAI framework includes the IRDAI (Protection of Policyholders\u2019 Interests, Operations and Allied Matters of Insurers) Regulations, 2024.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A repudiation letter is therefore the insurer\u2019s decision. It is not a court judgment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If that decision is contrary to the policy, evidence or law, it can be challenged.<\/p>\n\n\n\n<h2 id=\"h-when-can-an-insurance-company-be-challenged\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"When_Can_an_Insurance_Company_Be_Challenged\"><\/span>When Can an Insurance Company Be Challenged?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Typical disputes arise when an insurer:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>rejects a health, life, motor, fire, property, marine or commercial claim;<\/li>\n\n\n\n<li>relies on an exclusion that was not properly disclosed;<\/li>\n\n\n\n<li>alleges suppression of medical or other material facts without adequate proof;<\/li>\n\n\n\n<li>delays settlement;<\/li>\n\n\n\n<li>undervalues the loss;<\/li>\n\n\n\n<li>disputes a surveyor\u2019s assessment; or<\/li>\n\n\n\n<li>relies upon a procedural breach that did not materially affect an otherwise genuine claim.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, policyholders must understand the other side of the law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Insurance is a contract of utmost good faith. A genuine material non-disclosure can legally destroy a claim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has repeatedly emphasised duties on both sides. The insured must disclose material facts honestly, while the insurer must communicate policy terms fairly and prove the factual basis for repudiation. In <em>Maha Kali Sujatha v. Branch Manager, Future Generali India Life Insurance Co. The current monetary ceiling is \u20b950 lakh.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Read Also:<\/strong> Highlights of UCC in Uttarakhand<\/p>\n\n\n\n<h2 id=\"h-insurance-ombudsman-do-not-use-the-old-30-lakh-figure\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Insurance_Ombudsman_Do_Not_Use_the_Old_%E2%82%B930_Lakh_Figure\"><\/span>Insurance Ombudsman: Do Not Use the Old \u20b930 Lakh Figure<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is important for any 2026 article.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The current Council for Insurance Ombudsmen material states that complaints within its eligibility framework can involve compensation of up to \u20b950 lakh. Older material referring to \u20b930 lakh is outdated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is no fee for lodging an Ombudsman complaint, and the Ombudsman framework does not provide for engaging a lawyer before it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For a simple eligible dispute, this can be an effective route.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For complex evidence, higher-value claims, wider compensation or disputes outside Ombudsman eligibility, another forum may be necessary.<\/p>\n\n\n\n<h2 id=\"h-can-you-file-a-consumer-case-against-an-insurance-company\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_You_File_a_Consumer_Case_Against_an_Insurance_Company\"><\/span>Can You File a Consumer Case Against an Insurance Company?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Yes, where the complainant falls within the Consumer Protection Act and the facts disclose deficiency in service or another recognised cause of action.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under Section 69 of the Consumer Protection Act, 2019, the ordinary limitation period is two years from the date the cause of action arises. A delayed complaint may still be entertained upon sufficient cause, but condonation is discretionary and reasons must be recorded.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The current pecuniary limits are based on the value of goods or services paid as consideration, not simply the amount demanded as compensation:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Commission<\/th><th>Present Pecuniary Jurisdiction<\/th><\/tr><\/thead><tbody><tr><td>District Commission<\/td><td>Up to \u20b950 lakh<\/td><\/tr><tr><td>State Commission<\/td><td>Above \u20b950 lakh and up to \u20b92 crore<\/td><\/tr><tr><td>National Commission<\/td><td>Above \u20b92 crore<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">These limits come from the Consumer Protection jurisdiction rules notified in 2021.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is a point many insurance claimants miss.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For insurance disputes, the NCDRC has treated the premium paid as the consideration for determining pecuniary jurisdiction under the 2019 Act. Therefore, a claim worth crores does not automatically mean that the original consumer complaint belongs before the National Commission.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Claim amount and jurisdiction amount are not necessarily the same thing.<\/strong><\/p>\n\n\n\n<h2 id=\"h-can-a-business-sue-its-insurance-company-before-a-consumer-commission\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_a_Business_Sue_Its_Insurance_Company_Before_a_Consumer_Commission\"><\/span>Can a Business Sue Its Insurance Company Before a Consumer Commission?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Possibly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>National Insurance Co. Ltd. v. Harsolia Motors<\/em>, (2023) 8 SCC 362, the Supreme Court rejected the proposition that purchasing insurance by a commercial entity automatically makes the insurance service a \u201ccommercial purpose.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Insurance ordinarily protects against loss rather than itself generating profit. The dominant purpose and nexus with profit-making therefore matter. Ltd.<\/em>, (2020) 11 SCC 612, a three-judge Bench dealt with delayed intimation to the insurer where the theft had been promptly reported to police and found genuine.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court held:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cmere delay in intimating the insurance company about the theft\u201d should not shelter repudiation of an otherwise genuine claim.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The Court specifically held that where the FIR was promptly lodged, police investigation confirmed the vehicle remained untraced and the insurer\u2019s investigator found the theft genuine, mere delayed intimation to the insurer could not defeat the claim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Lesson:<\/strong> Delay matters. Oriental Insurance Co. Ltd.<\/em>, (2009) 8 SCC 507, the Supreme Court held that surveyor reports deserve due importance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An insurer may disagree with a surveyor for valid reasons, but it cannot keep appointing surveyors merely to obtain a favourable report. The Court required cogent reasons for rejecting the earlier assessment and appointing another surveyor.<\/p>\n\n\n\n<h3 id=\"h-alleged-non-disclosure-must-be-proved\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Alleged_Non-Disclosure_Must_Be_Proved\"><\/span>Alleged Non-Disclosure Must Be Proved<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Maha Kali Sujatha v. Branch Manager, Future Generali India Life Insurance Co. Ltd.<\/em>, 2024 INSC 296, the Supreme Court set aside repudiation where the insurer failed to establish its allegation regarding undisclosed prior policies with adequate evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court reiterated that a material fact is one capable of influencing the judgment of a prudent insurer and that the insurer\u2019s disclosure obligations are reciprocal. The claimant ultimately succeeded, and the insurer was directed to pay the policy amounts with interest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Suspicion is not proof. A repudiation letter cannot replace evidence.<\/strong><\/p>\n\n\n\n<h3 id=\"h-but-policyholders-cannot-conceal-material-facts-either\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"But_Policyholders_Cannot_Conceal_Material_Facts_Either\"><\/span>But Policyholders Cannot Conceal Material Facts Either<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Reliance Life Insurance Co. Rekhaben Nareshbhai Rathod<\/em>, (2019) 6 SCC 175, the insured had failed to disclose a prior life insurance policy despite a specific question in the proposal form.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court treated the prior policy as material to underwriting and upheld repudiation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is why an insurance dispute must be analysed on evidence, not emotion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The law protects a genuine claimant.
