What can I do now?\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is the perspective from which the <strong>court system in India<\/strong> is best understood.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India has a single integrated judicial system. At the top is the Supreme Court of India, followed by the High Courts and then the subordinate courts. Alongside these courts are specialised tribunals, commissions and statutory forums dealing with particular categories of disputes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But a case does not necessarily travel through every level. The correct route depends upon the nature of the dispute, the statute involved, the jurisdiction of the forum that passed the order and the remedy available under law.<\/p>\n\n\n\n<h2 id=\"h-where-most-litigation-begins-the-district-and-subordinate-courts\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Where_Most_Litigation_Begins_The_District_and_Subordinate_Courts\"><\/span>Where Most Litigation Begins: The District and Subordinate Courts<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">For an ordinary litigant, the District Court level is often where the legal battle actually begins.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On the civil side, different courts may hear suits depending upon the nature and value of the dispute and the allocation of jurisdiction under applicable State laws. Civil Judges and District Judges deal with civil matters, while the District Judge generally occupies the position of the principal civil court of original jurisdiction in the district.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Criminal proceedings follow a different structure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending upon the offence and the stage of the proceedings, a matter may come before a Judicial Magistrate, Chief Judicial Magistrate or Sessions Court. Serious offences triable by a Court of Session are dealt with at the Sessions level.<\/p>\n\n\n\n<h3 id=\"h-specialised-forums-and-subordinate-courts\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Specialised_Forums_and_Subordinate_Courts\"><\/span>Specialised Forums and Subordinate Courts<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">There is also an important recent development that every litigant should understand.<\/p>\n\n\n\n<h3 id=\"h-india-s-criminal-law-framework-changed-in-2024\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Indias_Criminal-Law_Framework_Changed_in_2024\"><\/span>India&#8217;s Criminal-Law Framework Changed in 2024<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Indian criminal justice system moved from the older IPC, CrPC and Indian Evidence Act framework to three new central criminal laws:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Bharatiya Nyaya Sanhita, 2023 (BNS)<\/strong> \u2014 replacing the Indian Penal Code, 1860;<\/li>\n\n\n\n<li><strong>Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS)<\/strong> \u2014 replacing the Code of Criminal Procedure, 1973; and<\/li>\n\n\n\n<li><strong>Bharatiya Sakshya Adhiniyam, 2023 (BSA)<\/strong> \u2014 replacing the Indian Evidence Act, 1872.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These laws came into force on 1 July 2024, subject to the transition provisions applicable to matters instituted under the earlier legal framework.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, when dealing with a contemporary criminal case, it is no longer sufficient to ask which section of the IPC or CrPC applies. The date and circumstances of the proceedings must also be examined to determine the applicable statutory regime.<\/p>\n\n\n\n<h2 id=\"h-what-does-a-trial-court-actually-do\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Does_a_Trial_Court_Actually_Do\"><\/span>What Does a Trial Court Actually Do?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is where the distinction between a trial and an appeal becomes important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The trial court is generally the court that deals most directly with the facts of the dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a civil case, this may involve:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>examining documents;<\/li>\n\n\n\n<li>framing issues;<\/li>\n\n\n\n<li>recording evidence;<\/li>\n\n\n\n<li>examining and cross-examining witnesses;<\/li>\n\n\n\n<li>considering admissions and pleadings; and<\/li>\n\n\n\n<li>determining the rights and liabilities of the parties.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In a criminal trial, the court examines the prosecution case, evidence, defence, witnesses and applicable law before determining whether the accused is guilty or not guilty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In simple terms, the trial court is usually where the question \u201cWhat actually happened?\u201d is examined most extensively.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That becomes extremely important later.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A litigant who reaches an appellate court should not assume that the entire case will simply be tried again from the beginning.<\/p>\n\n\n\n<h2 id=\"h-what-happens-if-you-lose\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Happens_If_You_Lose\"><\/span>What Happens If You Lose?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is where many litigants misunderstand the <strong>court system in India<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Losing before one court does not automatically mean that you can simply approach the next higher court and ask it to reconsider everything.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The first question is:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What remedy does the law provide against this particular order?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending upon the case, it may be:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a first appeal;<\/li>\n\n\n\n<li>a second appeal;<\/li>\n\n\n\n<li>a criminal appeal;<\/li>\n\n\n\n<li>a revision;<\/li>\n\n\n\n<li>a writ petition;<\/li>\n\n\n\n<li>a statutory appeal;<\/li>\n\n\n\n<li>a review; or<\/li>\n\n\n\n<li>in an appropriate case, a Special Leave Petition before the Supreme Court.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The remedy must be determined from the statute and the nature of the order\u2014not merely from the fact that the litigant has lost.<\/p>\n\n\n\n<h2 id=\"h-first-appeal-the-first-major-opportunity-for-review\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"First_Appeal_The_First_Major_Opportunity_for_Review\"><\/span>First Appeal: The First Major Opportunity for Review<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A first appeal is generally much wider than a second appeal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In an appropriate civil appeal, the appellate court may examine both questions of fact and questions of law, subject to the statutory framework governing the particular proceeding.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This means that the appellate court can, where permitted, examine whether the trial court correctly appreciated the evidence and whether the law was properly applied.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For a litigant, therefore, the first appeal can be a crucial stage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is not merely a formality.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A weakly prepared appeal may fail to identify the actual errors in the trial court&#8217;s judgment. It may intervene where there has been a jurisdictional error, material irregularity or another legally recognised ground for revisional interference.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court does not ordinarily treat revision as an unrestricted opportunity to re-try the entire dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction is practically important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before filing anything described as a \u201crevision,\u201d a lawyer must first determine whether the statute actually permits revision against the particular order.<\/p>\n\n\n\n<h2 id=\"h-specialised-courts-tribunals-and-commissions\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Specialised_Courts_Tribunals_and_Commissions\"><\/span>Specialised Courts, Tribunals and Commissions<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The <strong>court system in India<\/strong> is broader than the traditional hierarchy of civil and criminal courts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A dispute may begin before a specialised forum created by legislation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Examples include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Family Courts;<\/li>\n\n\n\n<li>Consumer Commissions;<\/li>\n\n\n\n<li>Motor Accident Claims Tribunals;<\/li>\n\n\n\n<li>Labour and Industrial forums;<\/li>\n\n\n\n<li>Debt Recovery Tribunals;<\/li>\n\n\n\n<li>National Company Law Tribunal;<\/li>\n\n\n\n<li>National Company Law Appellate Tribunal;<\/li>\n\n\n\n<li>tax and other statutory tribunals; and<\/li>\n\n\n\n<li>various other regulatory and specialised adjudicatory bodies.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These institutions are not simply additional levels of the ordinary civil-court hierarchy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Their jurisdiction comes from the statute creating them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is why the first question in a specialised dispute should often be:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cWhich statute governs this dispute, and what remedy does that statute provide?\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The answer determines where the case should begin and where an aggrieved party can challenge the resulting order.<\/p>\n\n\n\n<h2 id=\"h-the-high-court-much-more-than-an-appeal-court\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_High_Court_Much_More_Than_an_Appeal_Court\"><\/span>The High Court: Much More Than an Appeal Court<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The High Court occupies a particularly important position in the <strong>court system in India<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are currently 25 High Courts exercising jurisdiction over the States and Union Territories in accordance with the constitutional and statutory framework. Some High Courts have jurisdiction extending over more than one State or Union Territory.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A High Court can hear appeals and revisions from subordinate courts, subject to the relevant law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But its constitutional jurisdiction is equally important.<\/p>\n\n\n\n<h3 id=\"h-writ-jurisdiction-under-article-226\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Writ_Jurisdiction_Under_Article_226\"><\/span>Writ Jurisdiction Under Article 226<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Article 226 gives High Courts the power to issue writs and directions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A person may, in an appropriate case, approach the High Court directly to challenge unlawful government or public-authority action.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The traditional constitutional writs include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Habeas Corpus<\/strong><\/li>\n\n\n\n<li><strong>Mandamus<\/strong><\/li>\n\n\n\n<li><strong>Certiorari<\/strong><\/li>\n\n\n\n<li><strong>Prohibition<\/strong><\/li>\n\n\n\n<li><strong>Quo Warranto<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Importantly, Article 226 is not confined only to enforcement of fundamental rights. The High Court&#8217;s writ jurisdiction extends to other legal rights as well, subject to the constitutional limitations and principles governing writ jurisdiction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is why a person does not necessarily have to start with a civil suit before approaching the High Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But there is an important qualification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The existence of an alternative statutory remedy can influence whether a High Court should exercise its writ jurisdiction. The High Court may decline to entertain a writ petition where an effective alternative remedy exists, although this is a rule of judicial discretion rather than an absolute constitutional prohibition.<\/p>\n\n\n\n<h3 id=\"h-the-high-court-can-also-supervise-the-subordinate-judiciary\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_High_Court_Can_Also_Supervise_the_Subordinate_Judiciary\"><\/span>The High Court Can Also Supervise the Subordinate Judiciary<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The High Court is not merely an appellate court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under the Constitution, it exercises powers of superintendence over courts within its jurisdiction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This gives the High Court a constitutional supervisory role over the subordinate judicial system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consequently, the High Court can become involved in a case in several different ways:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>as an appellate court;<\/li>\n\n\n\n<li>as a revisional court;<\/li>\n\n\n\n<li>as a constitutional writ court; and<\/li>\n\n\n\n<li>where the law permits, in other forms of supervisory or original jurisdiction.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Which route is available depends entirely upon the facts and governing legislation.<\/p>\n\n\n\n<h2 id=\"h-when-does-a-case-reach-the-supreme-court-of-india\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"When_Does_a_Case_Reach_the_Supreme_Court_of_India\"><\/span>When Does a Case Reach the Supreme Court of India?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court is the highest court in the <strong>court system in India<\/strong>, but it is important to understand that it is not simply a third appeal available automatically in every case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court exercises several forms of jurisdiction, including original, appellate and advisory jurisdiction. The Supreme Court itself describes Article 32 as conferring original jurisdiction for this purpose.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court also has original jurisdiction in certain disputes between the Union and States and between States under Article 131, subject to the constitutional requirements governing that jurisdiction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, the statement that \u201cevery case must first go to the District Court, then High Court and finally Supreme Court\u201d is an oversimplification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Indian judicial system contains several constitutional and statutory routes.<\/p>\n\n\n\n<h2 id=\"h-a-simple-example-a-property-dispute\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_Simple_Example_A_Property_Dispute\"><\/span>A Simple Example: A Property Dispute<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose A claims ownership of a property and B disputes it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case may begin before the competent civil court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The trial court examines the pleadings, documents and evidence and eventually passes a judgment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose A loses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A may then have a statutory right of appeal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the first appellate court also decides against A, another appeal may or may not be available. In an appropriate civil matter, a second appeal to the High Court may arise only where the statutory requirements\u2014including the existence of a substantial question of law under Section 100 of the Code of Civil Procedure\u2014are satisfied.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the High Court decides against A, A may consider approaching the Supreme Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But again, the Supreme Court route is not automatic.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The legal question becomes whether the case satisfies the requirements for the particular Supreme Court remedy, including whether the Court should exercise its jurisdiction under Article 136.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is how a real case moves through the <strong>court system in India<\/strong>: not mechanically from one box to the next, but through remedies created by the Constitution and applicable legislation.<\/p>\n\n\n\n<h2 id=\"h-the-digital-transformation-of-india-s-courts\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Digital_Transformation_of_Indias_Courts\"><\/span>The Digital Transformation of India&#8217;s Courts<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is another important change in the way litigants interact with the <strong>court system in India<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Court administration is increasingly digital.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The e-Courts project provides online access to case information, cause lists and, in many cases, orders and judgments. The National Judicial Data Grid (NJDG) has become an important national repository of judicial data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court was brought onto the NJDG in January 2024, completing the integration of the Supreme Court with the three-tier judicial data ecosystem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The e-Courts system currently provides access to information concerning District Courts and High Courts, including case-status and other judicial information.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For a litigant, this has a practical consequence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You should no longer depend entirely upon informal updates such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u201cThe matter was listed.\u201d<\/li>\n\n\n\n<li>\u201cThe order has come.\u201d<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Case status, orders, listings and other information can often be checked through the official court and e-Courts systems.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, online information should still be verified against the official court record where the issue is legally important. It is not an automatic right of appeal.<\/p>\n\n\n\n<h3 id=\"h-are-tribunals-part-of-the-ordinary-court-hierarchy\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Are_Tribunals_Part_of_the_Ordinary_Court_Hierarchy\"><\/span>Are Tribunals Part of the Ordinary Court Hierarchy?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Not exactly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tribunals are statutory adjudicatory bodies created for particular areas of law. Their relationship with the High Courts and Supreme Court depends upon the Constitution, the statute creating the tribunal and the applicable judicial precedents.<\/p>\n\n\n\n<h3 id=\"h-can-i-challenge-a-district-court-judgment-in-the-high-court\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_I_Challenge_a_District_Court_Judgment_in_the_High_Court\"><\/span>Can I Challenge a District Court Judgment in the High Court?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Often yes, but the precise remedy depends upon the nature of the order and the governing statute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It may be an appeal, second appeal, revision or another proceeding.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The fact that a District Court has passed the order does not, by itself, tell you which remedy is available.<\/p>\n\n\n\n<h2 id=\"h-the-most-important-lesson-for-a-litigant\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Most_Important_Lesson_for_a_Litigant\"><\/span>The Most Important Lesson for a Litigant<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The <strong>court system in India<\/strong> is not simply a ladder on which every case climbs from District Court to High Court and then to the Supreme Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is better understood as a system of different judicial and statutory remedies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The right question after receiving an adverse order is not:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cWhich is the next higher court?\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">It is:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>\u201cWhat is the legally available remedy against this particular order, where must it be filed, and what is the limitation period?\u201d<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction can make the difference between a remedy being effectively pursued and a valuable legal right being lost.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For anyone facing litigation, the judgment or order should therefore be examined immediately\u2014not only for who won and who lost, but also for the <strong>jurisdiction, remedy, limitation period, grounds of challenge and appropriate appellate forum<\/strong>.<\/p>\n\n\n\n<h2 id=\"h-a-final-practical-point\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_Final_Practical_Point\"><\/span>A Final Practical Point<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">India&#8217;s judiciary is increasingly accessible through digital systems.
