question of maintainability, without reopening the substantive pension dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction is essential.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judgment is primarily a decision on procedural finality and the limits of a subsequent Article 136 challenge, rather than a judgment determining the pension entitlement itself.<\/p>\n\n\n\n<h2 id=\"h-the-procedural-history\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Procedural_History\"><\/span>The Procedural History<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">To understand the judgment, the chronology is more important than it may initially appear.<\/p>\n\n\n\n<h3 id=\"h-the-original-high-court-proceedings\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Original_High_Court_Proceedings\"><\/span>The Original High Court Proceedings<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The dispute originated before the Himachal Pradesh High Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Single Judge passed an order on 15 May 2012 in CWP No. 1679 of 2010.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The matter subsequently travelled through Letters Patent Appeal proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On 12 August 2022, the Supreme Court, in Civil Appeal No. 5251 of 2022, restored LPA No. 316 of 2012 to the High Court because the Division Bench had not decided the matter on merits.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Division Bench subsequently decided the LPA on 26 February 2024.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Bank then approached the Supreme Court.<\/p>\n\n\n\n<h3 id=\"h-the-first-slp\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_First_SLP\"><\/span>The First SLP<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Bank filed SLP (C) No. 16819 of 2024 against the High Court&#8217;s decision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On 23 September 2024, the Supreme Court dismissed the SLP.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court found no occasion to interfere with the High Court&#8217;s order in exercise of its jurisdiction under Article 136.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There was, however, an important qualification:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe question of law is kept open.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">This phrase subsequently became significant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is important to understand what it did\u2014and what it did not do.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It did not keep the particular dispute between the parties indefinitely open.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It preserved the question of law for appropriate consideration in another case or in circumstances where the question properly arose.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It did not amount to a general reservation of a right for the Bank to return to the Supreme Court after pursuing another remedy.<\/p>\n\n\n\n<h3 id=\"h-the-recall-application-and-limited-liberty\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Recall_Application_and_Limited_Liberty\"><\/span>The Recall Application and Limited Liberty<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">After dismissal of the first SLP, the Bank filed a miscellaneous application seeking recall of the Supreme Court&#8217;s order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On 20 December 2024, after arguments, the Bank sought permission to withdraw the application so that it could approach the High Court by way of review.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court permitted the withdrawal and granted liberty to pursue the review before the High Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This wording was crucial.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The liberty was to approach the High Court in review.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There was no corresponding liberty to return to the Supreme Court if the review failed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction ultimately became central to the Supreme Court&#8217;s decision.<\/p>\n\n\n\n<h2 id=\"h-the-high-court-review\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_High_Court_Review\"><\/span>The High Court Review<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Bank thereafter filed <strong>Review Petition No. 18 of 2025<\/strong> before the Himachal Pradesh High Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The High Court dismissed the review petition on <strong>11 April 2025<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Bank then approached the Supreme Court again.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This resulted in <strong>SLP (C) No. 15870 of 2025<\/strong>, which became the subject of the judgment reported as <strong>2025 INSC 1416<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The respondents raised a preliminary objection to its maintainability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court accepted that objection.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-what-did-the-supreme-court-actually-hold\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Did_the_Supreme_Court_Actually_Hold\"><\/span>What Did the Supreme Court Actually Hold?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is where precision matters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court did <strong>not<\/strong> establish a blanket rule that every second SLP following an earlier SLP is prohibited.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, the Court examined the particular procedural history.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Bank had already challenged the High Court judgment before the Supreme Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That SLP had been dismissed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Bank subsequently obtained only limited liberty to approach the High Court in review.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The High Court review was then dismissed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Bank attempted to return to the Supreme Court without having obtained specific liberty to do so.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court concluded that the earlier proceedings had attained finality between the parties and that the subsequent SLP could not be used to reopen the same dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court therefore dismissed the SLP as <strong>not maintainable<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-dismissal-of-an-slp-is-not-the-same-as-grant-of-leave\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Dismissal_of_an_SLP_Is_Not_the_Same_as_Grant_of_Leave\"><\/span>Dismissal of an SLP Is Not the Same as Grant of Leave<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the most important aspects of the judgment concerns the doctrine of merger.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An SLP under Article 136 is not itself an appeal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court first decides whether special leave should be granted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If leave is refused, the matter does not ordinarily become an appeal before the Supreme Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This principle was explained comprehensively in <strong><em>Kunhayammed v. State of Kerala<\/em>, (2000) 6 SCC 359<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The dismissal of an SLP without grant of leave ordinarily does not result in the merger of the High Court judgment into a Supreme Court appellate judgment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The three-Judge Bench decision in <strong><em>Khoday Distilleries Ltd. v. Sri Mahadeshwara Sahakara Sakkare Karkhane Ltd.<\/em>, (2019) 4 SCC 376<\/strong> reaffirmed this principle.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, one must be careful with the statement:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>\u201cThe Supreme Court dismissed the SLP, therefore the High Court can no longer review its judgment.\u201d<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That proposition is wrong.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A review before the High Court may remain maintainable after an SLP has been dismissed without grant of leave.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-high-court-review-can-survive-dismissal-of-an-slp\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"High_Court_Review_Can_Survive_Dismissal_of_an_SLP\"><\/span>High Court Review Can Survive Dismissal of an SLP<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This principle was also reinforced in <strong><em>Manisha Nimesh Mehta v. Board of Directors, ICICI Bank<\/em>, (2024) 9 SCC 573<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There, the Supreme Court considered a situation where a High Court review had been rejected on the premise that an earlier SLP had already been dismissed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court explained that where special leave had not been granted, merger had not occurred merely because the SLP had been dismissed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consequently, the High Court&#8217;s review jurisdiction was not automatically extinguished.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction is extremely important.<\/p>\n\n\n\n<h3 id=\"h-the-procedural-distinction\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Procedural_Distinction\"><\/span>The Procedural Distinction<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>SLP dismissed without leave \u2192 High Court review may still be maintainable.<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">But that does <strong>not<\/strong> necessarily mean:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Review dismissed \u2192 automatic right to file another SLP against the original judgment.<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">That second proposition is precisely where <em>Kangra Central Cooperative Bank<\/em> becomes important.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-why-the-liberty-granted-by-the-supreme-court-mattered\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_the_Liberty_Granted_by_the_Supreme_Court_Mattered\"><\/span>Why the Liberty Granted by the Supreme Court Mattered<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Bank was permitted to withdraw its recall application and pursue a review before the High Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the Supreme Court did not give the Bank an unrestricted right to return to the Supreme Court after the review failed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is a practical lesson of enormous importance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is a significant difference between:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Type of Liberty<\/th><th>Practical Meaning<\/th><\/tr><\/thead><tbody><tr><td><strong>Liberty to approach the High Court in review<\/strong><\/td><td>The litigant may pursue the review remedy before the High Court.<\/td><\/tr><tr><td><strong>Liberty to approach the High Court in review and, if unsuccessful, to approach the Supreme Court again<\/strong><\/td><td>The order expressly preserves a further route to the Supreme Court after the review proceedings.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The precise language of an order matters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For lawyers handling <strong>NRI Supreme Court <\/strong>litigation, this is not a minor drafting point.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An overseas client may assume that pursuing a review simply pauses the Supreme Court litigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That assumption can be dangerous.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s judgment demonstrates that <strong>the route preserved by an order must be read literally and in context<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-question-of-law-kept-open-does-not-keep-the-case-open\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>\u201cThe question of law is kept open.\u201d<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">A litigant should not automatically read such language as an invitation to return to the Supreme Court in the same dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court treated the earlier order as having attained finality between the parties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The legal question may remain open for another appropriate case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the particular dispute does not consequently remain perpetually alive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is an important distinction between:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Keeping a question of law open<\/strong>, and<\/li>\n\n\n\n<li><strong>Keeping a particular proceeding open.<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The two are not synonymous.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-the-importance-of-upadhyay-and-co\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Importance_of_Upadhyay_and_Co\"><\/span>The Importance of <em>Upadhyay and Co.<\/em><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court also considered <strong><em>Upadhyay and Co. v. State of U.P.<\/em>, (1999) 1 SCC 81<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That case established an important principle concerning withdrawal of an SLP.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where an SLP is withdrawn without liberty to file a fresh SLP, a subsequent attempt to challenge the same order may be barred.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court explained the public-policy principle underlying Order XXIII Rule 1 of the CPC and its relevance to Article 136 proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, <em>Upadhyay<\/em> should not be described as an exact factual match to <em>Kangra Central Cooperative Bank<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is an important difference.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Case<\/th><th>Relevant Procedural Circumstance<\/th><\/tr><\/thead><tbody><tr><td><strong><em>Upadhyay and Co.<\/em><\/strong><\/td><td>The relevant SLP itself had been withdrawn.<\/td><\/tr><tr><td><strong><em>Kangra Central Cooperative Bank<\/em><\/strong><\/td><td>The first SLP had been dismissed. What was subsequently withdrawn was the <strong>recall application<\/strong>, and the Bank was given liberty to approach the High Court in review.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Upadhyay<\/em>, the relevant SLP itself had been withdrawn.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Kangra Central Cooperative Bank<\/em>, the first SLP had been dismissed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What was subsequently withdrawn was the <strong>recall application<\/strong>, and the Bank was given liberty to approach the High Court in review.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, <em>Upadhyay<\/em> is better understood as supporting the broader principle of <strong>finality and the consequences of withdrawal without appropriate liberty<\/strong>, rather than as a direct factual template for the present case.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-what-about-s-narahari-v-s-r-kumar\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_About_S_Narahari_v_SR_Kumar\"><\/span>What About <em>S. Narahari v. S.R. Kumar<\/em>?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The judgment also requires careful reading of <strong><em>S. Narahari v. S.R. Kumar<\/em>, (2023) 7 SCC 740<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This authority cannot accurately be described as establishing an unrestricted right to file a second SLP.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The procedural circumstances in <em>Narahari<\/em> involved an earlier SLP that had been withdrawn with liberty to pursue review, followed by a subsequent challenge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court recognised a tension between the line of authority represented by <em>Upadhyay<\/em> and the principles concerning review and merger.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The issue was referred for consideration by a larger Bench.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, <em>Narahari<\/em> should be understood as identifying an unresolved legal tension rather than as creating a general rule that a litigant is always entitled to return to the Supreme Court after a review fails.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction is important when citing the case.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-the-significance-of-satheesh-v-k-v-federal-bank-ltd\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Significance_of_Satheesh_VK_v_Federal_Bank_Ltd\"><\/span>The Significance of <em>Satheesh V.K. v. Federal Bank Ltd.<\/em><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court also considered its recent decision in <strong><em>Satheesh V.K. v. Federal Bank Ltd.<\/em>, 2025 INSC 1140<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That case involved a different procedural route.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The first SLP had been withdrawn unconditionally, without liberty to re-approach the Supreme Court or pursue review.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The subsequent challenge was rejected on maintainability and abuse-of-process grounds.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Satheesh V.K.<\/em> therefore reinforces the importance of finality but should not be treated as factually identical to <em>Kangra Central Cooperative Bank<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The procedural distinction matters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Supreme Court practice, <strong>the precise order passed in the earlier proceeding can be more important than the label attached to that proceeding.<\/strong><\/p>\n\n\n\n<h2 id=\"h-the-review-order-was-also-important\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Review_Order_Was_Also_Important\"><\/span>The Review Order Was Also Important<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There was another important aspect of the judgment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The High Court had treated itself as inhibited, to some extent, by the earlier dismissal of the SLP.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court made it clear that this approach was not correct.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Once the Supreme Court had expressly permitted the Bank to pursue review before the High Court, the High Court was entitled to exercise its review jurisdiction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the High Court had also considered whether there was an error, illegality or other ground justifying review and concluded that there was none.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court did not disturb that conclusion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is important because the Supreme Court was not sitting in appeal over the original High Court judgment, nor was it using the second SLP as an indirect mechanism to review its own earlier dismissal order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The procedural door had closed.<\/p>\n\n\n\n<h2 id=\"h-article-136-is-extraordinary-jurisdiction\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Article_136_Is_Extraordinary_Jurisdiction\"><\/span>Article 136 Is Extraordinary Jurisdiction<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Article 136 confers extraordinary discretionary jurisdiction upon the Supreme Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An SLP is therefore not equivalent to an ordinary statutory appeal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has repeatedly emphasised that Article 136 jurisdiction is discretionary.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But extraordinary jurisdiction does not mean unlimited opportunities to relitigate the same dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The administration of justice requires finality.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This principle is reflected in the well-known maxim:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><em>interest reipublicae ut sit finis litium<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2014 it is in the public interest that litigation should come to an end.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The principle is especially important where a litigant has already had the opportunity to approach the Supreme Court and then pursues a further remedy under an order granting only limited liberty.<\/p>\n\n\n\n<h2 id=\"h-the-formal-challenge-was-to-the-review-order\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Formal_Challenge_Was_to_the_Review_Order\"><\/span>The Formal Challenge Was to the Review Order<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is a further technical point which should not be missed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The immediate SLP was formally directed against the High Court&#8217;s review judgment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the relief sought effectively required the litigant to reopen the underlying High Court judgment which had already been the subject of the earlier Supreme Court proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court therefore considered the procedural history as a whole.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is why authorities such as <strong>T.K. David v. Kuruppampady Service Cooperative Bank Ltd., (2020) 9 SCC 92<\/strong>, and <strong>Bussa Overseas &amp; Properties (P) Ltd. v. Union of India, (2016) 4 SCC 696<\/strong>, become relevant to understanding the limits of challenging a review rejection when the principal judgment itself is no longer open in the manner asserted.<\/p>\n\n\n\n<h2 id=\"h-article-142-relief-limited-to-186-persons\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Article_142_Relief_Limited_to_186_Persons\"><\/span>Article 142: Relief Limited to 186 Persons<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The judgment also contains an unusual Article 142 direction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Bank placed before the Court the potentially substantial financial consequences of the pension liability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Different figures were advanced during the hearing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The respondents referred to a liability of approximately \u20b930\u201335 crore, while the Bank&#8217;s counsel indicated a possible liability of approximately \u20b9250 crore.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These figures were submissions by counsel, not findings of the Supreme Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court ultimately exercised its power under Article 142 and confined the liability to the 141 pensioners and 45 spouses of the original writ petitioners, making a total of 186 persons.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court stated that this was being done on the peculiar facts of the case and to prevent further litigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Most importantly, the Court expressly stated that this direction would not constitute a binding precedent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, the Article 142 portion should not be presented as establishing a general rule that the Supreme Court can routinely reduce liabilities after finding an SLP non-maintainable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It was a case-specific equitable direction.<\/p>\n\n\n\n<h2 id=\"h-what-the-supreme-court-judgment-does-not-mean\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_the_Supreme_Court_Judgment_Does_Not_Mean\"><\/span>What the Supreme Court Judgment Does Not Mean<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The judgment should not be misunderstood.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It does not mean:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>that every second SLP is automatically barred;<\/li>\n\n\n\n<li>that dismissal of every SLP creates merger;<\/li>\n\n\n\n<li>that a High Court cannot review its judgment after an SLP is dismissed without grant of leave;<\/li>\n\n\n\n<li>that Article 136 jurisdiction has been abolished after review;<\/li>\n\n\n\n<li>that an NRI cannot file an SLP after a High Court review;<\/li>\n\n\n\n<li>or that \u201cquestion of law kept open\u201d can never have legal significance.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The correct question is always:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">What happened in the earlier Supreme Court proceeding, what liberty was granted, what remedy was subsequently pursued, and what exactly is the new proceeding asking the Supreme Court to reopen?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is the level at which the judgment must be understood.<\/p>\n\n\n\n<h2 id=\"h-why-this-matters-in-nri-supreme-court-litigation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_This_Matters_in_NRI_Supreme_Court_Litigation\"><\/span>Why This Matters in NRI Supreme Court Litigation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Although Kangra Central Cooperative Bank was not an NRI case, its procedural lesson is highly relevant to NRI Supreme Court Litigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NRIs frequently conduct Indian litigation through advocates, attorneys, family members or authorised representatives.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The client may be living in:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the United States;<\/li>\n\n\n\n<li>the United Kingdom;<\/li>\n\n\n\n<li>Canada;<\/li>\n\n\n\n<li>Australia;<\/li>\n\n\n\n<li>the Middle East;<\/li>\n\n\n\n<li>Europe; or<\/li>\n\n\n\n<li>another jurisdiction.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The physical distance does not change Indian procedural law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But it can make procedural communication more difficult.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An NRI client may be told:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cWe will withdraw this and file a review.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The next question should immediately be:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cWhat liberty will the Supreme Court&#8217;s order preserve if the review fails?\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That question can be crucial.<\/p>\n\n\n\n<h3 id=\"h-an-example\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"An_Example\"><\/span>An Example<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose an NRI loses before a High Court and approaches the Supreme Court through an SLP.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court dismisses the SLP without granting leave.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At this stage, a High Court review may still be available.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The NRI then pursues a review before the High Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But if the Supreme Court&#8217;s earlier order or subsequent procedural order grants only liberty to pursue the review\u2014and does not preserve a right to return to the Supreme Court\u2014the failure of the review does not necessarily create a fresh Article 136 opportunity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The result will depend upon the precise procedural history and orders.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, an NRI should never assume:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">High Court \u2192 SLP \u2192 Review \u2192 second SLP<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">is an automatic sequence of remedies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is not.<\/p>\n\n\n\n<h2 id=\"h-a-practical-checklist-for-nri-supreme-court-litigation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_Practical_Checklist_for_NRI_Supreme_Court_Litigation\"><\/span>A Practical Checklist for NRI Supreme Court Litigation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Before withdrawing an SLP, recall application or other Supreme Court proceeding, counsel should carefully examine the following.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>No.<\/th><th>Question to Examine<\/th><th>What Should Be Checked?<\/th><\/tr><\/thead><tbody><tr><td>1.<\/td><td>What exactly was the earlier Supreme Court order?<\/td><td>Do not rely merely on the case status.
