person, no injury is done.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the plaintiff freely and knowingly agreed to the risk of harm, they cannot later claim damages. Consent can be express (clearly given) or implied (understood from the situation).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Example:<\/strong> A spectator at a cricket match who sits near the boundary accepts the risk of being hit by a ball.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, consent obtained by force, fraud, or without proper understanding is not valid.<\/p>\n\n\n\n<h3 id=\"h-plaintiff-the-wrongdoer\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Plaintiff_the_Wrongdoer\"><\/span>Plaintiff, the Wrongdoer<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A person who is engaged in an illegal or wrongful act cannot usually claim damages for harm suffered while doing that act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Example:<\/strong> A trespasser injured by a reasonable protective measure on private land may not succeed in a claim.<\/p>\n\n\n\n<h3 id=\"h-inevitable-accident\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Inevitable_Accident\"><\/span>Inevitable Accident<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">An inevitable accident is an unexpected event that could not have been avoided even with reasonable care.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Example:<\/strong> A carefully driven car meets with an accident due to a sudden and unforeseeable tire burst.<\/p>\n\n\n\n<h3 id=\"h-act-of-god-vis-major\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Act_of_God_Vis_Major\"><\/span>Act of God (Vis Major)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This defence applies when harm is caused by extraordinary natural forces beyond human control and foresight.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Examples:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Severe earthquakes<\/li>\n\n\n\n<li>Unprecedented floods<\/li>\n\n\n\n<li>Sudden lightning strikes<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Ordinary weather events do not qualify.<\/p>\n\n\n\n<h3 id=\"h-private-defense-self-defense\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Private_Defense_Self-Defense\"><\/span>Private Defense (Self-Defense)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Every person has the right to protect their body and property from unlawful attack. The force used must be reasonable and proportionate to the threat.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Example:<\/strong> Pushing away an attacker to protect oneself is allowed, but continuing the attack after the danger has ended is not.<\/p>\n\n\n\n<h3 id=\"h-mistake\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Mistake\"><\/span>Mistake<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A mistake is a limited defense. A genuine and reasonable mistake of fact may protect the defendant in some cases, but a mistake of law is almost never accepted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Example:<\/strong> A police officer making an arrest based on reasonable and honest belief may be protected.<\/p>\n\n\n\n<h3 id=\"h-necessity\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Necessity\"><\/span>Necessity<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A person may cause limited harm to prevent a greater harm.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Example:<\/strong> Breaking a window to rescue a child trapped in a burning building may be justified by necessity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The harm caused must be less serious than the harm avoided, and no reasonable alternative should be available.<\/p>\n\n\n\n<h3 id=\"h-statutory-authority\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Statutory_Authority\"><\/span>Statutory Authority<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If an act is done under powers given by a law (statute), the person performing it is generally protected from liability for natural consequences of that act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Example:<\/strong> A municipal body digging a road under legal authority to lay pipes is usually protected against claims for temporary inconvenience.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Negligence in exercising the power is not protected.<\/p>\n\n\n\n<h3 id=\"h-act-of-state\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Act_of_State\"><\/span>Act of State<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Certain acts done by the government in the exercise of sovereign powers (especially in relation to foreign affairs or against foreigners) may be protected. This defense has limited application and does not cover ordinary actions against citizens.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Example:<\/strong> During a war or diplomatic conflict, the government of Country A orders its army to seize the property of citizens of Country B living in its territory. If those foreigners later try to sue the government for the loss of their property, the government can claim the defense of the Act of State. The court will usually not examine the case because it involves the sovereign powers of the state in relation to foreign affairs.<\/p>\n\n\n\n<h3 id=\"h-judicial-and-quasi-judicial-acts\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Judicial_and_Quasi-Judicial_Acts\"><\/span>Judicial and Quasi-Judicial Acts<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Judges, magistrates, and certain tribunals are protected for acts done in good faith while performing their judicial functions. This protection supports independent decision-making.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Example:<\/strong> A judge hears a civil case and, after examining the evidence, passes a judgment in favour of one party. Later, the losing party feels the decision was wrong and tries to sue the judge for damages, claiming the judgment caused financial loss. The judge is protected by this defense because the decision was made in good faith while performing judicial duties. The court will dismiss the claim against the judge to protect independent decision-making.<\/p>\n\n\n\n<h3 id=\"h-contributory-negligence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Contributory_Negligence\"><\/span>Contributory Negligence<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">When the plaintiff\u2019s own carelessness also contributes to the harm, the court may reduce the compensation according to the plaintiff\u2019s share of fault.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Example:<\/strong> A pedestrian who suddenly crosses the road without looking and is hit by a careful driver may receive reduced damages.<\/p>\n\n\n\n<h3 id=\"h-parental-and-quasi-parental-authority\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Parental_and_Quasi-Parental_Authority\"><\/span>Parental and Quasi-Parental Authority<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Parents, teachers, and persons in similar positions may use reasonable force or discipline for the benefit and correction of a child or student.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Excessive or cruel punishment is not protected.<\/p>\n\n\n\n<h3 id=\"h-authority-of-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Authority_of_Law\"><\/span>Authority of Law<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Certain persons are allowed by law to do acts that would otherwise be torts, such as lawful arrests by police officers or execution of valid court orders.<\/p>\n\n\n\n<h3 id=\"h-absolute-privilege-and-qualified-privilege-mainly-in-defamation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Absolute_Privilege_and_Qualified_Privilege_Mainly_in_Defamation\"><\/span>Absolute Privilege and Qualified Privilege (Mainly in Defamation)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Defense<\/th><th>Protection<\/th><\/tr><\/thead><tbody><tr><td><strong>Absolute Privilege<\/strong><\/td><td>Complete protection is given to statements made in special situations (for example, statements by judges, lawyers, or witnesses in court, or statements made in Parliament).<\/td><\/tr><tr><td><strong>Qualified Privilege<\/strong><\/td><td>Protection is given when a statement is made in the discharge of a duty or for the protection of an interest, provided there is no malice.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Qualified privilege protects people who speak honestly and without bad intention when they have a good reason to share information.
