A dispute over money, separation, household arrangements, or marital incompatibility must still be examined through the legal ingredients of the Domestic Violence Act and the evidence available on record.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For a husband facing what he believes is a false domestic violence case, the most important principle is straightforward:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Do not answer allegations merely with counter-allegations. Answer them with dates, documents, electronic records, financial evidence, residence records, and demonstrable contradictions.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is where a credible defense begins.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s recent decisions show an increasingly important balance. Courts must remain vigilant against genuine domestic abuse, but they must also prevent criminal or quasi-criminal proceedings from being mechanically extended to relatives against whom there are no specific and legally sustainable allegations.<\/p>\n\n\n\n<h2 id=\"h-what-is-a-domestic-violence-case-under-the-dv-act\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Is_a_Domestic_Violence_Case_Under_the_DV_Act\"><\/span>What Is a Domestic Violence Case Under the DV Act?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Protection of Women from Domestic Violence Act, 2005, is protective legislation. Section 12 enables an aggrieved woman to approach the magistrate for relief.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Importantly, domestic violence is not confined to physical assault.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 3 of the DV Act covers several forms of abuse, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>physical abuse;<\/li>\n\n\n\n<li>sexual abuse;<\/li>\n\n\n\n<li>verbal and emotional abuse;<\/li>\n\n\n\n<li>economic abuse.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Depending upon the facts, the magistrate can grant several forms of relief, including<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Provision<\/th><th>Principal Relief<\/th><\/tr><\/thead><tbody><tr><td>Section 18<\/td><td>Protection orders<\/td><\/tr><tr><td>Section 19<\/td><td>Residence orders<\/td><\/tr><tr><td>Section 20<\/td><td>Monetary relief<\/td><\/tr><tr><td>Section 21<\/td><td>Custody orders<\/td><\/tr><tr><td>Section 22<\/td><td>Compensation<\/td><\/tr><tr><td>Section 23<\/td><td>Interim and ex parte orders<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The proceedings under the DV Act are principally remedial and protective in character. A Section 12 application does not by itself mean that the husband will automatically be arrested.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the position changes when a protection order or interim protection order is breached. Section 31 creates a criminal consequence for breach of a protection order. It may remove context. Its authenticity may also be questioned.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under the Bharatiya Sakshya Adhiniyam, 2023, electronic records are subject to statutory requirements concerning admissibility and certification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A husband should therefore:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Preserve the original device wherever possible;<\/li>\n\n\n\n<li>retain complete conversations rather than selected screenshots;<\/li>\n\n\n\n<li>Preserve timestamps and original files;<\/li>\n\n\n\n<li>retain relevant emails and attachments;<\/li>\n\n\n\n<li>Preserve CCTV promptly before it is overwritten;<\/li>\n\n\n\n<li>Maintain bank and digital payment records;<\/li>\n\n\n\n<li>Avoid editing audio or video<\/li>\n\n\n\n<li>Preserve the surrounding conversation<\/li>\n\n\n\n<li>Maintain multiple secure backups;<\/li>\n\n\n\n<li>obtain appropriate legal advice regarding the requirements for proving electronic records.<\/li>\n<\/ul>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Do not merely save evidence. The court examined whether allegations against the husband&#8217;s relatives were sufficiently specific to justify the continuation of proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court ultimately found that the allegations against the concerned relatives were generalized and lacked specific overt acts. It held that merely supporting the husband, failing to intervene or advising the complainant to adjust in the matrimonial relationship does not automatically establish criminal liability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court nevertheless made an equally important qualification: genuine domestic violence can occur within matrimonial homes, sometimes without independent witnesses or readily available documentary evidence. Where specific acts and prima facie material exist, proceedings may legitimately continue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction is crucial.<\/p>\n\n\n\n<h2 id=\"h-what-should-the-defence-examine\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Should_the_Defence_Examine\"><\/span>What Should the Defence Examine?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">For each relative, ask:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What specific act is alleged?<\/li>\n\n\n\n<li>On what date?<\/li>\n\n\n\n<li>At what location?<\/li>\n\n\n\n<li>Was the relative present?<\/li>\n\n\n\n<li>Did the relative live in the same household?<\/li>\n\n\n\n<li>Was the relative separately residing?<\/li>\n\n\n\n<li>Is there independent supporting material?<\/li>\n\n\n\n<li>Does the complaint attribute the same allegations identically to several people?<\/li>\n\n\n\n<li>Does the alleged conduct actually satisfy the statutory definition?<\/li>\n\n\n\n<li>Are earlier pleadings consistent with the later complaint?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A parent living in another city cannot be treated in precisely the same manner as a spouse living in the same household merely because both have been named in the complaint.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The defence must be respondent-specific.<\/p>\n\n\n\n<h2 id=\"h-separate-residence-can-become-important-evidence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Separate_Residence_Can_Become_Important_Evidence\"><\/span>Separate Residence Can Become Important Evidence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Residence is often a critical factual issue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the husband and wife maintained a separate household from the husband&#8217;s parents, evidence of that arrangement may become relevant when allegations are made against the parents or other relatives.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Useful material may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>rental agreements;<\/li>\n\n\n\n<li>electricity bills;<\/li>\n\n\n\n<li>property records;<\/li>\n\n\n\n<li>employment records;<\/li>\n\n\n\n<li>school records;<\/li>\n\n\n\n<li>travel documents;<\/li>\n\n\n\n<li>municipal records;<\/li>\n\n\n\n<li>correspondence;<\/li>\n\n\n\n<li>photographs;<\/li>\n\n\n\n<li>independent household expenses.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The purpose is not to claim that a relative can never be proceeded against.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The purpose is to establish the actual domestic relationship and the factual circumstances in which the alleged acts could or could not have occurred.<\/p>\n\n\n\n<h2 id=\"h-residence-rights-under-the-dv-act-ownership-alone-is-not-the-answer\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Residence_Rights_Under_the_DV_Act_Ownership_Alone_Is_Not_the_Answer\"><\/span>Residence Rights Under the DV Act: Ownership Alone Is Not the Answer<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A husband should be particularly careful with arguments concerning the matrimonial home.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is no longer safe to argue simply:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>&#8220;The house belongs to my parents, therefore my wife has no residence rights.&#8221;<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Satish Chander Ahuja v. Sneha Ahuja<\/em>, (2021) 1 SCC 414, a three-Judge Bench of the Supreme Court rejected the narrow interpretation previously associated with <em>S.R. Batra v. Taruna Batra<\/em>. The Court held that the concept of a &#8220;shared household&#8221; cannot be determined solely by examining the title deed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The factual inquiry may involve:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Whether the spouses actually lived there;<\/li>\n\n\n\n<li>The duration of their residence;<\/li>\n\n\n\n<li>Whether they lived with the husband&#8217;s parents;<\/li>\n\n\n\n<li>Whether the property was independently occupied;<\/li>\n\n\n\n<li>Whether different floors or portions were separately used;<\/li>\n\n\n\n<li>Whether separate kitchens existed;<\/li>\n\n\n\n<li>Whether the property was rented or owned;<\/li>\n\n\n\n<li>The nature of the household arrangement;<\/li>\n\n\n\n<li>Whether alternative accommodation was provided.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Ownership is relevant, but ownership alone does not answer the shared-household question.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">A husband defending a residence claim should place the complete history of occupation before the court rather than relying on the title deed alone.<\/p>\n\n\n\n<h2 id=\"h-maintenance-and-monetary-relief-the-financial-record-matters\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Maintenance_and_Monetary_Relief_The_Financial_Record_Matters\"><\/span>Maintenance and Monetary Relief: The Financial Record Matters<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A wife may seek monetary relief under Section 20 of the DV Act and interim relief under Section 23.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A common but legally unsafe defence is:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>&#8220;She is educated, therefore she cannot claim maintenance.&#8221;<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Education or professional qualification does not, by itself, determine entitlement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court may examine the financial position of both parties, their actual income, liabilities, standard of living, dependent children and other relevant circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s decision in <em>Rajnesh v. Neha<\/em>, (2021) 2 SCC 324, remains a major reference point on disclosure of assets, income and liabilities and the management of overlapping maintenance claims.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A husband should therefore disclose relevant financial material, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Salary slips;<\/li>\n\n\n\n<li>Income-tax returns;<\/li>\n\n\n\n<li>Bank statements;<\/li>\n\n\n\n<li>Employment records;<\/li>\n\n\n\n<li>Business income;<\/li>\n\n\n\n<li>Loans and EMIs;<\/li>\n\n\n\n<li>Rent;<\/li>\n\n\n\n<li>Medical expenditure;<\/li>\n\n\n\n<li>Dependent parents&#8217; expenses;<\/li>\n\n\n\n<li>Children&#8217;s expenses;<\/li>\n\n\n\n<li>Existing maintenance orders;<\/li>\n\n\n\n<li>Amounts already paid;<\/li>\n\n\n\n<li>Other legally relevant financial obligations.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Where the wife has an independent income or financial resources, relevant and lawfully obtained evidence may also be placed before the court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The objective is not to conceal income.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is to give the court the complete financial picture.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppression of income, bank accounts or assets can seriously damage credibility.<\/p>\n\n\n\n<h2 id=\"h-a-significant-2026-maintenance-development\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_Significant_2026_Maintenance_Development\"><\/span>A Significant 2026 Maintenance Development<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s 2026 decision in <em>Salil Dhawan v. The appropriate legal remedy depends upon the order and procedural stage. That principle should never be compromised.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the equally important principle is that matrimonial discord should not automatically become a substitute for proof of domestic violence or criminal liability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For a husband facing a false domestic violence case, the answer is not retaliation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is preparation.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Build the chronology.<\/li>\n\n\n\n<li>Preserve the original electronic evidence.<\/li>\n\n\n\n<li>Collect the financial records.<\/li>\n\n\n\n<li>Establish actual residence.<\/li>\n\n\n\n<li>Separate the allegations against each relative.<\/li>\n\n\n\n<li>Compare every earlier statement with the present complaint.<\/li>\n\n\n\n<li>Comply with valid court orders.<\/li>\n\n\n\n<li>Challenge legally unsustainable proceedings through the appropriate remedy.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s recent jurisprudence demonstrates that the courts are attempting to maintain this balance: protecting genuine victims while refusing to permit vague, omnibus or unsupported allegations to become a substitute for a legally sustainable case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The guiding principle for a husband is therefore simple:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Do not fight a false domestic violence case with anger.
