The financially weaker spouse may also have to meet legal fees, court-related expenses, rent, medical costs, and ordinary household expenses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is precisely where <strong>Section 24 of the Hindu Marriage Act, 1955 (HMA)<\/strong> becomes important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 24 provides for <em>maintenance pendente lite<\/em>, meaning maintenance during the pendency of a matrimonial proceeding. It also enables the Court to award the necessary expenses of the proceeding.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But there is an important point that is often misunderstood.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Section 24 HMA does not prescribe that a wife automatically receives 25% of her husband&#8217;s income.<\/strong> Nor is maintenance automatically denied merely because the applicant is educated or employed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court has to examine the actual financial circumstances of both spouses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For someone involved in a divorce case in Delhi, that distinction can make a substantial difference.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Also Read: <a href=\"https:\/\/www.legalserviceindia.com\/Legal-Articles\/contested-divorce-in-delhi\/\">Contested Divorce in Delhi: Grounds, Procedure, Evidence &amp; Supreme Court Law 2026<\/a><\/p>\n\n\n\n<h2 id=\"h-what-is-section-24-hma\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Is_Section_24_HMA\"><\/span>What Is Section 24 HMA?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Section 24 of the Hindu Marriage Act deals with maintenance pendente lite and expenses of proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In simple terms, where either spouse does not have sufficient independent income to support himself or herself and meet the necessary expenses of the matrimonial litigation, the court may direct the other spouse to provide financial assistance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The provision is deliberately worded in gender-neutral terms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It applies to <strong>&#8220;either the wife or the husband.&#8221;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court can therefore award:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a reasonable monthly amount for support during the proceeding; and<\/li>\n\n\n\n<li>expenses necessary for conducting the matrimonial case.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The section also says that, as far as possible, an application for interim maintenance should be disposed of within 60 days from the date of service of notice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That 60-day requirement is intended to encourage speedy determination. A husband may also seek maintenance from his wife where his own independent income is insufficient and the wife has the financial capacity to provide support.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The gender-neutral language of Section 24 has been recognized by the Supreme Court, including in <em>Rajnesh v. <\/em><a href=\"https:\/\/www.legalserviceindia.com\/Legal-Articles\/interim-maintenance-delhi-section-24-hma\/\">Neha (2021)<\/a> 2 SCC 324.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But being legally eligible to apply is not the same thing as automatically receiving maintenance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The applicant has to establish financial insufficiency.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is why the central question is not simply<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&#8220;Who earns more?&#8221;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The more relevant question is<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Does the applicant have sufficient independent income to support himself or herself and meet the necessary expenses of the litigation, having regard to the financial circumstances of both parties?<\/strong><\/p>\n\n\n\n<h2 id=\"h-what-can-a-court-award-under-section-24\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Can_a_Court_Award_Under_Section_24\"><\/span>What Can a Court Award Under Section 24?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There are two separate aspects of relief.<\/p>\n\n\n\n<h3 id=\"h-1-monthly-interim-maintenance\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"1_Monthly_Interim_Maintenance\"><\/span>1. Monthly Interim Maintenance<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The court can award a reasonable monthly amount during the pendency of the matrimonial proceeding.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The purpose is not to punish the earning spouse or to make both parties financially identical.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court generally looks at the broader financial circumstances, including<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>income of both spouses;<\/li>\n\n\n\n<li>reasonable needs;<\/li>\n\n\n\n<li>standard of living during the marriage;<\/li>\n\n\n\n<li>assets;<\/li>\n\n\n\n<li>liabilities;<\/li>\n\n\n\n<li>dependent family members;<\/li>\n\n\n\n<li>medical requirements;<\/li>\n\n\n\n<li>children&#8217;s needs;<\/li>\n\n\n\n<li>employment and professional circumstances; and<\/li>\n\n\n\n<li>other relevant financial obligations.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has repeatedly emphasized that maintenance cannot be determined by a mechanical formula.<\/p>\n\n\n\n<h3 id=\"h-2-litigation-expenses\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2_Litigation_Expenses\"><\/span>2. Litigation Expenses<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Section 24 also permits the court to award the expenses of the proceeding.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is important because a spouse who lacks sufficient independent income should not be placed at a practical disadvantage merely because the other spouse has greater financial resources.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Reasonable legal fees and other necessary litigation expenses may therefore be considered separately from the monthly maintenance amount.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A person seeking such expenses should ideally give the court a realistic estimate rather than simply making a large, unexplained demand.<\/p>\n\n\n\n<h2 id=\"h-is-there-a-25-rule-for-interim-maintenance\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Is_There_a_25_Rule_for_Interim_Maintenance\"><\/span>Is There a 25% Rule for Interim Maintenance?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>No.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is probably the most common misconception surrounding maintenance in divorce cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is no provision in the Hindu Marriage Act stating that a wife is entitled to 25% of her husband&#8217;s income.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The figure of 25% appears in earlier Supreme Court decisions, including <em>Dr. Kulbhushan Kumar v. Raj <\/em>Kumari (1970) 3 SCC 129 and <em>Kalyan Dey Chowdhury v. Rita Dey <\/em>Chowdhury (2017) 14 SCC 200.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But those cases do not create a universal mathematical formula.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Kalyan Dey Chowdhury<\/em>, for example, the Supreme Court was dealing with permanent alimony under Section 25 and considered 25% of the husband&#8217;s net salary appropriate on the facts before it. The amount was ultimately modified in light of the husband&#8217;s subsequent circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court subsequently made the position considerably clearer in <em>Rajnesh v. Neha<\/em>:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">There is no straitjacket formula for determining maintenance.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, a pleading that simply says<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>&#8220;The wife is entitled to 25% of the husband&#8217;s salary.&#8221;<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">overstates the law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Twenty-five percent may sometimes be used as a broad comparative reference when examining quantum, but it is not a statutory entitlement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The better approach is to place the complete financial circumstances before the court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Also Read: <a href=\"https:\/\/www.legalserviceindia.com\/Legal-Articles\/how-to-file-divorce-in-delhi\/\">How to File Divorce in Delhi (2026): Complete Guide to Jurisdiction, Maintenance, Child Custody, and Family Court Procedure<\/a><\/p>\n\n\n\n<h2 id=\"h-how-do-delhi-courts-decide-the-amount-of-maintenance\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_Do_Delhi_Courts_Decide_the_Amount_of_Maintenance\"><\/span>How Do Delhi Courts Decide the Amount of Maintenance?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is no single calculation that works in every case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s decisions in <em>Jasbir Kaur Sehgal v. District Judge, Dehradun<\/em>, (1997) 7 SCC 7 and <em>Rajnesh v. Neha<\/em>, together with the Delhi High Court&#8217;s decision in <em>Bharat Hegde v. Saroj Hegde<\/em>, 140 (2007) DLT 16, provide the broad framework.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court may consider:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Factor<\/th><th>What the Court May Consider<\/th><\/tr><\/thead><tbody><tr><td><strong>Income of Both Spouses<\/strong><\/td><td>Salary is only one component. Business income, professional receipts, rent, investments, and other sources may also matter.<\/td><\/tr><tr><td><strong>Standard of Living<\/strong><\/td><td>The Court does not ordinarily look at maintenance in isolation from the lifestyle enjoyed during the marriage.<\/td><\/tr><tr><td><strong>Reasonable Needs<\/strong><\/td><td>Rent, food, transport, clothing, medical expenses and other genuine needs may be relevant.<\/td><\/tr><tr><td><strong>Liabilities<\/strong><\/td><td>Genuine loans and financial responsibilities may be considered, although simply showing EMIs does not automatically mean that the entire amount should be deducted from available income.<\/td><\/tr><tr><td><strong>Dependants<\/strong><\/td><td>Responsibilities towards children, elderly parents or other genuine dependants may affect the assessment.<\/td><\/tr><tr><td><strong>Assets<\/strong><\/td><td>Property, investments, savings and other assets may be relevant where they affect the financial capacity of either spouse.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The objective is to arrive at a figure that is reasonable and realistic in the circumstances of the particular case.<\/p>\n\n\n\n<h2 id=\"h-can-a-working-wife-claim-interim-maintenance\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_a_Working_Wife_Claim_Interim_Maintenance\"><\/span>Can a Working Wife Claim Interim Maintenance?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Yes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the answer requires an important qualification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Employment does not automatically disqualify a wife from Section 24 maintenance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, employment does not automatically create an entitlement either.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court has to determine whether the wife&#8217;s actual independent income is sufficient for her support and necessary litigation expenses in the circumstances of the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court explained this distinction in <em>Manish Jain v. Akanksha <\/em>Jain (2017) 15 SCC 801 and <em>Shailja v. <\/em>Khobbanna (2018) 12 SCC 199.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is a difference between:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>being capable of earning, and<\/li>\n\n\n\n<li>actually earning sufficient income to support oneself in the circumstances of the marriage.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction is extremely important in Delhi matrimonial litigation.<\/p>\n\n\n\n<h2 id=\"h-being-educated-does-not-automatically-defeat-a-maintenance-claim\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Being_Educated_Does_Not_Automatically_Defeat_a_Maintenance_Claim\"><\/span>Being Educated Does Not Automatically Defeat a Maintenance Claim<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A frequently raised defense is<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>&#8220;She is highly educated. She can easily get a job.&#8221;<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That argument, by itself, is insufficient.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court has to examine the actual circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, a spouse may have a professional qualification but:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>currently have no employment;<\/li>\n\n\n\n<li>have interrupted her career;<\/li>\n\n\n\n<li>have left employment because of family responsibilities;<\/li>\n\n\n\n<li>be earning substantially less than before marriage;<\/li>\n\n\n\n<li>have limited employment opportunities; or<\/li>\n\n\n\n<li>have an income that is inadequate in relation to the circumstances of the marriage.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court in <em>Shailja<\/em> made the distinction between earning capacity and actual sufficient income particularly important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Delhi High Court has applied this principle in recent cases.<\/p>\n\n\n\n<h2 id=\"h-recent-delhi-high-court-decision-himanshu-verma-v-chandni-verma\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Recent_Delhi_High_Court_Decision_Himanshu_Verma_v_Chandni_Verma\"><\/span>Recent Delhi High Court Decision: Himanshu Verma v. Chandni Verma<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Himanshu Verma v. Chandni Verma<\/em>, 2025:DHC:5068-DB, decided on 1 July 2025, the Delhi High Court considered the argument that the wife was capable of earning.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court did not accept the proposition that educational qualification or mere earning capacity automatically defeats a claim under Section 24.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court upheld interim maintenance of \u20b925,000 per month.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case reinforces an important proposition:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>A spouse cannot necessarily be denied maintenance merely because he or she possesses the qualifications to earn.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The actual financial circumstances still have to be examined.<\/p>\n\n\n\n<h2 id=\"h-but-an-earning-spouse-may-still-be-denied-maintenance\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"But_an_Earning_Spouse_May_Still_Be_Denied_Maintenance\"><\/span>But an Earning Spouse May Still Be Denied Maintenance<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The reverse proposition is equally important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 24 is not intended to provide an additional income to a spouse who already has sufficient independent financial resources.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A recent Delhi High Court decision illustrates this.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Brijesh Rajkumar Suiri v. Navita Brijesh Suri<\/em>, decided on 16 September 2026, the wife had been earning \u20b97,000 per month while working at a Bata showroom from March 2020 until June 2024.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The husband&#8217;s income was assessed at approximately \u20b922,000 per month.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The High Court did not simply follow the general principle that maintenance ordinarily runs from the date of the application. Hemant Badhani<\/em>, decided on 10 September 2025, the wife was herself earning approximately \u20b91.25 lakh per month.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The husband, however, had an annual income exceeding \u20b91 crore.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Delhi High Court enhanced the overall maintenance awarded for the wife and child to \u20b91.50 lakh per month.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court did not treat the wife&#8217;s employment as automatically ending the inquiry.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The relevant question was whether her own income was sufficient when viewed against the matrimonial standard of living and the very substantial disparity between the parties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is an important practical lesson.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A person cannot simply say:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;She has a salary, therefore she gets nothing.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Nor can the applicant say:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;He earns more, therefore I automatically receive a fixed percentage.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Neither proposition accurately represents the law.<\/p>\n\n\n\n<h2 id=\"h-what-if-the-spouse-is-hiding-income\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_If_the_Spouse_Is_Hiding_Income\"><\/span>What If the Spouse Is Hiding Income?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is one of the most important issues in actual maintenance litigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A respondent may disclose a surprisingly low salary while simultaneously maintaining a lifestyle that appears inconsistent with that income.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court can examine the surrounding evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Relevant material may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>bank statements;<\/li>\n\n\n\n<li>income-tax returns;<\/li>\n\n\n\n<li>salary slips;<\/li>\n\n\n\n<li>business records;<\/li>\n\n\n\n<li>property ownership;<\/li>\n\n\n\n<li>rent received;<\/li>\n\n\n\n<li>investment accounts;<\/li>\n\n\n\n<li>vehicles;<\/li>\n\n\n\n<li>foreign income;<\/li>\n\n\n\n<li>company directorships;<\/li>\n\n\n\n<li>substantial expenditure; and<\/li>\n\n\n\n<li>other evidence showing actual financial capacity.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court in <em>Jasbir Kaur Sehgal<\/em> recognized that where parties do not disclose their true financial position, some degree of estimation may become necessary.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The same principle applies to the applicant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A person seeking maintenance is also expected to make a truthful disclosure of income, assets and liabilities.<\/p>\n\n\n\n<h2 id=\"h-financial-disclosure-is-extremely-important-in-delhi\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Financial_Disclosure_Is_Extremely_Important_in_Delhi\"><\/span>Financial Disclosure Is Extremely Important in Delhi<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Delhi has developed detailed procedures for financial disclosure in matrimonial cases through the <em>Kusum Sharma<\/em> line of decisions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court subsequently adopted a nationwide framework in <em>Rajnesh v. Neha<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A Section 24 application should therefore not be treated as a simple application stating:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;My husband earns \u20b92 lakh and I need \u20b980,000.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The Court needs evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending upon the case, relevant documents may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>salary slips;<\/li>\n\n\n\n<li>bank statements;<\/li>\n\n\n\n<li>income-tax returns;<\/li>\n\n\n\n<li>Form 16;<\/li>\n\n\n\n<li>employment records;<\/li>\n\n\n\n<li>business records;<\/li>\n\n\n\n<li>property documents;<\/li>\n\n\n\n<li>investment statements;<\/li>\n\n\n\n<li>loan documents;<\/li>\n\n\n\n<li>EMI details;<\/li>\n\n\n\n<li>medical expenses;<\/li>\n\n\n\n<li>school fees;<\/li>\n\n\n\n<li>evidence of dependants; and<\/li>\n\n\n\n<li>details of previous maintenance proceedings.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If income is disputed, documentary evidence can become decisive.<\/p>\n\n\n\n<h2 id=\"h-what-if-the-husband-says-he-earns-very-little\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_If_the_Husband_Says_He_Earns_Very_Little\"><\/span>What If the Husband Says He Earns Very Little?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A claim of low income is not necessarily conclusive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court may examine whether the declared income is consistent with the evidence and the person&#8217;s actual financial circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is particularly relevant where:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the person operates a business;<\/li>\n\n\n\n<li>income is received through family enterprises;<\/li>\n\n\n\n<li>bank transactions indicate greater financial activity;<\/li>\n\n\n\n<li>substantial assets are owned;<\/li>\n\n\n\n<li>the lifestyle is inconsistent with the declared salary; or<\/li>\n\n\n\n<li>income is received from multiple sources.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, the Court should not simply assume that every respondent earns a high income because he appears financially comfortable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The assessment has to be evidence-based.<\/p>\n\n\n\n<h2 id=\"h-from-which-date-is-interim-maintenance-payable\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"From_Which_Date_Is_Interim_Maintenance_Payable\"><\/span>From Which Date Is Interim Maintenance Payable?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This question frequently arises in Delhi Family Courts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Rajnesh v. Neha<\/em>, the Supreme Court directed that maintenance should ordinarily be awarded from the date of the application.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The reasoning is straightforward.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If an application filed in 2024 is decided only in 2026, awarding maintenance only from the date of the final order could deprive the applicant of financial support during the very period for which the application was made.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But this is not an inflexible rule that overrides the facts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The 2026 <em>Brijesh Rajkumar Suiri<\/em> decision illustrates why.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where the applicant had sufficient independent income during part of the relevant period, the Court may examine that period separately.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, the safer proposition is:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>General Rule<\/th><th>Important Qualification<\/th><\/tr><\/thead><tbody><tr><td>Maintenance ordinarily runs from the date of the application.<\/td><td>The Court can determine entitlement for particular periods on the basis of the actual financial circumstances.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 id=\"h-what-does-the-60-day-rule-mean\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Does_the_60-Day_Rule_Mean\"><\/span>What Does the 60-Day Rule Mean?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Section 24 states that an application for maintenance pendente lite should, as far as possible, be disposed of within 60 days from service of notice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This provision was intended to prevent a financially dependent spouse from waiting indefinitely for interim relief.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the wording matters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It says &#8220;as far as possible.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The expiry of 60 days does not mean that maintenance is automatically granted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nor does it create a fixed sum payable from the 61st day.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court still has to decide the application on its merits.<\/p>\n\n\n\n<h2 id=\"h-what-about-maintenance-for-children\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_About_Maintenance_for_Children\"><\/span>What About Maintenance for Children?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Personal maintenance under Section 24 should be distinguished from maintenance and education of minor children under Section 26 HMA.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In many matrimonial cases, both issues arise together.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, a mother may seek:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>her own interim maintenance under Section 24;<\/li>\n\n\n\n<li>school fees and other expenses for the child under Section 26; and<\/li>\n\n\n\n<li>litigation expenses.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These are different legal heads and should ideally be presented separately.<\/p>\n\n\n\n<h2 id=\"h-can-maintenance-also-be-claimed-under-other-laws\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_Maintenance_Also_Be_Claimed_Under_Other_Laws\"><\/span>Can Maintenance Also Be Claimed Under Other Laws?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A spouse may have remedies under more than one statutory provision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending upon the facts, these may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Section 24 HMA;<\/li>\n\n\n\n<li>Section 25 HMA;<\/li>\n\n\n\n<li>Section 18 of the Hindu Adoptions and Maintenance Act, 1956;<\/li>\n\n\n\n<li>Section 20 of the Protection of Women from Domestic Violence Act, 2005; and<\/li>\n\n\n\n<li>Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The existence of multiple remedies does not mean that a person can obtain double recovery for the same financial need.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Rajnesh v. Neha<\/em>, the Supreme Court emphasized disclosure of previous maintenance proceedings and appropriate adjustment of overlapping awards.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A party should therefore disclose every previous maintenance application and order.<\/p>\n\n\n\n<h2 id=\"h-section-24-hma-and-section-25-hma-are-not-the-same\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Section_24_HMA_and_Section_25_HMA_Are_Not_the_Same\"><\/span>Section 24 HMA and Section 25 HMA Are Not the Same<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction is essential.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Provision<\/th><th>What It Deals With<\/th><\/tr><\/thead><tbody><tr><td><strong>Section 24 HMA<\/strong><\/td><td>Maintenance during the matrimonial proceeding and expenses of that proceeding.<\/td><\/tr><tr><td><strong>Section 25 HMA<\/strong><\/td><td>Permanent alimony and maintenance at or after the decree.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Section 25 expressly permits the Court to consider the conduct of the parties and other circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An interim maintenance order under Section 24 therefore does not automatically determine what permanent alimony should ultimately be awarded.<\/p>\n\n\n\n<h2 id=\"h-what-happens-in-a-void-marriage\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Happens_in_a_Void_Marriage\"><\/span>What Happens in a Void Marriage?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court addressed an important issue in <em>Sukhdev Singh v. Sukhbir Kaur<\/em>, 2025 INSC 197.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case concerned a marriage declared void under Section 11 HMA.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court held that a spouse of a marriage declared void can seek permanent alimony under Section 25 because the expression <q>any decree<\/q> is wide enough to include a decree of nullity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court also recognized that Section 24 relief can be considered while a Section 11 proceeding is pending, even where the Court may have a prima facie view that the marriage is void.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The decision is important because it demonstrates that the interim and permanent remedies under Sections 24 and 25 cannot be treated as interchangeable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It also makes clear that the conduct of the parties can be relevant to the Court&#8217;s discretion.<\/p>\n\n\n\n<h2 id=\"h-does-section-24-maintenance-stop-after-a-divorce-decree\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Does_Section_24_Maintenance_Stop_After_a_Divorce_Decree\"><\/span>Does Section 24 Maintenance Stop After a Divorce Decree?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This question has acquired particular importance in Delhi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ordinarily, Section 24 concerns maintenance during the proceeding, while Section 25 becomes relevant after the decree.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But what happens when the divorce decree itself is challenged in an appeal?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Delhi High Court considered this question in a significant decision dated 14 July 2026 in MAT.APP.(F.C.) 306\/2025.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Division Bench held that an appeal is a continuation of the matrimonial proceeding.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consequently, the Court held that Section 24 relief could continue during the pendency of the appeal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court distinguished <em>Sukhdev Singh v. Sukhbir Kaur<\/em>, observing that the Supreme Court decision had not decided the specific question of whether Section 24 continues during an appeal against a divorce decree.<\/p>\n\n\n\n<h3 id=\"h-30-is-not-a-statutory-maintenance-rule\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"30_Is_Not_a_Statutory_Maintenance_Rule\"><\/span>30% Is Not a Statutory Maintenance Rule<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">An important detail should not be missed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Delhi High Court did not create a new 30% maintenance rule.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Family Court had already directed payment calculated at 30% of the husband&#8217;s gross salary after statutory deductions. The High Court continued that existing direction from the date of the appellate application until disposal of the appeal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>30% is not a statutory formula.<\/li>\n\n\n\n<li>The case is authority on the continuation of the proceeding during appeal, not on a fixed percentage of salary.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-what-did-parvin-kumar-jain-actually-decide\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Did_Parvin_Kumar_Jain_Actually_Decide\"><\/span>What Did <em>Parvin Kumar Jain<\/em> Actually Decide?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Parvin Kumar Jain v. Anju Jain<\/em>, 2024 INSC 961, is another important Supreme Court decision arising from a long-running matrimonial dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case should, however, be read carefully.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Delhi High Court had dealt with the continuation of Sections 24 and 26 issues following withdrawal of the divorce petition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court ultimately exercised its power under Article 142 of the Constitution, dissolved the marriage and substituted a comprehensive financial arrangement involving permanent alimony and the child&#8217;s financial interests.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The decision therefore should not be cited for the broad proposition that:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><q>Every accrued Section 24 claim survives indefinitely after the matrimonial proceeding ends.<\/q><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That proposition goes further than the Supreme Court&#8217;s actual decision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The precise procedural history and the relief ultimately granted by the Supreme Court matter.<\/p>\n\n\n\n<h2 id=\"h-what-if-interim-maintenance-is-not-paid\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_If_Interim_Maintenance_Is_Not_Paid\"><\/span>What If Interim Maintenance Is Not Paid?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A maintenance order is not merely an expression of sympathy. It is a judicial order capable of enforcement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 28A HMA provides for enforcement of decrees and orders under the Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending upon the circumstances, appropriate execution and other enforcement remedies may be available.<\/p>\n\n\n\n<h3 id=\"h-practical-advice-for-unpaid-maintenance\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Practical_Advice_for_Unpaid_Maintenance\"><\/span>Practical Advice for Unpaid Maintenance<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The practical advice is simple:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Do not allow unpaid maintenance to accumulate indefinitely without taking steps for enforcement.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, there is no universal rule that a defence is automatically struck off immediately after a single missed payment. Merely being employed does not automatically disqualify her.<\/li>\n\n\n\n<li><strong>A husband can also claim maintenance under Section 24 HMA.<\/strong> The provision is gender-neutral and applies equally where either spouse lacks sufficient independent income.<\/li>\n\n\n\n<li><strong>Delhi courts consider the overall financial position of both spouses<\/strong>, including income, assets, liabilities, standard of living, reasonable needs, dependants and other financial obligations while determining interim maintenance.<\/li>\n\n\n\n<li><strong>Concealment of income or assets can affect the maintenance determination.<\/strong> Courts may require financial disclosure and can assess income where the disclosed figures do not appear credible.<\/li>\n\n\n\n<li><strong>Litigation expenses are separate from monthly maintenance.<\/strong> Section 24 HMA permits the court to award reasonable expenses required for pursuing or defending the matrimonial proceeding in addition to a monthly maintenance amount.<\/li>\n\n\n\n<li><strong>Interim maintenance is ordinarily considered from the date of the maintenance application<\/strong>, following the principle stated in <em>Rajnesh v.
