It determines whether a cause of action can be initiated, continued, or compensated. The traditional common-law rule is expressed in the maxim <em>actio personalis moritur cum persona<\/em> (\u201ca personal action dies with the person\u201d). Under this principle, tortious liability was regarded as strictly personal between the wrongdoer and the victim; the death of either party extinguished the right to sue or be sued.<\/p><div class=\"wp-block-paragraph\">The rigid application of the maxim produced serious injustice, particularly where the tort had caused proprietary loss or financial harm to dependants. Modern Indian law has therefore restricted the maxim through statutory enactments and judicial interpretation, preserving claims that affect the estate or create independent rights in favor of dependants.<\/p>\n\n\n\n<h2 id=\"h-death-of-the-wrongdoer\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Death_of_the_Wrongdoer\"><\/span>Death of the Wrongdoer<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 id=\"h-2-1-traditional-abatement-and-modern-estate-liability\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"21_Traditional_Abatement_and_Modern_Estate_Liability\"><\/span>2.1 Traditional Abatement and Modern Estate Liability<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">At common law a purely personal claim against a tortfeasor abated on the tortfeasor\u2019s death. Contemporary Indian law qualifies this rule. Where the tortious act has diminished the injured party\u2019s estate or enriched the deceased wrongdoer\u2019s estate, the cause of action survives against the legal representatives of the deceased.<\/p>\n\n\n\n<h3 id=\"h-2-2-enforceability-against-legal-representatives\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"22_Enforceability_Against_Legal_Representatives\"><\/span>2.2 Enforceability Against Legal Representatives<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Purely personal liabilities generally abate. Claims for proprietary or financial loss, however, may be pursued against the legal representatives to the extent of the assets of the estate. The representatives are not personally liable beyond the value of the property that comes into their hands.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Illustration:<\/strong> A tortfeasor negligently destroys another\u2019s property and dies before judgment. The injured party may proceed against the legal representatives, but recovery is limited to the assets of the deceased\u2019s estate.<\/p>\n\n\n\n<h2 id=\"h-death-of-the-injured-person\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Death_of_the_Injured_Person\"><\/span>Death of the Injured Person<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 id=\"h-3-1-personal-wrongs-and-proprietary-wrongs\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"31_Personal_Wrongs_and_Proprietary_Wrongs\"><\/span>3.1 Personal Wrongs and Proprietary Wrongs<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The death of the injured person does not automatically extinguish every claim. Survivability depends on the character of the right infringed:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Type of Claim<\/th><th>Effect of Death<\/th><\/tr><\/thead><tbody><tr><td><strong>Personal wrongs<\/strong><\/td><td>Causes of action for defamation, assault, or other personal injuries not resulting in death generally die with the victim.<\/td><\/tr><tr><td><strong>Estate claims<\/strong><\/td><td>Actions for loss to property or for financial harm that accrued before death survive for the benefit of the estate and may be enforced by the executor or administrator.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h3 id=\"h-3-2-statutory-provision-section-306-of-the-indian-succession-act-1925\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"32_Statutory_Provision_%E2%80%93_Section_306_of_the_Indian_Succession_Act_1925\"><\/span>3.2 Statutory Provision \u2013 Section 306 of the Indian Succession Act, 1925<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Section 306 provides that all demands and rights of action existing in favor of or against a person at the time of death survive to and against the executors or administrators, except causes of action for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>defamation,<\/li>\n\n\n\n<li>assault (as defined in the Bharatiya Nyaya Sanhita, 2023), or<\/li>\n\n\n\n<li>other personal injuries not causing the death of the party.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Recoverable heads that survive include pre-death medical expenses, damage to personal property, and other pecuniary losses that diminished the estate.<\/p>\n\n\n\n<h2 id=\"h-statutory-claims-for-wrongful-death\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Statutory_Claims_for_Wrongful_Death\"><\/span>Statutory Claims for Wrongful Death<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 id=\"h-4-1-creation-of-an-independent-cause-of-action\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"41_Creation_of_an_Independent_Cause_of_Action\"><\/span>4.1 Creation of an Independent Cause of Action<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Where a tortious act causes death, the Fatal Accidents Act, 1855 creates an independent statutory cause of action. The claim is brought by the executor, administrator, or representative of the deceased for the benefit of the specified dependents\u2014wife, husband, parent, and child.<\/p>\n\n\n\n<h3 id=\"h-4-2-compensatory-heads\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"42_Compensatory_Heads\"><\/span>4.2 Compensatory Heads<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Courts award damages proportionate to the loss resulting from the death. The principal heads are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>loss of financial dependency<\/strong> (support and future earnings the deceased would have provided);<\/li>\n\n\n\n<li><strong>funeral and other immediate expenses<\/strong> caused by the death;<\/li>\n\n\n\n<li><strong>loss of care, guidance, and companionship<\/strong>, in appropriate cases, and particularly under motor-accident jurisprudence.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A claim for pecuniary loss to the estate itself may also be joined under the Act.<\/p>\n\n\n\n<h2 id=\"h-death-caused-by-negligence-motor-vehicle-accidents\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Death_Caused_by_Negligence_Motor_Vehicle_Accidents\"><\/span>Death Caused by Negligence: Motor Vehicle Accidents<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 id=\"h-5-1-statutory-mechanism-under-the-motor-vehicles-act-1988\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"51_Statutory_Mechanism_under_the_Motor_Vehicles_Act_1988\"><\/span>5.1 Statutory Mechanism under the Motor Vehicles Act, 1988<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Fatal motor accidents are governed primarily by Section 166 of the Motor Vehicles Act, 1988. Claims are adjudicated by motor accident claims tribunals.<\/p>\n\n\n\n<h3 id=\"h-5-2-role-of-legal-representatives-and-insurers\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"52_Role_of_Legal_Representatives_and_Insurers\"><\/span>5.2 Role of Legal Representatives and Insurers<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Liability does not perish with the death of the victim or the driver. The legal representatives of the deceased may claim compensation against the driver, owner, or insurer. The Tribunal assesses both pecuniary loss to the dependants and conventional heads of damage. Special provisions also allow certain injury claims to survive the death of the injured person irrespective of the cause of death.<\/p>\n\n\n\n<h2 id=\"h-key-determinants-of-claim-survival\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Key_Determinants_of_Claim_Survival\"><\/span>Key Determinants of Claim Survival<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Whether a tort claim survives death turns on two principal criteria:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Criterion<\/th><th>Key Question<\/th><\/tr><\/thead><tbody><tr><td><strong>Nature of the right infringed<\/strong><\/td><td>Is the injury strictly personal (bodily integrity, reputation) or proprietary\/patrimonial (loss to the estate)?<\/td><\/tr><tr><td><strong>Statutory intervention<\/strong><\/td><td>Does an express statutory provision preserve the right of action or create an independent remedy for dependants?<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 id=\"h-conclusion\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Death no longer operates as an absolute bar to tortious liability. The maxim <em>actio personalis moritur cum persona<\/em> is now confined largely to purely personal grievances such as defamation and personal injury not resulting in death.
