The maxim <em>reformatio in <\/em>peius\u2014Latin for \u2018a change for the worse&#8217;\u2014exists precisely to remove that fear from the law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This article traces the maxim from Roman law through its modern statement by the Supreme Court of India in September 2026, explains how it operates across criminal appeals, tax and customs proceedings, and administrative remedies, and sets out what it does and does not protect against.<\/p>\n\n\n\n<h2 id=\"h-i-introduction-the-fear-that-keeps-people-from-appealing\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"I_Introduction_The_Fear_That_Keeps_People_from_Appealing\"><\/span>I. Introduction: The Fear That Keeps People from Appealing<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A litigant who has lost, in whole or in part, is told that the law gives them a right of appeal or revision. Very few people exercise that right without a moment&#8217;s hesitation\u2014not because they doubt their case, but because of an old and reasonable anxiety: what if the higher forum, on a closer look, decides the first court was not harsh enough and makes things worse?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If that fear were justified, the right of appeal would carry a hidden penalty, and people would be deterred from using a remedy the law itself gives them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The maxim <em>reformatio in <\/em>peius\u2014and its companion rule, the prohibition of <em>reformatio in peius<\/em>, often shortened to \u2018no reformatio in peius\u2019\u2014exists to remove exactly that fear.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Stated simply: a person who alone challenges a decision cannot, as a result of that very challenge, end up worse off than if they had never challenged it at all.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This article explains where the rule comes from, how the Supreme Court of India has now stated it in the clearest terms to date, and where its limits lie.<\/p>\n\n\n\n<h2 id=\"h-ii-origins-from-roman-law-to-modern-codes\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"II_Origins_From_Roman_Law_to_Modern_Codes\"><\/span>II. Origins: From Roman Law to Modern Codes<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The idea is old. Comparative legal scholarship traces the underlying concern to Roman law, where the notion that an appellate remedy should not itself become a source of harm to the very party invoking it was already recognized as a matter of procedural fairness.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The precise Latin phrase <em>reformatio in peius<\/em>, however, is a later coinage\u2014legal historians attribute its first documented use in criminal procedure literature to the German jurist Nikolaus Thadd\u00e4us G\u00f6nner, writing in 1804, though the underlying Roman-law material it draws on is considerably older.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The doctrine has since found a home, in one form or another, across a wide range of legal systems:<\/p>\n\n\n\n<h3 id=\"h-continental-civil-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Continental_Civil_Law\"><\/span>Continental Civil Law<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Continental civil law:<\/strong> In the Netherlands, Spain, and much of continental Europe, no <em>reformatio in peius<\/em> is a settled feature of civil and criminal appellate procedure, generally justified on the ground of party autonomy\u2014a party appealing for a better outcome should not be handed a worse one, since it was never asked for.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-european-court-of-human-rights\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"European_Court_of_Human_Rights\"><\/span>European Court of Human Rights<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>European Court of Human Rights:<\/strong> The ECHR has held that any alteration to an appellant&#8217;s detriment must be affirmatively justified within a fair process, treating the safeguard as bound up with the right to a fair trial.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-european-patent-office\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"European_Patent_Office\"><\/span>European Patent Office<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>European Patent Office:<\/strong> The Boards of Appeal of the EPO have built a substantial body of case law\u2014notably the consolidated decisions G 4\/93 and G 9\/92 and the exceptions carved out in G 1\/99\u2014holding that a sole appellant cannot be left worse off than before its appeal, while also marking out limited exceptions for correcting the appellant&#8217;s own earlier procedural errors.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-india-s-own-encounter-with-the-doctrine\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Indias_Own_Encounter_with_the_Doctrine\"><\/span>India&#8217;s Own Encounter with the Doctrine<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>India&#8217;s own encounter with the doctrine:<\/strong> India&#8217;s own encounter with the doctrine has been more piecemeal, growing out of specific statutory bars rather than a single codified principle\u2014which is what makes the Supreme Court&#8217;s recent decisions of particular interest.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-iii-the-indian-statutory-starting-point-section-386-crpc\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"III_The_Indian_Statutory_Starting_Point_Section_386_CrPC\"><\/span>III. The Indian Statutory Starting Point: Section 386 CrPC<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Long before the maxim was invoked by name, Indian criminal procedure contained a rule that embodies the same idea.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The proviso to Section 386 of the Code of Criminal Procedure, 1973 (now substantially carried forward as Section 427 of the Bharatiya Nagarik Suraksha Sanhita, 2023) bars an appellate court from enhancing a sentence in an appeal filed by the convicted person alone.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Enhancement is permitted only where the State, the complainant, or the victim has itself filed an appeal or revision seeking it\u2014and even then, only after the accused has been given an opportunity to show cause.<\/p>\n\n\n\n<h3 id=\"h-from-statutory-rule-to-modern-doctrine\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"From_Statutory_Rule_to_Modern_Doctrine\"><\/span>From Statutory Rule to Modern Doctrine<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">For decades this was treated simply as a rule of statutory construction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What has changed recently is that the Supreme Court has begun explaining why the rule exists\u2014and, in doing so, has reached for the language of <em>reformatio in peius<\/em> to describe a value that runs wider than Section 386 itself.<\/p>\n\n\n\n<h2 id=\"h-iv-nagarajan-v-state-of-tamil-nadu-the-maxim-enters-the-supreme-court-s-vocabulary\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"IV_Nagarajan_v_State_of_Tamil_Nadu_The_Maxim_Enters_the_Supreme_Courts_Vocabulary\"><\/span>IV. Nagarajan v. State of Tamil Nadu: The Maxim Enters the Supreme Court&#8217;s Vocabulary<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Nagarajan v. State of Tamil Nadu<\/em>, decided on 4 June 2025, the accused had been convicted under Sections 354 and 448 of the Indian Penal Code (outraging modesty and house trespass) and acquitted of the more serious charge under Section 306 (abetment of suicide). He alone appealed against his conviction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The High Court, instead of confining itself to his appeal, registered a suo motu criminal revision, convicted him under Section 306 as well, and enhanced his sentence to five years&#8217; rigorous imprisonment\u2014even though neither the State nor the complainant had sought any such enhancement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court held this could not stand. In doing so, it expressly invoked the maxim, quoting with approval the Bombay High Court&#8217;s explanation of it in a 2020 tax case (discussed in Part V below):<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">In this connection we may refer to the maxim <em>reformatio in peius<\/em>. It is a Latin phrase meaning a change towards the worse\u2026 no <em>reformatio in peius<\/em> or prohibition of <em>reformatio in peius<\/em> is a part of fair procedure and thus, by extension, can also be construed as part of natural justice. It is not only a procedural guarantee but is also a principle of equity. \u2014 Bombay High Court in <em>Jyoti Plastic Works Pvt. Ltd. v. Union of India<\/em>, 2020 SCC OnLine Bom 2276, quoted with approval in <em>Nagarajan v. State of Tamil Nadu<\/em><\/p>\n<\/blockquote>\n\n\n\n<h3 id=\"h-why-nagarajan-matters\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_Nagarajan_Matters\"><\/span>Why Nagarajan Matters<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The significance of <em>Nagarajan<\/em> is not merely that it reached the correct result under Section 386\u2014that much was already fairly settled\u2014but that it gave the underlying value a name and a wider justification: fair procedure, natural justice, and equity, not merely statutory technicality.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That reframing is what allowed the principle to migrate, within a little over a year, into an entirely different branch of law.<\/p>\n\n\n\n<h2 id=\"h-v-saudi-arabian-airlines-the-maxim-generalized-beyond-criminal-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"V_Saudi_Arabian_Airlines_The_Maxim_Generalized_Beyond_Criminal_Law\"><\/span>V. Saudi Arabian Airlines: The Maxim Generalized Beyond Criminal Law<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">On 1 September 2026, in <em>M\/s Saudi Arabian Airlines v. Union of India &amp; Ors<\/em>, the Supreme Court (Pardiwala and Bhuyan, JJ.) applied the same reasoning to a tax penalty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The airline had been penalized Rs. 12,000 for six instances of delayed deposit of Foreign Travel Tax under Section 38(3) of the Finance Act, 1979. It appealed. The appeal led to a remand\u2014and on remand, the adjudicating authority enhanced the penalty to Rs. 7,129,140: nearly six hundred times the original amount.<\/p>\n\n\n\n<h3 id=\"h-how-the-penalty-was-enhanced\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_the_Penalty_Was_Enhanced\"><\/span>How the Penalty Was Enhanced<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Every forum below the Supreme Court upheld the enhancement, reasoning that the remand was not a limited one and that the original penalty had in any case been erroneous\u2014falling below the statutory minimum\u2014so that the steep enhancement was merely a correction of that error.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court disagreed and framed the issue in terms that reach well beyond tax law:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Whether a litigant can be worse off by approaching the appellate forum as provided under the law or by approaching a court of law\u2026 no appellant, by filing an appeal, can be placed in a position worse than what existed prior to the filing of the appeal. \u2014 <em>M\/s Saudi Arabian Airlines v. Union of India &amp; Ors<\/em>, 2026 INSC 933 \/ 2026 LiveLaw (SC) 880<\/p>\n<\/blockquote>\n\n\n\n<h3 id=\"h-two-things-that-stand-out\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Two_Things_That_Stand_Out\"><\/span>Two Things That Stand Out<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n<li>First, the Court expressly relied on its own criminal-law reasoning in <em>Nagarajan<\/em> to decide a tax case\u2014confirming that the doctrine is now understood as a general principle of fair procedure, not a rule confined to any one branch of law.<\/li>\n\n\n\n<li>Second, the Court rejected the argument that a technically correct penalty justifies an enhancement that only came about because the appellant chose to appeal. A Comparative Note: The American Doctrine of Vindictive Sentencing<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Readers familiar with American constitutional law will notice a family resemblance to the due-process doctrine established in <em>North Carolina v. Pearce<\/em>, 395 U.S. 711 (1969), which held that a harsher sentence on retrial is not absolutely barred, but must not be motivated by vindictiveness for the defendant&#8217;s having successfully challenged the first conviction, and that the reasons for any increase must appear on the record.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The U.S. doctrine is narrower in one respect \u2014 it permits enhancement where genuinely justified by new information about the defendant&#8217;s conduct \u2014 and, following <em>Colten v. Kentucky<\/em>, 407 U.S. 104 (1972), the presumption of vindictiveness does not even arise where a different, disinterested tribunal does the resentencing.<\/p>\n\n\n\n<h3 id=\"h-indian-and-american-approaches-compared\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Indian_and_American_Approaches_Compared\"><\/span>Indian and American Approaches Compared<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Indian doctrine, as stated in <em>Saudi Arabian Airlines<\/em>, currently reads as more categorical: the question is not whether the enhancing authority was personally vindictive, but simply whether the worse outcome resulted from the appellant&#8217;s own recourse to a remedy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Whether Indian courts will, over time, recognise an exception for enhancements grounded in a genuinely new evidentiary record (as opposed to a mere re-assessment of the same facts) remains, as of this writing, an open and important question \u2014 one on which <em>Saudi Arabian Airlines<\/em> does not pronounce, since that case involved no new facts on remand at all.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Issue<\/th><th>Indian Position<\/th><th>American Position<\/th><\/tr><\/thead><tbody><tr><td>Core concern<\/td><td>Whether the appellant is placed in a worse position because of exercising a legal remedy.<\/td><td>Whether a harsher sentence is motivated by vindictiveness.<\/td><\/tr><tr><td>New information<\/td><td>The scope of any exception for genuinely new evidence remains an open question.<\/td><td>Enhancement may be permitted where genuinely justified by new information.<\/td><\/tr><tr><td>Different tribunal<\/td><td>The present doctrine focuses on the consequence of the appellant&#8217;s recourse.<\/td><td><em>Colten v.
