Can she still claim maintenance from me?\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Neither question has a simple yes-or-no answer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Indian matrimonial law does not provide an automatic right to permanent alimony merely because a person is a wife. At the same time, a woman does not lose her right to seek maintenance merely because she is employed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The recent decision of the Delhi High Court in <em>Rita Raj v. Pabitra Roy Chaudhuri<\/em>, 2025:DHC:9233-DB, brings this distinction into sharp focus.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court refused permanent alimony to a financially independent wife who was a senior Indian Railway Traffic Service officer. But the judgment should not be misunderstood as laying down a rule that every earning wife is disentitled to maintenance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That would be too broad a reading of the judgment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The real question in a divorce maintenance Delhi case is usually much more practical:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Does the spouse seeking maintenance genuinely require financial support, and does the other spouse have the financial capacity to provide it, having regard to the circumstances of the marriage?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is where Section 25 of the Hindu Marriage Act, 1955 becomes important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Also Read: <a href=\"https:\/\/www.legalserviceindia.com\/Legal-Articles\/how-to-file-divorce-in-delhi\/\">How to File Divorce in Delhi (2026): Complete Guide to Jurisdiction, Maintenance, Child Custody, and Family Court Procedure<\/a><\/p>\n\n\n\n<h2 id=\"h-what-is-permanent-alimony-under-section-25-hma\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Is_Permanent_Alimony_Under_Section_25_HMA\"><\/span>What Is Permanent Alimony Under Section 25 HMA?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Section 25 of the Hindu Marriage Act deals with permanent alimony and maintenance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unlike some popular descriptions of matrimonial law, Section 25 is not confined to women.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It permits either the wife or the husband to apply for permanent alimony.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court can award:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a lump-sum amount;<\/li>\n\n\n\n<li>monthly maintenance;<\/li>\n\n\n\n<li>periodic payments; or<\/li>\n\n\n\n<li>maintenance for a period extending up to the lifetime of the applicant.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The court is required to consider the financial circumstances of both parties, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>income;<\/li>\n\n\n\n<li>property;<\/li>\n\n\n\n<li>financial obligations;<\/li>\n\n\n\n<li>conduct of the parties; and<\/li>\n\n\n\n<li>other circumstances of the case.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The court may also secure the payment by creating a charge over the respondent&#8217;s immovable property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This makes one thing clear at the outset:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is no automatic mathematical entitlement to permanent alimony under Section 25.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The provision requires the court to exercise judicial discretion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Also Read: <a href=\"https:\/\/www.legalserviceindia.com\/Legal-Articles\/interim-maintenance-delhi-section-24-hma\/\" target=\"_blank\" rel=\"noopener\">Interim Maintenance in Delhi Under Section 24 HMA: Rules, 25% Myth &amp; 2026 Law<\/a><\/p>\n\n\n\n<h2 id=\"h-the-delhi-high-court-s-decision-in-rita-raj\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Delhi_High_Courts_Decision_in_Rita_Raj\"><\/span>The Delhi High Court&#8217;s Decision in <em>Rita Raj<\/em><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The judgement in <em>Rita Raj v. Pabitra Roy Chaudhuri<\/em>, delivered by a Division Bench of the Delhi High Court on 17 October 2025, is particularly relevant to disputes involving financially independent spouses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The parties had married on 25 January 2010.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Both had been married previously and were divorcees. The marriage did not result in a child.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The parties separated on 8 March 2011, meaning that their period of cohabitation was approximately ten months.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The wife was a Group &#8216;A&#8217; officer of the Indian Railway Traffic Service (IRTS). The husband was an advocate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The husband had obtained a decree of divorce on the ground of cruelty under Section 13(1)(ia) of the Hindu Marriage Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The wife challenged the decree and also sought permanent alimony under Section 25.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Delhi High Court ultimately dismissed the appeal and rejected the claim for permanent alimony.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The financial circumstances were central to that conclusion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court noted that the wife had a steady and substantial income. There was no child from the marriage, no proved financial dependency, no substantial income disparity and no demonstrated economic vulnerability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court therefore concluded that the circumstances did not justify an award of permanent alimony.<\/p>\n\n\n\n<h2 id=\"h-why-did-the-delhi-high-court-refuse-alimony\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_Did_the_Delhi_High_Court_Refuse_Alimony\"><\/span>Why Did the Delhi High Court Refuse Alimony?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The reasoning is more important than the headline.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court considered the combined effect of several circumstances:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the wife&#8217;s substantial and steady independent income;<\/li>\n\n\n\n<li>the absence of a child from the marriage;<\/li>\n\n\n\n<li>the very short period of cohabitation;<\/li>\n\n\n\n<li>the absence of demonstrated financial dependency;<\/li>\n\n\n\n<li>the absence of a substantial income disparity; and<\/li>\n\n\n\n<li>the absence of proved financial, medical or familial liabilities requiring support.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Court emphasised that permanent alimony is a measure of social justice and financial protection, not a mechanism for enriching one financially independent spouse at the expense of another.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In paragraph 85, the Court made the important observation that judicial discretion under Section 25 cannot be exercised to award alimony where the applicant is financially self-sufficient and independent, in circumstances where economic vulnerability has not been demonstrated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judgement therefore provides an important principle for permanent alimony in Delhi cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But there is an equally important qualification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Rita Raj<\/em> is not an authority for the proposition that an employed wife can never receive maintenance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction must be kept firmly in mind.<\/p>\n\n\n\n<h2 id=\"h-does-an-earning-wife-lose-her-right-to-maintenance\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Does_an_Earning_Wife_Lose_Her_Right_to_Maintenance\"><\/span>Does an Earning Wife Lose Her Right to Maintenance?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>No.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is probably the most important misconception surrounding divorce maintenance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The law distinguishes between:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a person who is capable of earning;<\/li>\n\n\n\n<li>a person who is actually earning; and<\/li>\n\n\n\n<li>a person who is financially self-sufficient.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These are not necessarily the same thing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court made this distinction clear in <em>Shailja v. <\/em>Khobbanna (2018) 12 SCC 199.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The fact that a woman is qualified or capable of earning does not automatically mean that she is earning enough to maintain herself.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The question is one of actual financial circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court subsequently reinforced this approach in <em>Kiran Jyot Maini v. Anish Pramod Patel<\/em>, 2024 INSC 530; (2024) 13 SCC 66.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That case is particularly important because the wife was herself earning.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Yet the Supreme Court did not treat her employment as an automatic bar to maintenance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court ultimately awarded a substantial lump-sum amount after considering the financial position of both spouses, their standard of living, income, employment and other circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, the proposition:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cA working wife cannot claim maintenance.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">is simply too broad to be legally correct.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The more accurate proposition is:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">A working wife may still receive maintenance if her independent income and resources are insufficient in the circumstances of the case. Conversely, a financially self-sufficient wife may be denied permanent alimony.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is the distinction between earning and financial independence.<\/p>\n\n\n\n<h2 id=\"h-rita-raj-and-kiran-jyot-maini-are-not-contradictory\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rita_Raj_and_Kiran_Jyot_Maini_Are_Not_Contradictory\"><\/span><em>Rita Raj<\/em> and <em>Kiran Jyot Maini<\/em> Are Not Contradictory<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">At first sight, the two decisions might appear to pull in opposite directions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They do not.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Rita Raj<\/em>, the applicant was a senior government officer with substantial independent income. The marriage had lasted only briefly, and there was no child. The Court found no substantial economic disparity or demonstrated financial vulnerability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Kiran Jyot Maini<\/em>, however, the Supreme Court was dealing with a substantially different financial situation. The wife&#8217;s income was significantly lower than the husband&#8217;s, and the Court considered the broader economic circumstances before granting substantial relief.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lesson is straightforward.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The salary of the wife is one factor. It is not the entire case.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A court must look at the financial picture as a whole.<\/p>\n\n\n\n<h2 id=\"h-what-if-the-wife-earns-1-lakh-a-month\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_If_the_Wife_Earns_%E2%82%B91_Lakh_a_Month\"><\/span>What If the Wife Earns \u20b91 Lakh a Month?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose a wife earns \u20b91 lakh a month.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Can she claim maintenance?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The answer cannot be determined merely from that figure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court may want to know:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>How much does the husband earn?<\/li>\n\n\n\n<li>What assets does each spouse own?<\/li>\n\n\n\n<li>Are there children?<\/li>\n\n\n\n<li>Who is paying for their education?<\/li>\n\n\n\n<li>What was the standard of living during the marriage?<\/li>\n\n\n\n<li>Does the wife have substantial investments?<\/li>\n\n\n\n<li>Does she own property?<\/li>\n\n\n\n<li>What are her monthly expenses?<\/li>\n\n\n\n<li>Did she give up career opportunities during the marriage?<\/li>\n\n\n\n<li>Does the husband have substantial liabilities?<\/li>\n\n\n\n<li>How long did the marriage last?<\/li>\n\n\n\n<li>Are there medical or other special expenses?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A wife earning \u20b91 lakh a month against a husband earning \u20b91.2 lakh may present an entirely different case from a wife earning \u20b91 lakh where the husband earns \u20b910 lakh a month and the marriage has resulted in children and significant financial dependency.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is precisely why divorce maintenance in Delhi cannot sensibly be reduced to a salary-percentage formula.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Also Read: <a href=\"https:\/\/www.legalserviceindia.com\/Legal-Articles\/contested-divorce-in-delhi\/\">Contested Divorce in Delhi: Grounds, Procedure, Evidence &amp; Supreme Court Law 2026<\/a><\/p>\n\n\n\n<h2 id=\"h-is-there-a-fixed-25-rule-for-alimony\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Is_There_a_Fixed_25_Rule_for_Alimony\"><\/span>Is There a Fixed 25% Rule for Alimony?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>No.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is another widespread misconception.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is no provision in Indian matrimonial law saying that a wife automatically receives 25% of her husband&#8217;s salary.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The figure of 25% appears in Supreme Court jurisprudence, most notably in <em>Kalyan Dey Chowdhury v. Rita Dey <\/em>Chowdhury (2017) 14 SCC 200.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the figure was applied in the factual circumstances of that case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It does not establish a statutory formula applicable to every matrimonial dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Earlier Supreme Court decisions, including <em>Kulbhushan Kumar v. Raj <\/em>Kumari (1970) 3 SCC 129, also demonstrate that particular percentages have been used in particular factual situations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But later jurisprudence makes the position clear:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>There is no universal mathematical formula for calculating permanent alimony.<\/strong><\/p>\n\n\n\n<h2 id=\"h-so-how-is-alimony-actually-calculated\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"So_how_is_alimony_actually_calculated\"><\/span>So how is alimony actually calculated?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is no calculator that a court can use by entering the husband&#8217;s salary and producing an automatic answer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court examines the circumstances of the marriage and the financial position of both parties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Important considerations include:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Factor<\/th><th>What the Court Considers<\/th><\/tr><\/thead><tbody><tr><td>Income of both spouses<\/td><td>The actual income and financial resources of each spouse.<\/td><\/tr><tr><td>Property and assets<\/td><td>Property, investments and other assets that may affect financial need.<\/td><\/tr><tr><td>Standard of living during marriage<\/td><td>The reasonable financial security and dignity enjoyed during the marriage.<\/td><\/tr><tr><td>Reasonable needs<\/td><td>Genuine expenses, including accommodation, food, transportation, healthcare and education.<\/td><\/tr><tr><td>Children<\/td><td>Education, healthcare, accommodation and other expenses relating to children.<\/td><\/tr><tr><td>Duration of marriage<\/td><td>The length of the marriage and the period for which the spouses lived together.<\/td><\/tr><tr><td>Career sacrifice<\/td><td>Whether a spouse abandoned or substantially interrupted a career because of marriage, childcare or family responsibilities.<\/td><\/tr><tr><td>Age and health<\/td><td>Medical conditions and future healthcare requirements.<\/td><\/tr><tr><td>Existing liabilities<\/td><td>Genuine financial obligations of the spouse who is being asked to pay.<\/td><\/tr><tr><td>Conduct<\/td><td>The conduct of the parties, as expressly contemplated by Section 25.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h3 id=\"h-income-of-both-spouses\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Income_of_Both_Spouses\"><\/span>Income of Both Spouses<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The court examines the actual income and financial resources of each spouse.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Salary is important, but it is not everything.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Business income, rent, investments and other sources of financial benefit may also matter.<\/p>\n\n\n\n<h3 id=\"h-property-and-assets\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Property_and_Assets\"><\/span>Property and Assets<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A spouse&#8217;s financial position cannot be assessed solely through monthly salary.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Property, investments and other assets can materially affect the question of financial need.<\/p>\n\n\n\n<h3 id=\"h-standard-of-living-during-marriage\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Standard_of_Living_During_Marriage\"><\/span>Standard of Living During Marriage<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Maintenance is generally intended to ensure reasonable financial security and dignity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has repeatedly recognised the importance of the standard of living enjoyed during the marriage.<\/p>\n\n\n\n<h3 id=\"h-reasonable-needs\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Reasonable_Needs\"><\/span>Reasonable Needs<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The court considers genuine expenses rather than simply accepting exaggerated claims.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>accommodation;<\/li>\n\n\n\n<li>food;<\/li>\n\n\n\n<li>transportation;<\/li>\n\n\n\n<li>healthcare;<\/li>\n\n\n\n<li>education;<\/li>\n\n\n\n<li>children&#8217;s expenses; and<\/li>\n\n\n\n<li>other reasonable household or personal expenses.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-children\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Children\"><\/span>Children<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The presence of children can significantly change the financial equation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Their education, healthcare, accommodation and other expenses have to be considered.<\/p>\n\n\n\n<h3 id=\"h-duration-of-marriage\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Duration_of_Marriage\"><\/span>Duration of Marriage<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A marriage lasting several decades may present a very different maintenance question from a marriage in which the spouses lived together for only a few months.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This factor was particularly relevant in <em>Rita Raj<\/em>.<\/p>\n\n\n\n<h3 id=\"h-career-sacrifice\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Career_Sacrifice\"><\/span>Career Sacrifice<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A spouse who abandoned or substantially interrupted a career because of marriage, childcare or family responsibilities may have a stronger claim than the salary figures alone would suggest.<\/p>\n\n\n\n<h3 id=\"h-age-and-health\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Age_and_Health\"><\/span>Age and Health<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Medical conditions and future healthcare requirements can become important factors.<\/p>\n\n\n\n<h3 id=\"h-existing-liabilities\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Existing_Liabilities\"><\/span>Existing Liabilities<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The court must also consider genuine financial obligations of the spouse who is being asked to pay.<\/p>\n\n\n\n<h3 id=\"h-conduct\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conduct\"><\/span>Conduct<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Section 25 expressly requires the court to consider the conduct of the parties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But maintenance should not become a disguised punishment.<\/p>\n\n\n\n<h2 id=\"h-rajnesh-v-neha-why-financial-disclosure-matters\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rajnesh_v_Neha_Why_Financial_Disclosure_Matters\"><\/span>Rajnesh v. Neha: Why Financial Disclosure Matters<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the most important Supreme Court decisions in modern maintenance law is <em>Rajnesh v. Neha<\/em>, (2021) 2 SCC 324.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court recognised a practical problem that matrimonial courts regularly encounter:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">How can a court determine fair maintenance if neither party gives a complete picture of their finances?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The Court therefore developed a framework requiring disclosure of matters including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>income;<\/li>\n\n\n\n<li>assets;<\/li>\n\n\n\n<li>liabilities;<\/li>\n\n\n\n<li>expenditure;<\/li>\n\n\n\n<li>financial obligations;<\/li>\n\n\n\n<li>previous maintenance orders; and<\/li>\n\n\n\n<li>other relevant financial circumstances.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This has transformed the practical handling of maintenance cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A spouse who claims to have a modest income but owns substantial property or receives undisclosed rental or business income may face serious difficulties before the court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Likewise, a spouse cannot simply demand an unrealistic amount without disclosing their own financial position.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Financial transparency has become central to maintenance litigation.<\/p>\n\n\n\n<h2 id=\"h-can-a-wife-claim-maintenance-under-more-than-one-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_a_Wife_Claim_Maintenance_Under_More_Than_One_Law\"><\/span>Can a Wife Claim Maintenance Under More Than One Law?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Potentially, yes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A matrimonial dispute can involve several statutory remedies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending upon the circumstances, claims may arise under:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Section 25 of the Hindu Marriage Act;<\/li>\n\n\n\n<li>Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023;<\/li>\n\n\n\n<li>Section 20 of the Protection of Women from Domestic Violence Act, 2005;<\/li>\n\n\n\n<li>the Hindu Adoptions and Maintenance Act, 1956; and<\/li>\n\n\n\n<li>other applicable statutory provisions.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">But this does not mean that a spouse can recover the same maintenance twice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Rajnesh v. Neha<\/em>, the Supreme Court dealt specifically with overlapping maintenance proceedings and directed courts to take existing awards into account.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, every previous and pending maintenance proceeding should be disclosed.<\/p>\n\n\n\n<h2 id=\"h-what-changed-after-the-bnss-came-into-force\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Changed_After_the_BNSS_Came_Into_Force\"><\/span>What Changed After the BNSS Came Into Force?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">From 1 July 2024, the Bharatiya Nagarik Suraksha Sanhita replaced the Code of Criminal Procedure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The summary maintenance provision corresponding to the old Section 125 CrPC is now Section 144 BNSS.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is important for lawyers and litigants because older judgments and articles will continue to refer to Section 125 CrPC.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The change in numbering does not mean that every earlier maintenance principle suddenly disappeared.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The broader jurisprudence concerning financial need, disclosure, overlapping remedies and fair maintenance continues to be relevant, subject to the statutory framework applicable to the particular proceeding.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Also Read: <a href=\"https:\/\/www.legalserviceindia.com\/Legal-Articles\/divorce-jurisdiction-section-19-hma-last-resided-together-delhi-high-court\/\" target=\"_blank\" rel=\"noopener\">Where to File Divorce Petition? Sukhbir Kaur, 2025 INSC 197, the Supreme Court held that a spouse whose marriage has been declared void under Section 11 of the Hindu Marriage Act can seek relief under Sections 24 and 25.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is significant because it demonstrates that the expression \u201cany decree\u201d in Section 25 has been interpreted more broadly than simply a decree dissolving a valid marriage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But again, there is an important distinction:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The right to seek relief is not the same as an automatic right to receive a particular amount.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The award remains discretionary and fact-dependent.<\/p>\n\n\n\n<h2 id=\"h-can-permanent-alimony-be-a-lump-sum-amount\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_Permanent_Alimony_Be_a_Lump-Sum_Amount\"><\/span>Can Permanent Alimony Be a Lump-Sum Amount?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Yes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 25 expressly permits the court to award a gross sum.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This can sometimes be more practical than an indefinite monthly payment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s decision in Parvin Kumar Jain v. Anju Jain, 2024 INSC 961; (2025) 2 SCC 227, is an important modern example.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court emphasised that there is no rigid formula and considered a broad range of circumstances before determining substantial financial relief.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The decision also reinforces an important principle:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Permanent alimony is intended to secure the dependent spouse&#8217;s financial future; it is not intended to punish the paying spouse or simply redistribute wealth.<\/strong><\/p>\n\n\n\n<h2 id=\"h-can-a-permanent-alimony-order-be-changed\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_a_Permanent_Alimony_Order_Be_Changed\"><\/span>Can a Permanent Alimony Order Be Changed?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Yes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 25(2) specifically permits the court to vary, modify or rescind an order where circumstances subsequently change.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 25(3) also deals with specified circumstances including remarriage and certain subsequent conduct.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, the expression \u201cpermanent alimony\u201d should not be misunderstood to mean an order that is incapable of being revisited under any circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The statute itself recognises that people&#8217;s financial and personal circumstances can change.<\/p>\n\n\n\n<h2 id=\"h-what-does-rita-raj-really-tell-us-about-divorce-maintenance-in-delhi\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Does_Rita_Raj_Really_Tell_Us_About_Divorce_Maintenance_in_Delhi\"><\/span>What Does Rita Raj Really Tell Us About Divorce Maintenance in Delhi?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">For practitioners, perhaps the most useful lesson from Rita Raj is that the court will look beyond labels.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Calling someone a \u201cwife\u201d does not automatically establish financial need.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Calling someone a \u201cworking woman\u201d does not automatically disprove it either.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court will ask:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What is her actual financial position?<\/li>\n\n\n\n<li>What is his actual financial position?<\/li>\n\n\n\n<li>What did the marriage look like financially?<\/li>\n\n\n\n<li>How long did it last?<\/li>\n\n\n\n<li>Are there children?<\/li>\n\n\n\n<li>Were there career sacrifices?<\/li>\n\n\n\n<li>What liabilities exist?<\/li>\n\n\n\n<li>Is there genuine economic vulnerability?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Those questions are far more important than the simplistic question of whether the wife has a job.<\/p>\n\n\n\n<h2 id=\"h-a-simple-illustration\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_Simple_Illustration\"><\/span>A Simple Illustration<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Consider two hypothetical marriages.<\/p>\n\n\n\n<h3 id=\"h-case-a\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Case_A\"><\/span>Case A<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The wife earns \u20b93 lakh per month as a senior government officer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The husband earns a comparable amount.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They have no children.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The marriage lasted less than a year.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Both own assets and neither has established financial dependency.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A claim for permanent alimony may face serious difficulty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This broadly illustrates the circumstances considered in Rita Raj.<\/p>\n\n\n\n<h3 id=\"h-case-b\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Case_B\"><\/span>Case B<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The wife earns \u20b91.25 lakh per month.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The husband earns \u20b98 lakh per month.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They have two children.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The wife left a substantially better-paying career after marriage and now bears significant child-related expenses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The marriage lasted 20 years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Here, simply pointing to the wife&#8217;s salary would not adequately answer the maintenance question.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court would have to examine the entire financial and matrimonial picture.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is why divorce maintenance Delhi cases are inherently fact-sensitive.<\/p>\n\n\n\n<h2 id=\"h-what-courts-should-not-do\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Courts_Should_Not_Do\"><\/span>What Courts Should Not Do<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The law does not support several simplistic approaches.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A court should not automatically say:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cShe works, so she gets nothing.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Nor should it automatically say:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cHe earns more, so she gets 25%.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Nor should permanent alimony be treated as:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cCompensation for obtaining a divorce.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Nor should it become an instrument for equalising the wealth of two financially independent spouses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s jurisprudence instead points towards a more balanced approach.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The purpose is fair financial support, not punishment and not enrichment.<\/p>\n\n\n\n<h2 id=\"h-practical-checklist-for-a-maintenance-case-in-delhi\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" decision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A maintenance case should therefore be prepared as a financial case, not merely as an emotional continuation of the matrimonial dispute.<\/p>\n\n\n\n<h2 id=\"h-the-present-legal-position\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Present_Legal_Position\"><\/span>The Present Legal Position<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The current law is best understood through a simple distinction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>An earning spouse is not necessarily a financially independent spouse.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Financial independence is not established merely by producing a salary figure.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court must consider income, assets, reasonable needs, matrimonial standard of living, children, liabilities, duration of marriage, career sacrifices, health, conduct and the other circumstances proved before it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Delhi High Court&#8217;s decision in Rita Raj is therefore an important judgment, particularly for cases involving a financially self-sufficient spouse.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But it should not be turned into a slogan that \u201cworking wives cannot get alimony.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That proposition is inconsistent with the broader Supreme Court jurisprudence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Also Read: <a
