It protects an individual&#8217;s fundamental right to personal liberty and freedom of movement. It means unlawfully preventing a person from going where he or she has a right to go.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The confinement may be caused by physical force, threats, the use of authority, or circumstances in which the person reasonably believes that he or she cannot leave.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, if a shopkeeper deliberately prevents a customer from leaving the shop by locking the door without lawful justification, it may amount to false imprisonment.<\/p>\n\n\n\n<h2 id=\"h-essential-elements\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Essential_Elements\"><\/span>Essential Elements<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The following elements generally constitute false imprisonment:<\/p>\n\n\n\n<h3 id=\"h-3-1-total-restraint-of-liberty\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"31_Total_Restraint_of_Liberty\"><\/span>3.1. Total Restraint of Liberty<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">There must be a complete restraint on the person&#8217;s freedom of movement. Mere obstruction of movement in one particular direction is ordinarily not sufficient if the person has a reasonable means of escape.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, preventing a person from moving towards one particular road, while leaving other reasonable routes open, may not constitute false imprisonment.<\/p>\n\n\n\n<h3 id=\"h-3-2-confinement-within-definite-limits\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"32_Confinement_Within_Definite_Limits\"><\/span>3.2. Confinement Within Definite Limits<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The person must be confined within an area from which he or she is not free to leave. The area may be a room, building, vehicle, premises, or even a larger geographical area.<\/p>\n\n\n\n<h3 id=\"h-3-3-intention\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"33_Intention\"><\/span>3.3. Intention<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The restraint must generally be intentional. Accidental or purely negligent restriction of movement will not ordinarily amount to false imprisonment.<\/p>\n\n\n\n<h3 id=\"h-3-4-absence-of-lawful-justification\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"34_Absence_of_Lawful_Justification\"><\/span>3.4. Absence of Lawful Justification<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The confinement must be unlawful. A person lawfully arrested by a police officer or detained under valid legal authority cannot ordinarily claim false imprisonment merely because his liberty has been restricted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Thus, the central question is whether the restraint was legally justified.<\/p>\n\n\n\n<h2 id=\"h-methods-of-imprisonment\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Methods_of_Imprisonment\"><\/span>Methods of Imprisonment<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">False imprisonment may be caused in several ways:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Physical force, such as holding or locking a person inside a room;<\/li>\n\n\n\n<li>Threat of force, where the threat is sufficient to make a reasonable person believe that leaving would result in harm;<\/li>\n\n\n\n<li>Abuse of legal authority, such as an unlawful arrest or detention by a person exercising official power;<\/li>\n\n\n\n<li>Other forms of restraint, where the circumstances effectively prevent the person from leaving.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Physical contact is therefore not essential to establish false imprisonment.<\/p>\n\n\n\n<h2 id=\"h-knowledge-of-confinement\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Knowledge_of_Confinement\"><\/span>Knowledge of Confinement<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A person does not always have to know at the exact time that he or she is being confined for an action in false imprisonment to arise. The important issue is the unlawful deprivation of liberty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, knowledge of the confinement may be relevant to the assessment of damages and to the circumstances of the particular case.<\/p>\n\n\n\n<h2 id=\"h-false-imprisonment-and-unlawful-arrest\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"False_Imprisonment_and_Unlawful_Arrest\"><\/span>False Imprisonment and Unlawful Arrest<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">An unlawful arrest is a common example of false imprisonment. When a person is arrested without lawful authority or without complying with the requirements of law, the detention may constitute false imprisonment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A police officer or other person exercising statutory powers must therefore act within the limits of the authority conferred by law.<\/p>\n\n\n\n<h2 id=\"h-false-imprisonment-and-malicious-prosecution\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"False_Imprisonment_and_Malicious_Prosecution\"><\/span>False Imprisonment and Malicious Prosecution<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">False imprisonment should be distinguished from malicious prosecution.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>False imprisonment concerns the unlawful restraint of a person&#8217;s liberty.<\/li>\n\n\n\n<li>Malicious prosecution concerns the wrongful institution of criminal or other legal proceedings against a person without reasonable and probable cause and with malice.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">False imprisonment may arise immediately from an unlawful detention, whereas malicious prosecution generally involves the initiation and continuation of legal proceedings.<\/p>\n\n\n\n<h2 id=\"h-defences\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Defences\"><\/span>Defences<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A defendant may avoid liability where the restraint was legally justified. Important grounds may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Lawful arrest;<\/li>\n\n\n\n<li>Valid statutory authority;<\/li>\n\n\n\n<li>Judicial authority or order;<\/li>\n\n\n\n<li>Consent, where legally valid;<\/li>\n\n\n\n<li>Other circumstances recognised by law as providing lawful justification.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The defendant may also establish that there was no complete restraint or that the alleged confinement did not result from his or her intentional act.<\/p>\n\n\n\n<h2 id=\"h-important-case-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Important_Case_Law\"><\/span>Important Case Law<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 id=\"h-bird-v-jones-1845\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Bird_v_Jones_1845\"><\/span>Bird v. Jones (1845)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In this leading English case, the plaintiff was prevented from passing through a particular part of a bridge but could leave by another route. The court held that there was no false imprisonment because there was no total restraint of liberty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case illustrates the important principle that false imprisonment generally requires complete restraint, not merely obstruction in a particular direction.<\/p>\n\n\n\n<h3 id=\"h-meering-v-grahame-white-aviation-co-ltd-1920\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Meering_v_Grahame-White_Aviation_Co_Ltd_1920\"><\/span>Meering v. Grahame-White Aviation Co. Ltd. (1920)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The case is important for the proposition that a person may be falsely imprisoned even though he or she is not aware of the confinement at the time. The existence of restraint and the issue of knowledge are distinct matters.<\/p>\n\n\n\n<h3 id=\"h-r-v-governor-of-brockhill-prison-ex-parte-evans-2000\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"R_v_Governor_of_Brockhill_Prison_ex_parte_Evans_2000\"><\/span>R v. Governor of Brockhill Prison, ex parte Evans (2000)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The case demonstrates that detention may become unlawful when a person is kept in custody beyond the period legally authorised, even where the detention resulted from an honest mistake in calculating the lawful period.<\/p>\n\n\n\n<h3 id=\"h-rudul-sah-v-state-of-bihar-air-1983-sc-1086\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rudul_Sah_v_State_of_Bihar_AIR_1983_SC_1086\"><\/span>Rudul Sah v. State of Bihar (AIR 1983 SC 1086)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court held that the petitioner\u2019s continued detention for over 14 years after his formal acquittal amounted to illegal confinement. The Court established the landmark principle of constitutional tort, awarding interim monetary compensation under Article 32 for the grave violation of the right to personal liberty under Article 21.<\/p>\n\n\n\n<h3 id=\"h-bhim-singh-v-state-of-jammu-amp-kashmir-air-1986-sc-494\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Bhim_Singh_v_State_of_Jammu_Kashmir_AIR_1986_SC_494\"><\/span>Bhim Singh v. State of Jammu &amp; Kashmir (AIR 1986 SC 494)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">An MLA was illegally arrested and detained by police officers to deliberately prevent him from attending a legislative assembly session. Finding a clear instance of false imprisonment that violated Articles 21 and 22(2), the Supreme Court directed the State to pay \u20b950,000 as exemplary damages for high-handed executive action.<\/p>\n\n\n\n<h3 id=\"h-k-basu-v-state-of-west-bengal-1997-1-scc-416\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"K_Basu_v_State_of_West_Bengal_1997_1_SCC_416\"><\/span>K. Basu v. State of West Bengal (1997) 1 SCC 416<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Addressing systemic custodial violence and arbitrary arrests, the Supreme Court framed mandatory procedural guidelines for arrest and detention to prevent custodial abuse. The Court reaffirmed that monetary compensation serves as an effective public-law remedy for established infringements of personal liberty caused by false imprisonment.<\/p>\n\n\n\n<h2 id=\"h-false-imprisonment-as-a-trespass-to-the-person\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"False_Imprisonment_as_a_Trespass_to_the_Person\"><\/span>False Imprisonment as a Trespass to the Person<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">False imprisonment belongs to the category of trespass to the person, along with assault and battery. These torts protect personal security, bodily integrity and individual liberty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The distinctive feature of false imprisonment is that the injury is primarily to a person&#8217;s freedom of movement, rather than to the person&#8217;s body.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is also generally regarded as an actionable tort without proof of actual damage. In other words, once unlawful confinement is established, the claimant need not necessarily prove financial or physical loss to establish the tort.<\/p>\n\n\n\n<h2 id=\"h-conclusion\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">False imprisonment is an important protection against the unlawful deprivation of personal liberty. It is not confined to imprisonment in the ordinary sense; any intentional and unlawful total restraint of a person&#8217;s freedom of movement may constitute the tort.
