The Constitutional Foundation: Protest Is a Right\u2014But Not an Absolute Right<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Three constitutional freedoms are particularly important.<\/p>\n\n\n\n<h3 id=\"h-article-19-1-a-freedom-of-speech-and-expression\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Article_191a_Freedom_of_Speech_and_Expression\"><\/span>Article 19(1)(a): Freedom of Speech and Expression<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This protects the citizen&#8217;s ability to communicate an opinion, criticism, grievance or demand.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A placard, speech, slogan, article, poster, symbolic display or peaceful public message may therefore fall within constitutionally protected expression.<\/p>\n\n\n\n<h3 id=\"h-article-19-1-b-right-to-assemble-peacefully-and-without-arms\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Article_191b_Right_to_Assemble_Peacefully_and_Without_Arms\"><\/span>Article 19(1)(b): Right to Assemble Peacefully and Without Arms<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This is the constitutional foundation for peaceful demonstrations, marches, meetings and similar collective activities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The words <strong>\u201cpeaceably and without arms\u201d<\/strong> matter enormously.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Constitution protects peaceful assembly\u2014not violence or intimidation.<\/p>\n\n\n\n<h3 id=\"h-article-19-1-c-freedom-of-association\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Article_191c_Freedom_of_Association\"><\/span>Article 19(1)(c): Freedom of Association<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Citizens may form associations, organisations and groups through which collective civic activity can be organised.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, Articles 19(2) and 19(3) permit reasonable restrictions in specified interests, including public order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The constitutional right is real, but its exercise is regulated.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has recognised peaceful demonstrations as an aspect of Articles 19(1)(a), 19(1)(b) and 19(1)(c).<\/p>\n\n\n\n<h2 id=\"h-2-the-most-important-legal-principle-there-is-no-arrest-proof-protest\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2_The_Most_Important_Legal_Principle_There_Is_No_%E2%80%9CArrest-Proof%E2%80%9D_Protest\"><\/span>2. The Most Important Legal Principle: There Is No \u201cArrest-Proof\u201d Protest<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This point should be made absolutely clear.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is no form of protest that gives a person immunity from arrest in every circumstance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A person can be peacefully protesting and nevertheless face police action if, for example:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a valid prohibitory order applies;<\/li>\n\n\n\n<li>the person knowingly disobeys a lawful direction;<\/li>\n\n\n\n<li>the assembly becomes unlawful;<\/li>\n\n\n\n<li>the protest causes legally relevant obstruction or danger;<\/li>\n\n\n\n<li>violence occurs;<\/li>\n\n\n\n<li>property is damaged;<\/li>\n\n\n\n<li>threats are made;<\/li>\n\n\n\n<li>prohibited objects are carried;<\/li>\n\n\n\n<li>the protest exceeds the conditions of an applicable permission\/NOC.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Consequently, this article does not promise \u201cprotection from arrest.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, it explains how to minimise legal exposure and maximise constitutional protection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is the legally responsible way to approach protest.<\/p>\n\n\n\n<h2 id=\"h-3-the-four-things-protesters-must-never-confuse\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3_The_Four_Things_Protesters_Must_Never_Confuse\"><\/span>3. The Four Things Protesters Must Never Confuse<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the biggest mistakes in discussions about protest law is treating four different concepts as though they mean the same thing.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Concept<\/th><th>Meaning<\/th><\/tr><\/thead><tbody><tr><td><strong>Constitutional protection<\/strong><\/td><td>The activity may fall within a fundamental right<\/td><\/tr><tr><td><strong>Permission\/NOC<\/strong><\/td><td>Administrative authorisation may be required for the particular place, route or event<\/td><\/tr><tr><td><strong>Legal defence<\/strong><\/td><td>A person may have arguments against a particular prosecution or police action<\/td><\/tr><tr><td><strong>Practical arrest risk<\/strong><\/td><td>Police may nevertheless detain\/arrest a person where statutory conditions are satisfied<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">A protest can therefore be constitutionally protected and still be subject to reasonable regulation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Conversely, the absence of permission does not automatically answer every constitutional question\u2014but it can substantially increase practical legal risk depending upon the applicable local law\/order.<\/p>\n\n\n\n<h2 id=\"h-4-supreme-court-s-basic-approach-to-peaceful-protest\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"4_Supreme_Courts_Basic_Approach_to_Peaceful_Protest\"><\/span>4. Supreme Court&#8217;s Basic Approach to Peaceful Protest<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Several Supreme Court decisions form the backbone of the law.<\/p>\n\n\n\n<h3 id=\"h-himat-lal-k-shah-v-commissioner-of-police\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Himat_Lal_K_Shah_v_Commissioner_of_Police\"><\/span>Himat Lal K. Shah v. Commissioner of Police<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court recognised that public streets and places may be legitimate venues for public meetings, while also recognising the State&#8217;s regulatory power.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The important principle is:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Regulation is permissible; arbitrary or unguided suppression is not.<\/strong><\/p>\n\n\n\n<h3 id=\"h-mazdoor-kisan-shakti-sangathan-v-union-of-india\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Mazdoor_Kisan_Shakti_Sangathan_v_Union_of_India\"><\/span>Mazdoor Kisan Shakti Sangathan v. Union of India<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court examined the competing interests of protesters and residents\/commuters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court recognised the importance of peaceful protest but emphasised that competing rights must also be balanced.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court stressed that public ways and public spaces cannot simply be occupied indefinitely in a manner that seriously interferes with others&#8217; rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This produces a useful practical rule:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Choose a form of protest that creates maximum public awareness with minimum interference with other citizens.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<h3 id=\"h-amit-sahni-v-commissioner-of-police\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Amit_Sahni_v_Commissioner_of_Police\"><\/span>Amit Sahni v. Commissioner of Police<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Shaheen Bagh litigation reinforced the principle that the right to protest does not include an unlimited right to occupy public roads indefinitely.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court specifically distinguished legitimate dissent from indefinite occupation of public ways that causes grave inconvenience to commuters.<\/p>\n\n\n\n<h3 id=\"h-in-re-ramlila-maidan-incident\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"In_Re_Ramlila_Maidan_Incident\"><\/span>In Re: Ramlila Maidan Incident<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This is equally important from the other side.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Even where the State possesses powers to maintain public order, police action must remain constitutionally controlled.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court scrutinised excessive force and emphasised the need for restraint and least-invasive measures.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A protester must obey lawful directions, but the State does not acquire unlimited power merely because a protest is taking place.<\/strong><\/p>\n\n\n\n<h2 id=\"h-5-the-new-legal-reality-bnss-has-replaced-the-crpc\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"5_The_New_Legal_Reality_BNSS_Has_Replaced_the_CrPC\"><\/span>5. The New Legal Reality: BNSS Has Replaced the CrPC<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Since 1 July 2024, the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) has replaced the CrPC framework for current criminal procedure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For protesters, two provisions deserve particular attention.<\/p>\n\n\n\n<h3 id=\"h-bnss-section-163\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"BNSS_Section_163\"><\/span>BNSS Section 163<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Section 163 concerns urgent cases of nuisance or apprehended danger.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It permits an empowered Executive Magistrate, where the statutory conditions are satisfied, to issue a written order directing persons to abstain from a particular act or take specified measures where necessary to prevent obstruction, danger to human life, disturbance of public tranquillity, riot or affray.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is the modern statutory provision corresponding broadly to the old Section 144 CrPC framework.<\/p>\n\n\n\n<h3 id=\"h-practical-lesson\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Practical_Lesson\"><\/span>Practical Lesson<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Before organising a physical protest, particularly in Delhi or another major city:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Check whether a current Section 163 order applies to the proposed location, date, route and activity.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This is not a theoretical precaution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8216;s official notification database currently records multiple Section 163 orders issued during 2026, including orders issued by the Commissioner of Police and district-level officers.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Provision<\/th><th>What Protesters Should Consider<\/th><\/tr><\/thead><tbody><tr><td>BNSS Section 163<\/td><td>Check whether a current order applies to the proposed location, date, route and activity.<\/td><\/tr><tr><td>Old Section 144 CrPC<\/td><td>BNSS Section 163 broadly corresponds to the earlier Section 144 framework.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 id=\"h-6-bnss-section-148-when-an-assembly-can-be-ordered-to-disperse\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"6_BNSS_Section_148_When_an_Assembly_Can_Be_Ordered_to_Disperse\"><\/span>6. BNSS Section 148: When an Assembly Can Be Ordered to Disperse<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Section 148 BNSS provides for dispersal of an unlawful assembly and also applies to an assembly of five or more persons likely to cause a disturbance of public peace.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The provision allows the competent authority to command such an assembly to disperse. BNS Section 223: Why Ignoring an Applicable Order Can Become Dangerous<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Section 223 of the Bharatiya Nyaya Sanhita concerns disobedience of an order duly promulgated by a public servant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where the statutory requirements are satisfied, knowingly disobeying such an order can attract criminal liability. The provision also distinguishes consequences depending upon whether the disobedience causes or tends to cause obstruction, danger to human life, health or safety, riot or affray.<\/p>\n\n\n\n<h3 id=\"h-therefore\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Therefore\"><\/span>Therefore<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Do not assume that \u201cI am exercising my fundamental right\u201d automatically answers a charge alleging deliberate disobedience of a valid order.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The validity, scope, communication and constitutional reasonableness of the order can become matters of legal examination\u2014but deliberately ignoring it is a serious risk.<\/p>\n\n\n\n<h2 id=\"h-8-fifteen-powerful-ways-to-protest-without-breaking-the-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"8_Fifteen_Powerful_Ways_to_Protest_Without_Breaking_the_Law\"><\/span>8. Placard March<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This is probably the most recognisable form of peaceful protest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Participants walk in an organised procession carrying placards containing lawful messages.<\/p>\n\n\n\n<h4 id=\"h-constitutional-foundation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Constitutional_Foundation\"><\/span>Constitutional Foundation<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Primarily:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Article 19(1)(a)<\/li>\n\n\n\n<li>Article 19(1) (b)<\/li>\n\n\n\n<li>Article 19(1)(c)<\/li>\n<\/ul>\n\n\n\n<h4 id=\"h-how-to-make-it-lawful\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_to_Make_It_Lawful\"><\/span>How to Make It Lawful<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Before organising:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>identify the proposed route;<\/li>\n\n\n\n<li>check local restrictions\/orders;<\/li>\n\n\n\n<li>obtain whatever permission\/NOC is legally required;<\/li>\n\n\n\n<li>communicate the expected number of participants;<\/li>\n\n\n\n<li>specify start and end time;<\/li>\n\n\n\n<li>appoint organisers\/marshals;<\/li>\n\n\n\n<li>maintain pedestrian and emergency access;<\/li>\n\n\n\n<li>prohibit weapons;<\/li>\n\n\n\n<li>prohibit property damage;<\/li>\n\n\n\n<li>establish a clear dispersal time.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">expressly states that NOCs are required for public rallies, meetings, morchas and protest gatherings in public spaces.<\/p>\n\n\n\n<h4 id=\"h-maximum-impact-version\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Maximum-Impact_Version\"><\/span>Maximum-Impact Version<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Instead of thousands of identical placards, use a single coordinated message architecture:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>One problem \u2192 one fact \u2192 one demand.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>\u201cWE ARE NOT HERE TO BLOCK THE CITY.<br>WE ARE HERE TO ASK ONE QUESTION.\u201d<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That can be considerably more memorable than hundreds of unrelated slogans.<\/p>\n\n\n\n<h4 id=\"h-legal-protection\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Legal_Protection\"><\/span>Legal Protection<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Potentially strong, provided the assembly, route and content comply with applicable law and orders.<\/p>\n\n\n\n<h3 id=\"h-9-silent-protest\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"9_Silent_Protest\"><\/span>9. Silent Protest<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A silent protest can be extraordinarily powerful.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Participants stand together without slogans, speeches or amplification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Each person carries one sentence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Example:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u201cI HAVE A QUESTION.\u201d<\/li>\n\n\n\n<li>Or:<\/li>\n\n\n\n<li>\u201cWHO IS ACCOUNTABLE?\u201d<\/li>\n<\/ul>\n\n\n\n<h4 id=\"h-why-it-is-legally-attractive\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_It_Is_Legally_Attractive\"><\/span>Why It Is Legally Attractive<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">It substantially reduces:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>noise disputes;<\/li>\n\n\n\n<li>inflammatory speech;<\/li>\n\n\n\n<li>amplification issues;<\/li>\n\n\n\n<li>confrontational interaction.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">It does not, however, eliminate assembly or location-related restrictions.<\/p>\n\n\n\n<h4 id=\"h-legal-protection-0\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Legal_Protection-2\"><\/span>Legal Protection<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Generally stronger from a speech\/noise perspective, but still subject to reasonable restrictions governing assembly and location.<\/p>\n\n\n\n<h3 id=\"h-10-black-ribbon-or-black-badge-protest\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"10_Black_Ribbon_or_Black_Badge_Protest\"><\/span>10.
