The defendant need not intend the full extent of the harm that results.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Example:<\/strong> A hits B with a stick on purpose. A is liable for battery even if the blow unexpectedly breaks B\u2019s arm.<\/p>\n\n\n\n<h3 id=\"h-negligence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Negligence\"><\/span>Negligence<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Failure to take reasonable care. It requires (i) a duty of care, (ii) breach of that duty, and (iii) resulting damage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Example:<\/strong> A driver looks at a phone, becomes distracted, and hits a pedestrian. The carelessness, not any desire to cause harm, creates liability.<\/p>\n\n\n\n<h3 id=\"h-recklessness\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Recklessness\"><\/span>Recklessness<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Conscious disregard of a high and unjustifiable risk of serious harm\u2014more blameworthy than ordinary carelessness.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Example:<\/strong> Driving at high speed through a crowded market while fully aware of the danger.<\/p>\n\n\n\n<h3 id=\"h-malice\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Malice\"><\/span>Malice<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">An improper motive or the absence of just cause. Malice is not required for most torts; a bad motive does not turn a lawful act into a tort, nor does a good motive excuse a wrongful one.<\/p>\n\n\n\n<h4 id=\"h-malice-in-fact\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Malice_in_Fact\"><\/span>Malice in Fact<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Actual spite or ill-will (e.g., filing a false police report purely to harm an enemy).<\/p>\n\n\n\n<h4 id=\"h-malice-in-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Malice_in_Law\"><\/span>Malice in Law<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Doing something unlawful without lawful excuse (e.g., abusing official power to dismiss someone).<\/p>\n\n\n\n<h3 id=\"h-motive\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Motive\"><\/span>Motive<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The reason why the defendant acted. Motive is generally irrelevant in tort law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Example:<\/strong> Publishing a defamatory statement out of jealousy. Liability arises from the statement itself, not from the jealousy.<\/p>\n\n\n\n<h3 id=\"h-fault\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Fault\"><\/span>Fault<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The overall degree of blameworthiness (intention, negligence or recklessness). While most torts require some form of fault, a few impose strict liability, holding the defendant responsible even if every reasonable precaution was taken.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Example (strict liability):<\/strong> Storing a dangerous chemical that escapes onto neighbouring land creates liability under the rule in <em>Rylands v Fletcher<\/em>, regardless of the care exercised.<\/p>\n\n\n\n<h2 id=\"h-core-legal-requirements-for-most-torts\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Core_Legal_Requirements_for_Most_Torts\"><\/span>Core Legal Requirements for Most Torts<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Wrongful act or omission:<\/strong> The defendant did something the law forbids or failed to do something the law requires.<\/li>\n\n\n\n<li><strong>Violation of a legal right:<\/strong> The conduct infringed a right protected by law (safety, property, reputation, liberty, etc.).<\/li>\n\n\n\n<li><strong>Legal injury:<\/strong> The plaintiff\u2019s legal right was violated. Actual pecuniary loss is not essential (<em>injuria sine damno<\/em>). Conversely, pure financial loss without violation of a legal right (<em>damnum sine injuria<\/em>) is not actionable.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-injuria-sine-damno\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Injuria_Sine_Damno\"><\/span>Injuria Sine Damno<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Being unlawfully prevented from voting gives a cause of action even if the preferred candidate still wins (<em>Ashby v White<\/em>).<\/p>\n\n\n\n<h3 id=\"h-damnum-sine-injuria\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Damnum_Sine_Injuria\"><\/span>Damnum Sine Injuria<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A rival opens a lawful competing business and takes customers; the loss of profit is not actionable.<\/p>\n\n\n\n<h3 id=\"h-causation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Causation\"><\/span>Causation<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The wrongful conduct must be a sufficiently direct cause of the harm.<\/p>\n\n\n\n<h3 id=\"h-absence-of-a-valid-defence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Absence_of_a_Valid_Defence\"><\/span>Absence of a Valid Defence<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">No recognised legal justification (self-defence, consent, necessity, act of God, etc.) exists.<\/p>\n\n\n\n<h2 id=\"h-key-principle\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Key_Principle\"><\/span>Key Principle<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Different torts demand different levels of fault. Intentional torts require deliberate intent; negligence requires a failure to exercise reasonable care; strict-liability torts require no fault at all. His career has spanned diverse roles across different districts, including Kolkata Police, serving as DCP, 5th Battalion, Kolkata Armed Police and DCP (Port Division), for approximately 4 years. He served in Barrackpore Police Commissionerate, holding the positions of DCP (Special Branch) and DCP (Traffic) for over 4 years. He was posted in the districts of Dakshin Dinajpur and Nadia as Additional SP. At the sub-divisional level, he has worked as SDPOs of Gangarampur, Raghunathpur and Kalna sub-divisions of West Bengal. His tenure as Special IG and subsequently as IGP of Correctional Services, West Bengal, for over 4 years, saw him deeply engaged in improving the prison and correctional system. He visited numerous correctional homes across West Bengal, interacting with inmates, both male and female, including children residing with their incarcerated mothers. His outreach extended to correctional homes in Assam, Bihar, and Tripura. This hands-on approach provided him with invaluable insights into the workings of prisons and the complexities of the prisoner psyche. Beyond his operational roles, Md. Imran Wahab possesses a strong academic background, holding B.Sc., M.A., L.L.B., and M.B.A. degrees. He has also completed Post Graduate Diplomas in Human Rights, Project Management, Corporate Management, Computer Application, Public Administration, Medical Law, Disaster Management, Fire Safety &amp; Hazards Management and Psychology. He has attended Indian government sponsored specialized training in police and management matters in SVPNPA, Hyderabad, IIM, Ahmedabad and Singapore. He is the author of the books 'Police Investigation &amp; Allied Matters' and 'Alternative Dispute Resolution: Evolving Trends and Innovations' demonstrating his commitment to knowledge sharing within the law enforcement field. As an observer for the Election Commission of India, he has gained firsthand experience in conducting assembly elections and bye-elections in Uttar Pradesh, Rajasthan, Assam, Bihar, and Tripura (twice).
